OF THE CITY OF DOWNEY
OCTOBER 31ST, 1961
The City Council of the City of Downey held an adjourned meeting in
the Council Chamber of the Downey City Hall at 8:00 A.M., October 31, 1961,

Reverend Austin Coe of Memorial Christian Church delivered the invocation.
Mayor Scott E. Temple announced that Zone Case #61 upon which a public
hearing had been held, closed, then taken under submission will be the first
item considered and requested a report from the Planning Director on the
feasibility of an alleyway. Mr. Griselle reported that the investigation
made by the Planning Commission disclosed that at this time they would -not rec-
ommend an alley between the industrial property owners and the residential
property owners.
It was moved by Councilman Peavey, seconded by Councilman Corbin and
passed by the following vote that the easterly 70 feet be rezoned M -1 and re-
ferred back to the Planning Commission for their report.

Mayor Temple announced that the next item on the agenda to be considered
is Zone Case #40 which had been taken under submission quite some time ago.
Mr. Griselle presented a resume of this particular case.
It was moved by Councilman Peavey, seconded by Councilman Corbin and passed
by the following vote that the recommendation of the Planning Commission be
upheld and the zone change granted as recommended.

A letter from Mr. Ray P. Biby requesting that Lot Split #90 be recon-
sidered by Council. This case had been taken under submission on or about
June 9, 1959.
Mr. Griselle gave a resume of this particular lot split case. Speaking
in favor of this lot split were Ruth Ball, 8419 Cherokee Drive who stated
she also spoke on behalf of Mrs. Marvin, Mrs. Hook and Mrs. Brain who are
interested in a street going through; Mrs. Christensen, 9951 Brookshire and
Mr. Ray P. Biby.
Mr. Biby stated that a street wider than 30' would be questionable and
submitted a revised plan to Council.
It was moved by Councilman Peavey, seconded by Councilman Corbin and
passed by the following vote that Lot Split #90 be referred back to the
Planning Commission with the new proposals and that the interested property
owners work with Mr. Biby and the Commission.

A letter from the City of Hermosa Beach submitting a resolution passed
by them condemning the Soviet Union for the resumption of nuclear testing.
RESOLUTION NO. 885
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONDEMNING THE 'SOVIET UNION FOR THE RESUMPTION OF NUCLEAR
TESTING
The resolution was read by title only. It was moved by Councilman
Peavey, seconded by Councilman Corbin and so ordered that fuMber reading be
waived.

passed by the following vote that Resolution No. 885 be adopted.

A letter from the Los Angeles County Road Department submitting a
resolution passed by the County Board of .Supervisors finding that the pro-
posed improvement of Brookshire Avenue, within the City of Downey, is of
general County interest, and providing that County Aid shall be extended
therefor in the amount of $10,000.00.
Mr. King explained that the $10,000 was requested to apply on the addi-
tional costs of securing rights of way on Brookshire Avenue between Firestone
Boulevard and Manatee Street.

It was moved by Councilman Peavey, seconded by Councilman Giddings
and passed by the following vote to accept the resolution of the County
Board of Supervisors and that the City grant approval for the County to
do this work and accept the county aid as specified.

A letter from Mr. Willis R. Leach regretfully declining his appointment
to the Planning Commission.
It was moved by Councilman Corbin, seconded by Councilman Giddings and
so ordered that Mr. Leach's decline of the appointment to the Planning
Commission be accepted.
Letters from Mrs. Marian Wilson Jones, Wilson & Wilson, Attorneys and
Lewis Sweasy relative to Lot Split #196. Mr. King reviewed this case and
reported that the City has not been able to determine justification for
deletion of the conditions placed by the Planning Commission and subsequently
appealed by Mrs. Jones. It was Mr. King's suggestion, however, that if
Council should decide to support the Planning Commission in its decision,
there is a possibility of assisting, through gas tax funds, the cost of
paving on Stewart and Gray Road only, as a street of major importance.
Mr. Griselle explained the setback on Old River School Road.
After much discussion, it was moved by Councilman Peavey, seconded by
Councilman Giddings and passed by the following vote that the decision of the
Planning Commission in Lot .Split #196 be affirmed, the appeal denied except
that the paveout along Stewart and Gray Road be deleted as a condition.

An announcement from the Southeast District Veterans. Service Center
Annual Council Meeting Thursday, 6:30 P.M., November 9, 1961, American Legion
Post #335, 9335 California Avenue, .South Gate.
An announcement from the League of California Cities with proposed
ordinance from the League of California Cities regarding amendment of local
sales and use tax ordinances administered by the .State Board of Equalization
pursuant to the Bradley -Burns Uniform Local Sales and Use Tax Law. This
change was explained by the City Attorney.

The Mayor announced that Reverend Roy Cogswell would like to make a
report for the Hospital Board. Mr. Cogswell stated that the property
known previously as the Lucci property could be purchased from Mr. Peacock
for $400,000 subject to conditions which are acceptable to the Board;
namely, the entire parcel of land be made available to them in clear title
and in such manner that a hospital can be erected on the land; subject to
sale of the property on Stewart and Gray Road; and subject to satisfactory
payment arrangements.
Councilman Giddings inquired about the status of the City of Downey
under the Hill- Burton Foundation. Mr. Cogswell stated that the City of
Downey should be very close to the top within the next year, barring any
explosive developments which are not anticipated at this time.

The City Attorney stated that the right of way is t2l acquired from
property owned by Rudolph J. Manzo in the amount of $7,215.00 and
Mr. Sheldon G. Trenery in the sum of $6,263.23.
Mr. King reported that the costs for acquiring the right of way of the
two mentioned properties were based upon appraisals.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING ITS INTENTION TO VACATE A PORTION OF VIA AMORITA
LYING NORTHWESTERLY OF SHERRY AVENUE, AS SHOWN ON TRACT
NO. 14227
The resolution was read by title only. Mr. Barhite reported that cur-
rently the City has under its jurisdiction a portion of Via Amorita lying
northwesterly of Sherry Avenue within the Los Angeles County Department of
Water and Power right of way. This easement is unimproved, and extends only
to the Rio Hondo Channel.
This vacation has been requested by the Los Angeles Department of Water
and Power on the grounds that Via Amorita will not be extended northwesterly
of Sherry Avenue in view of the existence of the Rio Hondo Channel immedi-
ately to the West. The City Planning Commission considered this matter and
recommends vacation.
After discussion, it was moved by Councilman Peavey, seconded by Council-
man Giddings and so ordered that the resolution be held for further study
of the matter.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
EXTENDING THE AGREEMENT WITH THE COUNTY OF LOS ANGELES
FOR POUND SERVICES
The resolution was read by title only. Councilman Skinner stated that
one of the first letters he had received from his district was one requesting
that the City check with South Gate regarding cost, efficiency of operation,
etc. of their pound services. Councilman Peavey recommended that other pound

services be investigated prior to extending the agreement with Los Angeles
County in order to determine if the services rendered by them are adequate
to the needs of the City of Downey. The Mayor ordered the matter tabled
to the last meeting in November.

Mr. Barhite explained that the purpose of Cash Contract No. 73 for
miscellaneous repairs is to take care of damaged curb, gutter and side-
walks and driveways at various locations throughout the City of Downey.
It was moved by Councilman Peavey, seconded by Councilman Giddings
and passed by the following vote to approve plans and specifications and
authorize advertising for bids for Cash Contract No. 73.

Mr. Barhite explained that the plans and specifications have been
completed for the opening and improvement of Dalen Street along the
southerly boundary of Autonetics, between Ardis Avenue and Bellflower
Boulevard. The estimated cost of this improvement is $17,000. In order
that this project may proceed, it will be necessary to secure from unap-
propriated reserves the amount of $16,500 and deposit to Account No. 13620.
This proposed improvement includes the construction of asphalt paved street
44 feet wide, and cinder block wall along the southerly perimeter of this
street, together with drainage facilities.

grant authority to advertise for bids for Cash Contract #65, Dalen Street
improvements between Ardis Avenue and Bellflower Boulevard.

Mr. King reported that North American Aviation has indicated approval of
dedicating their 46 feet for street right of way and that he will check plans
and specifications relative to alignment and grade with them and the Downey
Land Company and report back to Council at their next meeting.

Mr. King stated that it is indeed a pleasure to report that the
largest assessment district in the City has been completed. This
involved over 400 property owners in the Klondyke district.

of completion for A.D. No. 10-- Klondyke.

After a summation of bids for improvements on Dunrobin Avenue and other
streets (A.D. #55), it was moved by Councilman Corbin, seconded by Councilman
Giddings and passed by the following vote to award the bid to the lowest and
best bidder, Bay Area Concrete Company, in the amount of $15,804.19, and reject
all other bids.

reimburse the D. B. & E. Construction Company $1,587.90 at such time that it
shall be collected from the property owner for the issuance of a permit to
connect to the newly constructed sewer at Paramount Boulevard northerly of
Albia Street.

It was moved by Councilman Corbin, seconded by Councilman Peavey
and passed by the following vote to approve work completed and accept
sanitary sewers for public use under Private Contract No.'s 5868 easterly
from Downey Avenue between Devenir Street and Puritan Avenue and #5924
on the north side of Imperial Highway between Izetta Avenue and Coldbrook
Avenue.

The City Manager reported on the progress of the remodeling program and
requested an additional appropriation of $2,225.00 from operating reserves
for remodeling of the west wing for the Building and Safety and Planning and
Zoning Departments.
It was moved by Councilman Peavey, seconded by Councilman Giddings and
passed by the following vote to authorize an additional appropriation of
$2,225.00 from operating reserves for remodeling for the Building and Safety
Department and the Planning and Zoning Department.

Authority was requested from City Council for the City Manager to sign
a contract with the General Telephone Company for operation and maintenance
of 68 alarm system operations throughout the downtown area. He reported
that this contract contains a 30 -day cancellation clause on the part of the
City.

passed;by the following vote to authorize the City Manager to sign a contract
on behalf of the City of Downey with the General Telephone Company for opera-
tion and maintenance of the alarm system.

The City Attorney reported that with relation to the matter of the Hospital
site reported by Reverend Roy Cogswell, a suit is pending under which it is
possible to recover approximately $16,000 in a litigation of the City of
Downey vs. Lucci. Such funds, if recovered, to then be used for street paving.
The City Attorney requested the opinion of Council as to whether or not it
would be advisable to set a trial date to determine if this matter can be
worked out and the City's wishes in pursuing the pending litigation. It was Council's

The City Attorney also reported on the status of the matter of the
City of Downey vs. the Downey County Water District.
Also reported by the City Attorney was that in the matter of Assessment
District #64, Stamps Avenue, condemnation action pending, Mr. Utley has
requested submittal of some offer above the appraisal price.
Mr. King reported that final approval has been received from the State
Division of Highways on the Firestone Boulevard improvements, and that a
final report will be forthcoming soon on the local Post Office.
Mayor Temple reported that a request has been received from the Southern
Pacific Railroad Company for the City Manager to send signature approval in
lieu of appearing in their behalf relative to the acquisition of Western
Railroad with petition for leave to intervene. The City Attorney advised
that this will not be necessary and the communication was ordered received
and filed.
The Mayor reported that a request has been received for the City of
Downey to join in a special ceremony to be held in Kansas City, Missouri for
a rededication of the monument to international understanding in a People -to-
People program. It was so ordered that November 10, 11 and 12 be proclaimed
for this great dedication to liberty 40 years ago in the rededication of the
Liberty Memorial located in Kansas City, Missouri.
RESOLUTION NO. 892
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
OBSERVING NOVEMBER 19 -25, 1961 AS MERCY WEEK AND
THURSDAY, NOVEMBER 23 AS MERCY DAY
The resolution was read by title only. It was moved by Councilman
Giddings, seconded by Councilman Peavey and so ordered that further reading
be waived.
It was moved by Councilman Giddings, seconded by Councilman Peavey and
passed by the following vote that Resolution No. 892 be adopted.

It was ordered by Mayor Temple that November 12 -19 be proclaimed
Books from America Week and that the City Librarian, Lester Bergslien, assist
Chief Gain in collection of these books through the fire stations.
Councilman Giddings stated that he would like to know if there is any
City in the State of California which has a more efficient and better,
cleaner, more honest police department than the City of Downey - -in his mind
there is none. He also stated he would like to refute statements made by a
certain attorney to the newspapers with regard to a certain police state
Downey is supposed to have. The Police Department of the City of Downey was
rated 100% by the Federal Bureau of Investigation during his term as Mayor.
Councilman Corbin stated he also desired to go on record as being in
accord with Councilman Giddings' statements relative to the Downey City
Police Department.
Charles "Red" Barrett of the Downey Chamber of Commerce submitted drawings
and plans for approval of the City Council, after which the City Attorney
recommended amending the lease to include the plans and drawings as a part of
the lease agreement.

It was moved by Councilman Corbin, seconded by Councilman Giddings
and passed by the following vote to modify the lease to show Exhibit Al
in lieu of Exhibit A.

It was moved by Councilman Giddings, seconded by Councilman Corbin
and passed by the following vote to authorize the City Manager, upon
receipt of approval of the Building Department, to give written approval
to the Downey Chamber of Commerce for the plans and specifications and
design criteria.
