MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
SEPTEMBER 26TH, 1961
The City Council of the City of Downey held a regular meeting in
the Council Chamber of the Downey City Hall at 8:00 A.M., September 26,
1961, Mayor Carroll M. Dunnum presiding.

The invocation was delivered by Reverend Roy L. Ruth of the Methodist
Church.
A plaque was presented to Reverend Ruth by Mayor Carroll M. Dunnum on
behalf of the City Council in thanks to him and other members of the
Minesterial Association of Downey for the manner of their service to Council
in their inspiring messages'which have always been most welcome. Reverend
Ruth stated he considered it a real privilege to render this service and to
be asked to do so and expressed appreciation for the recognition.
It was moved by Councilman Peavey, seconded by Councilman Corbin and so
ordered that the minutes of the City Council Meeting held on September 11,
1961, be approved as written.
The City Clerk read the following correspondence:
(1) A letter from the Cudahy Improvement Association, Inc. requesting
the City of Downey's support in opposing gambling in Cudahy with a suggested
resolution as adopted by the City of Cudahy.
RESOLUTION NO. 867
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
JOINING WITH THE CUDAHY IMPROVEMENT ASSOCIATION, IN-
CORPORATED IN OPPOSING ORGANIZED GAMBLING
The resolution was read by title only. It was moved by Councilman
Temple, seconded by Councilman Corbin and so ordered that further reading
be waived.
Councilman Giddings arrived at the Council Meeting at 8:07 A.M.
It was moved by Councilman Corbin, seconded by Councilman Temple and

(2) A letter from The Friends of the Downey City Library Executive
Board announcing an open house on October 5, 1961 at the Downey City
Library. The City Clerk was advised to contact Council regarding their
attendance, the letter being then subject to file.
(3) An appeal from Mrs. Marie Wilson Jones in Lot Split #196,
objecting to the conditions placed on approval of the Lot Split by the
Planning Commission.
Mayor Dunnum stated he felt that the property owner involved in Lot
Split #196 should be required only to improve the property being affected
by the split according to a precedent established about a year and a half
ago by Council in the case of Downey Land Company. He suggested that the
matter be set for hearing.
Sherman Griselle, Director of Planning, stated that it is not neces-
sary to set a hearing and brought out the fact that certain conditions
required in a previous Plot Plan had not been met and were actually a prior
condition which had been set by the Planning Commission.
Attorney Don Wilson, representing Mrs. Jones, questioned the prior
requirement. Mr. Griselle explained the previous requirements set forth
by the Planning Commission. The matter was deferred at this time until
the file could be obtained from the Planning Department files.
The City Clerk continued with the written correspondence:
(4) A letter of petition from various citizens in protest of "Kart-0-
Rama" on Firestone Boulevard. It was ordered accepted and referred to the
City Manager for report at the next Council Meeting.
(5) A letter from Mrs. Constance Chalmers, Program Director of Rancho
Los Amigos Hospital in appreciation of the program presented by the City of
Downey Youth Band.
(6) Copies of letters of Mr. Oren L. King regari.ng escrow proceedings
for the exchange of properties with the Downey Land Company in construction
of a new street from Ardis to Bellflower Boulevard. The City Manager stated
that a more complete report of the escrow proceedings will be presented at
the next Council Meeting.
A letter of appeal from E. D. Caldwell in protest of Zone Change Case
No. 72.
It was moved by Coupcilman Temple, seconded by Councilman Peavey and
passed by the following vote to accept the appeal and set it for hearing on
December 11, 1961, at the hour of 7:30 P.M. in the Council Chamber of the
Downey City Hall, with appeal being held in abeyance as set forth in the
letter request.

(8) A claim for service filed by Safeway Tree Service. It was moved
�. by Councilman Temple, seconded by Councilman Corbin and so ordered that the
claim be denied and referred to the City Attorney.

Mr. Griselle, Director of Planning, returned with the file on
Plot Plan #2 and read the letter addressed to Mrs. Marian M. Jones
of August 7, 1957, outlining the approval by the Planning Commission
of modification of a setback subject to the conditions that the nec-
essary widening, curbs and gutters and sidewalks be completed in
accordance with the Department of Public Works, and dedicated to the
City of Downey or that a bond be posted with the City of Downey in
lieu of actual construction of said improvements in such an amount as
would be fixed by the Director of Public Works.
Attorney Wilson, representing Mrs. Jones, was briefed by Mayor
Dunnum as to the proceedings of this matter prior to his arrival at the
Council Meeting.
Councilman Giddings requested Mr. Griselle to read the letter
addressed to Mrs. Jones dated July 27, 1961, setting forth the conditions
put upon the lot split to which the appeal has been made. Items 3, 4 and
5 of this letter are based on the previous conditions stipulated in 1957.
It was therefore suggested by Councilman Temple that any arguments be
confined to Items 1, 2 and 6 applying to the present lot split
After considerable discussion it was moved by Councilman Peavey,
seconded by Councilman Corbin to affirm the decision of the Planning Com-
mission in Lot Split #196.
Mrs. Jones stated that the former restrictions had been placed only
upon the sign and pumps for a service station and not on the service
station improvement itself, but because of the fact that the restrictions
covered the improvements, they did not go ahead with such improvements.
Mrs. Jones' attorney requested opportunity to review this matter.
Mr. Griselle stated he would have to check on the improvements made on
this plot plan. Mayor Dunnum requested it be established to what advantage
the property owners had taken of Plot Plan #2.
It was moved by Councilman Peavey and seconded by Councilman Corbin to
withdraw their former motion to uphold the decision of the Planning Com-
mission in Lot Split #196. So ordered.
It was moved by Councilman Temple, seconded by Councilman Peavey and
so ordered to table the matter in order to investigate fully with further
hearing to be held at the next Council Meeting, 7:30 P.M., October 9, 1961.
The City Attorney was instructed to check the legal aspect of this
matter to ascertain fully and completely the City Council's ability or
inability to act in this case, with reports requested also from the Building
Department, Planning Department and the City Manager.
Mayor Dunnum stated he had received a letter from Governor Brown with
reference to local disaster plans as a result of a meeting in Washington,
D. C. suggesting that each municipality in the State of California do four
things: 1. Review emergency plans in the City with all of the agencies of
the government which have emergency capabilities and that they be assigned
appropriate tasks; 2. Adopt necessary ordinances to provide training
agencies to put in force; 3. Initiate surveys of all public buildings to
determine space available for suitable shelter; 4. Take steps to provide an
r-� emergency planning agency and consider the economies and services in ac-
complishing this in-concert of action with other adjoining municipalities.
In addition, Mayor Dunnum stated, he had received a great many communications
from the people of the City of Downey relative to what is being done in the City
on public fallout shelters. There is an acute awareness of this need in the
community and it is time the City Council takes definite steps to provide

needed shelters for the people. The Mayor asked the City Clerk to read
one of the letters, written by Mrs. Gordon M. Strahan, 12359 Gneiss
Avenue, Downey.
After the letter was read, the Mayor remarked that there should be
started a sincere and dedicated program to meet this horrible peril and
suggested that assessment districts could be established wherein the
people would be willing to tax themselves for large, adequate fallout
shelters and recommended a Citizens Committee to investigate the best ways
and means of meeting particular problems in the City of Downey. It was
the feeling of the Mayor that Mrs. Strahan would be a very likely person
to serve on such a committee.
It was moved by Councilman Giddings, seconded by Councilman Temple
to appoint a Civil Defense Committee to determine the ways and means for
carrying out Governor Brown's recommendations and consider Mrs. Strahan's
recommendations.
Mayor Dunnum requested that Council be prepared to designate an
individual from each Councilmanic District at the nest meeting to act on
the Civil Defense Committee. The following vote was then taken on the
motion stated above:

The City Manager presented a job classification and requirements for
a Deputy Director of Civil Defense and reported that approval for matching
of funds by the Federal government for this civil defense program had been
received from the California Disaster Office in Sacramento yesterday. He
informed Council that the civil defense and disaster program in the City of
Downey would function along with the Director of Area E; would perform
administrative duties in connection with the office of the City Manager.
Approval of the job specifications has not yet been received from the
Personnel Advisory Board but as soon as this is received, the position can
be advertised. Several applications, a few of which appear promising, have
already been filed, it was reported by the City Manager.
Councilman Temple recommended that each Councilman appoint two members
to the Civil Defense Committee as he did not feel a 5- member committee
adequate to do a good job. The Mayor so ordered.
The City Clerk read a letter from Mr. N. L. Smith of the Southern
Pacific Company in appreciation for the resolution helping them in seeking
control of the Western and Pacific Railroad. Mr. N. L. Smith, 8125 Nance
Street, Downey, was recognized and requested that a representative from the
City of Downey be present at the hearing to be held, October 16 in Los
Angeles, and the latter part of October in San Francisco. He informed
Council that the Southern Pacific Company considers Downey a key point and
advised expenses for a City representative would be borne by the Southerri
Pacific Company. This is merely a followup on the previous action of the
City Council. The Mayor so ordered that a representative from the City of
Downey appear at a hearing in this matter.

District No. 57, Hall Road and other streets. It w as ordered filed
with the City Clerk.

GUTTERS, AND DIWEWAYS IN THE CITY OF DOWNEY, DETERMINING
THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST THEREFOR,
DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY
PUBLIC BENEFIT, AND THAT THE EXPENSE THEREOF SHALL BE
ASSESSED UPON A DISTRICT (A.D. NO. 57)

Councilman Giddings inquired if consideration is being given to in-
stallation of traffic signals at the intersection of Woodruff and Hall Road.
The City Manager replied there is a complete analysis being made in this
project.

The City Manager reported the relinquishment of a portion of Lindell
Avenue from the State Division of Highways was merely a routine matter of
deeding. It was moved by Councilman Giddings, seconded by Councilman Temple
and passed by the following vote to authorize the City Clerk to acknowledge
the State Division of Highways' intention to relinquish a portion of
Lindell Avenue north of the Santa Ana Freeway.

and passed by the following vote to accept improvements required of the
subdivider in their agreement with the City of Downey on Tract No. 19301,
Conrad Street and Brock Avenue, and authorize release of cash bond less
amount of remodeling wall.

It was reported by the City Manager that at the Council Meeting held
on October 11, 1960, Council initiated a zone change of the B -1 (buffer
zone) located approximately 600 feet west of Woodruff Avenue and south of
Washburn Crossing Road, which consideration will be to reduce the width
of the existing 100 feet wide B -1 zone to a width of 30 feet, and hereby
refers such proposal to the Planning Commission for a public hearing, and
a report of findings, summaries of hearings and recommendations of the
Planning Commission concerning this matter shall be filed with the Council
within 60 days. The decision was presented to the City Council on Monday,
January 16, at which time it was taken under submission pending the comple-
tion of the newzoning ordinance. It will be recalled that the reduction of

the buffer zone from 100 to 30 feet in the 1200 block on Woodruff
Avenue was initiated by the property owners facing Woodruff who
dedicated their frontage and installed curbs and gutters in the
improvement of Woodruff Avenue. These owners have now been re-
questing what action will be taken and it is suggested that a public
hearing be set with 10 -day notification so that this matter may be
considered.
It was moved by Councilman Corbin, seconded by Councilman Temple
and so ordered that a hearing be set for 7:30 P.M., October 9, 1961,
in the Council Chamber of the Downey City Hall on the above matter.
Also reported by the City Manager was the item of bids recently
received for the Fire Department drill tower to be located on the rear
of the Public Works Yard. The low bid submitted was $19,497 from
E. & T. Constructors. Savings in the amount of $1290 can be realized
through changes of materials which will be agreeable to the General
Contractor. This will leave an amount of $18,207 for the building as
specified with an additional amount of $1,000 necessary for certain
phases which were not included in the contract and which will be ac-
complished by Fire Department personnel. The completion of this
project is extremely important to the Fire Department's training program.
It was therefore requested that necessary funds be transferred to allow
the speedy construction of this facility, and that the changes in material
mentioned above will reduce the low bid by $1290 to a new total of $18,207.

Mr. Irvin Phelan, 7714 Yankey Street, Downey, presented a report from
the Civic Center Committee and Coordinating Council relative to a proposed
civic auditorium for the City of Downey. They are recommending that the
building be of a theatrical type or character, with sloping floor; that
the ground floor have a capacity of 800, the balcony, 400. It was felt
that this size facility could meet all requirements with the exception,
possibly, of some of the school events which may come up occasionally.
Dining room capacity was recommended for 600; with auxiliary meeting rooms
to seat approximately 800 for dining. Accommodations were also recommended
for youth dances for possibly 1,000.
Mayor Dunnum inquired if it is now the recommendation of the Civic
Center Committee to present their plan to the architects with the idea
that they prepare preliminary plans and specifications. Mr. Phelan replied
in the affirmative.
The City Manager stated that it is hoped by the end of October a
definite plan can be drawn for circulating to the people of Downey.
Mayor Dunnum highly commended Mr. Phelan and the Civic Center Committee
for their definite and positive recommendations at which they arrived and
,..� presented to Council, and thanked him for his splendid job, well done.

preliminary plans and specifications for a civic auditorium, at the specified
limitation of $3,000 as previously authorized.

It was moved by Councilman Temple, seconded by Councilman Peavey and
passed by the following vote to authorize the Director of Planning to
attend the American Institute of Planners Annual Conference in Detroit,
Michigan, November 26 - 30 and for the Chief of Police to attend the
International Association of Chiefs of Police in Montreal, Canada from
September 30 to October 5, 1961. Funds are in the budget for these pur-
poses.

The City Manager and the Chief of Police presented a check in the
amount of $1,084 from the California Peace Officers Training Fund. Chief
Robinson stated that this is their first refund check, reimbursable under
the program adopted by the State Legislature in 1960, becoming effective in
October. He reported that during the past 8 months, 5 police personnel were
sent to full recruit training at the Police Academy. It was also reported by
Chief Robinson that 5% of all fines with the exception of traffic fines, are
put into a RpcCial fund and thus it would seem the criminals are actually
"training police officials to catch them better" through expenditure of this
fund for training police personnel. Fifty per cent of the salary of these
trainees is paid for the first 160 hours of training. The Chief turned the
check back to the General Fund.
The City Manager advised that since the Annual Leage of California Cities
Meeting is to be held on October 22 - 26 which will conflict with the second
Council Meeting of the month of October, it would be his recommendation that
Council, at this time, set another date for the second meeting in October,
suggesting October 31. The Mayor so ordered.
It was also reported by the City Manager that Councilmen, Department
Heads and three or four of the executive secretaries will be attending a
League program in San Gabriel Friday, September 29.

on the south side of Imperial from Adenmoor Avenue to Bellflower Boulevard,
not to exceed the amount of $3500 from the current year's budget of Gas Tax
money.

Mr. Wendell Wiser, 11215 Woodruff Avenue, reviewed his suggestion that
City Council study the possibility of use of storm drains as temporary
shelters, giving dimensions of the various drains throughout the City of Downey,
advising that in his checking of them, he has learned that there are entrances
every 600 feet and a manhole every 500 feet; that gases are negligible.

Mayor Dunnum suggested to Mr. Wiser that he contact the Citizens
Civil Defense Committee when formed so that they could study his rec-
ommendation. Mr. Wiser was also advised by the Mayor that Mr. Barhite,
Director of Public Works, has been asked to study this matter and
Council therefore has been unable to reply to Mr. Wiser's request as yet.
Mr. John Ezzell, ;7916 East 4th Place, advised the City Council that
the hospital board was studying two sites with relation to the location
of a new Downey Community Hospital, one on Stewart and Gray Road and the
other, known as the Lucci property on Paramount Boulevard. In his
presentation of these studies Mr. Ezzell asked if the City Council could
give their recommendation as to which would be more beneficial for the
City of Downey. Various members of the City Council expressed their
opinion personally in favor of the Paramount Boulevard site; however,
it was agreed as noted by Mayor Dunnum that the City Coincil, .as a body
could not make any recommendation at this time without the considered
opinion and study from the Planning Commission, as well as their own
investigations.
Mr. Paul Gaines, 8339 East 2nd Street, Downey$ representative from
the Junior Chamber of Commerce, presented the problem and plan to City
Council for the forthcoming Christmas parade. The Chamber of Commerce,
downtown and Stonewood business areas, he atated, would like the parade
to be held on November 25, the first Saturday following Thanksgiving.
The board, in trying to combine the Chrisatimas parade with a birthday
celebration of the City, suggested December 4 or 17. The Junior Chamber
of Commerce is not in favor of the 25th for various reasons, so have
selected as a tentative date, only, December 16.
It was discussed by Council that any anniversary celebration be dis-
pensed with and the Junior Chamber of Commerce to go ahead with their own
.-. plans on the Christmas parade.
Councilman Giddings inquired about the status of the Master Plan
study. Mr. Griselle stated that the plan was authorized to begin July 1;
however, this was not possible due to the rather late authorization. The
principal planner will start on the job next Monday and the consultant, Mr.
Whitnall, has been employed. The basic steps, tooling up for the process,
have begun and the department is moving forward toward getting into larger
quarters which are necessary for making the master plan. Also census
information and block data will be invaluable in their planning, and it is
hoped that this will be received in October. Base maps from engineers have
been completed; basic essentials for putting together a Master Plan. Start-
ing shortly after the first of the year and early spring, recommendations will
be coming to Planning Commission, Chamber of Commerce, and other groups, so
by next summer the City should be well into a Master Plan.
Councilman Giddings stated that the citizens were not criticizing but
merely want assurance that a plan is in the working stages.
Mr. Griselle assured Council that the Master Plan will be produced in
the time specified. Upon inquiry, the Director of Planning also assured
that there will be a recommended procedure for keeping the Master Plan current.
Councilman Temple reported the League of California Cities will have an
early session on October 22 at 2:30 P.M. and would like to have the Council
to appoint someone to be their sister -city representative at this meeting.
It was so ordered that Councilman Temple represent the City of Downey at this
particular session of the League Meeting.
Councilman Temple informed Council of the program in cooperation with the
U. S. Conference of Mayors' International Delegation which will go to Munich
in West Berlin. This program is designed to show the solidarity of the free
world in the battle against communism. Each mayor was solicited to send a
telegram to Mayor Willie Brandt of West Berlin relative to the solidarity of
the free world in the attempt to bolster their morale. Mayor Dunnum reported
he did this immediately upon receiving the message last Friday.

It was agreed that the telegram message was sufficient action in
this program.
Councilman Peavey requested that the City Manager contact the
School Board to check on the installion of sidewalks in front of the
Maude Price School if the City puts in sidewalks at the west end of
^ Suva as approved by them last year.
Councilman Peavey stated he had been informed that a city auditorium
might possibly be built with lend -lease money, and suggested that the
City Manager investigate on the type of procedure and the City Attorney
check on the legality of such steps.
Councilman Peavey recommended that the City Manager be authorized
to attend the interim committee meeting in San Francisco and Los Angeles
relative to the Assembly bills now pending before the committee. The Mayor
so ordered, and directed that any other representative who is able, also to
attend.
There being no further business to come before the Council, the meeting
adjourned at 10:55 A.M.
