MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
NOVEMBER 13TH, 1961
The City Council of the City of Downey held a regular meeting in the
Council Chamber of the Downey City Hall at 7:30 P.M., November 13, 1961,
Mayor Scott E. Temple presiding.

The Mayor announced that before any business on the agenda is considered,
a film on bicycle safety would be shown, with a presentation of certificates
of award being made to persons responsible for the production of the film- -
Downey Police Department, North American Aviation, Space and Informations
Division, and the Downey Woman's Club. Chief of Police Ivan A. Robinson re-
ported that 30,000 bicycle pamphlets will be distributed in Downey classrooms.
The Mayor presented certificates to the following persons:
.-- Richard Stacey, N.A.A. Space & Informations Division; Byron Bauer, camer-
aman; Byron Conklin; another certificate to Richard Stacey for personal
services; Felix Lawler, N.A.A., who spearheaded this project and is a member of
the Safety Council; E. J. Hunter (not present); Bud Clark who helped on sound
and film; Doug Farmer (not present); Al Lopez, absent; Downey Community Hos-
pital representative; Mr. Jorgensen of Adams Ambulance Service; secretary for
Sports Film Industries; and Dick Joy (not present).
Chief Robinson then introduced members of the Safety Council who were
present.
Mrs. Bernoid, President of the Downey Woman's Club, was presented a
certificate of award for the club's assistance in the bicycle safety program.
A 15- minute recess was called by the Mayor for the showing of the film.
The Council Meeting reconvened at 8:15 P.M. with Reverend Ackerman of
the Christ Lutheran Church delivering the invocation. The City Clerk had been
excused from the meeting.
Mayor Temple announced that this is the time and place set for the hear-
ing on the Debt Limit Report for A.D. #57, Hall Road. The Mayor asked the
Deputy City Clerk if she had received the Affidavit of Publication and the
Affidavit of Posting. The reply was affirmative.
It was moved by Councilman Corbin, seconded by Councilman Skinner and so
ordered that the affidavits be received and filed.
The City Engineer read the Debt Limit Report to the Council.
The Mayor inquired of the Deputy City Clerk if there were any written
protests. There were none.

The Mayor asked if there were any oral reports. There were none.
There being no written and no oral protests, it was moved by Council-
man Corbin, seconded by Councilman Giddings and so ordered that the hearing
on the Debt Limit Report for A.D. #57, Hall Road, be closed.
RESOLUTION NO. 893
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
MAKING FINDING ON THE REPORT FOR THE IMPROVEMENT OF
HALL ROAD AND OTHER STREETS (A.D. #57)
The resolution was read by title only. It was moved by Councilman

The Mayor announced that now is the time and place set for the hearing on
the Resolution of Intention in A.D. #57, Hall Road.
The Mayor asked the Deputy City Clerk if she had received the affidavits
of publication and posting. The Deputy City Clerk stated she had.
It was moved by Councilman Giddings, seconded by Councilman Corbin and so
ordered that the affidavits be received and filed.
The Mayor asked if there were any written protests. There were none.
Mr. Richard Barhite presented a report on the Debt Limit. The City Attorney
advised this report should, by minute action, be made a part of the hearing.
It was moved by Councilman Giddings, seconded by Councilman Corbin that the
report on the Debt Limit be made a part of the hearing. So ordered.
It was moved by Councilman Giddings, seconded by Councilman Skinner and so
ordered that the hearing on the Resolution of Intention be closed.
RESOLUTION NO. 894
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING WORK TO BE DONE ON HALL ROAD AND OTHER STREETS
IN ACCORDANCE WITH RESOLUTION OF INTENTION NO. 887
(A.D. #57)

It was moved by Councilman Corbin, seconded by Councilman Giddings and
so ordered that the minutes of the meeting of October 31, 1961, be approved

The Deputy City Clerk read the following written correspondence:
A letter from the County Board of Supervisors advising of the possibil-
ity of a special election to determine the public's reaction to the need for
fallout shelters.
A letter of appeal filed by Mrs. Eugene Baldoni, Jr. with the required
$50 deposit in protest of Zone Exception Case #246.
Mr. Sherman Griselle, Director of Planning, presented a brief resume of
the Planning Commission decision.
It was moved by Councilman Giddings, seconded by Councilman Skinner and
passed by the following vote that a hearing be set on Zone Exception Case
#246 for 7:30 P.M., December 11, 1961, in the Council Chamber of the Downey
City Hall.

A letter from the Downtown Downey Business Association requesting sup-
port of the City for Christmas Decorations in the amount of $500. The City
Manager advised that it had been the policy of the City in the past not to
participate in this project, as it was felt to be the responsibility of the
Downey Chamber of Commerce.
It was moved by Councilman Giddings and seconded by Councilman Corbin
that the City of Downey not participate in the Christmas Decorations project.
Councilman Skinner requested a report on this project from the Chamber
of Commerce in the near future.

A letter of resignation from Richard Barhite, Director of Public Works,
to accept the position of Director of Public Works for Stanislaus County
effective December 1, 1961.
It was moved by Councilman Giddings, seconded by Councilman Corbin and
passed by the following vote to accept with regrets the resignation of
Richard Barhite, Director of Public Works, effective November 30, 1961.

RESOLUTION NO. 895
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
COMMENDING RICHARD G. BARHITE FOR HIS ORGANIZATION AND
ADMINISTRATION OF THE PUBLIC WORKS DEPARTMENT OF THE CITY
Mayor Temple read the resolution in full. It was moved by Councilman
Corbin, seconded by Councilman Giddings and passed by the following vote that
Resolution No. 895 be adopted.

Mr. King stated he wished to let Mr. Barhite know, and on behalf of the
administration, it had been a pleasure to work with him for 42 years.
An announcement of the County Boundary Commission of a proposed East
Maywood Addition No. 2 to the City of Maywood.
The Deputy City Clerk reported many letters had been received supporting
the special book shelf in the City Library on American Heritage and requesting
that it be maintained indefinitely. Also, there were some letters protesting
this shelf being maintained in the City Library.
Speaking on the subject were:
Lois H. Morgan, 9616 E. Lubec, who requested that her letter be read in
full.
Priscilla Slocum, 7733 Corey, Downey, who also requested her letter be
read.
Mrs. John Veeder, 9504 Rives Avenue, who recited the rules and regulations
governing the library in the Municipal Code; that there should not be a division
by selection by a particular group nor through emotion or threat, which would be
a disturbance of the regular pattern of the operation of the library. Two books
were displayed by Mrs. Veeder which could be examples of controversy - -where one
book would be found dissenting by one person, the other would not be.
Patricia Bonn, 9309 Parrot Avenue who praised the Dewey - Decimal System used
by the City Library for the selection of books and urged Council not to allow
extreme right or leftists issues to be in the library. She commended very
highly the Downey City Library and the City Librarian.
Mr. Robert Tucker from Whittier, employed in the Autonetics Division of
North American Aviation, and a member of Local #887 of the Division of United
Automobile Workers in America (which represents 15,000 members in this particular
industry alone, according to Mr. Tucker), who stated he had been asked to speak
for Mr. J. C. Kinder, a Downey resident. He requested that a library on the
history of collective union - -the union's side of the story, be approved by the
Downey City Library. He stated this collection of books has been approved by
libraries all over the United States. Some of the books, he reported, paint the
entire union picture.

Mr. Paul Schaffner, 10237 Hopeland, Downey, who stated the policies
set out in the municipal code for operation of the library should apply
regardless of the content of the book and requested that these books be
assimilated into the library on the same basis as other donations and
should deserve no more consideration than any list of books that other
citizens might donate; that the public library should not be made a
political battleground but should maintain an impartiality toward all
ideas that it has in the past. He protested the singling out of any
special group of books as representing the American Heritage as he believes
it is embodied in the library as a whole and in the principles that a good
Public Library stands for.
Mr. James Gillespie, 7614 Cleargrove, a Downey attorney, who stated
he is not for or against the book shelf; however, he believes the library
should conform with the book buying policy set forth in the Municipal Code
and also the rules and regulations in setting up the Library Advisory Board
which appear in Sections 2420 and 2424.
Mrs. Betty Toro, 7930 Cole Street objected to giving the sole power to
select books to one man, the City Librarian. The Mayor announced that this
particular policy will be reviewed by the Library Board.
Lars. Samuel Berland requested that her letter to Council be read in full.
The letter urged that the Library Board adhere to the Code of Ethics approved
in the past and to implement it in such a way to prevent the library from
becoming a tool of partisan thinking, and that all books in the library should
be handled equally, catalogued according to the universal Dewey Decimal System.
The Mayor stated that the policy of the library operations is normally not
to have special shelves but they may be accepted for a temporary time. He
reported that the Library Board has requested Council's guidance in this matter
under discussion.
Councilman Corbin stated he feels the shelf should be retained for the people
are free to read them or not to read these books.
Councilman Skinner stated he is in favor of leaving the shelf as it is.
Councilman Giddings stated he wished to clarify that the Library Board is
merely an advisory board; that Council makes the final decisions. He is for
anything for America to be in the library and not for anything against America.
He would be in favor of getting all the communistic literature out and leaving
all that is there for America. He stated further that it should be made certain
that a review is made of all the books placed on the shelves in the library and
that there should be a good knowledge of each book's contents.

passed by the following vote that the special shelf in the library on American
Heritage remain as a special exception to the rule; that it is made certain that
nothing goes into the library which is against America; and that the Library Board
be asked to review the methods of the selection of books.

project, the most complete in the entire draining system, and its location.

PROHIBITING PARKING ON BOTH SIDES OF HALL ROAD, A
POINT 200 FEET EAST OF COLDBROOK AVENUE TO BELLFLOWER
BOULEVARD

Mr. Clinton Parish, 9105 Hall Road, objected to prohibiting parking on
this street as he feels it will be a handicap to the property owners, es-
pecially those with rental units. The City Manager advised that there will
have to be a review of this matter; however, Hall Road will be torn up soon
due to construction work and parking would be prohibitive anyway. He advised
that there will be another study made, but as the prohibiting of parking at
this time had been requested by over a majority of the residents, it was in
order. The resolution was tabled until further study can be made with a sub-
sequent report being made to Council.
RESOLUTION NO. 898
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AUTHORIZING THE PURCHASING AGENT TO PARTICIPATE WITH
THE COUNTY OF LOS ANGELES AND OTHER AGENCIES IN THE
COOPERATIVE PURCHASING PROGRAM
The resolution was read by title only. Mr. Kendall reported that this
cooperative purchasing program is permissive and the City Attorney advised that
the City has the right to choose which items it wishes to purchase under this
program.

RESOLUTION NO. 899
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
OPPOSING COMMERCIALIZED GAMBLING AT PREMISES OPERATED FOR
THE BUSINESS OF GAMBLING AT DRAW POKER OR LOW BALL, AT
WHICH MORE THAN 20 PLAYERS PARTICIPATE PER ESTABLISHMENT
UNDER ONE ROOF, AND OPERATING UNDER ONE LICENSE, WHERE A
FEE OF ANY TYPE IS CHARGED.

tion was recommended by the League of California Cities.

The City Manager introduced Mr. W. E. Schneider from the Robert Schweser
Company who outlined a lease- purchase arrangement for financing an auditorium
and community facilities building. It was stated that this would be a lease and
option program financing of this facility. His firm would assist in the organi-
zation of a corporate organization, the sole benefit would be for the City of
Downey; and probably there would be five directors who would be allowed possibly
$25 a meeting to the maximum of $100 per year.
Councilman Giddings suggested thtthis plan be presented to the Civic
Center Committee for further study and then, upon their recommencation, meet with
Mr. Snyder, the Civic Center Committee and the Finance Committee to go over it
fully.
Mr. King advised that the Civic Center Committee will be meeting at 9:00 A.M.,
November 15, and invited Mr. Snyder to attend, if it would be possible for him to
do so.

The resolution was read by title only. The City Attorney stated that
^ this resolution sets a hearing for November 28, 1961, at the hour of 8:00 A.M.,
and that the proposed changes are technical changes only and do not change the
substance or cost of the work. The changes are being made merely to clear up
some possible ambiguities.

The City Manager reported that the work required of Integrated, Inc. for
remodeling the City Hall under Cash Contract No. 60 -A has been satisfactorily
completed. This work included the Public Works Building, City Manager's office,
Mayor's office and Police Department holding room. The initial contract price
was $53,540.00, which has been modified by the following changes and needed
added facilities, listing the cost thereof:

It was moved by Councilman Giddings, seconded by Councilman Corbin
and passed by the following vote to accept the work done under Cash Con-
tract No. 60 -A and authorize filing a Notice of Completion.

Councilman Giddings inquired about landscaping of the City Hall which he
stated he felt was badly needed. It was his understanding that the City
Forestry Department was to have taken care of this.
Mr. Barhite reported that the Public Works Department will be radoing the
lawns next spring and that landscaping is planned for completion at the new
Public Works Building by the time set for the open house, November 28, 19611
Mr. Barhite reported that plans and specifications have been completed
for the extension of a service road or alley, together with paving of that
portion of the Public Works Yard to serve the Fire Department training tower.
It was moved by Councilman Corbin, seconded by Councilman Giddings and so
ordered to approve plans and specifications for Public Works Yard paving and
authorize advertising for bids.
It was requested that Council approve a proposal to give to the Park
District, 14 steel street lighting standards acquired as surplus material,
for use in the City parks. The City Attorney advised that this is possible if
the surplus can be declared no longer needed for public use and that there is
not a reasonable market for their sale.
It was moved by Councilman Corbin, seconded by Councilman Giddings and
passed by the following vote to declare the 14 steel street light standards
surplus property, no longer needed for public use; that there is no reasonable
market for the sale of them; and approve giving the 14 steel street light
standards to the Park District for use in the City parks.

It was moved by Councilman Corbin, seconded by Councilman Giddings and so
ordered to approve the application of the Downey Jaycees for a parade permit
for November 30 from 7:00 to 9:00 P.M.
�-. It was reported by the City Manager that after screening and interviewing
available candidates for the position of Deputy Director of Civil Defense,
Mr. Edwin T. Powell has been recommended by the Personnel Board to assume the
position under Schedule No. 20 at a beginning salary of $594 per month,
effective Wednesday, November 15, 1961. Final approval of Council was requested.

and passed by the following vote to approve the employment of Edwin T. Powell
as Deputy Director of Civil Defense in Schedule No. 20, at a beginning salary
of $594 per month, effective Wednesday, November 15, 1961.

It was further requested that Council authorize the transfer of $11,846
from the operating reserve fund for the Civil Defense budget for the remainder
of the fiscal year. The budget constitutes anticipated expenditures of $7,725
for salaries (Deputy Director and Secretary; utilities, transportation and
communications - $1150; contract services primarily relating to printing and
personnel training - $500; material and supplies - $350; retirement compensa-
tion insurance and depreciation of equipment - $1071; and $1068 for office
equipment,furniture and radio equipment. It is necessary to allocate this
entire budget prior to the formal submission for one -half reimbursement through
the state and federal government.

passed by the following vote to approve the Civil Defense Budget as outlined
and authorize the transfer of funds.

Mr. Sorensen explained that it would appear desirable at this time to
have an action brought by some attorneys representing the City, naming him as
the City Attorney as defendant for the purpose of compelling him to file the
condemnation action in the Offstreet Parking District as it appears probable
that any bond buyer would require either a judgment in a test case or some
other assurance of the validity of the proceedings primarily by reason of the
amount involved ($400,000 to $500,000). It was his recommendation that Council
employ special attorneys for this purpose at an early date to avoid delay in
setting up this parking district. However, the City Attorney stated that if
Council was not in any particular hurry to set up this particular assessment
district, it could be tabled with the possibility that other developments might
make it unnecessary to file such action. No action was taken by Council at this
time.
The City Manager reported that a survey of the present animal regulation
as handled by the Los Angeles County Pound Department, the Southern California
Humane System has resulted in a recommendation that the Council authorize con-
tinuance of the present contract with the Los Angeles County Pound. It is noted
that the City of South Gate discontinued their city pound facilities.

passed by the following vote to continue the pound agreement with the County of
Los Angeles.

The City Manager inquired about the possibility of removing the partition
at the end of the Council Chamber to extend the room to seat more citizens.
It was moved by Councilman Corbin, seconded by Councilman Giddings and
passed by the following vote to remove the partition to enlarge the Council Chamber
and submit a survey report at the next Council Meeting with regard to cost, size
and possibility of an additional conference room and entrance.
