OF THE CITY OF DOWNEY
JULY 25TH, 1961
The City Council of the City of Downey held a regular meeting in
the Council Chamber of the Downey City Hall at 8:00 A.M., July 25,
1961, Mayor Carroll M. Dunnum presiding.

Councilman Peavey was welcomed back from his 70 -day trip around the
world by Mayor Dunnum.
Councilman Peavey stated he had a wonderful trip and had seen so much
that he was unable to say which place was the most outstanding. He also
stated that when it is seen what chances for freedom people will take in
Europe, the citizens of the United States should cherish their freedom just
that much more. He invited Councilman to see the pictures which were taken
on his travels.
Mayor Dunnum thanked Councilman Peavey for his invitation and stated
he would be looking forward to seeing them.
The Mayor stated this is the time and place for the public hearing
set on the Debt Limit Report for A.D. #12, Sixth Street improvements.
Mayor Dunnum then asked the City Clerk if she had the Affidavit of Mailing
relative to the hearing. The City Clerk replied she had the affidavit.
It was moved by Councilman Corbin, seconded by Councilman Temple and
so ordered that the Affidavit of Mailing relative to A.D. #12, Sixth Street,
be received and filed.
The Director of Public Works presented the factual data of the investi-
gation report which showed a total of $14,016.34 for this assessment
district.
The report was ordered accepted and filed.
The Mayor asked if there were any written protests. The City Clerk
replied there were no written protests, however a memorandum from the
Engineering Division was read reporting a meeting held with eight of the
sixteen residents in the area and indicating their unanimous approval of
the improvements on Sixth Street, A.D. #12. The memorandum was ordered
accepted and filed.
The Mayor asked if there were any oral statements or comments to be
made by anyone in the audience. There were none.

passed by the following vote that the hearing on the Investigation Report
in A.D. #12, Sixth Street, be closed.

RESOLUTION NO. 835
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
FINDING AND DETERMINING THAT ASSESSMENT DISTRICT NO. 12
(SIXTH STREET AND LAKEWOOD BOULEVARD) IS FEASIBLE AND
THAT THE LANDS WITHIN THE PROPOSED DISTRICT WILL BE ABLE
TO BEAR THE BURDEN OF SUCH PROPOSED ASSESSMENT
The resolution was read by title only. It was moved by Councilman
Temple, seconded by Councilman Corbin and so ordered that further reading
be waived.

and passed by the following vote that Resolution No. 838 be adopted.

Mayor Dunnum announced that this is the time and place set for the
hearing on the Resolution of Intention for A.D. #12, and asked the City
Clerk if she had the Affidavits of Publication, Posting and Mailing
relative to this hearing. The City Clerk replied she had these affidavits.
It was moved by Councilman Giddings, seconded by Councilman Temple
and so ordered that the Affidavits of Publication, Posting and Mailing be
received and filed.
The Mayor asked if there were any written protests. The City Clerk
replied there were none. There were also no oral comments.

so ordered that the hearing on the Resolution of Intention for A.D. #12,
Sixth Street, be closed.
RESOLUTION NO. 836
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING WORK TO BE DONE ON SIXTH STREET AND LAKEWOOD
BOULEVARD (A.D. NO. 12) IN ACCORDANCE WITH RESOLUTION
OF INTENTION NO. 815
The resolution was read by title only. It was moved by Councilman
Peavey, seconded by Councilman Corbin and so ordered that further reading
be waived.

It was moved by Councilman Corbin, seconded by Councilman Temple
and so ordered that the minutes of the Council Meeting of July 10 be
approved as written.
It was moved by Councilman Giddings, seconded by Councilman Temple
and so ordered that the minutes of the Adjourned Meeting of July 17 be
approved as written.
The City Clerk read the following written correspondence:
(1) A letter from the Treasurer of the Greater All American Markets,
Inc. relative to a settlement agreement figure of $820.00 to the City of
Downey for an awning erected by the City on property leased from and
owned by Greater All American Markets. The City Attorney requested that
this matter be continued to the next Council Meeting in order that he may
make a further study of this matter. So ordered.
(2) A report from the Los Angeles County Road Department approving
$33,000.00 for Brookshire Avenue from Firestone to Manatee for the City of
Downey under the 3/16 gas tax money.
(3) A copy of a letter written by Mr. Barhite, Director of Public
Works, to Aman Brothers Construction Company which stated the City Council
wished them to share the gratification of a job well done as expressed by
several residents living on Gallatin Road for their appreciation to both
the City and the contractor.
(4) A telegram from Congressman Clyde Doyle regarding the posting
of bids on July 17 for the new Post Office in Downey, bids to be opened
September 1.
(5) A letter from H. L. Dougan, Chairman of the City Wide Taxpayers
Association of Downey, requesting that the City Council have all future
City Council Meetings recorded in their entirety by means of tape record-
ings or verbatim et litteratim.
It was moved by Councilman Peavey, seconded by Councilman Temple and
so ordered that the matter be taken under submission and referred to the
City Attorney.
(6) A letter from the City Wide Taxpayers Association of Downey com-
mending the Department of Public Works on their efforts to improve the
traffic control on Firestone Boulevard by the installation of islands.
The City Manager asked Council to consider the plans previously sub-
mitted to Council at their last meeting and suggested that instead of the
improvements extending only from Lakewood Boulevard to the western city
limits, they be extended from the east city limits to the west city limits.
The City Manager advised the work on the improvement to the east city
limits could be withheld until the storm drains are being installed in the
fall, at which time the islands will need to be removed.

and passed by the following vote to approve the plans as previously sub-
mitted for improvements on Firestone Boulevard with landscaping to extend
from city limits to city limits.

The City Attorney advised that no date for hearing had been inserted

the resolution adds the Capital National Bank to the depositories of

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY AUTHORIZING THE ACQUISITION OF CERTAIN
RIGHTS OF WAY ON FOSTER ROAD AND'WOODRUFF AVENUE
The resolution was read by title only. The City Manager reported
that an agreement has been obtained from the owner of property at the
northeasterly corner of Foster Road and Woodruff Avenue in the amount of
$10,000.00 for acquisition of right of way. The appraisar valued this
land at considerably more due to severance damages. Funds will come out
of 3/16 gas tax monies in the current budget, according to the City
Manager.

ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE
FUNDS OUT OF WHICH THE SAME ARE TO BE PAID (#3216-#3313

After a summation of bids for Cash Contract No. 45, Paramount Boule-
vard improvements, it was recommended that the bids be awarded to the
lowest and best bidder, 0. R. Benedict Company in the amount of $8,729.52,
subject to State approval.
It was moved by Councilman Giddings, seconded by Councilman Temple
and passed by the following vote that Contract #45 for Paramount Boulevard
improvements be awarded to the lowest and best bidder, 0. R. Benedict
Company, in the amount of $8,729.52, subject to State approval, and that
all other bids be rejected.

It was moved by Councilman Giddings, seconded by Councilman Peavey
and passed by the following vote that the work be approved for Cash Con-
tract No. 50, Gallatin Road improvements between Lakewood Boulevard and
Downey Avenue, and that authority be granted to file a Notice of Completion.

A summation of the bids for Cash Contract #63 for Florence Avenue, et
al. was reviewed by Council. The City Clerk reported she had received a
petition objecting to the installation of sidewalks on Tweedy Lane. The
City Manager recommended deletion of this portion of the contract and
meeting with the residents to discuss further, the possibility of installing
these sidewalks at a later date.
Councilman Peavey advised that it was upon his request that steps were
taken to install sidewalks on Tweedy Lane for the safety of school children
going to and from the Maude Price Elementary School, Roger Casier Elementary
School and North Downey Junior High School, and that he is willing to give
whatever right of way is necessary for sidewalks on the side of Tweedy Lane
on which he lives. He hopes that the residents objecting will give further
consideration and thought to the safety of these school children.

passed by the following vote to delete Tweedy Lane from Contract #63 for
sidewalks with the possibility that Council recondier this at a future date.

The City Manager inquired if the bid might be awarded to A -1
Concrete, Inc. with the deletion of that portion applying to Tweedy
Lane. Mr. Barhite reported that the specifications provided for
deletion of any portion.
It was moved by Councilman Giddings, seconded by Councilman Temple
and passed by the following vote that the bid with the deletion of that
portion applying to Tweedy Lane for Cash Contract #63 in the amount of
$20,962.94 be awarded to the lowest and best bidder, A -1 Concrete, Inc.,
and all other bids be rejected.

approving plans with the deletion of Tweedy Lane from these specifications.

After a summation of bids, it was moved by Councilman Corbin,
seconded by Councilman Temple and passed by the followong vote that Cash
Contract #69 for application of slurry seal on various streets throughout
the southwesterly portion of the City of Downey be awarded to the lowest
and best bidder, Hunt Process Co., at the unit figure of $17.00 per ton,
and that all other bids be rejected.

The City Attorney requested authorization to attend in New York in
September the National Institute of Municipal Law Officers with reasonable
expenses allowed.

passed by the following vote that the City Attorney and any members of the
Council who desire, be authorized to attend the National Institute of
Municipal Law Officers in New York in September with reasonable expenses
allowed.

The City Attorney asked to report at this time on matters relating to
the Municipal Auditorium proposed for the City of Downey, reminding Council
that he had been asked to have an agreement drawn up to be with 04'Melveny
& Myers for bonds. He reported they will be happy to accept such employ -
ment and their services will consist of drafting of all ordinances,
resolutions, notices and other documents required in the bond proceedings,
the general supervision of the proceedings, the examination of the proceed-
ings step by step as taken, and the issuance of their approving opinion to
the purchaser of the bonds.
For these services their fee will be 2/10 of 1% for the first $1,000
of bonds authorized and 1 /10 of 1% of the amount of bonds in excess of
$1,000,000 payable $1,00 following the canvass of the election returns
and the remainder following the dale of the bonds. -A prorata pottion
(treating each sale as excess over all prior sales) of the remainder of
the total fee will be payable following each sale. Where the bond proposi-
tion fails at the election, the fee will be $1,000.

The above is based on the assumption that all bonds which carry will
be sold at three sales. If portions of the bonds are sold at different
times, there will be an additional fee of $400 for each sale after the
first three sales.
The City Attorney advised action can be taken at this time or
taken under submission for further study. It was stated these fees are
reasonable fees for services of this nature.

The City Attorney advised he had also been asked to draw up a con-
tract of employment for Anthony and Langford. This firm had submitted
to him a form based upon one of the previous contracts which the City had
with them and some changes had been made by the City Attorney who reported
upon advising the firm of Anthony and Langford of these changes, all were
agreeable. Copies can be made available to Council for them to read if
they so desire before approving the proposed contract.
Mayor Dunnum briefed Councilman Peavey on the matter of the Civic
Auditorium as it had proceeded to date, reporting on the $500 cost
authorized by Council for the firm of Anthony & Langford to prepare a
sthemtic layout for a proposed civic auditorium; that the firm of Welton &
Becket had been authorized to make a study of the entire downtown core area
for the sum of $10,000, and that both studies had been completed and
presented during the absence of Councilman Peavey. Both firms have been
working independently and without apparent liaison, had ascertained and
determined the area immediately south of the City Hall as the most logical
area for a municipal auditorium. The first public meeting had been held
disclosures were made to the people, Anthony & Langford presented slides
depicting a 1500 seat auditorium, service facilities, meeting rooms,
cafetoriums, a full size stage, balcony seating of 500, lower floor of 1,000
entrances at all sides except for the Firestone side which was to have
service facilities only; banquet room, small dance floor in the back, also
banquet facilities for approximately 250 people, seating arrangement for
flat floor facility of 500, dance floor of about 1,000.
The City Attorney gave a rundown of the provisions of the proposed
contract between the City and Anthony & Langford. There were four phases
set forth:
1. The Schematic. 2. Design development phase based on a cost of
62% of the total construction cost in preparation of documents. 3. Con-
struction phase. 4. Actual construction phase.
The sum of $3,000 was stipulated as the maximum amount required to
put the issue on the April 1962 ballot with $2,000 to be paid upon execution
of the agreement.

ment between the City and the firm of Anthony and Langford, as outlined and
approved by the City Attorney.

The City Clerk reported one protost had been received against the weed
abatement program. The Mayor stated any appeals will first be considered,

The Director of Public Works indicated that proper owners desiring to

Mr. Barhite, Director of Public Works, presented a report on the status
of public works projects. The report was ordered accepted and filed.

The City Manager reported that the continued study with the Board of
Trustees of the Community Hospital and with the City's emergency depart-
ment has resulted in the recommendation that the City join with the
hospital and the medical association in supporting the expenses of full -time
round - the -clock emergency services at the Downey Community Hospital. Costs
of this are estimated at a maximum of $690 per month for the City's
one -third share. Hospital officials indicate they feel this deficiency will
reduce materially each month as these emergency facilities become better
known throughout the area. The other 2/3 would be paid equally by the
Downey Community Hospital and the staff doctors of the Downey Community
Hospitall' This would. amount to a maximum expenditure for the City of
$7,590 for the 11 :'months remaining in the current year. It is felt this
expenditure is justifiable for these emergency services and, it is therefore
recommended that the City Council authorize appropriation and transfer of
this amount of money from unappropriated revenues.
It was moved by Councilman Peavey to approve appropriation of a maximum
of $690 per month in accordance with the City Manager's report as the
City's one -third share in the expenses of operating an emergency facility
at the Downey Commurdty Hospital. The motion died for the lack of a. second.
Mr. William Kemper, Administrator of the Downey Community Hospital
reported that they have advertised for services of a physician at the rate
of $1,000 per month for the emergency facility of the Downey Community
Hospital, however, to date they have been unsuccessful.
Upon Councilman Giddings' inquiry regarding establishment of a pool of
doctors for this facility, Mr. Kemper reported there were only sufficient
volunteers for this service to handle 13 days out of the month, and this
would not be including night coverage.
Mayor Dunnum stated he is agreeable for the City of Downey to share to
the extent of 1/3 of any loss, not to exceed the sum of $750 per month.

passed by the following vote that the City of Downey enter into a. contract
with the Downey Community Hospital whereby the hospital will provide con-
tinuous emergency service on a 24 -hour basis for any individuals within the
confines of the City of Downey in need of emergency service; that the City
will pay to the hospital the sum not to exceed $750 per month, and only such
sums as are equal to 1/3 of this hospital deficit cost of maintaining such
an operation; that this agreement be reduced in writing and the Mayor be
authorized to execute the contract on behalf of the City.

The City Manager advised Mr. Kemper to please advise his doctors to
stand by for a week or so if they cannot find a. physician for this emergency
facility.
The City Manager reported that the Downey Land Development Company ha.s
been contacted relative to the acquisition of "right of way on the southern
part of their property between Ardis and Bellflower Boulevard. He also
reported that at the cost of $14,000.00, a traffic signal may be installed
on Bellflower. Upon Councilman Giddings' inquiry regarding a barricade at
the end of Ardis Avenue, the City Manager reported the plan is to try first
without the barricade to alleviate this traffic problem.
Mayor Dunnum stated that Council are all painfully aware of the
intolerable situation which exists in this area and that all other means
have been tried to combat the problem, all of which have proven unsuccessful.

The City Manager reported that a $500 estimate has been submitted for
the cost of 175 standards throughout the central business district for
display of fla.gs to be furnished by the Downey American Legion. Funds are
available in the budget for this expenditure. The Legion representatives,
according to Mr. King, hope that the City will install these brackets.
It was suggested by Councilman Peavey that the wise move on the part
of the City would be for them to keep the flags and install them. The
City Manager reported the brackets would be located particularly on
dedicated City streets.
It was moved by Councilman Peavey, seconded by Councilman Temple and
passed by the following vote that approval be granted for the City to
appropriate $400 for installation of brackets on light standards for the
purpose of displaying flags in the central business district on special
occasions.
