MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
JUNE 27TH, 1961
The City Council of the City of Downey held a regular meeting
in the Council Chamber of the Downey City Hall at 8:00 A.M., June 27,
1961, Mayor Carroll M. Dunnum presiding.

The Reverend John T. Chase, First Christian Church, delivered the
invocation.
Mayor Dunnum announced that this is the time and place set for the
public hearing on Planning Resolution No. 51, and asked the City Clerk if
there were any written communications relative to this matter. The City
Clerk replied there were none. The Mayor asked if there were any oral
communications. There were none.
Sherman Griselle, Director of Planning, gave a resume of the matter
which is Zone Case #66.
It was moved by Councilman Corbin, seconded by Councilman Temple and
so ordered that the hearing on Planning Resolution No. 51 (Zone Case #66)
be closed.
It was moved by Councilman Temple, seconded by Councilman Corbin
and so ordered that the minutes of the adjourned meeting of Junel7, 1961,
be approved as written.
It was moved by Councilman Corbin, seconded by Councilman Temple and
so ordered that the minutes of the regular meeting of June 12, 1961, be
approved as written.
The City Clerk read the following written communications:
(1) A letter from the Chamber of Commerce relative to their previous
petition signed by almost 300 signatures in support of the establishment
of a heliport in the City of Downey and requesting Council to further con-
sider proceeding at the proposed site at the earliest opportunity.
(2) A letter from the Downey Board of Realtors accompanied by a
resolution recommending establishment of a heliport at the proposed site
on Bellflower Boulevard.
(3) A letter from the Alameda School District recommending that a
flight pattern for helicopters have an approach from the southeast along
the railroad tracks at an 800 angle turning back to the heliport, and
stating that the School District would not be opposed to the proposed site
if the flight pattern would not go over any school property, with the
recommendation that this condition be included in a lease with L. A. Airways.

Mayor Dunnum stated that as the proposed heliport site is in his
district he has made a very careful survey of the matter and feels
that the heliport will be a facility and service which all cities will
eventually want in their cities. He stated he has found no other suit-
able location; that he does not consider the noise factor unfavorable
in light of the noise presently existing from trains, trucks, etc.;
that he does not believe the helicopters would present a hazard any more
serious than the traffic which the school children are confronted with
each day; that property evaluation, if certain precautions are taken,
will not be affected by a depreciation in value; and that the overall
detriment which a few people will sustain is offset by the overwhelming
benefit to the community in having this facility.
It was moved by Councilman Dunnum, seconded by Councilman Corbin
and passed by the following vote that the City of Downey enter into a
lease with the Los Angeles Airways at the proposed site on the terms
and conditions set forth in the lease heretofore presented to the Council,
with the following conditions and corrections amending:
1. That L. A. Airways will adhere to flight patterns, safe alti-
tudes and distances from the adjacent school as approved by
the Federal Aviation Administration in the interest of public
safety.
2. That the City complete a maximum height brick fence around the
City Maintenance Yard so that any sound that would be eminating
in the direction of these homes would be directed upward (the
Mayor was told this is a fact by an expert);
authorizing the Mayor to sign a lease with these two conditions included.

The City Manager reported that he had also made a thorough investiga-
tion, together with the Director of Public Works, and no locations more
suitable than the one proposed were available. L. A. Airways have reported
that they are under F.A.A. regulations and operations and will have to
comply with all their safety rules and regulations. The approach height
is from 400 to 500 feet or upward in approaching a heliport site. The
average flight is 1500 feet above the ground.
The City Clerk continued reading the following correspondence:
(4) A letter from the California Fire Chiefs' Association commending
Chief Gain for printing numerous copies of the proposed Uniform Fire
Prevention Code which were distributed during the annual conference in
Monterey.
(5) A letter from Standard Oil Company regarding a geophysical
reconnaissance in the City of Downey. Mr. Edwin Welge, representative of
Standard Oil Company, answered questions of the Council and assured them
they will be fully responsible and have extensive liability coverage for
this type operation, and that no drilling will be done without the consent
of the property owners.
It was moved by Councilman Temple, seconded by Councilman Corbin and
passed by the following vote that permission be granted for Standard Oil
Company of California to conduct a geophysical survey within the City
limits of Downey.

(6) A letter from Norma V. Bleamaster objecting to the weed
abatement program. Ordered accepted and filed.
(7) A letter sent to All American Markets regarding settlement
for the metal awning adjoining their building at 9613 Imperial Highway
which the City used for one year. Ordered accepted and filed.
(8) A letter from Assemblyman Carley V. Porter outlining the
action taken on AB -2728. Ordered accepted and filed.
(9) A letter of appeal to Zone Exception No. 231 from C. A. Peterson
who had made the required $50.00 deposit.
The City Manager recommended that a special meeting be set for hearing
this appeal as well as appeal to Zone Exception No. 227, along with hearings
on Planning Resolutions No. 54 (Zone Case #68) and No. 55 (Zone Case #70),
suggesting the date July 17, 1961, at 7:30 P.M.
The Mayor so ordered that the July 10 regular meeting be adjourned
to July 17, 1961, for hearings on:
1. Appeal to Zone Exception No. 231
2. Appeal to Zone Exception No. 227
3. Planning Resolution No. 54 (Zone Case #68)
4. Planning Resolution No. 55 (Zone Case #70)
to be set at 7:30 P.M. in the Council Chamber of the Downey City Hall.
The City Clerk continued with the written correspondence:
(10) A letter from Merta Spiegle extending her gratitude for City
Council's recognition of her as the new president of Downey Coordinating
Council at its June 12 meeting.
(11) Notices from the County Boundary Commission for proposed
incorporation of La Colima, Annexation #137 to the City of Compton and
#2 to the City of Paramount.
*(12) Four post cards requesting continuance of the Municipal Bus
System. Ordered accepted and filed.
Councilman Temple inquired if citizens using the municipal buses would
be notifed. Mr. King reported this is being done, as well as notification
of the bus drivers who have other positions.

RESOLUTION NO. 819
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING BUDGET FOR EXPENDITURE OF FUNDS ALLOCATED FROM
THE STATE HIGHWAY FUND TO CITIES
The resolution was read by title only. The following projects
included within this program were outlined by the City Manager:
Major City Street and Secondary Street Maintenance $96,032.00
Paramount Blvd. from SPRR to Stewart & Gray Rd. 15,300.00
Brookshire Ave. from Firestone Blvd. to Manatee 65,000.00
Unforeseen projects 15,000.00
$191,332.00
The budgetted amount deducted from allocated Gas Tax Funds leaves a
total of $195,000 available for new projects this next fiscal year.
Mr. King requested addition of $33,000 to the project for Brookshire from
Firestone to Manatee, over and above the 5/8 and 3/16 gas tax money. This
amount had already been allocated by Supervisor Bonelli from Highway Thru
Cities Fund toward a project for which it is not now needed and could well
be used for this Brookshire project.

Dr. E. W. Durfey was presented five scrolls for each member of his board.
Both Drs. Coss and Durfey expressed their thanks and appreciation
of the special recognition.

The Director of Public Works recommended an extension of time be
granted the contractor for Cash Contract No. 50-- Gallatin Road, due to
extra work requested by property owners in excess of the present contract.
In spite of the delay, completion of the project is expected within the
first week in July.

passed by the following vote to grant an extension of time of 7 working
days to the contractor for Cash Contract No. 50-- Gallatin Road.

The City Manager reported the City has been receiving excellent
service from L & S Service in dispensing of gasoline into City vehicles.
They have agreed to maintain the same charge of .0365fi. per gallon for
this service the coming fiscal year. This charge includes not only the
storage and dispensing of gasoline but also the checking of tires,
batteries and water and the cleaning of windshields.
It was moved by Councilman Temple, seconded by Councilman Corbin and
passed by the following vote to award the contract for dispensing and
storage of gasoline and services to L & S Service for the fiscal year
1961 -62 at a price of .0365 cents per gallon.

The Director of Finance reported that bids had been called for
group health insurance. Among 17 bids, the Nash Agency was the lowest
bidder but due to a typographical error in their bid, Mr. Kendall
recommended rejection of all bids and negotiating with the Nash Agency
for Blue Cross Group Insurance.
It was moved by Councilman Corbin, seconded by Councilman Temple
and passed by the following vote that all bids for group health insur-
ance be rejected and the City negotiate with the Nash Agency for Blue
Cross Group Insurance.

Mayor Dunnum requested that in conjunction with the City Manager's
Report, Item #4, listing promotional and cultural groups which the City
has supported in the past, the Downey Choralaires (Downey Mixed Chorus)
be added to the list with an amount of $50.00 per month appropriated to
support their expenses. It was also noted that the Downey Art Museum
had been omitted from the list and the Director of Finance was sent to
check the amount appropriated to them last year.
It was moved by Councilman Temple, seconded by Councilman Corbin
and held in abeyance until the amount to be appropriated for the Art
Museum could be checked out, that appropriations for promotional and
cultural groups within the City be allowed as recommended in Item #4
of the City Manager's Report.
Upon the recommendation of the Chief of Police and the Purchasing
Division, it was recommended that the City maintain its present franchise
with the towing agencies of Ray's Automotive and Doug's Tug, extending
these franchises through the next fiscal year with the following
changes: (1) Inside storage rates on vehicles requiring special
handling to be raised to $1.50 per day. (2) The Vehicle Code numbers
be changed to concur with the new Code Codification.
The Chief of Police reported this service is jurisdiction only for

Mayor Dunnum stated he is prepared at this time to authorize
the hiring of a Principal Planner and accept the City Manager's
recommendations at this time.

Planner on Pay Key #20 ($566 per month), and that an estimate study
begin on the Master Plan with the assistance of Mr. Gordon Whitnall at

Mr. Rob N. Nimmo, 9150 E. Florence asked if the time element would
mean that there would be interim meetings and if the time table contem-
plated a finished master plan, complete and ready to adoptand operate
under. The City Manager answered in the affirmative, that meetings will
be held with the public and that every endeavor will be made to complete
it within this time.
Mr. Kendall reported that the previous amount appropriated to the
Downey Art Museum by the City to its support was the sum of $1200.
Thereupon, Mayor Dunnum asked for the vote on the motion which he re-
stated that Council approve the items specified in the City Manager's
Report in Item #4 for contractual agreements with a number of promotional
and cultural groups within the City on the conditions specified heretofore
on previous contracts, authorizing the Mayor to sign these agreements on
behalf of the City.

Councilman Temple suggested requesting a quarterly report from the
Downey Art Museum.
The Director of Finance reported that the contractual agreement
between the City and the Parks and Recreation District is continually
reviewed to see, if during the year, it is not adquately paying for the
services by this District. Last year the amount in the contract was set
at $3800. This coming fiscal year the contract amount is set at $5,000.
After considerable discussion as to whether or not the City should
expend any of its funds on behalf of the City for development and
pursuance of a recreational program within the City, and the Mayor's
inquiry as to whether or not the City should give the Park and Recreation
District $5,000 when the voters want the City to stay out of Parks and
Recreation District, the City Attorney, City Manager and Director of
Finance were asked to check into the matter further.

Councilman Corbin inquired of the possibility of paving a parcel
directly across from Gallatin School on Gallatin Road, as the owners
did not wish to dedicate their property for these improvements.
Mr. Barhite was directed to make a study of this matter and report the
cost for the City to put in curbs and gutters at this location.
Councilman Temple suggested a budget item for paveouts. Mr. Barhite
reported that this is being done and that the City spends $30 to $50,000
each year with $50,000 in the budget for 1961 -62. Mr. Barhite indicated
if the City contributes engineering and incidental costs, it would
encourage complete improvements rather than "spotty" ones.
Mayor Dunnum asked that either the Fire Department or the Forestry
Department water poppy seed plantings by Girl Scouts at Lakewood Boulevard
at the appropriate time.
The City Attorney came back with the statement to Council that the
total cost of performing services on the part of the City to the Parks and
Recreation District was estimated at approximately $10,000 per year. The
City could make a finding that the services performed by the City adminis-
trative staff for the Park and Recreation District are of benefit to the
citizens of Downey in that it provides a better recreation program and a
more efficient recreation operation, and this is in lieu of direct expense
by the City for providing certain recreation facilities for its citizens.
It was moved by Councilman Corbin, seconded by Councilman Temple and
so ordered that this matter be continued to the next Council Meeting.
The City Attorney was excused from the meeting at 9:50 A.M.
Arthur Hansen, 9023 Farm, requested some blacktop work on Baysinger,
Irwingrove, Bigbee, Farm and Gotham Streets due to flood damage over the
years in this tract.
Mayor Dunnum instructed an investigation be made by the Director of
Public Works and report his findings to Council.
Mr. Hansen added that there is heavy traffic on Vultee, including some
truck traffic. The Police department was asked to report the use of Vultee
as a truck route. The Chief of Police stated this is not a through truck
route.
The City Manager reported a note from the Purchasing Agent advised that
the City Clerk had rented the apartment at 84162 Second Street, owned by
the City, unfurnished. It was therefore requested that the furniture
removed from this apartment be declared surplus and approval given to put
it up for auction on July 8, 1961, in conjunction with the Police Department
auction.
It was moved by Councilman Temple, seconded by Councilman Corbin and
so ordered that furniture from the apartment owned by the City at 84162
Second Street be declared surplus and approve putting it up for auction
on July 8, 1961, in conjunction with the Police Department auction.
Chief Gain requested authorization for the City's affiliation with the
Municipal Fire Defense Institute which would cost $1.00 for each fire depart-
ment member at a total sum of $68.00 per year.

authorize the City's affiliation with the Municipal Fire Defense Institute
