Dunnum presiding. PRESENT: Councilmen: Giddings, Temple, Corbin, Dunnum ABSENT: Councilman: Peavey ALSO PRESENT: Oren L. King, City Manager Royal M. Emory Ackerman of Christ Lutheran Church delivered the invocation. Mayor Dunnum stated he had been asked that a resolution relative to Youth Employment be presented to Council and proceeded to read the resolu- tion in full. RESOLUTION NO. 795A A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ENDORSING DOWNEY YOUTH EMPLOYMENT SERVICE After being read in full, by Councilman Giddings and pas No. 795A be adopted. AYES: 4 Councilmen: NOES: 0 Councilmen: ABSENT: 1 Councilman: it was moved by Councilman Temple, seconded sed by the following vote that Resolution Giddings, Temple, Corbin, Dunnum None Peavey The Mayor announced that this is the time and place set for the pubic hearing relative to the Downey Parking District, and asked the City Clerk if she had received the Affidavits of Publication, lbsting and Mailing. The City Clerk replied she had. It was moved by Councilman Giddings, seconded by Councilman Temple and so ordered that the Affidavits of Publication, Posting and Mailing be received and filed. The Mayor inquired if any written protests or objections to the Downey Parking District had been received. The City Clerk replied there had not. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote that there is a finding that there has not been a written protest filed by the owners of more than one -half (1/2) of the area of the property included within the district and subject to assessment. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND CONVENIENCE REQUIRES ORDERING THE ACQUISITION AND IM- PROVEMENT FOR VEHICLE PARKING DISTRICT NO. 1 OF SAID CITY AND ESTABLISHING THE BOUNDARIES OF SAID DISTRICT The ordinance was read by title only. AYES: 4 Councilmen: Giddings, Temple, Corbin, Dunnum NOES: 0 Councilmen: None ABSENT: 1 Councilman: Peavey The City Manager presented a proposal of Tishman Research Corporation regarding possible double decking parking facilities in the proposed Downey Parking District. Mayor Dunnum recommended that the report be re- ceived and filed for further study, with copies of the material contained in the report being made available to all members of the Council. The Mayor stated that now is the time and place set for the hearing on the confirmation of assessments on the Downey Lighting District, A.D. No. 50, and inquired if any written protests had been received. The City Clerk replied there had not. The Mayor then asked if anyone in the audience desired to make any comment or protest. There were none. Mr. Barhite gave a brief summary relative to the Downey Lighting District. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote that the hearing on the Downey Lighting District be closed. AYES: 4 Councilmen: Giddings, Temple, Corbin, Dunnum NOES: 0 Councilmen: None ABSENT:1 Councilman: Peavey Council Minutes 5/8/61 -2- 1110 RESOLUTION NO. 796 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CONFIRMING THE ASSESSMENT FOR THE IMPROVEMENT OF DOWNEY AVENUE The resolution was read by title only. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that further read- ing be waived. It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote that Resolution No. 796 be adopted. AYES: 4 Councilmen: Giddings, Temple, Corbin, Dunnum NOES: 0 Councilmen: None ABSENT: 1 Councilman: Peavey It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the minutes of the meeting of April 25, 1961, be approved as corrected. The City Clerk presented the following correspondence: 1) A letter from the State of California Division of Highways giving a report on the progress of Firestone Boulevard improvement. 2) Letters from Mrs. H. K. Walsh, Mr. Howard Hess and Jack and Esther Kellums requesting sanitation contracts in their areas with Lemons Disposal be continued. This matter was tabled until a full Council can discuss the disposal problem. 3) A letter from the Downey Chamber of Commerce requesting that a new Chamber building be located in the Civic Center and that the City lease an area of land, 45 feet by 50 feet, in the Civic Center to the Chamber of Commerce for a term of twenty -five years at a fee of $1.00 per year. The City Manager observed that it would be very desirable for the Chamber of Commerce to be situated in the Civic Center and recommended taking this matter under submission. City Manager Oren King also stated that represent- atives of Welton and Becket will present their "Program of Action" for the downtown area May 15, 1961, in the Council Chambers. Members of the City Council, Chamber of Commerce, Planning Commissioners, Civic Center Committee, the Downtown Steering Committee, the Press and all interested citizens are urged to attend. 4) A notice from the Public Utilities Commission that an application for increased rates by Park Water Company had been denied. The notice was ordered accepted and filed by the Mayor. 5) A notice of proposed Annexation No. 2 to the City of Paramount from the County Boundary Commission. 6) An announcement of the League Meeting May 18, 1961, at the Elks Club, 4101 E. Willow Street, Long Beach, at 7:00 P.M. Mayor Dunnum advised all Councilmen who plan to attend this meeting to so advise the City Clerk. _ 7) A letter from Burke, Williams & Sorensen relative to the case of Downey vs. Downey County Water District presenting a bill of $6300.00 for preparation of documents for applying for leave to sue, plus time spent in court. The letter also advised the Attorney General's office has authorized the filing of an appeal and this has been prepared and sent out on Ma6 5.' Council Minutes 5/8/61 -3- 1121 It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote to appropriate $6300.00 which is to be transferred from the operating reserves to the City Attorney's Fund. AYES: 4 Councilmen: Giddings, Temple, Corbin, Dunnum NOES: 0 Councilmen: None ABSENT: 1 Councilman: Peavey 8) A petition signed by 17 property owners on Lakewood Boulevard requesting that the Planning Commission make a study of the zoning on Lakewood at the same time the study is made of Florence Avenue and Imperial Highway. The City Clerk advised that a similar letter had been forwarded to each Councilman. The Mayor recommended referring this matter to the Planning Commission and also requested the opinion on the matter of the Planning Director. Mr. Griselle advised that he agrees Lakewood Boulevard warrants a study but his department is not prepared to do so at this time. The Mayor concluded that any determination which would be made by the Council would be an invasion of the provinces of the Planning Commission and with the consent of Council, he referred the matter to the Planning Commission. 9) A petition bearing 43 signatures objecting to the establishing of a heliport on Bellflower Boulevard. Mayor Dunnum advised that in order that the matter might be considered by a full Council, it will be deferred until the arrival of Councilman Peavey. 10) A letter from the Downey Symphonic Society requesting the contin- uation of the same appropriation in the proposed preliminary budget for the coming year as had been appropriated in the year 1960761, of $1800.00 per year. It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote to grant the request of the Downey Symphonic Society for an appropriation of $1800.00 for the year 1961 -62. AYES: 4 Councilmen: Giddings, Temple, Corbin, Dunnum ROES: 0 Councilmen: None ABSENT: 1 Councilman: Peavey 11) A letter from the State of California Governor's Office addressed to Mr. Merritt Yancey, Chairman of the Library Advisory Board, inviting him and the Librarian to attend the Public Library Conference in Sacramento to be held June 12 and 13. It was moved by Councilman Temple, seconded by Councilman Giddings and passed by the following vote that approval be granted with reasonable expenses allowed for attendance of one Library Board Member and the Librarian to attend the Governor's Conference for Public Library Trustees and Officials to be held in Sacramento on June 12 and 13. AYES: 4 Councilmen: Giddings, Temple, Corbin, Dunnum NOES: 0 Councileen: None ABSENT: 1 Councilman: Peavey The City Attorney advised he had received a letter from the County Health Department from the health officer of the County of Los Angeles acting as health officer of the City of Downey relative to sanitary sewers for A.D. No. 54, Fontana Street. It was the health officer's recommendation that they be installed in order to facilitate the proceddings. Council Minutes 5/8/61 -4- 1112 It was moved by Councilman Giddings, seconded by Councilman Temple and so ordered that the letter from the Office of County Health Depart- ment be spread in the minutes of the meeting, as follows: "SUBJECT: Sanitary Sewer Assessment District No. 54 Fontana Street, City of Downey. "RECOMMENDATION: It is respectfully recommended that sanitary sewers be installed in this district. "ANALYSIS: This Department has made an investigation of the Fontana Street Sanitary Sewer Assessment District No. 54, City of Downey, as shown on the attached map. During the course of this in- vestigation, 8 house -to -house calls were made. Of this number, 3 occupants were not at home or did not answer the door. Of the 5 property owners or tenants actually contacted, 4 or 80% reported that they had experienced trouble with their individual subsurface sewage disposal systems. They complained that the systems filled up, causing raw sewage to back up into the house plumbing fixtures or to overflow onto the surface of the ground. Also that frequent pumping and cleaning out of the systems was necessary. One contact reported that they pumped their seepage pit every six months. Another reported that they had pumped their sewage disposal system four times in the last year. "The soil within the area of this proposed sani- tary sewer district consists mostly of a fine silty sand. This type of soil is not too conducive to the proper functioning of any type of individual subsurface sewage disposal system, as it has poor leaching qualities. Also, the majority of these sewage disposal systems have been in use over a period of several years and the effective sidewall leaching areas of the seepage pits are now becom- ing sealed with a natural accumulation of sludge and slime growths. "In view of our survey, I, the undersigned Health Officer of the County of Los Angeles, having been officially desig- nated by the City Council of the City of Downey to perform public health services for the City of Downey, do hereby recommend that proceedings be instituted at once for the installation of sanitary sewers in the Fontana Street Sanitary Sewer Assessment District No. 54, City of Downey. This recommendation is made as an improvement necessary to the protection of public health and pursuant to the provisions of Section 2808 of the Streets and Highways Code." Chief Deputy Health Officer The City Attorney advised he also was in receipt of a letter from Mr. George Bullock voicing objections to proposed MTA Act amendments and requesting the City of Downey to support in substance their position in the City of Compton. The matter was taken under submission for a further — study and report from the City Attorney and City Manager. Councilman Peavey arrived at the meeting at 8:15 P.M. Council Minutes 5/8/61 -5- 1113 A letter from the League of California Cities was reviewed by the City Attorney relative to SB 1031, Municipal Liability Bill (renewal of doctrine of governmental immunity). After voicing his opinion of the bill, Mayor Dunnum recommended it be opposed. Relative to the bill on utility tax exemption for railroads to be �- excluded, the City Manager advised that the City Council had already gone on record as opposing this bill. The action was reaffirmed. Councilman Temple read a letter from Mr. H. L. Dougan requesting the reopening of Zone Case No. 40 for reconsideration. (Stewart and Gray Road) It was recommended a hearing be set for the next night Council Meeting, June 12, 1961, at 7:30 P.M. in the Council Chamber of the City Hall, to be advertised as a second and further hearing. Councilman Peavey was briefed by Mayor Dunnum on correspondence read during his absence regarding the matter of establishing a heliport in the City of Downey. City Manager Oren King gave a summary of this matter stating that Downey would be the only City in this area which is certificated for the establishment of a heliport and would be the central distributing area for mail and cargo in this district, and being established on Bellflower Boulevard adjacent to the new City Yards and on the same site as the city forestry department, it will be made as attractive as possible. Mayor Dunnum inquired about the possibility of having a test demonstration to determine noise factor. Councilman Giddings recommended that the L. A. Airways representatives present all the facts to the people to be affected and that the City Manager be directed to request the L. A. Airways to meet with interested citipens and request a helicopter be brought in for demonstration. Councilman Peavey recommended the matter be taken under submission and that all persons interested in being notified when further action might be taken should leave their names and addresses with the City Clerk. At 8:45 P.M. Mayor Dunnum requested a short intermission for the purpose of turning on the lights in the area adjacent to the City Hall and Council Chamber on Brookshire and Third Street. The meeting reconvened at 8:55 P.M. Mayor Dunnum requested that the letter from the Downey Chamber of Commerce be read again by the City Clerk for the benefit of Councilman Peavey, who recommended that every effort possible be made to locate the Chamber of Commerce building in the Civic Center. It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote to approve location of the Chamber of Commerce in the Civic Center area, with site and terms to be determined at a later date after a more thorough study can be made. AYES: 5 Councilmen: Giddings, Temple, Corbin, Peavey, Dunnum NOES: 0 Councilmen: None �., ABSENT: 0 Councilmen: None Mayor opened the discussion on sanitation contracts at this time and disqualified himself, as previously, stating that as an attorney he has represented some of the individuals interested in the sanitation contracts in matters not involving the City, but in light of the attorney - client relationship which has existed in the past, he would not participate in the hearing and requested that Mayor Pro Tempore Scott Temple preside. Council Minutes 5 /8/61 -6- 1114 Mayor Pro Tempore asked for comments from the Council. Councilman Giddings stated he would like to see a,change which would permit apartment house owners paying City license fees to contract for their own refuse service. Councilman Peavey stated he desired readvertising and eliminating apartment house owners paying a business license to do business with any licensed contractor. Councilman Corbin also desired elimation of apartment houses and suggested extension of the present contracts for the collection of garbage and refuse in each of the three districts. Councilman Temple stated he would favor extending the existing contracts but objected to a 5 -year contract and feels it should be on a 90 -day cancellation basis. Speaking for continuation of the present refuse contractors was Mr. Howard Hess of 7555 Brunache, stating that he is very satisfied with the present services rendered and voiced the opinion of many people in the room. Speaking as an apartment house owner was Mr. Robert Reed, 10005 Pico Vista, Downey, who stated he would like to have the right to hire his own rubbish collector. Also, Larry Hoag, 9315 Bigley Avenue, who requested that all apartment house owners (over 7 apartments) be given an option on contracting with a private contractor. It was moved by Councilman Giddings, seconded by Councilman Corbin and passed by the following vote to rescind the motion formerly made to call for bids for sanitation service as set forth in the motion which was passed at the Council Meeting of April 25, 1961. The report was ordered by the Mayor to be accepted and filed. It was moved by Councilman Temple, seconded by Councilman Giddings and passed by the following vote to approve Councilman Peavey's leave of absence to take a 70 -day trip around the world, Peavey not voting. A. Airways for a heliport. It was reported by City Manager that the continued field analysis in determining the appraisal and suggested purchase price for the Park Water Company entailed an additional expenditure of $90.00 and it was recommended that Council authorize this transfer from Capital Improvements Fund to General Government Account No. 2200 -165. It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote to approve the following transfer of funds: $90.00 from Account No. 2000 -699 to Account No. 2200 -165 AYES: 5 Councilmen: Giddings, Temple, Corbin, Peavey, Dunnum NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None In keeping abreast with legislation relative to the cities, City Manager summarized AB- 2495, Limitation on Annexation of Territory to CitiPQ It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote to authorize opposition to AB -2495 with notifica- tion to the proper legislative authorities. The recommendation would be that City Council authorize an item in the proposed preliminary budget for 1961 -62 in the amount of $9,386.00, to be Downey's 50 -50 share of the administrative and personnel expenses. With regard to information relative to fallout shelters for the con- tinuance of municipal operations in case of disaster, the matter was held under submission for a report back to Council after more information is obtained. (See City Manager's Report of May 8, 1961.) Director of Finance Glenn Kendall requested authority to withhold Warrant #2633 in order for the City Attorney to investigate a lien filed against the payee by the Downey County Water District. It was moved by Councilman Temple, seconded by Councilman Giddings and so ordered to grant authority to withhold Warrant #2633. The Director of Finance reviewed the matter of the City's liability insurance which was awarded to Pacific Indemnity on a three -year basis �. a year ago with option to renew. At this time there appears to be an indication for a slight decrease. It was recommended that Council again continue the agreement for the next year. Bert DuMars, Chairman of the Personnel Advisory Board presented the board's report which contained four basic recommendations: 1. A 2.5% salary increase across the board, excluding Department Heads. 2. Adjustments for 13 bench mark employees and 2 additional specific employee adjustments. 3. Setting up of a 2.5% cost of living increase as a guide for future years. 4. Educational aid program for City employees. Council (Minutes 5/8/61 -11- 1119 Miles Sprague, President of the Downey Employees Association, asked for clarification of certain phases of the Personnel Advisory Board's report. After discussion it was recommended by the City Manager that Council approve the Personnel Advisory Board's recommendation excluding department heads at this time. It was moved by Councilman Peavey, seconded by Councilman Dunnum and passed by the following vote to approve the recommendation of the Personnel Board for a 2.5% salary increase across the board, excluding department heads. After considerable discussion relative to need for an additional fire engine and additional firemen, it was agreed to leave the fire engine in the budget providing the additional personnel was reduced to six. It was moved by Councilman Temple, seconded by Councilman Peavey and passed by the following vote to leave the fire engine in the budget as presented but to reduce the personnel in the fire department to an additional six firemen instead of ten. The City Manager was directed by the Mayor to include this in the final draft pf the budget to be submitted for approval to Council. It was recommended by Councilman Peavey that the PBX be removed from the City Clerk's office and placed somewhere in the hall as an information booth to handle information to the public. Mayor Dunnum stated that his thinkingon this subject coincides with that of Councilman Peavey. Councilman Peavey suggested that when the City Hall is remodeled a fireproof vault for safekeeping of official City records be given consideration.
