MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
HELD ON APRIL 25, 1961
The City Council of the City of Downey held a regular meeting in the
Council Chamber of the Downey City Hall at 8:00 A.M., April 25, 1961,
Mayor Carroll M. Dunnum presiding.

Reverend John Ashcraft of Trinity Baptist Church presented the invocation.
The Mayor announced that now is the time and place for the public hearing
on the vacation of Quoit Street, and inquired if anyone in the audience
wished to speak on the matter. There were no comments from the audience nor
from Council.

RESOLUTION NO. 788
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE VACATION OF A PORTION OF QUOIT STREET
WITHIN TRACT NO. 12760
The resolution was read by title only. It was moved by Councilman
Temple, seconded by Councilman Corbin and so ordered that further reading be

It was moved by Councilman Temple, seconded by Councilman Giddings and
so ordered that the minutes of the meeting of April 10, 1961, be approved

The City Clerk presented the following correspondence:
A letter from Henry A. Dixon who operates Acme Cleaners at 8127 E.
Firestone Boulevard requesting that when the appraisal is made for the
acquisition of this property for the proposed parking district, the cost
of moving his equipment be included. The letter was referred to the City
Manager and City Attorney.

A letter from the Downey Union High School District Board of Trustees
submitting a resolution from their Board requesting extension of Cedartree
Road in the Edith Unsworth Scholl area and a letter accompanied by a
petition bearing 700 signatures from the Gallatin City School District
Board in support of this resolution. The matter was referred to the City
Manager and the Director of Public Works with the suggestion that they
meet with the school people relative to making this a joint project.
A letter of appeal to Zone Change Case #64 from H. E. Black, 8052
Alameda St. Mr. Black, upon recognition, presented his reasons for request-
ing a zone change. He requested Council to review the action of the
Planning Commission denying the request for this zone change and asked
that reconsideration of the request be granted.
The City Attorney advised that the City Council could not have a hear-
ing under the present zoning ordinance and that it would be more proper for
Council to initiate a zone change and refer it back to the Planning Commission
for hearing, or that Mr. Black could refile with Planning Commission under
the present ordinance but after the new ordinance goes into effect 30 days
from the date it is adopted, he will have to wait one year before refiling.
Mayor Dunnum recommended that Mr. Black get in touch with the City Attorney
and City Manager and work out a plan which would be most suitable to all
parties as the City Council is unable to entertain this matter by reason
of the ordinance as it now exists.

ordered that further study and report be made of this Zone Change #64 by the
City Attorney and City Manager.
A letter from Supervisor Bonelli acknowledging and congratulating
Downey on its Annual Report.
A letter from Clyde Doyle regarding the possibility of incorporating
the proposed changes in the new post office of including a combined fallout
shelter and civil defense headquarters.
An announcement of the Central Water Basin Meeting to be held at the
Elks Club in Huntington Park on May 4, 1961, at 6:30 P.M.
A letter from the County Boundary Commission advising of proposed annexa-
tion District No. 136 to the City of Compton.
Sanitation Committee Report. Councilman Corbin stated he objected to
the renewal of the contract for sanitation unless the apartment house owners
may contract with anyone they see fit. Since they are required to have a
license to operate, he feels it seems no more than fair to be set up in this
manner.
Mayor Dunnum asked to go on record that as an attorney who has represented
some of the individuals involved in this matter in matters not involving the
City of Downey, however, in light of attorney - client relationship which has
existed in the past, he feels he should disqualify himself from participation
in the hearing and requested Scott Temple, Mayor Pro - Tempore to conduct the
balance of the hearing on the sanitation contract renewal.
Mr. Larry Chaney, Chairman of the Sanitation Committee, was recognized
by the Mayor Pro Tem and presented his report of the meting held by the
committee which resulted in a 3 to 3 vote on the motion to renegotiate on a
5 -year contract.

It was moved by Councilman Peavey, seconded by Councilman Temple
and defeated by a tie vote to readvertise for bids specifying that the
new type equipment be used; that apartments of 7 units or more be
deleted thereby allowing them to contract their own disposal service,
the contract to be for 5 years.

Mayor Dunnum interrupted at this point of the lengthy discussion
on the sanitation matter to allow a group of Girl Scouts from the Tri-
Neighborhood of Downey to make their presentation of 12 yellow rose
bushes to the City in celebration of their Golden Anniversary in 1962.
Presenting the roses to the City were: Diana White, Marcia Ehinger,
Cathy Ray, Karla Funk and Mrs. William Ehinger.
Mayor Pro - Tempore Temple reopened the matter of the sanitation con-
tract and inquired whether the equipment would have righthand drive and if
the operators would observe all traffic and safety regulations.
Mr. Stanley Magargee of Rio Hondo Disposal Company stated all new trucks
would have righthand drive.
It was moved by Councilman Corbin that the contract be awarded the
present contractors for a 5 -year period to include new equipment and
exclude apartment houses. The motion died for the lack of a second.
When questioned regarding the possible cancellation of the contract
should a contractor fail to meet minimum or maximum requirements which
could be established, the City Attorney advised this could be done only if
the contractor has not met the contract and complied with minimum or
maximum requirements. Such a contract can be written to include termination
within 2, 3 or however many days might be stipulated.
It was moved by Councilman Giddings, seconded by Councilman Peavey and
passed by the following vote that the City Manager, City Attorney, Director
of Public Works shall present to Council for its approval a proposed agree-
ment on which there will be a call for bids, containing minimum standards,
with one bidder for each of the three districts which shall remain as
presently fixed; with a provision that for each apartment house for which a
business license is required, there shall be a maximum charge of 50¢ per
unit per month; also providing that upon reasons being shown, an increase or
decrease can be established in the cost; that pickup at the apartment house
area shall be once or twice a week, depending on need; contract to be for a
5 -year term with load packers to be provided by January 1, 1962.

Works.

PLACES IN THE CITY OF DOWNEY, TO BE MAINTAINED AND
ELECTRIC CURRENT TO BE FURNISHED FOR LIGHTING SAID
FIXTURES AND APPLIANCES FOR A PERIOD OF THREE YEARS
( DOWNEY CITY LIGHTING DISTRICT)

Said resolution set the hearing on proposed improvement for the hour of 7:30
PM on June 12, 1961, in the Council Chambers of the Downey City Hall.
Mayor Dunnum reported that certain subsidiaries of the Santa Fe Rail-
road Company are endeavoring to have the United States Congress enact
legislation which would return to them property known as Cheli Air Depot
which had been donated to the Government, but which the Department of
Defense now declares excess to its need, and the property is now in the
course of disposition by General Services Administration. The City of Downey
has been asked to support this move through adoption of a resolution.

Councilman Temple recommended supporting the return of the property.
RESOLUTION NO. 793

AIR FORCE DEPOT

Mr. R. E. O'Reilly, Vice - President of Chanslor Western Oil and
Development Company, residing at 7827 Danvers Street, Downey, was recognized
by Mayor Dunnum and presented his report on the request for the return of
the land known as Cheli Air Force Depot which is surplus to the Government.

After a summation of bids on Contract No. 50, Gallatin Road improvement,
it was recommended that the contract be awarded to the laaest and best
bidder, Aman Brothers, in the amount of $61,131.31, and that all ether bids
be rejected.

passed by the following vote to authorize awarding Contract No. 50, Gallatin
Road improvements, to the lowest and best bidder, Aman Brothers, in the
amount of $61,181.31, and reject all other bids.

It was reported by the Director of Public Works that the work has been
completed on Cash Contract No. 47, miscellaneous paveouts, and recommendation
was that Council accept these improvements and authorize filing a Notice of

It w as reported by the Director of Public Works that the work required
of Sully- Miller Contracting Company under Cash Contract No. 43 with the City
of Downey, being the application of slurry seal on streets throughout the
northerly portions of the City, has now been satisfactorily completed. It
was recommended that the City Council accept this improvement and authorize
filing a Notice of Completion.

The City Manager reported that plans and specifications are completed
and a contract has been awarded by the Baptist Church to proceed with
reconstruction of the intersection at Third and Dolan Streets to the normal
right angle turn.
It was reported by the City Manager that a review is being made of
all businesses which are operating out of zone (primarily those in the
residential areas), and at this time there have been listed approximately
78 businesses which are operating out of zone and which have been referred
to the Planning Commission for their interpretation as to those which are to
be eliminated under the new ordinance. As soon as they have specifically
identified those who are in non - conforming status, they will be notified and
given a proper time to move.
Gordon Prentiss, 7901 Seventh Street, Downey, read a letter addressed to
Council in further protest of T. V. licensing in homes, signed by 17 licensed
T. V. shop owners.
In the improvement of Paramount Boulevard southerly at Firestone it was
recommended that Council authorize extension of the present project to include
paving of Paramount southerly to Stewart and Gray on the easterly side. This
would include the narrow strip of paving to connect with the curbs and gutters
providing the property owners deed the property and install their curbs and
gutters. This would include the paving in connection with Plan Check No. 54038
and authorize deletion of the paving from the requirements by the Planning Com-
mission in connection therewith. The work would proceed under Gas Tax Monies.

A progress report was made by City Manager that Federal authorities have
authorized the design of our post office upon an estimated square foot basis
of approximately 28,000 square feet, and have also agreed that it would be
patterned after the architectural design of the City Library.
A report was also made that relative to the Firestone improvement project
an attempt will be made to expedite this project through contact with the
proper Division of Highway officials and a request for appropriate funds for
this work at the earliest possible date.
Mr. King reported that the City of Los Angeles Float chassis had been
acquired by the City for a total price of $254.80. It is believed purchase
of this float chassis will accomplish an estimated savings of approximately
$2,000.00 per year and that it will stimulate additional interest of local
citizens, high school students and others in the construction of the rose
float here in Downey. The float will be stored at the new city yards. Funds
are available for this purchase under "Community Promotion ".
It was found by the City Council that the float chassis was an item of
unique and special character and was the only one of its kind available and
was available only from the one source and it therefore was moved by
Councilman Temple, seconded by Councilman Giddings and passed by the following
vote that the action of the City Manager purchasing the float chassis be
approved and ratified.

It was recommended that our City Librarian attend the hearing on
Senate Bill 789 providing financial aid to libraries, restricting the aid
to those serving communities of 100,000 or more. The City Librarian will
be representing the cities in this area relative to opposing this bill with
expenses being shared by the various cities. Downey's estimated share will
not exceed $20.00.
It was moved by Councilman Peavey, seconded by Councilman Giddings and
passed by the following vote to authorize the attendance of the City Librarian
at the hearing on Senate Bill 789 with expenses not to exceed $20.00.

It was reported that the traffic problem on Ardis Street near North
American has been alleviated to some extent, however Mayor Dunnum reported
the congestion is still tremendous and suggested that efforts be accellerated
to relieve this traffic problem. The City Manager informed Council that a
further meeting with North American is to be arranged and a subsequent report
will be made to Council.
Councilman Temple reported there is to be an official air raid on Friday
which is a public, statewide alert to be covered by Mr. Charles Bates who is
the coordinator during the illness of Director Vineent Young.
Councilman Peavey reported on the meeting with the League of California
Cities in Sacramento to oppose various legislation, AB 267 in particular.
This particular bill has been deleted, however AB 2728 has been introduced in
its stead dealing with Multiple Districts. Councilman Peavey strongly urged
opposition to this bill.
It was moved by Councilman Peavey, seconded by Councilman Temple and
so ordered that a resolution be drawn to oppose AB 2728.

Mayor Dunnum stated he does not feel the priority list should be
abandoned or detoured from without a very serious study or reevaluation.
Council directed the Director of Public Works to report to the City
Council at his earliest convenience relative to priority list and all work
which has been done relative to this list as established some six months
ago. Also a report was requested of outstanding smaller jobs and how long
it would take to complete them.
The City Attorney advised Council that in the matter of the City cf
Downey vs. Downey County Water Company, if Council wishes to appeal, per-
mission must be obtained from the Attorney General's office. The cost of
this appeal would amount to approximately $2500.00 which is less than the
cost already incurred in this matter.
After discussion, it was moved by Councilman Giddings, seconded by
Councilman Peavey and passed by the following vote that the City Attorney
file an appeal in the trial court decision in the matter of the City of
Downey vs. Downey County Water Company.

The City Attorney reported that relative to the proposed MTA legislation
the Mayor should direct a letter to assemblymen stating the City Attorney
reported upon his meeting with Mr. Lloyd Bullock in this matter.
Mayor Dunnum suggested honoring senior citizens with certificates similar
to those being issued by MTA allowing a reduction in fares on the Downey
Municipal Bus Lines.
The City Manager was directed to work out a program along this line and
submit his report.
