MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
HELD ON APRIL 10, 1961
The City Council of the City of Downey held a regular meeting in
the Council Chambers of the Downey City Hall at 7:30 P.M., April 10,
1961, Mayor Carroll M. Dunnum presiding.

Reverend R. W. Moore of the First Methodist Church delivered the invotation.
It was moved by Councilman Giddings, seconded by Councilman Temple and so
ordered that the Minutes of the meeting of March 20 be approved as amended.
It was moved by Councilman Peavey, seconded by Councilman Corbin and so
ordered that the minutes of March 28 be approved as written.
The City Clerk presented the following written correspondence:
1) A letter from Grace Baptist Church expressing gratitude for blacktop
paving in front of church property.
2) A letter from the American Society for Public Administration in
recognition of entry to City Administrative Achievement Award.
3) A letter from Anthony & Langford, Architects offering their services
for a preliminary study of the size, type, cost and location of an Auditorium
and Community Service Building for Downey. Mayor Dunnum asked Mr. King, City
Manager, if he had a recommendation to make regarding this survey.
The City Manager recalled to Council the ground research made about 3
years ago relative to the first building in the Civic Center Development
which was the library and recommended that further initial study be made
as to the location, size, type and an estimated price of an Auditorium, the
cost of such survey not to exceed $400 or $500.
It was moved by Councilman Giddings, seconded by Councilman Temple and
passed by the following vote that the firm of Anthony and Langford be employed
to make a study and recommendation as to the type, size, cost and location
of a Civic Auditorium, cost of the survey not to exceed $500, such expenditure
to be transferred from the Caoital Improvement Find, Account No. 9- 2000 -165.

4) A letter from Mr. & Mrs. Clarence Schmalz relative to their desire
for sewer connection. The letter was referred to the City Manager and
Director of Public Works for a report at the next Council Meeting.

5) A petition in reference to Zone Case #45 involving the 9000
block on Iowa Street, appealing for an R -3 zone under the new Master
Zoning Plan.
A report was given to the Council by Sherman Griselle, Director of
Planning, relative to the zoning in this area.
It was moved by Councilman Dunnum, seconded by Councilman Temple
and passed by the following vote that by minute action only the Council
indicate its desire and intent to have this property become R -3 property
if, as and when the streets are brought up to those standards that are
required normally in other areas of Downey with R -3 zoning and the
Planning Director to contact the individuals who signed the petition and
advise them of this action which is all in accordance with the following
conditions as set forth below by the Planning Commission:
1. Dedication of widening on Margaret Street to provide a 60 -foot
right of way.
2. Margaret Street and Iowa Street to be improved to City Standards.
3. "A" Street, as shown on Exhibit "A ", to be improved to City
Standards.
4. Dedication of corner cutoff at Hall Road and Bellflower Boulevard
and improve these streets with sidewalks, curbs, and gutters.
5. Change of zone to R -3 not to take effect until the improvements
outlined above have been completed.

6) A letter from Royal M. Sorensen, City Attorney, summarizing AB 441.
The City Manager reminded Council this bill has already been opposed. The
letter was ordered accepted and filed.
7) A letter from the City Attorney relative to vacation of alley
behind 4th Place stating that the public hearing was held in accordance with
Section 8300 of the Street and Highway Code and inasmuch as there was a
majority protest to the vacation at that time, he does not believe any change
of the findings can be made in the absence of additional evidence.
Councilman Peavey recommended that the alley remain open. It was
ordered that the City Manager and the City Attorney advise Mr. Boshae as
a result of a study by the Legal Department, the previous action of the City
Council shall stand.
8) A letter from the Downey Junior Chamber of Commerce requesting
that the City of Downey lend its support to the Downey Wind Ensemble. The
matter was referred to the City Manager for his study and report.
9) A letter from the Finance Advisory Committee recommending the
purchase and use of an automatic check signer and letters from the City
Clerk- Treasurer and Director of Finance supporting the recommendation.
After a report from Mr. Kendall on the merits of the automatic check
signers, it was moved by Councilman Corbin, seconded by Councilman Giddings

10) An invitation from Santa Fe Springs to attend the open house
of their Fire Station No. 2, 9834 Dice Rd., on Friday, April 14, 1961,
from 10 a.m, to 9 p.m.
11) A letter from Dr. Arnold J. O'Toole, President of the Downey
Rose Float Association, with recommendations to the Council of resignations
and replacements.
It was moved by Councilman Temple, seconded by Councilman Peavey and
so ordered that the resignations from the Downey Rose Float Association be
accepted with regret and all appointments held in abeyance at this time.
Mayor Dunnum recognized James Bannister and asked if he wished to
add his comments at this time. Mr. Bannister requested that the Council
proclaim the week of May 1 as "Guadalajara Week" in conjunction with the
Festival planned for May 4 at the Silver Saddle Inn. He reported that 40
persons have signed for the trip to Guadalajara which businessmen and
interested citizens will make, presently projected for June 23.

so ordered that the week of May 1 -6 be proclaimed as "Guadalajara Week."
Mayor Dunnum reminded Council that the matter relative to contracts
on the present garbage and rubbish pickup had been taken under submission
for further study and inquired if they wished to take any action at this
time.

so ordered that the matter be referred back to the Sanitation Committee.

Councilman Giddings recommended that the City Manager be directed to
make a study on what the City is now spending on traffic signal maintenance,
modernization and channelization and what it would cost the City to do the
work itself, and to report the findings at the earliest convenience.

After a summation of the bids received for Cash Contract No. 57,
Bellflower Boulevard, Imperial Highway and Public Works Yard, it was rec-
ommended that the contract be awarded to the lowest and best bidder,
Sully- Miller, in the amount of $72,510.89, and that all other bids be
rejected.
It was moved by Councilman Peavey, seconded by Councilman Corbin
and passed by the following vote that the bid for Cash Contract No. 57,
Bellflower Boulevard, Imperial Highway, Public Works Yard be awarded to the
lowest and best bidder, Sully- Miller, in the amount of $72,510.89, and that
all other bids be rejected.

After a summation of bids for Cash Contract No. 62, resurfacing of
certain streets within the City of Downey, it was recommended that the bid
be awarded to the lowest and best bidder, A. J. Beinschroth, in the amount
of $16,040.00, and that all other bids be rejected.
It was moved by Councilman Temple, seconded by Councilman Giddings
and passed by the following vote that the bid for Cash Contract No. 62 for
_ the resurfacing of certain City Streets, be awarded to the lowest and best
bidder, A. J. Beinschroth, in the amount of $16,040.00, and that all other
bids be rejected.

Councilman Giddings inquired about the progress of Gallatin Road
improvements. Mr. Barhite, Director of Public Works, reported bids will
be opened on April 18 with work beginning probably on May 1.
It was requested by the Director of Public Works that the City
Council appropriate $2,328.70 from the Capital Improvements Fund (Account
No. 1- 2000 -699) for the payment of additional rights of way on Brookshire.
It was moved by Councilman Giddings, seconded by Councilman Temple
and passed by the following vote to approve appropriation of $2,328.70
from the Capital Improvements Fund, Account No. 1- 2000 -699, for payment
of additional rights of way under Gas Tax Project No. 2, Brookshire Avenue
- Florence Avenue to Cherokee Drive.

The Director of Public Works reported that the work required by
Relleum Construction Company in their agreement with the City of Downey for
Tract No. 24291 - Imperial Highway and Old River School Road, has been
satisfactorily completed. It was recommended that the City Council accept
these improvements and authorize the release of the bonds.

passed by the following vote to accept the improvements in Tract No. 24291,
Imperial Highway and Old River School Road, and authorize the release of
the improvement bonds.

Approval was requested of the City Council to authorize the circulating
of petitions for overhead street lighting on Pangborn Avenue between
Florence Avenue and Dacosta Street.
It was moved by Councilman Temple, seconded by Councilman Giddings and
passed by the following vote that approval be granted for circulation of
petitions for overhead street lighting on Pangborn Avenue.

It was further recommended by the City Manager that the matter be
referred back to the Transportation Committee and held in abeyance until it
can be determined what the bus system can do for the City.

Service Buses be rejected and authorize the refund of bid bonds to all bidders,
with the matter being referred back to the Transportation Committee for

The City Manager reported that the City's Progress Report is now
ready for circulation throughout the City. Councilman Peavey recommended
that a copy of this report be forwarded to all members of the City Council
of the City of Guadalajara.
The City Manager reported that relative to the request of the City
Council for a further report on the widening of Third Street at its
intersection with Paramount, the opening of this street as suggested by the
City Council would entail the acquisition of 302 feet x 30 feet on Third
Street and 10 feet x 145 feet on Paramount Boulevard which is appraised at
$14,500, plus severance damages estimated at $5,000 which may be. offset
through court procedure by estimated benefits to the property.
The City Manager was directed by Council to continue to negotiate for
• more economical way to widen Third Street and report back to Council at
• later date.
The City Manager was directed to proceed with negotiations for the
acquisition of 15 feet x 140.74 feet on Downey Avenue and 262 x 180 feet
on Cherokee with a total appraised value of $5,617 for the land. As the
total appraised value of land and improvements are set by the appraiser at
$7250 with special benefits estimated at $1500 which leaves a total amount
of $5750 for the acquisition of the land and the moving of the garage,
shrubs, etc., special benefits of $1500 might have to be applied in connection
with the removal of the garage, trees and shrubs.
The City Manager submitted information relative to estimated cost of
improving Downey Avenue north of Florence.

If dedication of the necessary right of way on a gratis basis is
successful, then it is suggested that an appropriation of $10,600 be made
from Gas Tax Funds to finance the project. Otherwise, if the Council
desires to proceed with the project, then an additional appropriation of
$7,000 for a total of $17,600 will be required from Gas Tax Funds from
the 1961 -62 Budget.
Council ordered negotiations be continued for right of way acquisition
on Downey Avenue.

Inclusion of previously authorized project of $5,000.00 for
sidewalks on Florence Avenue approaching East Junior High School
and $5,000.00 for sidewalks across the bridge approach on Florence
Avenue easterly of Fairford Boulevard was suggested with a project
total of approximately $16,000.00, as it is felt a lower unit price
per square foot may be accomplished in this manner. Bids may be
called for construction in July or August prior to school opening
next fall and can be included in the 1961 -62 budget.
It was moved by Councilman Peavey, seconded by Councilman
Giddings and passed by the following vote to approve the recommenda-
tion of the City Manager for sidewalks in the vicinity of schools
on Tweedy Lane and Foster Bridge Boulevard as outlined above.

It was moved by Councilman Temple, seconded by Councilman Dunnum
and so ordered that the Director of Public Works and Planning, the
Traffic Committee and the City Manager make a study forthwith of
needed sidewalks throughout the City.
It was suggested that a survey of needed sidewalks throughout the
City which the High School District had just completed might be obtained.
Mayor Dunnum directed that a letter be written to the Gallatin
School Board with a copy being sent to the Unified District, inquiring
when sidewalks will be installed at the Maude Price School.
Upon the recommendation of the City Manager, it was moved by
Councilman Giddings, seconded by Councilman Temple and passed by the
following vote that one -half hour schedule on the Woodruff Village route
between downtown Downey, Stonewood, down Bellflower to Foster and
Woodruff, be established with a one -hour headway on the other two southern
routes, one of which is the Rancho Los Amigos and the other known as the
South Downey Route terminating at Gardendale and Brookshire.

Relative to the acquisition of property adjacent to Central Fire
Station on Downey Avenue, the City Manager and Chief Robert Gain of the
Fire Department were directed to study and report back to Council.

and passed by the following vote that $150.00 be allocated for an
appraisal of the property adjacent to Central Fire Station.

and so ordered that Council support AB 1705 - Sales and Use Tax. Utili;ty
Use Tax Exemption,with customary action with respect to recommendations to
various representatives.

so ordered that Council oppose AB 391 - Tax Exemption - Household Goods and
Personal Effects, with the customary recommendation to the Senate.

so ordered that Council oppose AB 1638 and AB 990 - Decrease in City In-
Lieu Tax Receipts,with recommendations being sent to Sacramento.

passed by the following vote that approval be granted for any Councilman
who is able to do so to attend a meeting in Sacramento on Monday, April 17,
for discussion of AB 267 (creation of metropolitan area multi - purpose
districts) with reasonable expenses allowed.

Planning to attend the American Society of Planning Officials Conference in
Denver, Colorado from April 30 to May 4 with reasonable expenses approved.

The City Clerk read a letter from the City Clerk of South Gate
with an attachment letter from Mayor Milo Dellmann setting forth
various reasons why all city councilmen should attend both the U. S.
Conference of Mayors in Washington in June and the American Municipal
Association Conference in Seattle in August. At the same time a world
conference of local government is being held in Washington.
It was moved by Councilman Peavey, seconded by Councilman Corbin
and passed by the following vote that approval be granted for the
attendance of the Mayor and any members of the City Council who can
attend any of these conferences and that reasonable expenses be allowed.

Councilman Temple reported it has come to his attention that there
are numerous businesses operating from residences out of zone and that
these persons are being given licenses even if they are working out of
zones, particularly representing the T. V. business. He called on
Mr. Gordon Prentiss, 7901 Seventh Street, to present his views on the
matter. Mr. Prentiss objected to competition when it is run on an unequal
basis, and objected to licensing when persons out of zoning.
Also objecting to businesses being operated from residences was
Mr. William Beckley of Beckley and Rausch T.V.
It was suggested that a list of known violators be given to Mr. King
who will see that they are contacted forthwith and the necessary action
taken, with a report being forwarded to Prentiss and Beckley and Rausch.
Councilman Temple reported that at the Sister City Committee meet-
ing held recently, it was decided to take up an offer of U.S.C. to
furnish a choral group to sing, charging for the program, to help put on
the Art Festival in June. This group had just returned from Guadalajara
and is most anxious to assist the Sister City program.
It was moved by Councilman Temple, seconded by Councilman Giddings
and so ordered to recognize the project proposed by the choral group
from U.S.C. as being beneficial to the Sister City program.
Councilman Peavey complimented Mr. King, City Manager, for the fine
Progress Report.
Councilman Corbin reported on his attendance at the Contract Cities
Seminar in Palm Springs recently.
Mayor Dunnum thanked Councilman Corbin for his attendance at this
meeting as this type thing helps Council keep abreast.
Councilman Temple recommended the reappointment of his appointees
on all the Citizens Committees.
Councilman Peavey recommended reappointment of his committee members
with the exception of the Sister City and Rose Float Committees.
Councilman Corbin recommended reappointment of his committee members,
adding to the Sister City Committee Mrs. Paul Spradling.
Councilman Giddings recommended reappointment of his committee
members, adding Mrs. Eunice DuMars to the Rose Float Committee.
