HomeMy WebLinkAboutMinutes-03-13-61-Regular Meeting1060 MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY HELD ON MARCH 13, 1961 The City of Downey held a regular Council meeting in the Council Chambers in the Downey City Hall at 7:30 P.M., March 13, 1961, Mayor Carroll M. Dunnum presiding. PRESENT: 4 Councilmen: Temple, Corbin, Peavey, Dunnum ABSENT: Councilman: Giddings ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney Glenn Kendall, Director of Finance, Assistant City Manager Richard Barhite, Director of Public Works Sherman Griselle, Director of Planning Robert W. Gain, Fire Chief Ivan A. Robinson, Chief of Police Ray Lake, Director of Building and Safety Lee Leavitt, City Engineer Harold F. Durham, Traffic Engineer Della Doyle, City Clerk Virginia Miller, Acting Deputy City Clerk Reverend Curtis Puryear, Pastor of Immanuel Baptist Church of Downey delivered the invocation. Mayor Dunnum announced that this is the time set for hearing on Everest Street AD #25 investigation report which was continued from January 24, 1961, and the hearing of Intention on Everest Street AD #25. Mr. Barhite, Director of Public Works, gave a report to the Council on the possibility of eliminating Eucalyptus at the connection of Glenn and Eucalyptus; also the reduction of Everest Street right -of -way could be made from 40 feet to 36 feet, thereby cutting the cost of this assessment district. Mr. King reported that if it is agreeable with the property owners during the week of March 13, he would meet again with them and make a report in conjunction with the City Engineer and Director of Public Works to give them further informa- tion before the assessment district was killed. Mr. Earl J. Berry, 8536 Eucalyptus Street, Downey, spokesman for the Prog- ressive Property Owners Association, gave a report to the Council on Everest Street AD #25. He stated the property owners were of the opinion that if 57.2% of the majority of the parcels in the district signed a petition protesting this assessment district, the project would automatically be killed by such action. Also, they were protesting the overall cost as being too high; and secondly, it was financially impossible for the property owners to meet the assessments to be levied on this project. He asked the Council to proceed at this time with the request of the organization of the Progressive Property Owners Association to kill this project. Mayor Dunnum then said the Chair would entertain a motion to delete from this particular program the Avenues of Eucalyptus and Everest. City Attorney Sorensen was asked to give an opinion on whether the City at this time could proceed with Brookshire if Eucalyptus and Everest are withdrawn from the assessment district. The City Attorney reported the property owners may at any time prior to the conclusion of the hearings withdraw their protests. If there is a resolution opposing a change adopted and following that the protests are withdrawn; and assuming the change should delete all of the property in the assessment district, except Brookshire, the Council would have the authority to proceed with Brookshire or such portion of that district as remains. If protests are not withdrawn the City may not proceed with any portion of this, or any other portion for a period of one year. '# OWL Mr. Berry reported that the property owners had unaniously voted against the proposals as outlined by Mr. Barhite and were not going to withd8ay the protest petitions but again requested that the district be abandoned. Mayor Dunnum asked if there were any proponents on Assessment District #25. It was moved by Councilman Peavey, seconded by Councilman Corbin and so ordered that the hearing on the debt limit report be closed. It was moved by Councilman Dunnum, seconded by Councilman Temple, and so ordered that the hearing on the Intention on Assessment Districe #25 be closed. The findings of the City Council were that there was a 57.3% protest to the formation of District #25, Everest St. It was moved by Councilman Peavey, seconded by Councilman Temple, and so ordered that Assessment District #25 be abandoned. Mayor Dunnum stated that Assessment District #25 by this motion had been effectively killed. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that the matter on Ardis Avenue traffic be placed on the agendo at this time. City Engineer H.F.Durham gave a report to the Council on the progress of studies on Ardis Avenue traffic and the possible solutions of turning signs to divert the traffic; street striping to prohibit passing, as immediate measures to remedy this situation; also the possibility of a service road being opened in the hear future. Mr. W. C. Avery, 13207 South Ardis, Downey, appeared before the Council in behalf of the property owners on Ardis Avenue, and asked that action be taken tonight. It was moved by Councilman Temple, seconded by Councilman Peavey that the City Engineer be directed to proceed with erection of signs as outlined in his written report to the Council and for the striping of Ardis Avenue. Mr. Avery stated that the residents of Ardis Avenue were not in favor of striping Ardis Avenue for four lanes. Mr. Anthong Carney, 13061 Ardis; and Mr. Francis E. Brown, 13054 Ardis, also stated opposition to striping of Ardis Avenue. Councilman Temple and Peavey withdrew the previous motion and second, and Councilman Peavey moved, Councilman Temple seconded the motion that the signs be erected to direct traffice, and that the Traffic Engineer proceed with rec- ommendations as outlined in his report with the elimination of the street stripe& AYES: 4 Councilmen: Peavey, Dunnum, Corbin, Temple, NOBS: 0 ABSENT: 1 Councilman: Giddings It was moved by Councilman Temple, seconded by Councilman Borbin and passed by the following vote that the Minutes of the meeting of February 28th be approved as corrected. The City Clerk presented the following written correspondence: _ 1) Protest letters from Kenneth and Alma Issac and Clyde and Goldie Kress on Everest Assessment District #25. 2) A letter from Barbara G. Becker and Homer E. Geis on the name change of Lexington Gallatin Road. 1062 3) A letter from Mrs. Sam Miller regarding the schools and Civil Defense. 4) A letter from A. J. Tudisco relative to Zone Change #59. City Attorney Sorensen stated that no protests can be made to a Zone Change. Letter referred to Planning Division for reply to Mr. Tudisco. 5) A letter from the Board of Supervisors County of Los Angeles relative to reorganization of Municipal Courts. The City Manager was requested to ask for further delay for study purposes of this matter. 6) A letter from the United States Conference of Mayors relative to membership in this organization. 7) A letter of resignation from Joe Glenn Coss to the Sister City Committee, which was approved with regret by the Council. 8) A letter of resignation from Marie C. Coffey to the Sister City Committee, which was approved with regret by the Council. 9) A letter from James Bannister, Herald American, of resignation to the Sister City Committee, which was approved with regret by the Council. 10) A letter from Norma V. Bleamaster regarding weed abatement on property owned by her at 11957 South Patton Road, Downey. 11) A letter of invitation to Installation Banquet from the Bellflower Chamber of Commerce. 12) A letter from Ione Steele expressing appreciation for the attention given to the lights on Lakewood Boulevard from Downey Ford. 13) A letter from the City of Long Beach regarding Resolution No. 772 supporting the City of Long Beach's position with respect to the case before the Civil Aeronautics Board. 14) A letter from Mary L. Phillips, 10309 Foster Road, regarding the "Walking Men." 15) A letter from the Board of Supervisors County of Los Angeles regarding the incorporation of the City of Whittwood. 16) A letter from Richard G. Barhite to Oren L. King on Florence Avenue sidewalks, also petition to obtain a traffic signal on Florence Avenue and Mattock. Mr. Lloyd L. Stromberg, 8315 Lexington - Gallatin Road; Mr. Demos D. Shakarian, 8413 Lexington- Gallatin Road; expressed their desire that Council change the name of Lexington- Gallatin Road from Brookshire to Downey Avenue to Lexington Road. RESOLUTION NO. 774 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CHANGING THE NAME OF LEXINGTON - GALLATIN ROAD It was moved by Councilman Peavey, seconded by Councilman Temple and so ordered that further reading be waived. It was moved by Councilman Peavey, seconded by Councilman Temple and passed by the following vote that Resolution No. 774 be adopted as corrected: a. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 3142 OF THE DOWNEY MUNICIPAL CODE, OF WHICH SECTION RELATES TO THE RIDING OF BICYCLES. It was moved by Councilman Temple, seconded by Councilman Peavey, and so ordered that further reading be waived. AYES: 4 Councilmen: Temple, Peavey, Corbin, Dunnum NOES: 0 ABSENT: 1 Councilman: Giddings A situation peculair to the students from East Junior High crossing Florence Ave. was outlined by the City Mananger's report iten #5 and after some discussion it was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote that $5,000 be allocated from the Capital Improvements Fund for the construction of sidewalks on Florence Ave. from Haledon to Sideview. Mr. George Woodward, Advertising Manager of All American Markets and Mr. Gurtler of the All American Home Center spoke in protest to any legislation further regulating the dodrto door distribution by 'Walking Men'. Mr. Mach E. Laner of Mack E. Laner Avertising, Beverly Hills, California gave a report to the Council and stated that these men are supervised throughout the City and requested that no further legislation be passed. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the letters of resignation of Joe Coss, Marie Coffey and Jim Bannister be accepted with regret and that a letter of thanks be written from the City Managers office in appreciation of their outstanding work on the Sister City Committee. ORDINANCE NO. 161 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING THERETO SECTIONS 8109 - 8109.3, WHICH SAID SECTIONS RELATE TO THE INSTALLATION OF DRIVEWAYS AND DRIVEWAY APRONS, SIDEWALKS, CURBS, GUTTERS, AND PAVING. It was moved by Councilman Temple, seconded by Councilman Peavey and passed by the following vote that Mayor Carroll M. Dunnum be appointed as official Director of the City of Downey and Hollis M. Peavey as alternate director as Downey's representatives to the Independent Cities of Los Angeles County. The findings of the petitions for the Downeyhowntown Parking District were given by the clerk; these findings showed that not less than 60% had signed the petitions. It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote that 8:00 A.M., March 28, be the time set for hearing on the Master Plan of Streets and Highways, as recommended by the City Planning Commission at their regular meeting of March 1, 1961. AYES: 4 Councilmen: NOES: 0 ABSENT: 1 Councilman: Temple, Corbin, Davey, Dunnum Giddings 1.06 It was moved by Councilman Peavey, seconded by Councilman Temple, and so ordered that the City Manager draw a resolution setting forth that the parking meters on all downtown on- street parking meters have the heads removed and two - hour parking be substituted as requested by the Chamber of Commerce, and in accordance with Item 3 of the City Manager's Report of March 13, 1961. Mayor Dunnum asked the Councilmen to study the list of Committee Members relative to new appointments on April 1. It was moved by Councilman Peavey, seconded by Councilman Temple that the City Manager's recommendations on Pending State Legislation - Assembly Bill #1640 be accepted, and that the contact the Supervisor of the Park Board and see if the property could be conveyed to the City, and that the City Manager notify the League that we oppose this bill. Mr. King requested that Item 6 of his report be included in the Council Minutes regarding the progress made on the removal of Unsafe Structures within the City. Of the fourteen public nuisances existing in July 1960, all have been removed, demolished or rehabilitated with the exception of those located at 12349 South Clark, 9044 Imperial Highway, and 7949 Florence Avenue. It is also the intention of the City to instigate proceedings with the District Attorney at this time nn the remaining unsafe structures. It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote that an additional $3,000 be authorized to be transferred from the Capital Improvements Fund for the construction project on Old River School Road from Imperial to Quill. AYES: 4 Councilmen: NOES: 0 ABSENT: 1 Councilmen: Temple, Corbin, Dunnum, Peavey Giddings It was moved by Councilman Corbin, seconded by Councilman Peavey and passed by the following vote that the purchase of a 1250 GMP Pumper from Crown Coach Corporation, the only bidder, be approved at the total price of $31,610.86 including complete apparatus, necessary nozzles, ladders and tools and sales tax, and that the addition of one extra 4" gate valve costing $102.34, and the elimination of two compartments costing $274.56 also be approved leaving a total cost of $31,438.64. 4 AYES: Councilmen: Temple, Corbin, Dunnum, Peavey o AYES: Councilmen 1 ABSENT: Councilman: Giddings It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote that the Council approve an expenditure of $800.00 to Mr. Lynn Hamilton of Detroit Design Engineering, 12325 Bellflower Boulevard, for relocation of the electrical transmission line on their property; provided the heliport plans materialize; and that any such additional cost incident to the cost of the wiring not to exceed $800.00. AYES: 4 Councilmen: Temple, Corbin, Dunnum, Peavey NOES: 0 ABSENT: 1 CounctiVnan: Giddings It was moved by Councilman Peavey, seconded by Councilman Temple that the City Manager be authorized by the Council to get the right -of -way acquisition constituting 140 feet on Brookshire appraisal for a report back to the next Council meeting. Mr. King reported that the new post office has been approved in Washington for the corner of Myrtle and Firestone. He asked approval from the Council to check the possibility of constructing a basement for Civil Defense, of which Area "E" represents 12 or 13 cities. A review has been made of all the govern- ment agency offices in this area who are leasing or have other office space in Downey. Approval was granted. 't.Uf8 It was moved by Councilman Temple, seconded by Councilman Corbin that Mr. King be authorized to write letters to 'Ashington expressing Downey's desire to have the first chance to acquire the old post office building. Motion was so ordered. It was moved by Councilman Peavey, seconded by Councilman Corbin that Mr. Ralph Frank, Manager of the Capital National Bank, be appointed as a member of the Finance Committee. 'Motion was so ordered. It was moved by Councilman Peavey, seconded by Councilman Corbin that the City acquire property at the corner of Downey Avenue and Florence and widen that portion of the street, even if condemnation proceedings are necessary to do so. Motion was so ordered. The Council heard complaint by James Terry, 10256 Belcher, Downey, regarding improvement and widening of the section of Foster Road between Woodruff and Faust Avenues on the southeast border of Downey. He presented a petition to the Council with 150 signatures in support of this request. Mayor Dunnum asked for a report from Police Chief I. A. Robinson, City Engineer, H. F. Durham, and Richard Barhite, Director of Public Works and from Mr. King to be prepared and report to the Council at the next meeting of March 28 on this situation. It was moved by Councilman Peavey, seconded by Councilman Corbin and so ordered that the meeting be adjourned until 7:30 P. M., March 20. There being no further business to come before the Council,the meeting adjourned at 11 :20 P.M. .. —D ayor
