Dunnum presiding. PRESENT: Councilmen: Giddings, Temple, Corbin, Peavey, Dunnum ABSENT: ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney Glenn Kendall, Director of Finance, Assistant City Manager Richard Barhite, Director of Public Works Sherman Griselle, Director of Planning Robert W. Gain, Fire Chief Ivan A. Robinson, Chief of Police Ray Lake, Director of Building and Safety Lee Leavitt, City Engineer Harold F. Durham, Traffic Engineer Della Doyle, City Clerk Virginia Miller, Acting Deputy City Clerk Reverend R. V. Cogswell, Pastor of the First Presbyterian Church of Downey delivered the invocation. The Mayor announced that this is the time set for the hearing on Downey Lighting District Annex #3. The Clerk reported there were 2 written petitions in protest. Mr. Howard Hess, 7555 Brunache, reported that of the 35 property owners in this district, 29 signatures appeared on a petition protesting the lighting in this area. It was moved by Councilman Giddings, seconded by Councilman Temple and so ordered that the petition on Downey Lighting District Annex #3 be referred to the Public Works Department to check the signatures on same, and that the petition be presented back to the Council after checking. AYES: 5 Councilmen: Giddings, Temple, Corbin, Peavey, Dunnum NOES: 0 ABSENT: 0 It was moved by Councilman Temple, seconded by Councilman Peavey that the Brunache area be excluded from Downey Lighting District Annex #3. Wilkinson, 11329 Muller, reported that the citizens in Downey Lighting District Annex #3 did not want the particular type of lighting that had been proposed. 85 to 90% of the residents want lighting, but do not want the proposed lighting standards as presented. Mayor Dunnum moved that the Downey Lighting Hearing be placed at the foot of the ca,l,andar in order that the City Engineer could check the petitions and give a report back to the Council before the close of the meeting. The Mayor announced that this is the time set for hearing the report on the feasibility of forming Assessment District No. 25, Everest Street et al. W'7619 l The Mayor asked the City Clerk if she had the Affidavit of Publication. She announced in the affirmative. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that the Affidavit be received and filed. Barhite, Director of Public Works, presented the factual data on this Assessment District No. 25 to the Council. The Clerk reported written protests in the form of petitions on Assessment District No. 25 with approximately 57'/. plus signatures on the petition against this District. Also, received two postal cards protesting this district. She reported that the petitions had been checked by the Public Works Department and the 5719 plus signatures verified. Mayor Dunnum moved that the hearing on the actual protests on this work on AD #25 be continued to March 13 in view of the filing of the protests with the objections thereto, at which time the entire matter could be disposed of very summarily. It was moved by Councilman Corbin, seconded by Councilman Temple, and passed by the following vote that the hearing on AD #25 be continued until March 13 at 7:30 P.M. in the Council Chambers. AYES: 5 Councilmen: Giddings, Temple, Corbin, Peavey, Dunnum NOES: 0 ABSENT: 0 The City Clerk read the following correspondence: 1) Notice of meeting of the Los Angeles County Division, League of California Cities, Thursday, February 2, 1961. 2) Letter from the County Boundary Commission on Annexation No. 4 to the City of Commerce. 3) A letter from the Downtown Downey Business Association requesting per- mission to formulate plans for a Sidewalk Sale on Saturday, February 4. It was moved by Councilman Peavey, seconded by Councilman Giddings, and passed by the following vote that permission be granted to the Downtown Downey Business Association for the Sidewalk Sale, subject to the use of not over half of the sidewalk, and that they be allowed to cover the parking meters during this sale. Moore, Superintendent, Downey Unified School District, relative to termination of the lease on space occupied by the School District in the present City Hall. It was mw ed by Councilman Temple, seomded by Councilman Dunnum and passed by the following vote that the letter written by Mr. King to the School District be ratified. AYES: 5 Councilmen: Giddings, Temple, Corbin, Peavey, Dunnum NOES: 0 ABSENT: 0 5) A letter from the Public Utilities Commission, State of California, relative to the consolidation of the Downey, Los Angeles County, California Agency now located at 8156 East Nance Street, with the agency at Los Angeles in Los Angeles County, California, located at 357 Aliso Street, Los Angeles, by the Railway Express Agency, effective February 15, 1961. 6) A letter from the Downey Chamber of Commerce protesting the closing of the Railway Express office located in Downey. It was moved by Councilman Temple, seconded by Councilman Peavey, and passed by the following vote that the City Manager prepare a protest on the closing of the Downey Railway Express Agency in Downey and present it to the Public Utilities Commission. AYES: 5 Councilmen: Giddings, Temple, Dunnum, Corbin, Peavey NOES: 0 ABSENT: 0 7) A letter from the Downey Rose Float Association stating that Downey had won first place on the float in the Pasadena Tournament of Roses Parade for cities with population of 80,000 to 100,000. Also, requesting that the City authorize the transfer of $2,750 to Account 9- 2000 -331 in support of the program for the period ended for the 1961 float. A grand total of $6,318.34 in funds was raised by the Rose Float Association. It was moved by Councilman Temple, seconded by Councilman Peavey and passed by the following vote to authorize the transfer of $2,750 from the Operating Reserve Account to Account 9- 2000 -331 for the Downey Rose Float Association. AYES: 5 Councilmen: Giddings, Temple, Dunnum, Corbin, Peavey NOES: 0 ABSENT: 0 8) A letter from the Los Angeles County Road Department with proposed resolution, finding that the proposed improvement of Bellflower Boulevard and Brookshire Avenue, within the City of Downey, is of general County interest, and providing that County aid shall be extended therefor in the amount of $42,000. It was moved by Councilman Dunnum, seconded by Councilman Giddings and passed by the following vote that City Attorney Sorensen prepare a resolution approving the authority for improvement of Bellflower Boulevard and Brookshire Avenue from Aid to Cities fund provided by the County in the amount of $42,000. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNCIIPAL CODE BY AMENDING SECTIONS 6506, 6507, AND 6508 AND ADDING THERETO SECTIONS 6505.2, 6E505.3, 6506.1, AND 6507.1 THROUGH 6507.6 AND REPEALING SECTIONS 6509 AND 6509.1 ALL OF SAID SECTIONS RELATE TO DANCE HALLS AND CAFE ENTERTAINMENT. i ©33 It was moved by Mayor Dunnum that this Ordinance be ordered off calendar, subject to modifications regarding lighting in the ordinance as originally presented. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING TO ARTICLE II OF SAID CODE A NEW CHAPTER TO BE DESIGNATED CHAPTER 9 MISCELLANEOUS AND CONSISTING OF SECTIONS 2900 AND 2900.1, WHICH SAID SECTIONS RELATE TO STANDARDS FOR RECRUITMENT AND TRAINING OF PEACE OFFICERS It was moved by Councilman Peavey, seconded by Councilman Temple and so ordered that further reading be waived. It was moved by Councilman Giddings, seconded by Councilman Temple and so ordered that the City Council accept the work completed under the contract on Assessment District No. 33 - Phlox Street, and authorize the filing of Notice of Completion. It was moved by Councilman Peavey, seconded by Councilman Temple, and passed by the following vote that the City Council approve an appropriation of $700 from Account No. 1- 2000 -699 to Account No. 13520 for construction of the drainage structure on Bluff Road South of Dos Rios Road. King on the estimated costs for purchase of City owned bus operations. Mayor Dunnum stated that the Council was encouraged by the report on the bus system for the City of Downey, and requested that a more extensive study be made by the City Manager during the week, and that the matter of the City operating its own bus system be adjourned until 8:00 A.M., January 31, 1961. The Director of Public Works Lighting District Annex #3 showed opposed the lighting improvements he had the name of the person who lighting improvements and is inve circulated. reported that the petition on Downey approximately 43% of the property owners in this district. He also reported that had circulated the petition on these stigating the authority bylwhich it was 1036 It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote that the proceedings on Downey Lighting District Annex #3 be abandoned and allow it to start over with meetings to be held by the City Manager's Department to make a study of what the citizens want in this district regarding lighting. AYES: 5 Councilmen: Giddings, Temple, Corbin, Peavey, Dunnum NOES: 0 ABSENT: 0 Mayor Dunnum asked for a report from the Director of Public Works to be given at the next meeting as to when the paveout at Udisco would be completed. The Council called for a ten - minute recess at 9:50 A.M. and reconvened at 10:00 A.M. ORDINANCE NO. 157 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY PROHIBITING THE DEVELOPMENT OF MULTIPLE DWELLINGS IN THE R -3 ZONE WITHOUT PROVIDING ADEQUATE PARKING. The Ordinance was read in full to the Council. It was moved by Councilman Peavey, seconded by Councilman Temple and passed by the following vote that the emergency clause of Ordinance No. 157 be adopted.
