King, City Manager Richard Barhite, Director of Public Works Della Doyle, City Clerk Acting Mayor Corbin announced that due to the lack of a quorum there would be no business transacted. The Mayor announced the hearing on Downey Lighting District Annex #1 would be continued to January 16, 1961 at 7:30 P.M. Gain, Fire Chief Loren Morgan, Deputy Chief of Police Ray Lake, Director of Building and Safety Lee Leavitt, City Engineer Harold F. Durham, Traffic Engineer Della Doyle, City Clerk Virginia Miller, Acting Deputy City Clerk Reverend R. W. Moore, Pastor of the First Methodist Church of Downey delivered the invocation. Fire Chief Elmer C. Gates of the City of Santa Fe Springs presented a plaque to the Downey Fire Department for services rendered in the fire at Rothschild Oil Refinery on December 2- 3, 1960. Fire Chief Robert W. Gain presented a plaque and copy of brochure on church safety to Mrs. Alice Johnson for her help in forming plans relative to fire pre- vention in Downey Churches. The Mayor announced that this is the time set for the hearing on Downey Lighting District Annex #1. The Mayor asked the City Clerk if she had the Affidavit of Publication and Posting of Notices. She answered in the affirmative. It was moved by Councilman Temple, seconded by Councilman Corbin, and so ordered that the Affidavits be received and filed. The Clerk reported that there were no written protests. The Mayor then called for any oral statements for or against the hearing on Downey Lighting District Annex #1. There were no oral statements for or against. It was moved by Councilman Temple, seconded by Councilman Corbin, and passed by the following vote that the hearing be closed. AYES: 5 Councilmen: Temple, Dunnum, Giddings, Corbin, Peavey NOES: 0 ABSENT: 0 RESOLUTION NO. 749 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING CERTAIN LIGHTING FIXTURES; APPURTENANCES AND APPLIANCES ON CERTAIN STREETS AND PUBLIC PLACES OF SAID CITY TO BE MAINTAINED AND ELECTRIC CURRENT TO BE FURNISHED, ALL IN ACCORDANCE WITH RESOLUTION NO. 725 OF SAID CITY ( DOWNEY CITY LIGHTING DISTRICT, ANNEXATION 1, ZONE 1) It was moved by Councilman Temple, seconded by Councilman Giddings and so ordered that further reading be waived. It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote that Resolution No. 750 be adopted. AYES: 5 Councilmen: Temple, Dunnum, Giddings, Corbin, Peavey NOES: 0 ABSENT: 0 City Attorney Sorenson reported that there could be no hearing on Downey Lighting District Annexation #3 because of defeat in publication of the Hearing. The City Clerk stated that two Bids on Bonds on Klondyke AD #10 were received prior to 7:45 P.M. on January 9, 1961. The following bids were opened and read by City Attorney Sorenson: Gross and Company Record Searching Title Company, which bid contained a clause that the bid would terminate at the close of business on January 16, 1961. City Attorney Sorenson stated in view of this statement, he would suggest that these two bids be referred to the Treasurer for computation, and the matter referred back to the Council for award at the next meeting, January 24, 1961. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote that award of the bid on bonds be held until the Council Meeting of January 24, 1961. In view of the fact that the regular council meeting of January 9, was adjourned and continued to January 16, Record Searching Title Company would grant an extension of time of another week. City Attorney Sorenson then asked the Treasurer to review these two bids and report back to the meeting during the evening of January 16, 1961. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote that the motion previously made to hold the bids on the bonds until the Council Meeting of January 24, 1961 be rescinded. The following bids were opened and read by City Attorney Sorenson: Sulley- Miller $ 199,111.85 Boddum Construction Co. $ 204,684.40 Sheets Construction Co. $ 193,180.64 Oswald Brothers $ 197,336.27 Cox, Harold E. $ 199,976.67 It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote that the bids on construction on Klondyke AD #10 be referred to the Director of Public Works and the City Attorney for checking. Minutes of the Off- street Parking Steering Committee Meeting held on January 11, 1961 were read in full by the City Clerk. Mr. Frank J. Beckner appeared in behalf of the Steering Committee and the downtown property owners. His comments favoring the formation of the downtown parking district were related primarily to the acquisition of the one -half block facing Second Street between New and La Reina. He stated that this half block parking area is about equal distance from Downey and Firestone and for the con- solidation with the parking area across the street from Second would provide a large amount of off- street parking for the downtown business district. He stated that the parking district should be formed whether the City buys the post office parking lot or not, but that the Steering Committee had recommended that the City participate in the district to the extent of purchasing the lot next to the post office in an endeavor to assure location of the post office in the downtown area. He stated the Steering Committee felt it was better to concen- trate on this large lot between New and LaReina rather than endeavor to purchase a number of smaller lots in various locations throughout the business district. --� The firm of Welton- Beckett, Consulting Engineers and Architects, was represented by Mr. Tim Matthews who presented the basic concept of their planning for the future development of the central core area of the City of Downey. Mr. Matthews' analysis presented a program outlining the importance of retaining such magnets as the post office, County Courts, Civic Center, to support additional commercial developments and activities in the downtown business area. Mr. Matthews again emphasized the importance of the parking district as the basic tool with which the City and the property owners and businessmen could jointly use to set up and follow through on this develop- ment program. Mr. Matthews concluded his planning analysis with the state- ments that the formation of this district and the City's financial support had many precedence through similar acts in many cities throughout the State of California. Mr. John Nordbak, 7235 Via Rio Nida, stated that there had been some misunderstanding about-his views on the downtown parking area, and that he feels it not only desirable but absolutely necessary that it be formed. He feels that it is the purpose of the City to encourage and support the growth of the City for the citizens therein, but does not think the majority should be taxed to benefit the minority, and that he thoroughly believes in civic growth, however he does not believe that the City Council should put City funds into the parking district for the benefit of the downtown business group. In answer to Mayor Peavey, Mr. Nordbak stated that he did not own any property in the downtown business area, but was interested primarily as a resident and taxpayer of the City. Mr. James Gillespie, 7244 Cleargrove, Downey, spoke in opposition to the City's participation in the acquisition of the lot next to the post office and in support of Mr. Nordbak's comments. Mr. Dan Barrett, 7229 Via Rio Nida, supported Mr. Nordbak's opposition to the City's acquisition of the post office lot stating that it was a very bad precedent to set the district up and have the City pay part of it on the basis that it benefits everybody. Mr. Irving E. Rosen, Attorney, 11066 S. New Street, stated he wished it to be written into the records that all of these proceedings taken were out of order and felt they were irregular. Mayor Pro Tem. Dunnum stated that no council action Mould be taken ,.up to this time; that it was an informative matter and action was taken only after getting a cross section of public opinion. 1024 It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote that the City Council approve the formation of the parking district and authorize the circulation of petitions. AYES: 5 Councilmen: Temple, Dunnum, Corbin, Peavey, Giddings NOES: 0 ABSENT:O The City Attorney reported that the Director of Finance and the Treasurer had reviewed the bids on bonds on Klondyke AD #10 and recommended that the bond bid be awarded to Record Searching Title Company, the highest and best bidder. It was moved by Councilman Temple, seconded by Councilman Giddings and passed by the following vote that the bid on bonds on Klondyke AD #10 be awarded to Record Searching Title Company and all other bids be rejected. AYES: 5 Councilmen: Temple, Giddings, Corbin, Dunnum, Peavey NOES: 0 ABSENT:O The City Clerk read the following correspondence: 1) A letter from the League of California Cities notifying Councilmen of the regular meeting for January 1961, at the Santa Anita Race Track, The Honorable Frank G. Bonelli as speaker for this meeting. 2) A letter from the Central Basin Water Association extending invitations to attend the next regular meeting of the Board of Directors of this Association. 3) A letter from the County Boundary Commission with description of proposed Annex No. 9 to the City of Whittier. 4) A letter from the League of California Cities asking for appointment of a Councilman to serve as member of the League Committee on International Munici- pal Cooperation. Councilman Temple was appointed to serve on this Committee. 5) A letter from the Downey Chamber of Commerce on the accomplishments of the Sister City Program. 6) A letter from the Downey Chamber of Commerce requesting additional funds for use by the Chamber on various projects during the year. It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote that the Chamber of Commerce be granted the $3,000 fund requested, and authorize the transfer of $3,000 from Operating Reserve to Account 9- 2000 -331. AYES: 5 Councilmen: Temple, Dunnum, Giddings, Corbin, Peavey NOES: 0 ABSENT:O 7) A letter from the Downtown Downey Business Association thanking the Council for the action and interest taken in revitalization of downtown Downey. (8) A letter from the Downey Junior Womans Club regarding the Rose Float Committee seeking additional funds for the New Year's Day Float. (9) A Complaint from Thomas D. Shives for Claim for Damage. It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote that the claim be denied and referred to the insurance company. AYES: 5 Councilmen: Temple, Dunnum, Corbin, &avey, Giddings NOES: 0 ABSENT: 0 (10) A letter from Marian Wilson Jones regarding the relocation of palm trees along LaReina between Firestone and Second. (11) A letter from Cayer and Hegner, Attorneys at Law, notifying the City of Downey that Mr. James C. Carson is discontinuing the local bus service at the close of business on February 11, 1961. (12) A copy of letter written by City Manager Oren L. King to Mr. John J. Cayer, Attorney for Mr. James C. Careon, accepting the cancellation of contract on bus service effective, February 11, 1961. 1025 (13) A copy of letter written by City Manager Oren L. King to Mr. C. M. Gillis, Executive Director, Metropolitan Transit Authority, requesting the continuation of bus service within the City of Downey. Mr. King requested the Council to approve signing of the letters to the Attorney for Mr. James C. Carson and the Metropolitan Transit Authority. It was moved by Councilman Dunnum, seconded by Councilman Giddings and _ passed by the following vote that these letters be approved, and that the City Manager be authorized to sign the letters for mailing to the Attorney and Metropolitan Transit Authority. King investigate the cost on some small buses and report back to the next Council meeting. (14) A letter from Wilson & Wilson, Attorneys at Law, with deposit of $50.00 from Stanton E. Bower, relative to operating and maintaining a veter- inary medical clinic at 8542 Florence Avenue, protesting Zone Exception Case #210. February 13, 1961 was set as a date for hearing on Zone Exception No. 210. (15) A letter from Planning Commission on Zone Change #61, which will be held for master plan. (16) A letter from Richard W. Loveland for Pay -Less Free -Dry Laundromats relative to the license fee for self- service laundries. It was moved by Councilman Dunnum, seconded by Councilman Giddings and passed by the following vote that the word "services" be eliminated from the present ordinance on business license, thus placing the laundromats in a cate- gory of paying a minimum of $25.00. license fee. Dunnum at 10:05 P.M. and absented himself from the room. It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote that the City Council support the district by agreeing to pay into the district an amount equal to the cost of acquisition and improvement of the proposed parking lot adjacent to the proposed post office site on Firestone and Myrtle, such amount being estimated at $145,000, contingent upon the Post Office being located at the corner of Firestone and Myrtle. New Street, again stated to the Council that he felt the meeting was not in order, to which reply Mayor Pro Tem Dunnum and City Attorney Sorenson ruled that they saw nothing out of order, and that no answer was necessary. RESOLUTION NO. 752 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AUTHORIZING THE ISSUANCE AND SALE OF BONDS ON ASSESSMENT DISTRICT 64 (STAMPS AVENUE) 10 It was moved by Councilman Giddings, seconded by Councilman Corbin and so ordered that further reading be waived. This, in most cases is impossible, and Mr. Griselle suggested that the Council allow the Planning Commission 90 days from the date of January 16, 1961 to report back on the matter of the C -3 zoning for all downtown property. It was moved by Councilman Giddings, seconded by Councilman Corbin and passed by the following vote that the Planning Commission be authorized to have 90 days within which to report back to the Council on C -3 zoning of the downtown area. Mayor Peavey offered his resignation as Mayor of the City of Downey and gave a resume of the past year's work as Mayor of Downey. He also complimented the Councilmen for their extended cooperation and support during the past year.
