Dunnum presiding. PRESENT: Councilmen: Giddings, Temple, Corbin, Dunnum ABSENT: Councilman: Peavey ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney Glenn Kendall, Director of Finance, Assistant City Manager Richard Barhite, Director of Public Works Sherman Griselle, Director of Planning Robert W. Gain, Fire Chief Ivan A. Robinson, Chief of Police Ray Lake, Director of Building and Safety Lee Leavitt, City Engineer Harold F. Durham, Traffic Engineer William G. Goggin, Assistant Director of Planning Della Doyle, City Clerk Virginia Miller, Acting Deputy City Clerk Attorney Donald L. Wilson, representing Dr. Stanton E. Bower in Zone Exception Case No. 210,presented an appeal to the Council with pictures in evidence. The pictures were received and marked Exhibits A, B, C, D & E; also a News Article was received and marked Exhibit F. William A. Goggin, Assistant Director of Planning, presented factual data to the Council on Zone Exceipion Case #210 and a resume of information heard at the meeting of the Planning Commission of the City of Downey. It was moved by Councilman Temple that the Council take this case under submission. Mayor Dunnum stated that hearing no second to the motion, the motion fails for lack of a second. It was moved by Councilman Giddings, seconded by Councilman Corbin and passers by the following vote that the Council deny the request of Dr. Stanton E. Bower on Zone Exception Case No. 210, and Planning Commission decision upheld. AYES: 3 Councilmen: Giddings, Corbin, Dunnum NOES? 1 Councilman: Temple ABSENT 1 Councilman: Peavey The City Clerk stated that six Bids on Bonds on Assessment District #64 were received prior to 7:45 P.M. on February 13, 1961. The following bids were opened and read by City Attorney Sorensen on Assessment District #64, Stanps, Avenue: Gross & Company Downey Savings & Loan Lytle, John W. The Gaylord, Inc. Wald Enterprises Crowell, Weedon & Company It was moved by Councilman Temple, seconded by Councilman Corbin that these six bids be referred to the Director of Finance for computation, and the matter be presented back of the meeting during the evening of February 13, 1961. Council Minutes 2/13/61 -1- i ' I 1 The City Clerk stated that five Bids on Construction on Stamps Avenue AD #64 were received and dated prior to 5:00 P.M. on February 13, 1961. The following bids were opened and read by City Attorney Sorensen: Sulley Miller $25, 198.96 Griffith & Co $30,961.83 Boddum Construction $25,950.50 Oswald Brothers $31,802.34 McAnnis & Baker $28,870.75 It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote that the construction bids on Stamps Avenue AD #64 be referred to the Director of Public Works for a report back to the Council meeting on February 28. AYES: 4 Councilmen: Temple, Dunnum, Corbin, Giddings NOES: 0 ABSENT: 1 Councilman: Peavey Mr. W. C. Avery, 13207 South Ardis, Downey, presented a petition to the Council from property owners residing on Ardis Avenue, South of Imperial Boulevard and North of Foster Road, regarding the excess traffic on Ardis Avenue. City Manager Oren King reported that the traffic situation on Ardis Avenue has been studied and is still being reviewed at the present time. A meeting was held with Autonetics relative to a possible solution to this problem. A complete report will be available for presentation at the Council meeting of February 28, as another meeting is scheduled with Autonetics and the Traffic Department of the City will have information compiled.on the increase in traffic on this residential street. Mayor Dunnum asked the traffic committee and the chairman of this committee, Mr. Harold Durham, to study this matter immediately, and the citizens living on Ardis Avenue will be kept informed as to what progress is made on this traffic problem. Mayor Dunnum announced that the bond bids on Stamps Avenue Assessment District #64 had been checked by the Director of Finance and the bid of Downey Savings and Loan at par plus $50.00 premium with interest rate of 5z% proved to be the best bid. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote that the bond bid be awarded to Downey Savings and Loan, and to reject all other bids. AYES: 4 Councilmen: Temple, Corbin, Giddings, Dunnum NOES: 0 ABSENT: 1 Councilman: Peavey The City Clerk presented the following written correspondence: 1) A letter from Congressman Clyde Doyle to Robert W. Burgess, Director, Bureau of Census, relative to Annexation No. 1 on the final population figure of Downey. Council Minutes 2/13/61 -2- 1045 2) Letter from Robert W. Burgess, Director, Bureau of the Census, to Mr. King concerning the possible omission in the 1960 Census count of certain areas annexed to Downey. Mayor Dunnum asked City Manager Oren King to follow through on the enumeration on the areas listed as being within the city limits in the 1960 Census count. 3) A letter from Caesar Mattei, Director of Downey Youth Band, expressing gratitude and thanks to the members of the City Council for underwriting the band. 4) A letter from Lemons Disposal Company regarding the expiration of a three -year contract between this company and the City of Downey on July 1, 1961. 5) A letter from Rio Hondo Disposal Service regarding expiration of contract between this company and the City of Downey on July 1, 1961. 6) A letter from Andrew V. Hohn regarding contract between this company and the City of Downey which expires July 1, 1961. It was moved by Councilman Giddings with the consent of the Council that these three letters be referred to the Sanitation Committee and the City Manager for further handling. 7) A letter from the Public Utilities Commission to Mr. King regarding additional service to the City of Downey by the Railway Express Agency. This has been referred to the Chamber of Commerce who is making a study on the Downey agency. e) A letter from Railway Express Agency to L. E. Pickett, Markers Pre- serving Kitchens, relative to operation of the Downey office. 9) A letter from the City of Long Beach relative to Senate Concurrent Resolution No. 62 Report on street improvement monies. Mayor Dunnum asked that Mr. King give a later report to the Council regarding these funds. 10) A letter from George G. Wynne, United States Information Agency, for the City to participate in the June 12 -20 exhibit now being planned for the World Congress of Local Governments in Washington. 11) A letter from William F. Farell, Office of Transportaion, City of Santa Monica relative to transportation study of the Downey area. Mr. King reported that the bus transportation study is still being conducted and that bus consultants had been contacted. Mayor Dunnum asked for a breakdown of recommendations on the bus situation, and for the City Manager to make a report on this at the next council meeting. 12) A letter from the Downey Symphonic Society, Inc. extending invitation to Mayor and Councilmen and other City Officials to the next Salon to be held Thursday, March 16, 1961. 13) A letter from James D. Brown, 9339 Samoline, Downey, Vice President of the Downey Chapter of the S.P.E.B.S.Q.S.A, Inc., and a proposed trip to the city of Philadelphia in June. Mr. Brown also gave an account to the Council of the activities of this organization and its plans to attend the convention in Philadelphia in June. Members of the Council unanimously adopted the Downey Revelaire Chorus as the Official Representatives of the City of Downey. Mayor Dunnum referred the matter of this Chorus to attend the convention in Philadelphia to City Mangger Oren King for a study of ways and means to assist this group. Council Minutes 2/13/61 -3- x:046 ORDINANCE NO. 159 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY AMENDING SECTION 3186 RELATING TO RESTRICTED SPEED LIMITS. It was moved by Councilman Temple,seconded by Councilman Giddings and so ordered thatfurther reading be waived. It was moved by Councilman Giddings, seconded by Councilman Corbin and passed by the following vote that Ordinance No. 159 be adopted. AYES: 4 Councilmen: Giddings, Temple, Corbin, Dunnum NOES: 0 ABSENT: 1 Councilman: Peavey ORDINANCE NO. 158 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING TO ARTICLE II OF SAID CODE A NEW CHAPTER TO BE DESIGNATED CHAPTER 9 MISCELLANEOUS AND CONSISTING OF SECTIONS 2900 AND 2900.1, WHICH SAID SECTIONS RELATE TO STANDARDS FOR RECRUITMENT AND TRAINING OF PEACE OFFICERS. It was moved by Councilman Temple, seconded by Councilman Giddings and so ordered that further read ng'.be waived. It was moved by Councilman Giddings, seconded by Councilman Corbin and passed by the following vote that Ordinance No. 158 be adopted. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING THERETO SECTIONS 8109 - 8109.3, WHICH SAID SECTIONS RELATE TO THE INSTALLATION OF DRIVEWAYS AND DRIVEWAY APRONS, SIDEWALKS, CURBS, GUTTERS, AND PAVING. After some discussion by the Council of this ordinance, Section 8109.3 is to be modified and in the case of an appeal, it is to be made to the City Planning Commission rather than to the City Council, and then with the right of appeal to the City Council. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SUB - SECTION (d) OF SECTION 6253 OF THE DOWNEY MUNICIPAL CODE, WHICH SAID SECTION RELATES TO LOCKERS AND COIN OPERATED MACHINES. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that further reading be waived. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote that Resolution No. 761 be adopted. Mayor Dunnum asked Mayor Pro Tem Temple to conduct the meeting on this resolution, in order for Mayor Dunnum to abstain action on this resolution. It was moved by Councilman Giddings, seconded by Councilman Corbin and passed by the following vote that award of contract #55 - Sewer Construction to Maintenance Yard be made to Max Milosevich in the amount of $2,550, and reject all other bids. Council Minutes 2/13/61 -7- 1050 AYES: 4 Councilmen: Giddings, Temple, Corbin, Dunnum NOES: 0 ABSENT: 1 Councilman: Peavey It was moved by Councilman Corbin, seconded by Councilman Giddings and passed by the following vote that an appropriation of additional funds in the amount of $16,000 be made from gas tax money, Account 11050, on Cash Contract No. 50, Gallatin Road between Lakewood Boulevard and 100 feet west of Downey Avenue. AYES: 4 Councilmen: Giddings, Temple, Corbin, Dunnum NOES: 0 ABSENT: 1 Councilman: Peavey It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote that as a matter of policy on streets of major importance, the City Council has agreed that in the event the land owner dedicates free of charge to the City of Downey the land for street purposes, that the City will install without charge to the property owner the curbs and gutters, coextensive with the land dedicated. AYES: 4 Councilmen: Giddings, Temple, Corbin, Dunnum NOES: 0 ABSENT: 1 Councilman: Peavey It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that priority on projects for which engineering is now under way be given the following priority. 1) Brookshire street sewer and construction 2) Hall Road AD #57 - Lakewood to Woodruff Street construction 3) Bellflower Boulevard - North of Imperial Street Widening combined with Public Works Yard at 12334 Bellflower. 4) Paramount Boulevard street widening south of Southern Pacific Railroad. RESOLUTION NO. 766 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING RESOLUTION NO. 622 PROVIDING RATES OF COMPENSATION FOR CERTAIN EMPLOYEES. It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote that Resolution No. 766 be adopted. AYES: 4 Councilmen: Giddings, Temple, Corbin, Dunnum NOES: 0 ABSENT: 1 Councilman: Peavey RESOLUTION NO. 767 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING RESOLUTION NO. 638 PROVIDING RATE OF COMPENSATION FOR THE DIRECTOR OF PLANNING. It was moved by Councilman Corbin, seconded by Councilman Giddings and passed by the following vote that Resolution No. 767 be adopted. AYES: 4 Councilmen: NOES: 0 ABSENT: 1 Councilmen: Giddings, Temple, Corbin, Dunnum Peavey Council (Minutes 2/13/61 -8- x.4.51 It was moved by Councilman Temple, seconded by Councilman Giddings and passed by the following vote that the Lease Agreement between South Los Angeles Tranpsortation Company and the City of Downey for the operation of buses within--the City be Authorized to be signed by the City Manager with . amendments to the agreement as follows: Paragraph 3 Page 2 under the provision as to warranty, the words "mechanical work necessary" shall be deleted. Insert a provision to the effect that the City is not responsible for repairs incident to breakdowns other than due to normal use.
