OF THE CITY OF DOWNEY
HELD OCTOBER 1pth,1960
The City Council of the City of Downey held a regular meeting in the
Council Chambers of the Downey City Hall at 7:30 P.M., October 10th,1960,
Mayor Peavey presiding.
PRESENT: Councilmen: Temple, Dunnum, Gidding, Corbin, Peavey
ALSO PRESENT: Oren L. King, City Manager
Royal M. Sorensen, Attorney
Glenn Kendall, Assistant City Manager
Lee Leavitt, City Engineer
Robert Gain, Fire Chief
Loren Morgan, Deputy Chief of Police
Sherman Griselle, Director of Planning
Ray Lake, Director of Building and Safety
Dick Barhite, Director of Public Works.
Reverend Ernest Sillers of St. Mark's Episcopal Church delivered the
invocation.
Mayor Peavey presented Mrs. Everett C. Horner a Certificate of Appreciation,
for the outstanding work as president of the Coordinating Council 1959 -60, in
behalf of the City.
The Mayor then intuoduced James Allgood, President of the Coordinating
Council who requested the Councils consideration in helping the program of
Jobs of Juniors undertaken by the Coordinating Council. He outlined that
there is a deficit of approximately $300.00 from last years program and he
also stated that they hope to continue the program again this year and are
requesting Council consider a allocation of $750.00 for this project.
The Mayor then announced that the hour of 7:30 P.M. had arrived and that
the bids for the Sale of Bonds on Phlox Avenue AD#33 were to be opened.
There were six bids received and opened by the Clerk. The City Attorney
read the bids.
It was moved by Councilman Temple, seconded by Councilman Dunnum, and
passed by the following vote that these bids be received and referred to the
Director of Finance, the City Attorney and the City Manager for analysis.

The bids on the construction of work on Plhox Ave. A033 were then opened.
There were three bids received which the Clerk opened and the City Attorney
read;
It was moved by Councilman Dunnum, seconded by Councilman Giddings, and
passed by the following vote that these bids be referred to the Director of
Public Works, the City Attorney and the City Manager for analysis and recom-
mendation.

The Mayor then opened the hearing on the Vacation of the Alley- 4th Place
as scheduled and advertised for this time.
The Clerk presented correspondence on this hearing:
Mrs. Rose Meltzer was in favor of the vacation
Arnold Thomas, 7946 E. 4th St. was protesting the vacation.
Southern California Gas Company and Downey County Water District
protesting on the grounds that they had utility facilities in
this alley and would have to retain the aceess thereto,
The following people spoke in protest to the vacation:
J.E. Willaford, 7909 4th Place
V. G. Aiken, 7937 4th Place
R. S. Bradfield, 7910 4th Street
Mr. Maurice Meltze ;,7921 4th Place spoke in favor of the vacation.
It was moved by Councilman Temple, seconded by Councilman Giddings, and
so ordered that the hearing be closed.
Councilman Dunnum suggested that a study be made to see if it is feasible
to obtain right of way to open the alley to a width that would be more practical.
It was moved by Councilman Temple, seconded by Councilman Corbin and passed
by the following vote that the matter be taken under submission and requested a
report from the City Manager an the possibility of opening the alley to a usable
width.

The hearing on the report on Stamps Ave. AWt64 was then opened.
The Mayor asked the City Clerk if she had the affidavit of mailing relative
to this hearing. She answered in the affirmative.
It was moved by Councilman Temple, seconded by Councilman Corbin and so
ordered that the affidavit be received and filed.
The City Engineer then presented the factual data of the report.
The Clerk reported that there were no written protests.
The Mayor then called for any oral statements for or against the improvement
or relating to the report.
Dr. B. T. Utley, 8348 Vista del Rio and Mr. James Lacey, 8360 Vista del Rio
spoke in protest to the improvement. They requested that Stamps Ave. be opened to
Gallatin Rd. rather than Vista del Rio as the improvement would be very determental
to their two properties.
It was moved by Councilmen Giddings, seconded by Councilmen Temple, and so
ordered that the hearing be closed.
After some discussion the Council held action on the Resolution of Feasibility
pending the hearing on Intention scheduled for the meeting of October 25th,1960.
The analysis on the bids for bonds on Phlox Ave. AD #33 were presented and
after a complete review It was moved by Councilman Temple, seconded by Councilman
Corbin and passed by the following vote that the bid be awarded to J. B. Hanauer &
Co., the lowest and bast bidder, at 99.40% of par at a rate of 6% interest, in the
amount of $51,262.24 and that all other bids be rejected.

The Clerk then read the following correspondence:
A note of appreciation from Mr. Joe Coss for the flowers in memory
of his father.
A letter from Ralphs Grocery Co. with a check in the amount of $1700.00
enclosed as their portion of the cost for construction of a left turn into the
pr.?operty located on the southeast corner of Lakewood and Firestone and expressing
thanks to the City in their helf in obtaining permission from the Division of
Highways to construct such a turn.
It was moved by Councilman Temple, seconded by Councilman Giddings, and do
ordered that this check and letter be received and referred to the Director of
Finance and the City Manager.
A letter from the County of Los Angeles, Board of Supervisors inviting
the City Officials to attend the dedication of the County's new Hall of Admin-
istration on Friday, October 28th,1960 at 10:30 A.M.
A letter from the Rio San Gabriel Civic Association urging the Council to
give high priority to the matter of a City Charter and suggesting that a Citizen's
Committee be appointed and fund appropriated for professional services to assist
in the matter.
A letter from Mr. Lee Sievers, of the Sievers Construction Company requesting
that Council take action on Zoning Variance Case No.175.
The CityAttorney reported that Mr. Sievers had signed an agreement to grant
to the City of Downey an option to purchase said real property at any time prior
to November 1,1970 upon notice. Within thirty days from the date of said notice the
grant deed conveying title to the City free and clear of all liens and encumberances,
together with a policy of title insurance shall be delivered to the City for the
sum of $50.00 as the entire purchase price.

by the following vote that this agreement be approved and recorded.

ORDINANCE NO.152
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ZONING CERTAIN PROPERTY ADJACENT TO LAKEWOOD BOULEVARD
SO AS TO LIMIT THE USE OF THE SAME TO VEHICLE PARKING.
The Ordinance was read in full. It was moved by Councilman Dunnum, seconded
by Councilman Temple, and passed by the following vote that this ordinance be
considered an emergency measure and should be adopted without the preliminary
introduction and second reading before final adoption.

RESOLUTION NO. 689
A RESOLUTION OF THE CITY CVVNCU OF THE CITY OF DOWNEY
ORDERING THE VACATION OF PORTIONS OF FONTANt STREET, A
SERVICE ROAD PARALLEL WITH LAKEWOOD BOULEVARD EXTENDING
NORTHERLY FROM STEWART AND GRAY ROAD, AND A PORTION OF THE
ALLEY PARALLEL WITH LAKEWOOD BOULEVARD EXTENDING NORTHERLY
FROM STEWART AND GRAY ROAD, WITHIN TRACT NO. 13183.
The resolution was read by title only. It was moved by Councilman Corbin,
seconded by Councilman Giddings, and so ordered that further reading be waived.

passed by the following vote that Resolution No. 689 be adopted.

Councilman Dunnum suggested that inasmuch as Mr. Richard Roe, attorney for
the Park Water District and our CityAttorney had completed and presented the
proposed agreement and legal findings on the purchase of the Park Water District
that they outline and report on this matter at this time.
The Attorneys then outlined briefly what their findings were and emphasized
that they were presenting the legal requirements but were not recommending as to
the policy. It is now necessary for the Council to study the findings and to
determine what their pleasure is so that these can be considered by the directors
of the Water Company.

passed by the following vote that the minutes of the Meeting of September 27th,
1960, be approved as presented.

to provide the necessary funds for the Traffid Signal at Gardendale St. and
Garfield Ave.

A summary of the bids for the traffic signal and Safety lighting at
Florence Ave. and Willey -Burke Ave. Contract #48 was presented. It was moved
by Councilman Corbin, seconded by Councilman Temple, and passed by the following
vote that the contract be awarded to Paul Gardner Corp, the lowest and best
bidder, in the amount of $10,647.00 and all other bids be rejected.

Passed by the following vote that the Council authorize an appropriation of
$3000 from the capital improvement fund to construct a concrete bottom in the
drainage structure to provide a uniform grade for the elimination of stagnant
water from Hondo Street to Quill Dr. (From AC 9- 2000 -699 to AC 13490)

passed by the following vate that the City Council hereby announce its intention
to initiate and consider a change in zone of the B -1 Buffer Zone located approxi-
mately 600' west of Woodruff Avenue and south of Washburn Crossing Road, which
consideration will be to reduce the width of the existing 100' wide B -1 zone to a
width of 30 feet, and hereby refers such proposal to the Planning Commission for a
public hearing, and a report of findings, summaries of hearings and recommendations
of the Planning Commission concerning this matter shall be filed with the Council
within 60 days.

At the request of the Planning Commission, Sherman Griselle, Director of
Planning reported to the Council that there are some properties that the County
is holding and is willing to release. They ask that the Council consider the
acquisition of these properties at this time as they are in a position that will
aid in the opening of Brookshire at a future date. Mr. Griselle presented a
map showing these properties and it was the Councils request that this be invest-
igated further and a report made on the possibility and cost of acquiring any
available land that the County has available.
The City Manager reported on the plans of the Chamber of Commerce's
Industrial Committee to have an industrial exhibit under a large tent on the
parking lot across the street from the City Hall on Thursday,Friday and Saturaday,
December 15, 16, & 17th. He asked what Councils pleasure was in regard to cele-
brating the Cit*s fourth anniversary at that time. It was the agreed opinion that
and City celebration should be on Saturaday December 17th the anniversary date of
the Incorporation of the City.
Mr. King submitted the basic reason for the salary recommendations as
requested by the Council at the meeting of September 27th.
After some discussion it was moved by Councilman Giddings, seconded by
Councilman Corbin and passed by the following vote that approval be given to the
following adjustments.
Chief Accountant- advance the classification from Pay Key 22 ($600 -729)
to Pay Key 23 ($629 -766).
Administrative Assistant - advance the classification from Pay Key 21
($571 -694) to Pay Key,22 ($600 -729).
Senior Administrative Assistant - Advance the classification from Pay
Key 22 ($600 -729) to Pay Key 23 ($629 -766).

Councilman Temple inquired as to the possibility of requesting the County
to eliminate tax assessment on fall out shelters. The City Attorney is to report.
Councilman Giddings reported that he had received several letter of apprec-
iation for the actions taken at the corner of Lakewood and Florence at the Yeakel
lot to eliminate the nuisance value.

passed by the following vote that necessary expenses be approved for any of the
Councilmen who wished to attend the Inter - American Municipal Congress in San
Diego, October 12- 22,1960
