MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
HELD AUGUST 8TH, 1960
The City Council of the City of Downey held a regular meeting
in the Council Chamber of the Downey City Hall at 7:30 P.M., August 8th,
1960, Mayor Pro - Tempore Carroll M. Dunnum presiding.

Reverend R. F. Curtis of the Assembly of God Church delivered the
invocation.
Mayor Pro - Tempore Dunnum announced that this is the time and place
set for the hearing on Special Permit Case #7 relative to a ham radio
tower.
The Mayor Pro - Tempore asked if there were any written protests.
The Deputy City Clerk read two letters written by the following persons:

Jerome Earl & Irene M. Hocker, 9030 Gaymont
Glenn Kendall, Assistant City Manager, read a protest from Marcus A.
and Barbara G. Starr, which had been handed to him by the Acting Planning
Director, William Goggin, requesting reactivation of a letter of protest
written previously and including it in the current hearing on the matter.
The Deputy City Clerk reported a letter had also been received from
Howard F. Shepherd, Jr., Attorney, representing the Los Angeles Area Councal.
of Amateur Radio Clubs, Inc., which presented certain arguments for consid-
eration of the Council in connection with the hearing set down in the matter
of Roger Swenson of 9024 Gaymont Street, Downey. Copies of this letter were
distributed to each councilman.
Mr. Goggin was requested to present a resume of the proceedings held
by the Planning Commission.
The Mayor Pro Tem asked if there were any oral protests or comments.
Those to speak against the Special Permit #7 for a ham radio tower were:

Wesley Sherman, 9107 Tweedy Lane
Wendell Schooling, 9315 Gaymont (who spoke at the request of
Wesley Sherman to explain the interference he had ex-
perienced from a similar ham operation)
Jack Gurley, 7808 Finevale Dr.
The main objections voiced by the objectors were TV and radio inter-
ference, unsightliness for the neighborhood, the dangers of such a radio
antenna falling if not maintained or inspected periodically, and a lessen-
ing of property values.

After a question and answer period by the Council of the objectors,
Mayor Pro - Tempore Dunnum asked for oral comments from any proponents.
Speaking for Zone Case #7 for a special permit were:

H. E. Black, 8052 E. Alameda, Downey
Both Mr. Myers and Mr. Black reported interference to reception to
TV and radio sets by ham radio operations usually are found to be directly
due to a weakness in the design of the sets. They also stated that the
Federal Communications Commission mails a form, which, if the questions
contained on such form are correctly and completely answered and returned
to FCC, would be forwarded to the manufacturer of a set. In most cases, the
manufacturer would usually mail a filter to the person to be used on the TV
set. Although the FCC does not have a sufficient number of engineers and money
to investigate all complaints received, there are numerous volunteers to
investigate complaints. Mr. Black stated in approximately 1200 cases of TV
interference he had investigated, only two "Ham" radio operators were found to
be directly at fault. All ham operators are required to comply with FCC
rules, and they take a very dim view of any amateur radio operator that
operates off the beam and causes interference with other radio and TV sets.
In his rebuttal, Mr. Hocker stated the interference was also noticed
on his telephone. Mr. Shepherd stated that the telephone companies have a
device or filter which is placed in the head set to eliminate the trouble with
the telephone. Mr. Shepherd also stated that the price or quality has nothing
to do with the causing of the interference - -it is the model, year, and condition
of the set.
It was moved by Councilman Temple, seconded by Councilman Giddings and
so ordered that the hearing be closed on Special Permit #7, the application
of Roger Swensen for a ham radio tower.
Councilman Temple inquired of Mr. Goggin what the conditions were which
had been imposed by the Planning Commission on the approval for the special
permit to erect a ham radio tower.
Mr. Goggin read the following conditions:
1. That the height and size of the tower and antenna shall
conform to the approved plot plan.
2. That the erection maintenance shall conform to the City of
Downey Building Code.
3. The operation shall conform to the rules and regulations of
the Federal Communications Commission.
4. That there shall be no radio or television interference with
adjacent property or properties within the surrounding area.
5. That approval be granted under Section 510.
Councilman Giddings questioned how Item #4 may be governed.
Mr. Goggin explained that when there is avalid complaint, the FCC would
be notified and if no action was forthcoming from the FCC, the City and Build-
ing and Safety Director would investigate to ensure action from the FCC.
It was moved by Councilman Corbin and seconded by Councilman Temple
that the decision of the Planning Commission be upheld in Special Permit Case
No. 7 and that the appeal be denied.
It was moved by Councilman Giddings, seconded by Councilman Temple
that the motion be amended to add the condition that an annual inspection
of such towers be required.
Mayor Pro - Tempore expressed the dangers of such a requirement in that
it may result in an expensive suit against the City should such towers
cause damage, and it could be said that the City had not had proper in-
spection. He also compared this condition to the fact that there are
present throughout the City, many high voltage towers, lines, and cables
which would not be required to have inspection. He advised greatly against
imposing such a responsibility on the City through such a condition.
Councilman Temple withdrew his second to the amendment to the motion to
uphold the decision of the Planning Commission. The motion died for the
lack of a second.
The original motion to uphold the decision of the Planning Commission
in Special Permit Case No. 7 and to deny the appeal was passed by the follow-
ing vote of the Council:

The City Manager stated he would work with the Director of'$uilding &
Safety in making an analysis for establishing periodical inspections in cases
of this kind.
It was moved by Councilman Temple, seconded by Councilman Corbin and
passed by the following vote that the minutes of July 26, 1960, be approved
as corrected, changing the word "anatomizing" in the third paragraph of page 12
of the matter dealing with the Recreation and Park District to "autonomy ".
Mr. King, City Manager, stated the City Council wished to recognize the
members of the Public Works Department who have completed certain phases of
in- service training. The following employees were presented letters of
commendation:
Dwaine Jones, Ernest Axness, Myles Sprague, William Huyck,
Ben Minamide, Lee Leavitt, Witold Hryniewicki, Mel Harldson,
and Richard Barhite
Absent were:
Frank Sleeper, Paul White, Donald Stoddard, Robert DeSio, Robert Buonodono,
Bob Vollmer and Hal Durham
Mr. King expressed commendation for the in- service training program through
which the employees are endeavoring to better themselves for the good of the City
of Downey.
The Mayor - Pro - Tempore recognized several citizens in the audience who
were present to hear a report of the drainage problem relative to Zone Case
#40 which had been taken under submission over a year ago. It was recommended,
since all persons concerned had not been notified, that the matter be continued
to the first evening meeting in September.
It was moved by Councilman Temple, seconded by Councilman Giddings and
,-r passed by the following vote to continue the matter of Zone Exception Case #40
to 7:30 P.M., September 12, 1960, in the Council Chamber of the Downey City
Hall.

The Deputy City Clerk read the following written correspondence:
A letter from Reno Sirrine, Chairman of the Board of Directors of
the Downey Recreation & Park District, acknowledging the excerpt from
the Minutes of the City Council Meeting of July 26, 1960, and stating
their gratitude for the proposals contained in the excerpt. The proposal
is being directed to a newly appointed committee for diligent study and
will be acted upon by the Board at the earliest feasible date, with the
possibility that an early agreement could place the proposals on the
.r November ballot.
The Deputy City Clerk stated a letter from John A. Nordbak, Architect,
11032 S. Myrtle Street, Downey, pertaining to an article appearing in the
Daily Signal relative to an Auditorium Building for Downey, had been re-
ceived, copies of which had been sent to the Councilmen along with their
agenda.
A letter from Bob D. & Patricia Husband; Roy L. & Dorothy M. Mitchell;
and Jack W. & Sue J. Worthen was read requesting annexation to the City of
Downey of their properties on the south side of Golden Avenue, east of
Downey Avenue and to the city lines of Paramount and Downey. The letter was
referred to the City Manager.
A letter was read from Raleigh George, Chairman of the Board of
Directors of the Downey Symphonic Society, Inc. expressing appreciation and
thanks for the appropriations which have been granted by the City Council
and submitting their projected budget for the coming season, 1960 -61.
Mayor Pro Tempore Dunnum requested copies of the budget for members of the
City Council.
The Mayor Pro - Tempore requested Mr. Roberts, who had been waiting for
some time to speak to the City Council, to come forward. Mr. Roberts
announced that a new closed door discount operation is to be built at the
northeast corner of Brookshire and Imperial Highway to be known as UDISCO,
with groundbreaking ceremonies tentatively planned for August 12, 1960.
Mr. Roberts was advised to contact the City Manager to make arrangements for
the most convenient time to hold such groundbreaking ceremonies in order
that members of the City Council might be present.

SECTION 3177, WHICH SAID SECTION RELATES TO PARKING
METERS

The City Manager reminded Council that this ordinance was requested by the
Manager of the Downey Chamber of Commerce to give authority to the City
Council to suspend parking regulations or restrictions on a given date.

RESOLUTION NO. 647

ADOPTING BUDGET AND APPROVING MEMORANDUM OF AGREEMENT
FOR EXPENDITURE OF GAS TAX ALLOCATION FOR MAJOR CITY
STREETS
The resolution was read by title only. It was explained by Mr. King
that the subject agreement formalizes the request for Gas Tax Funds from
the State Division of Highways for the following purposes:
1. Major and Secondary City Street maintenance for
$115,600.00
1960 -61
2. Supplemental appropriation for Stewart & Gray Rd.
between Bellflower Boulevard and Woodruff Ave. 20,000.00
$135,600.00

ING JULY 1, 1960, AND FIXING THE LIMITATIONS OF
EXPENDITURE FOR THE SEVERAL FUNDS, FUNCTIONS, DEPARTMENTS
AND ACTIVITIES CARRIED ON UNDER SUCH FUNDS

that the budget be approved as presented with the understanding that it can
be reconsidered and any changes made with respect to capital expenditures
and additional personnel.

The City Manager also reported that an extension of time has been
requested for Contract #35 (Florence Avenue improvements) because of
certain drainage problems which need correction.
It was moved by Councilman Giddings, seconded by Councilman Temple
and so ordered that authority be granted for an extension of time to
August 12, 1960, for completion of Contract #35, Florence Avenue.
It was reported by the City Manager that the work required of Sully
Miller Contracting Company for the application of slurry seal on various
streets throughout the southwesterly portion of the City of Downey has now
been completed. It is recommended that the City Council consider the fol-
lowing actions:
1. Acceptance of the work.
2. Authority to record the Notice of Completion.
It was moved by Councilman Temple, seconded by Councilman Giddings
and so ordered to accept the work required under Cash Contract #41 (slurry
seal) and authorize filing a Notice of Completion.
Plans and specifications for improvement of Imperial Highway between
Paramount Boulevard and the west City Limits, and Old River School Road
between Imperial Highway and Quill Drive, have been submitted to the State
Division of Highways for their approval, according to the City Manager. It
is recommended that, subject to the State's approval, Council approve the
plans and specifications and authorize advertising for bids.
It was moved by Councilman Temple, seconded by Councilman Giddings and
so ordered to approve plans and specifications for Cash Contract #38 (Imperial
Highway, Old River School Road).

ordered to authorize advertising for bids for Cash Contract #38 (Imperial
Highway, Old River School Road).
After a summation of bids for construction contract on Benedict Avenue,
A.D. #14, it was recommended that the contract be awarded to the lowest and
best bidder, Sully- Miller Contracting Company in the amount of $11,934.39, and
all other bids be rejected. The City Manager reported there had been an error
in item 10 of the low bidder, which should have been in the amount of $411.60,
bringing the total bid to the sum shown above. The City Attorney had approved
this bid.
It was moved by Councilman Giddings, seconded by Councilman Temple and
passed by the following vote to award the bid for A.D. #14 construction to
the lowest and best bidder, Sully- Miller Contracting Company, in the amount of
$11,934.39, and that all other bids be rejected.

Prints have been prepared showing a proposed sewer to be constructed on
Fontana Street westerly from Downey Avenue through assessment district pro-
ceedings and Mr. Barhite reported that this improvement was requested by
seven property owners. Council permission was requested for the Public Works
Department to authorize circulating a petition.
It was moved by Councilman Temple, seconded by Councilman Corbin and so
ordered that the Public Works Department be authorized to circulate a petition
for Fontana Sewer Improvement District, A.D. #54.
The City Manager suggested that Council authorize the three items under "B"
of his street improvement projects list reviewed by the Council on Wednesday
morning, August 3, which are Brookshire Avenue from Imperial to Eucalyptus- -
$52,000; Gallatin Road from Lexington to Downey -- $45,000; Imperial Highway from
the westerly city limits to Paramount -- $70,000; totaling $167,000. Further
study will be necessary for the remaining amount of street improvement funds.

passed by the following vote to authorize appropriation of gas tax funds for
the improvement projects contained in Item B of the City Manager's report of
August 2, 1960.

The City Manager reviewed the request of the Planning Commission for the
City Council to.establish the future widths and setback lines on Brookshire
Avenue from Firestone Boulevard to Imperial Highway. The ultimate width would
be 80' plus an 8' setback, which would result in a 28' setback from the present
right -of -way line where the street now has an existing width of only 40'.
It was moved by Councilman Temple, seconded by Councilman Giddings and so
ordered that the policy set out above be adopted.
In accordance with the City Council's request at their last meeting, the
appraisal for the acquisition of property for the widening of Cherokee at its
intersection with Downey is approximately $7250. It was requested by the City
Manager that Council authorize the appropriation of this amount for the acquisi-
tion of land and if the acquisition of this property from the owners should
fail, then the City Attorney should proceed with condemnation.
It was also requested that $900 be allocated for the improvement of
Foster Road (paving).
It was moved by Councilman Temple, seconded by Councilman Giddings and
passed by the following vote to approve the appropriation of $7250 for the
acquisition of property for the widening of Cherokee and $900 for the paving
of Foster Road as outlined in the City Manager's report.

It was recommended that Council authorize the following expenditures

3. Account No. 10055 - Metal Awning at Corp. Yard 2000.00
4. Account No. 13000 - Acquisition of Land - Cherokee & Downey 7250.00
5. Account No. 13000 - Mercury Vapor Lighting, 3rd & Brookshire 6300.00
$17,385.00
It was moved by Councilman Corbin, seconded by Councilman Giddings and
passed by the following vote to authorize the following budget transfers as
outlined above:

It was recommended that Council authorize transfer of funds from the
Capital Improvement Fund No. 2000 -699 to the Cooperative City Street Projects
Fund, Account No. 1- 4130 -681 - Public Works, for the following projects which
previously had been authorized by minute action of the City Council:
1. Hall Road - Lakewood to Woodruff - Reconstruct street in
conjunction with A.D. #57 $15,000.00
2. Imperial Highway - Ardis Way westerly - Complete curb and
gutter and extend pavement 600.00
3. Quill Drive - West of Paramount - Extend pavement to join
curb and gutter 600.00
4. Rio Hondo Place - West of Old River School Rd. - Construct
drainage pipe to drain surface flows 2,500.00
5. Adenmoor Ave. - Southerly of Imperial - Construct full
street improvements adjoining Fire Station 7,000.00
6. Phlox St. - Westerly of Downey Avenue - City's share of
A.D. #33 3,000.00

It was moved by Councilman Temple, seconded by Councilman Corbin and
passed by the following vote to provide sufficient funds to cover items
listed in the cooperative street program above the council authorized, trans-
fer of $25,000 from Account No. 2000 -699 to Account No. 13000 to be added
to the $25,000.previously.allocated for improvement projects for the current
year, making a total for-these projects of $50,000.00. (Actual projects
approved in this program now total $40,850.00, leaving a balance of $9,150.00
in the $50,000 cooperative street program.)

It was reported by the Deputy City Clerk that the sewer constructed
under Private Contract #5517 in the alley south of Telegraph Rd. and
easterly of True Avenue has been completed. It was recommended that the City
Council consider the acceptance of this improvement for public use.
It was moved by Councilman Temple, seconded by Councilman Corbin and so
ordered to accept the dedication of the sanitary sewer for public use which
was constructed under PC #5517 (Telegraph Rd. & True Avenue).
After a summation of the bids received for preparing the floor, furnish-
ing and laying asphalt tile on the cement floors of the central hallway of
the City Hall, it was recommended that the bid of B & J Linoleum & Shade Co.,
the only bid received, be accepted and the bid awarded to them for the
preparation and installation of "C" Grade Asphalt Tile for the sum of $942.58.
It was moved by Councilman Temple, seconded by Councilman Corbin and
passed by the following vote to award the bid for hallway tile for the City
Hall to the B & J Linoleum & Shade Co. in the amount of $942.58.
