OF THE CITY OF DOWNEY
HELD JUNE 13TH, 1960
The City Council of the City of Downey held a regular meeting in
the Council Chamber of the Downey City Hall at 7:30 P.M., June 13th, 1960, .
Mayor Hollis M. Peavey, presiding.

The Mayor announced that this is the time and place for the hearing of
protests or objections against the assessment for improvement of Dempster
Avenue and Prichard Street.
The Mayor asked the City Clerk if she had the following affidavits:
1. Affidavit of Publication.
2. Affidavit of Posting.
3. Affidavit of Mailing.
The City Clerk answered she did have the affidavits of publication,
posting and mailing.
It was moved by Councilman Temple, seconded by Councilman Corbin and
passed by the following vote that the affidavits of publication, posting
and mailing be received and filed.

The Mayor asked if there were any written protests. There were none.
The Mayor then asked if there were any oral protests. No one came forward.
There being no written and no oral protests, it was moved by Council-
man Corbin, seconded by Councilman Temple and passed by the following vote
that the hearing on Dempster Avenue improvements, A.D. #42 (sidewalks) be
closed.

RESOLUTION NO. 606

CONFIRMING THE ASSESSMENT FOR THE IMPROVEMENT OF DEMPSTER
AVENUE AND PRICHARD STREET
The resolution was read by title only. It was moved by Councilman
Temple, seconded by Councilman Giddings and so ordered that further reading

The Mayor announced that the time had arrived for the hearing on the
application of Mr. James Shubin d /b /a Santa Fe Springs Cab Company.
The City Clerk reported that she has the application and that it had been
duly advertised.
The City Manager reported that the application by Mr. Shubin for operation
of a taxicab company in the City of Downey had been investigated by the Chief
of Police and that everything seemed to be in order, and that the schedule of
fares would be the same as now exists with the Southeast Cab Company.
The Mayor asked if there were any protests.
Mr. Wesley Ballard, operator of the Southeast Taxi, protested in that
he feels his company adequately handles the City of Downey for taxi service
to its citizens. Mr. Ballard's atto m ey, Mr. Mark F. Joseff, reviewed the
city ordinance covering taxicabs and the issuance of the permits to the two
cab companies under that ordinance two years ago. He questioned whether the
necessity and convenience, particularly of the citizens of Downey, would be
served with the addition of a second cab company, or would it impose a
difficulty on the Southeast Cab Company.
After discussion by the Council, it was moved by Councilman Temple,
seconded by Councilman Giddings and passed by the following vote that the
hearing on the application of Mr. James Shubin d /b /a Santa Fe Springs Cab
Company be closed.

Mr. W. A. Wilson, President of the Downey Chamber of Commerce presented
a report of the accomplishments of the Chamber in the past year. He
requested consideration by the Council of allocation of $1291.66 per month
or $15,500 per year from the City of Downey to the Chamber of Commerce.
The Mayor stated that Mr. Wilson's request for funds from the City of
Downey will be referred to the budget committee.
Councilman Dunnum arrived at the meeting at 7:55 P.M.
It was moved by Councilman Giddings, seconded by Councilman Temple and
passed by the following vote that the minutes of the meeting of May 24, 1960
be approved as corrected.

The City Clerk read the following written correspondence:
A letter from Mr. William P. Wilson, Attorney representing Helen Sachs,
appealing the decision of the City Planning Commission of Zone Exception
Case #180 to establish and maintain a parking area at 8324 Sixth Street. The
proper deposit of $50.00 had been made.
It was moved by Councilman Giddings, seconded by Councilman Temple and
so ordered that a hearing be set on Zone Exception Case #180 for 8:00 A.M.,
June 28, 1960, in the Council Chamber of the Downey City Hall.
The City Clerk presented a letter of appeal which had been accompanied
by the required $50.00 deposit, from Mr. Wilfred and Mrs. Olive Fleming in
Zone Exception Case No. 184, to establish, operate and maintain an appointment
barber shop in a separate building with an adjoining parking area.
It was moved by Councilman Temple, seconded by Councilman Corbin and so
ordered that a hearing on Zone Exception Case No. 184 be set for 8:00 A.M.,
June 28, 1960, in the Council Chamber of the Downey City Hall.
The City Clerk continued reading the following correspondence:
A letter from James T. Fickes, Architect, reporting the National Life
and Accident Insurance Company has completed their office building at
12105 Paramount Boulevard with all off site improvements completed, including
gutters, curbs and sidewalks. It was during the initial stage of development
that these voluntary improvements were agreed on and the Downey Building
Department stated that the adjacent patching of street work would be put in by
the City, as this would be handled by gas tax money. It was requested by the
owners that this patch work be done as soon as possible as it is quite a
traffic hazard, since the areas to the north and to the south are completely
smooth. The Director of Public Works was asked to check into this matter and
to report to the Council.
A copy of a letter which had been written by Supervisor Frank G. Bonelli
to the Assistant State Highway Engineer in Los Angeles referring him to a
letter from Supervisor William J. Phillips of Orange County regarding the
divided highways.
A letter from Mrs. Lenna Aldridge, a member of the League of Women Voters,
who desired to share with the Mayor and City Council the interest and
enthusiasm that was shown in the combined annual municipal report and the
League's Know Your Town Study at a League annual State Council meeting.
A letter from Mr. T. J. Barrett, President of the Downey Youth
Athletic Coordinating Council indicating their concern about the future
recreational picture in the event the voters would elect to dissolve the
present Downey Recreation and Park District and place the function under city
management.
A letter from Harold Cummins, President, North Downey Pony League
commending the City of Downey Recreation and Park District headed by
Mr. Ray Goates, Supt., and his able staff; i. e., Mr. Mel Hombs, Recreation
Director, and Mr. Fritz Howell, Activities Director. Mr. Cummins stated
the Downey Recreation and Park District is doing a wonderful job in the eyes
of this small group in the City.
A letter from Ruth W. Connor, Treasurer of the Downey Museum of Art,
accompanied by a financial statement for the calendar year 1959. To pursue
their program in the best interests for the citizens of Downey, it is
requested that the City allocate to the Downey Museum of Art the sum of $6,000.
The Mayor stated that this matter would be referred to the budget committee.
A letter from the Downey Chamber of Commerce outlining their budget
of $38,536.00 for the coming year and reporting the accomplishments for the
past year and requesting an allocation of $15,500.00 from the City as outlined
by Mr. William Wilson earlier in the meeting.

A claim for damages from Lurdean Evens by H. H. Hegner, Jr., her
attorney. Ms. Evans was injured in the City of Downey on a public sidewalk.
The claim had been referred to Mr. Kendall who stated it should be denied
by the City and referred to the insurance company. The City Attorney had
also reviewed the claim and recommended denial.
It was moved by Councilman Dunnum, seconded by Councilman Temple and
passed by the following vote that the claim of Lurdean Evans be denied.

The City Clerk read a letter addressed to ROno Sirrine, Downey Recrea-
tion and Park Board, to be signed by the Mayor, to clarify the recent mis-
understanding which may have been generated relative to the future of the
Park District. The letter outlined the City's belief that if the Recreation
and Park District were consolidated with the City, additional benefits would
be derived by all concerned. The City Council also wished to assure the
members of the Park Board that the City would budget each year an amount at
least equal to the current 25p, tax rate under which the Downey Recreation
and Park Board has been operating.
It was moved by Councilman Giddings, seconded by Councilman Temple and
passed by the following vote to authorize the Mayor to sign the letter to
Reno Sirrine and present it to the Park and Recreation Board.

Mr. Mortimer Lowy of 10336 Hasty Avenue, Downey, spoke on behalf of the
Downey Art Museum and outlined their program, reporting that they now have
art classes.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING SECTION 3158 OF THE DOWNEY MUNICIPAL CODE,
WHICH SAID SECTION RELATES TO PARKING
The ordinance was read by title only. The City Manager reported that
a further survey of the Downey Municipal Code relative to prohibiting parking
on any street which does not exceed 20 feet indicates that these provisions
are now covered under Section 3158 and it is not believed necessary to amend
this section. No action was taken by the City Council.

AMENDING SECTION 9102.1 OF THE DOWNEY MUNICIPAL CODE

The ordinance was read by title only. Mr. William Goggin gave a
resume of Zone Change Case #49 relative to the west side of Downey
extending north from De Palma to the Y.M.C.A. permitting multiple
residential units and relative to vacation of ingress and egress rights
along the alley for possible future development.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING AND APPROVING THE MASTER AGREEMENT FOR EXPENDI-
TURE OF FUNDS ALLOCATED UNDER SECTION 2107.5 OF THE
STREETS AND HIGHWAYS CODE
The resolution was read by title only. The City Manager reported
that the City of Downey will receive approximately $7500 as their annual
engineering allocation from the state for the 1960 -61 fiscal year. This
money may be used to support the Engineering Department in any of the
Public Works programs and the agreement is a standard annual document
for that purpose.

Mr. Barhite, Director of Public Works and Street Superintendent, pre-
sented the report for the improvement of assessment District No. 33
(Phlox Street and Pivot Street) showing the amount of $60,629.64 to be
assessed to the district. The report was presented pursuant to Division 4
of the Streets and Highways Code, being the Special Assessment Investigation,
Limitation, and Majority Protest Act of 1931, covering the proposed acquisi-
tion of necessary rights of way and construction of curbs, gutters, pavement
and drainage structure under Improvement District No. A.D. 33 which was
filed with the City Clerk.

ESTABLISHING ITS POLICY IN CONNECTION WITH THE CURRENT
ISSUE BETWEEN THE CITY AND THE DOWNEY COUNTY WATER
DISTRICT (FUTURE MUNICIPAL CITY WATER SYSTEM)

The City Attorney reported that the complaint had been filed against
the Downey County Water District and that a copy had been left with the
attorney for the Water Company.
It was moved by Councilman Dunnum, seconded by Councilman Giddings
and passed by the following vote that the firm of Burke, Williams and
Sorensen be authorized to proceed forthwith with quo warranto proceedings
to test the validity of the City's position in the water issue as against
that of the Downey County Water District.

After a summation of bids received for the construction of the im-

Mr. King reported that a petition had been received from the residents
of the 9000 block of Lyndora Street, requesting the City Council to install a
street light on a steel pole, replacing the existing light now located on a
wooden pole. The light wasoriginally installed on a wooden pole because the
pole was suitably located and it was also needed for other domestic
electrical service. Recently the domestic electrical service has been re-
moved from this pole, leaving only the street lighting circuit. It was
recommended that the City Council approve the installation of a street
light mounted on a steel lighting standard on the north side of Lyndora
Street adjacent to 9093 and that the cost thereof, estimated at $135.00 be
paid out of the reserve fund of the Gardendale Lighting District.

Mr. King reported that the improvements have been completed as required
in Tract #21840 - Dos Rios Road & Bluff Road, however there have been certain
problems arise through the course of the development of the individual lots
along the northwesterly side of Dos Rios Road. These lots were graded to
drain away from the street. Because of the method of grading and development
of the lots, there has been considerable soil erosion along the back portions
of these lots. Some improvements have been constructed in such a manner as
to be subject to inundation during rainy seasons. The discrepancies are
beyond the limits of the dictates of the Engineering Division and are not
covered in the agreement or the improvement bond for the development of the
public rights of way.
The Mayor stated there should be set provisions to cover drainage in
new subdivisions and that it should be included in the subdivision ordinance.
The Director of Building & Safety reported that this will be included in the
building code as a grading ordinance.
The assistant secretary of J. E. Riley and Sons, 2010 S. Los Angeles St.,
Anaheim stated he did not feel the money should be held up for the street
improvements due to difficulties encountered in the lots. Mr. Goggin was
asked to check the records in his department to determine if there had been
any definite grading requirements in the original plans and report later in
the meeting on his findings.
After a summation of the bids received for the purchase of a power street
sweeper, it was recommended that all bids be rejected. It was also recom-
mended that the City Manager be authorized to negotiate for the purchase of
a power street sweeper with the Conveyor Company at a cost not to exceed
$9,739.00.

Mr. William Goggin returned with the information that in Tract #21840
the proposed lot grading was to be that all the lots facing the flood
control would drain to the flood channel. The first 50 or 70 feet of the
lots were fairly uniform as to grading, then there was a drop -off which
caused the drainage problem.

The City Clerk advised that Districts 4 and 5 have a vacancy on the
Library Board whose members are appointed by resolution by the City Council.
It was recommended that these appointments be made in order to have them
approved at the next Council meeting.
Chief Robinson of the Police Department reported on the completion of
the first year of the School Boy Patrol and read an honorable discharge
which is to be presented those patrols who will be graduating. He
requested Council confirmation and approval of this form which recognizes
the fine job the school boy patrols have done.
The Mayor and Council confirmed the action of presentation of honorable
discharges to the graduating school boy patrols and commended them on the
wonderful job which they have done this past year.

so ordered that the Mayor send a letter of commendation to the school boy
patrol for the good job well done.

The City Manager reported a new bus route has been mapped out and
that the Cross Town Bus Line manager, Mr. Carson, has agreed to eliminate
Route #2 (Downey Manor) and to re- route 'it ° to -service the triangle area,
and to have Route #1 go into Rancho Los Amigos effective July 1, 1960.
Councilman Dunnum expressed his desire to have an over -all goal to
attempt to require half -hour service on all lines.

the contract between the City of Downey and the Cross Town Bus Line to

Frank T. Hamilton, Attorney, 458 S. Spring Street, Room 1004, Rowan
Building, Los Angeles, representing Ralph and Betty Lucci, requested a
continuation on the suit filed by the City against the Lucci's, and reported
on the progress made in the development of the Lucci property and of proposed
possible uses to which the property on Paramount Boulevard could be put.
Mr. Hamilton requested the City Council to instruct their city attorney to
give further extension of time to make a market research to determine the best
use of the property in question.

passed by the following vote that in the case of City of Downey vs. Lucci, et al.,
the Lucci's be granted an extension of time to plead until June 28, 1960, on
condition that Mr. Frank Hamilton, the attorney for the Lucci's, present to
them a proposed plan whereby the Lucci's would deposit with the City the amount
sought by such lawsuit. That in the event such agreement is entered into and
such deposit of money is made with the City not later than June 28, 1960, then
the Lucci's would have a period of time set forth in the agreement to complete
a market analysis of the subject property. That at the end of such time if
the market analysis were not favorable for the development as proposed, then
the City to have the right to use the monies so deposited for the purpose of
completing the improvements under the existing subdivision contract. That in
the event no such agreement is entered into and no such deposit is made, then
the City Attorney is instructed to proceed forthwith with the pending litigation;.

Mr. Kenneth Hunter, 12029 S. Horton, Downey, reported a parking condition
on Horton. The resideRoes in the block are all single family dwellings with
single car garages. Some families on the block have graduated to 2, 3 and
in one instance, a 4 -car family. The parking of these cars on the street
causes difficulty in entering and leaving the driveways. Also, 24 -hour parking
is present a great deal of the time. Another item he brought up was the
parking of a house trailer on the setback of the driveway of one family and
actually parking in the front yard.
Mr. Hunter was instructed to contact the Planning and Zoning Department
for remedying the problem of the parked house trailer. The traffic engineer,
Mr. Hal Durham, was instructed to investigate the parking problem and make his
report to the City Council.
Deputy Chief Loren Morgan of the Police Department introduced the new
Civil Defense Director, Vincent J. Young, and gave a resume of his background.
The Mayor welcomed Mr. Young and stated he was happy to have him join
the forces of the City of Downey and hoped that he would be happy working with
the City.
The Mayor read an excerpt from the League of California Cities' bulletin
with relation to home rule relative to working conditions of city employees.
The Mayor recommended sending a resolution to Assemblymen and the State
Senator wherein they would advise us of any request coming before them
relative to working conditions, salaries, etc. pertaining to city
employees which might upset "home rule ". The City Attorney was instructed
to draw the resolution along those lines.
The meeting was adjourned by Mayor Peavey at 11:45 P.M. to 2 :30 P.M.
