MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
HELD MAY 24TH, 1960
The City Council of the City of Downey held a regular meeting
in the Council Chamber of the Downey City Hall at 8:00 A.M., May 24th,
1960, Mayor Hollis M. Peavey presiding.

delivered the invocation.
It was moved by Councilman Temple, seconded by Councilman Giddings
and so ordered that the minutes of the meeting held on May 9th, 1960, be
approved as corrected.
The City Clerk read the following written correspondence:
An announcement of a testimonial dinner honoring Mayor George C.
England of Inglewood Tuesday evening, June 14, at the Hollywood Turf
Club in Inglewood at 7:30 P.M.
An announcement of the Federation of Community Coordinating Councils`
meeting May 25, 1960, at 10:30 to noon, at the Union Oil Center in
Los Angeles on the 1960 White House Conference on Children & Youth.
A letter from the County of Los Angeles Federation of Community
Coordinating Councils to attend the Seventh Annual Presidents Recognition
Banquet honoring Presidents of Community Coordinating Councils, at 6:45 P.M.,
on Wednesday, June 1, in the Regency Room at the Sheraton West Hotel.
A letter addressed to the Engineering Department from R. K. Goates,
Superintendent of the Downey Recreation and Park District, expressing
appreciation for the assistance of its survey crew in marking out the
location of the foul lines on the ball diamonds at Rio San Gabriel Park.
A letter addressed to Mayor Peavey from Charles K. Bergin, Rear
Admiral of the U. S. Navy, congratulating him and the fine people of the
community for the spirit of generosity so notably exhibited in the recent
"Count Your Blessings" project. It has been an honor for the Mine Force,
U. S. Pacific Fleet to cooperate with the City in such a worthwhile cause.
A report on the results of the distribution of clothing will be forwarded
when the mission is completed.
A letter from the Central and West Basin Water Replenishment District
reporting that under Section 60325 of the California Water Code, notice
of the levy of a water replenishment assessment must be given to operators
of water producing facilities and in accordance therewith, on April 21,
1960, the Board of Directors of the District levied an assessment of $3.19
on each acre foot of ground water to be produced through water producing
facilities located within this District during the ensuing fiscal year
commencing July 1, 1960, and ending June 30, 1961.
A transmittal letter from the City of Norwalk with a resolution
regarding moving picture industry which was passed by their City Council.
A letter from Donald W. Niemand, President, Downey Mixed Chorus,
presenting a token gift of one dollar as a first step toward the
building of a Downey Civic Auditorium.
The City Manager was instructed to submit a letter of acknowledg-
ment advising the Downey Mixed Chorus the token will be held until
further studies are conducted in the future.
A letter from the City of South Gate advising that at the last
.— Council Meeting held in their city a revision of charges for the care
of Downey's prisoners in their City jail was authorized. The new charge
will be $4.20 per prisoner and will commence effective July 1, 1960.
It was moved by Councilman Temple, seconded by Councilman Corbin
and passed by the following vote to authorize the Mayor to execute the
agreement between the City of South Gate and the City of Downey for
the City of Downey to use the jail services of the City of South Gate
with a charge of $4.20 per prisoner, effective July 1, 1960.

A letter was read from Emerson G. Krieger, Census District Supervisor,
making a preliminary announcement of the population of Downey with the
figure being 83,828 at the census count to date, taken as of April 1, 1960.
The City Manager reported that the preliminary budget had been
predicated upon an estimated population of 85,000.
ORDINANCE NO. 144
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING TO CHAPTER
9 OF ARTICLE II, SECTIONS 2900 THROUGH 2909, WHICH SAID
SECTIONS ESTABLISH RULES AND REGULATIONS FOR THE PURCHASE
OF SUPPLIES, SERVICES, AND EQUIPMENT
The ordinance was read by title only. It was moved by Councilman
Temple, seconded by Councilman Giddings and so ordered that further
reading be waived.
It was moved by Councilman Giddings, seconded by Councilman Temple
and passed by the following vote that Ordinance No. 144 be adopted.

RESOLUTION NO. 605
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AUTHORIZING THE ISSUANCE AND SALE OF BONDS ON ASSESS-
MENT DISTRICT NO. 14 (BENEDICT AVENUE)
The resolution was read by title only. The City Attorney ex-
plained that the resolution sets the time for receiving the bids for the
sale of bonds for Benedict Avenue for 8:00 A.M., June 28, 1960, and also
for the opening of bids for construction.
It was moved by Councilman Temple, seconded by Councilman Giddings
and so ordered that further reading be waived.
It was moved by Councilman Temple, seconded by Councilman Corbin
and passed by the following vote that Resolution No. 605 be adopted.

The Director of Public Works reported that the sanitary sewer located
in Paramount Boulevard between Albia and Duesler which is being offered
for dedication by the D.B. & E. Construction Company, Inc., has been com-
pleted and it is recommended that Council approve the work and accept for
public use the sanitary sewer so offered.
It was moved by Councilman Temple, seconded by Councilman Corbin and
passed by the followong vote that the work under P.C. -5335 be approved for
sanitary sewers in Paramount Boulevard between Albia and Duesler and be
accepted for public use.

The City Attorney reported that he has talked ;to the Attorney
General's office several times within the past month and that he is
continually being assured that the opinion on the matter pending
relative to the City's water suit has been written by one of the
subordinantes and it is just waiting the final approval by Eugene
Jacobs. The City Attorney hopes to have the decision within a
couple of weeks.
A petition was presented to the City Clerk by Mr. Tad Macia,
10208 S. Lakewood, Downey, protesting against the proposed island
divider at Florence and Lakewood intersection.
Also present to speak against the island divider were:

R. E. McCallum, Realtor, representing Arrington Square
After lengthy discussion it was moved by Councilman Giddings,
seconded by Councilman Dunnum and passed by the following vote to
request the State Division of Highways to delete the concrete barrier
on Florence Avenue from the contract.

It was moved by Councilman Dunnum, seconded by Councilman Temple and
passed by the following vote that the Traffic Engineer be authorized and
directed to prepare a counter proposal for left -turn bays on Florence
Avenue to be submitted to the State Division of Highways simultaneously
with the request for deletion of the concrete barrier.

It was moved by Councilman Giddings, seconded by Councilman Temple and
passed by the following vote that the sub - committees under the Public
Safety Committee be dissolved and four new committees created with each
Councilman appointing one member to each of the four committees.

It was moved by Councilman Temple, seconded by Councilman Giddings
and so ordered that the City Manager be instructed to notify each member
of the previous citizens committees to thank them for their good work and
to notify of reappointments.
Mr. John J. Cayer, 10840 Atlantic Avenue, Lynwood, representing the
Cross Town Suburban Bus Lines, submitted a proposal to the City Council
for continuance of the southern route at a cost to the City of $500.00
per month and at such time as they can supplement this route with Cross
Town Suburban routes through P.U.C. approval, to assume full responsibility
and costs eliminating the $500.00 per month support of the City, and to
assume the advertising and benches. Cross Town officials state that if
they can get approval from the P.U.C. for that purpose, they will be able
to implement a new route from Lynwood to supplement the present routes
from Norwalk, Santa Fe Springs, Pico Rivera and Huntington Park.
Councilman Dunnum suggested that he was vehemently against an inter-
city bus service and wished to keep it a local bus service. He stated
it might be advisable to run the buses every half hour instead of hourly.

Suggestions were also made to extend the bus service into the
t riangle area and to Rancho Los Amigos.
It was moved by Councilman Giddings, seconded by Councilman Temple
and passed by the following vote that Downey Mnnicipal bus route #1
be continued as it has been established; that Route #2 be discontinued
to the north and be altered to start in the triangle area and extend
into the Rancho Los Amigos area.

The City Manager was instructed to work out the modification of
bus route #2.
Councilman Temple requested a report from the Chamber of Commerce on
Merchants' participation in script for the municipal buses.
The City Manager noted that the City's insurance company has advised
that during the past three years the insurance rate of 27F per $100 has
been reduced four times with the last reduction published April 21, 1960,
bringing the current insurance rate down to .095 or 9z(,, per $100 per
year. This reduction will save the City approximately $260 per year upon
an approximate valuation of $1,031,218 of City property.
Authority was requested to transfer $569 from the accounts listed
below to provide sufficient funds for the purchase and installation of one
additional air conditioning unit in the Engineering Annex:

Instruments; 1 -4020 -654 - Radio Equipment; 1- 4020 -695 - Special Reports;
to Account No. 1 -4020 -612 - Furniture and Fixtures.

The City Manager reported that originally the budget was set up-for
retirement charges on the basis of 7 per cent for non - service personnel
and 11 per cent for service personnel. Actual retirement figures amount
to 8.97% for all personnel which necessitates these transfers. The
overall figures are the same and this will bring each retirement account
up to the proper amount in each department. Transfer is requested of
$2015 from Account No. 9 -3040 -531, Police Department; and $2,015 from
Account No. 9-3530-531, Fire Department, to cover deficiencies in all
non - service departments, totaling $4,030 as included in the present budget.

It was moved by Councilman Temple, seconded by Councilman Dunnum

It was moved by Councilman Giddings, seconded by Councilman Temple

Mr. King reported that $1,000 per month had been included for bus
subsidiary in the preliminary budget for 1960 -61.
A joint meeting of the City Council and the Park Board was announced
by Mr. King to be held on May 24, 1960, at 7:30 P.M. in the conference room
in the rear of the Council Chamber.
The City Manager reported an application has been received from a
taxi company operated by Mr. James Shubin as the Santa Fe Springs Cab
Company and it was recommended that Council set a hearing sometime after
June 1, probably for June 13, at 7:30 P.M. in the Council Chamber of the
Downey City Hall. So ordered by Mayor Peavey.
Numerous inquiries regarding construction of fallout shelters have
been received by the City and the City Manager requested that Council
authorize the City Attorney to set up a revision of the present building
code to waive fees for fallout shelters for residences.

and passed by the following vote that the City Attorney be authorized to
prepare a revision to the Downey Municipal Code waiving fees for fallout
shelters for residences.

Mr. King reviewed the matter of improvements on Hall Road for which
Council had previously authorized $15,000 for participation in this project.
It has been determined that Aerojet will participate in more than 50% of
the improvements on Hall Road. The City Manager advised that the City °s
share probably would exceed the $15,000.
Inasmuch as the street is of real importance to the industrial area
and improvements thereon would alleviate a flooding condition during the
rainy season, it was moved by Councilman Dunnum, seconded by Councilman
Corbin and passed by the following vote authorizing the City to participate
in' street improvements on Hall Road with utilization of the $15,000 previ-
ously authorized.

L. V. Prosser, 8203 Arnett, made inquiry about buffer strips being
taken out in the matter of Zone Exception Case No. 185. The Council
advised Mr. Prosser of his rights of appeal.
There being no further business to come before the Council, the
meeting adjourned at 10:30 A.M.
