Peavey presiding. PRESENT: Councilmen: Temple, Corbin, Peavey ABSENT: Councilmen: Dunnum, Giddings ALSO PRESENT: Oren L. King, City Manager Glenn Kendall, Assistant City Manager Richard Barhite, Director of Public Works LeGrande Leavitt, City Engineer Ivan A. Robinson, Chief of Police Robert Gain, Fire Chief Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend Frank Peters of the First Baptist Church, delivered the invocation. Mayor Peavey announced that now is the time and place set for the continuation of the hearing on Stamps Avenue improvements, A.D. #24. It was reported by the City Manager that subsequent to the last report submitted, it has been brought out that an existing road easement indicates further study and, therefore, recommended that the hearing be continued to May 9, 1960 so that the above- mentioned conditions may be thoroughly checked. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that the hearing on Stamps Avenue improvements, A.D. #24 be continued to 7:30 P.M., May 9, 1960, to the Council Chamber of the Downey City Hall. It was moved by Councilman Temple, seconded by Councilman Peavey and so ordered that the minutes of the Council Meetings of April 11, 1960 be approved as corrected and of April 18 and 19, 1960 be approved as written. The City Clerk read the following written correspondence: A letter from A. L. Himelhoch, District Engineer of the Division of Highways with reference to a letter dated February 5, 1960, written by Mayor Peavey relative to the City's proposal for channelization of Firestone Boulevard in the City of Downey. The study is expected to be completed in about a month and as soon as possible after its completion, a decision will be made regarding the plan submitted by the City of Downey and the Division of Highways will further advise the City. A letter from the County Boundary Commission advising of a proposed annexation to the City of Maywood. A letter from the Division of Housing advising of a Governor's Conference on housing to be held June 13 -14 -15 at the Hotel Statler- Hilton in Los Angeles. They asked to be notified at the earliest opportunity of the designation of the officials who will represent the City of Downey. A letter of apology for failing to appear and give the invocation at the meeting at which the new City Council was installed and offering congratulations to the new Councilman, Ben Corbin, and the two reelected Councilmen, Carroll M. Dunnum and Hollis M. Peavey. !A�', A letter from Joseph R. Grillo, President - Elect, Southeast District Bar Association, relative to a short ceremony celebrating LAW DAY which is being observed throughout the nation on May 2, 1960. The local ob- servance is set for 9:00 A.M., Monday, May 2, 1960, in the Courtroom of Department Southeast "B ", of the Los Angeles County Superior Court, located at 8620 California Avenue, South Gate, California. Councilman Dunnum has agreed to represent the Mayor in extending a few remarks identifying the City of Downey with LAW DAY. A bulletin from the League of California Cities announcing the City Clerks' Institute at Berkeley, May 4, 5, and 6, 1960. Permission was requested by the City Clerk to attend. The City Manager also requested approval of the City Council for the Assistant City Manager and Director of Finance to attend. It was moved by Councilman Temple, seconded by Councilman Peavey and passed by the following vote to authorize attendance by the City Clerk and the Director of Finance to attend the City Clerks' Institute in Berkeley, May 4, 53 and 6, 1960. Sorensen regarding Downey Contract No. 19, Woodruff and Eglise Avenues, relative to liquidated damages in the amount of $1400.00 which the contractor has disputed. The contractor has offered to compromise the matter by the City's paying to the contractor $700.00 of the amount now withheld. The City Attorney recommended that such a compromise might be advisable considering the ex- pense of litigation and the loss of time of various employees. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote to approve the contractor's compromise with payment to the contractor of $700.00, to be made from the unappropriated reserve fund. AYES: 3 Councilmen: Temple, Corbin, Peavey NOES: 0 Councilmen: None ABSENT: 2 Councilmen: Dunnum, Giddings The City Manager reported that approximately 69% of the property owners on Rivergrove Drive, extending northerly of Glencliff Drive along the west side of "the island" have signed an informal petition for the improvement of this street. The estimated cost of an assessment district for this improvement is $38,000.00. The engineering cost, therefore, to take this project to a public hearing is estimated at $4500.00. In view of this rather large expenditure, and the fact that the people signed only an informal petition, it is suggested that the City Council authorize the following: a. The expenditure of $1200.00 to complete the preliminary engineering required to tentatively establish grades and determine solutions to drainage problems and arrive at a more precise estimate of costs to the district. b. City forces to enter upon the private street to perform such field surveying as is necessary to determine the information outlined above. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote that authority be granted for the expenditure of $1200.00 to complete preliminary engineering required to tentatively establish grades and determine solutions to drainage problems and arrive at a more precise estimate of costs to the district for improvement of Rivergrove Drive, A.D. #58. The amount of the agreement was $72,667.00. Extra work required to modify certain traffic signals amounted to $338.25, making the total cost of construction $733,005.25. It is recommended that the City Council take the following action: a. Accept the work performed by the contractor. b. Authorize the recording of the Notice of Completion. c. Authorize the City Engineer to spread the assessment. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote to approve acceptance of the work per- formed by Fishback and Moore, Inc. in A.D. #20, Downtown Street Lighting (Firestone Boulevard); authorize recording a Notice of Completion and authorize the City Engineer to spread the assessment. AYES: 3 Councilmen: Temple, Corbin, Peavey NOES: 0 Councilmen: None ABSENT: 2 Councilmen: Dunnum, Giddings The Traffic Committee made an investigation as requested by the City Council relative to the need for traffic signals at Florence Avenue and Lexington & Gallatin Road (Brookshire) and at Wiley Burke Street and Florence Avenue. Based on the analysis contained in the Traffic Committee's Report, it was recommended that traffic signals be installed at Lexington and Gallatin Road. It was moved by Councilman Peavey, seconded by Councilman Corbin and passed by the following vote to authorize proceeding with preparations to install traffic signals at Lexington & Gallatin Road and Florence Avenue and at Wiley Burke and Florence Avenues. Peterson Company, in the amount of $68,797.70, and that all other bids be rejected. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote that Contract #39 be awarded, subject to the approval of the City Attorney, to the lowest and best bidder, Eric L. Peterson Company, in the amount of $68,797.70, and that all other bids be rejected. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote to approve the plans and specifications and authorize a call for bids under Contract #41 for resurfacing of an additional 8 miles of City streets. The amount of the original contract was $27,540.89. The final cost of construction is $28,675.05, with a difference of $1,154.16. The increase of the final construction cost over the bid is outlined in Item #4 of the City Manager's Report. This sewer is located on Gurley Avenue just southerly of Manatee Street and is offered for dedication by Harry K. Sindell. It was moved by Councilman Peavey, seconded by Councilman Corbin and passed by the following vote to accept for dedication of the sanitary sewer constructed under P.C. -5406. Based upon these appraisals and after further conferences with officials of Kirkhill and Aerojet, the following recommendation was submitted: a. That the City Council authorize the payment of $6,073.99 to Holm -Royal (Kirkhill) for the acquisition of a strip of land 40'x1282.321. This amount of money is based upon the actual cost of improvements pre- viously installed by Mr. Royal and Mr. Holm and is reported by the appraisal of the property. b. That the Council authorize the payment of $5,501.00 to Aerojet for the acquisition of a strip of right of way 351- 37'x12721. This is also based upon previous improvements paid for by Aerojet and supported by the appraisal. Because there is some question as to the acquisition of the right of way from Kirkhill, the recommendation was changed to instruct the City Attorney to start condemnation proceedings. It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote that authority be granted to pay Aerojet $5,500.00 from gas tax funds and authorize the City Manager to enter into escrow for the acquisition of the strip of right of way 35- 37'x1272' and also that the City Attorney be instructed to start condemnation proceedings against Holm -Royal (Kirkhill) for the acquisition of the right of way which they hold. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote that an additional $20,000.00 be authorized from the Gas Tax Funds for the improvement of Stewart and Gray Road. Robinson of the Police Department announced that May l through May 7 has been proclaimed Burglary Prevention Week and it is hoped the public can be educated to take greater precautions to protect their families and homes from burglary. The City Manager reported that at the meeting held by the State Division of Highway Engineers relative to the procedures on freeway loca- tion, the Division of Highway Engineers stated that they were only in the preliminary studies of the actual possible location of the Century Freeway from its westerly extremity near the Los Angeles International Airport and Pacific Coast Highway and its easterly extremity at the Santa Ana Freeway. In accordance with previous studies relative to the best location for this freeway through the City of Downey, it was recommended that the High- way Commission consider the southern route between the south city limits of Downey and Gardendale Street. .--, It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote to instruct the City Attorney to draw a resolution indicating the City of Downey wishes the Century Freeway to follow the most southerly route along Gardendale Street. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the follo,,&g vote that the following transfer of funds be approved: Amount From To $292.00 1- 3030 -612 1- 3030 -621 50.00 it 1- 3030 -694 AYES: 3 Councilmen: Temple, Corbin, Peavey NOES: 0 Councilmen: None .—� ABSENT: 2 Councilmen: Dunnum, Giddings A further review of the need for the cooperation of the City with the Grace Baptist Church in completing the narrow paveout area between the existing pavement and their newly installed curb and gutters in front of the church on Quill Street has resulted in a further realization of the need to complete this as early as possible, according to the City Manager. This church has improved its property in a very commendable manner and has completed its curbs and gutters, as well as the walls around the church as requested by the City's Nanning Commission. It was sug- gested that consideration be given to the City's participation in this project amounting to approximately $600.00. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote to authorize the paveout in the amount of $600.00 on Quill Street in front of the Grace Baptist Church. It is suggested that authority be granted to recruit the Planning Director within a salary range of $800.00 to $950.00 per month and that the actual entrance salary be based upon the ability of the Director recruited in accordance with recommendation of the Personnel Board and final approvelof the City Council. It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote to authorize recruitment for a Planning Director for the City of Downey within a salary range of $800.00 to $950.00 per month. Temple, Corbin, Peavey None Dunnum, Giddings that a joint meeting of the City Council and has been tentatively set for Tuesday the conference room at the rear -of the Ar_34 Councilman Temple wished to commend the various groups such as the YMCA, High School Service Groups, etc. who assisted in the Cancer Crusade on Monday night, April 25, 1960, in which an area in his district received contributions of over $1500.00 for this good cause. Councilman Temple suggested that the City Manager be authorized to do some research relative to proposing a future ordinance for property owners to maintain their house to a degree that it will not lower the value of adjacent properties. There being no further business to come before the Council, the meet- ing adjourned at 9:30 A.M. City Cler Mayor
