MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
FEBRUARY 9TH, 1960
The City Council of the City of Downey held a regular meeting
in the Council Chambers of the Downey City Hall at 8:00 A.M. on
Tuesday, February 9th, 1960, Mayor Hollis M. Peavey presiding.

The invocation was delivered by Reverend Rodney T. Cogswell of the
Presbyterian Church of Downey.
The Mayor announced that now is the time and place for the hearing
on Benedict Avenue (A.D. #14).
The City Attorney reviewed for the City Council that at the original
hearing the resolution and notices prepared could not be approved because
there was not 4/5 vote present, and that the hearing which was reset had
not a necessary 30 -day interim. A new resolution is required resetting
the hearing to 8:00 A.M., Tuesday, March 22, 1960, in the Council Chambers
of the Downey City Hall.
RESOLUTION NO. 566
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
SETTING THE TIME AND PLACE FOR HEARING ON THE ACQUISI-
TION OF NECESSARY RIGHTS OF WAY, CONSTRUCTION OF CURBS,
GUTTERS, AND PAVEMENT IN ASSESSMENT DISTRICT NO. 14
(BENEDICT AVENUE)
The resolution was read by title only. It was moved by Councilman
Temple, seconded by Councilman Stamps and so ordered that further reading
be waived.
It was moved by Councilman Temple, seconded by Councilman Dunnum and
passed by the following vote that Resolution No. 566 be adopted, setting
the hearing on Benedict Avenue (A.D. #14) for 8:00 A.M., Tuesday, March 22,
1960, in the Council Chambers of the Downey City Hall.

The Mayor announced that now is the time and place for the hearing on
the work change on Elm Vista Drive (A.D. #21).
The Mayor asked if there was anyone present who wished to speak. No
one came forward.
Councilman Dunnum requested a report from Mr. King as to the results
of his meeting with Mr. Grider, spokesman for the group of citizens who had
requested the work change. Mr. King reported that Mr. Grider agrees with
the change in the work to be done in A. D. #21 (Elm Vista Drive) but would
protest installation of sidewalks. The plans do not call for the installa-
tion of sidewalks in this assessment district. It was therefore recommended
that a letter be sent to this effect to Mr. Grider.

RESOLUTION NO. 570
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DIRECTING A MEASURE TO BE PLACED UPON THE BALLOT FOR
THE GENERAL ELECTION TO BE HELD ON APRIL 12, 1960, SAID
MEASURE RELATING TO COMPENSATION OF COUNCILMEN
The resolution was read by title only.
Mr. Stephen Skinner, 8708 Imperial Highway, stated he wished to speak
on the matter as he feels that the item should be put on the ballot to be
decided by the vote of the people. He stated he feels the Councilmen have
been doing a find job and when the first municipal election was held the
measure quite possibly had not been submitted properly to the people for
their complete understanding. The original petition which was circulated
at the time of incorporation indicated compensation for the Councilmen but
by some error was not placed on the ballot.
Mr. William Wanamaker, Manager of the Golden Star Bank, concurred
with Stephen Skinner and added that with the City operating with approximately
$1,000,000 reserve, which can be accredited directly to the fine work of
the City Council who should be heartily commended, he also would like to see
the measure put on the ballot for the municipal election in April. He
presented examples and comparisons of salaries paid Councilmen in other cities.

Mr. King called attention to a warrant included in the Resolution in
the amount of $750.00 payable to the Downey Symphony Orchestra, represent-
ing total payment rather than monthly payments of $150.00 as had been
originally agreed between the City of Downey and the Downey Symphony
Association.

It was moved by Councilman Temple, seconded by Councilman Stamps
and passed by the following vote to authorize the contract between the
City of Downey and the Downey Symphonic Association be modified to
provide that the payment in the total amount of $750.00 be paid on or
before February 15, 1960, and that the Mayor be authorized to execute
the agreement on behalf of the City.

After a summation of bids for Florence Avenue improvements by the
City Manager, it was recommended that Contract #35 be awarded to the
lowest and best bidder, Eric L. Peterson, in the amount of $40,999.61.
The City Attorney reported that the bid had been properly signed and
that the proper bond has been submitted.

Florence Avenue be awarded to the lowest and best bidder, Eric L. Peterson
in the amount of $40,999.61, and that all other bids be rejected.

Mr. King reported that the traffic signal under Contract #33 at Clark
and Adoree had been properly installed and recommended acceptance of the
work and authorization of Notice of Completion.

The City Manager reported that the work on Parking Lot #2, Contract
#34 has been completed and recommended acceptance of the work and filing
Notice of Completion and authorize payment to the contractor.

Lot #2 be accepted and authorizing filing a Notice of Completion and payment

Mr. King reported that with the concurrence of the City Council, the
Director of Public Works has been requested to set up the following procedure
for completion of City street projects: Paveout 20' x 1350' on the east
side of Bellflower Boulevard between Hall Road and Stewart and Gray at a
cost of approximately $10,000 from the gas tax funds. The property owners
have agreed to pay the cost of curb and gutters if the City will make the
necessary paveout.

Mr. King reported that Assessment District No. 10, which provides
for the improvement of Verdura, Klondyke, Laureldale and other streets
southerly of Gardendale, and in the vicinity of Downey Avenue, also pro-
vides for certain improvements on Downey Avenue and Gardendale Avenue
which are major City streets.
Some time ago, the City Council authorized the budgeting of $12,000
to cover the cost of proposed improvements on Downey Avenue. The improve-
ments on the south side of Gardendale between Verdura Avenue and Laureldale
Avenue are estimated to cost approximately $5,000.00
It is recommended that the City Council authorize an additional $5,000
from accrued Gas Tax Funds in order that the City may cooperate in this
portion of the project.

passed by the following vote to authorize an additional $5,000 from accrued
Gas Tax Funds in order that the City may cooperate in improvement of major
City streets in connection with Assessment District No. 10.

The Mayor acknowledged Dr. O'Toole, William Wanamaker and Ed Schwaner
of the Rose Float Association. Mr. Wanamaker introduced Dr. O'Toole,
President, and Ed Schwaner, Vice President. Mr. Wanamaker submitted the
financial report of the Rose Float Association and requested aid from the
City of Downey to make up their $427.96 deficit.
Councilman Dunnum acknowledged the tremendous job the Rose Float
Committee has done this year and stated that they were one of the hardest
working groups that exists in the City of Downey.

passed by the following vote to approve payment to the Rose Float Association
by the City of Downey of the deficit of $427.96.

The Mayor stated that he was very grateful to Dr. O'Toole, Ed Schwaner
and Bill Wanamaker and the entire committee and proud of the float and the
work carried on this year which certainly was very outstanding.
Councilman Stamps concurred with Councilmen Dunnum and Peavey that the
Rose Float Association had done a splendid job.
Mr. King reported that the sewer on Morning Avenue and Cole Street,
P.C. 5250, has been completed satisfactorily and recommended acceptance and
dedication.

The City Manager reported that the work has also been satisfactorily
completed on the sewer at Deming Avenue and Gardendale Street, P.C. 5274,
and recommended acceptance of the work and dedication to the City,

Mr. Stephen G. Skinner, Chairman of the Planning Commission, reported
that the proposed Planning Ordinance was very well received by the public
at the hearing held on Monday night. There are some changes recommended:
a bit of liberalization in the sign area; and some changes in the maps. The
Planning Commission has taken under submission the maps and ordinance until
next Monday, February 15, 1960.
The City Clerk read the following written correspondence:
An announcement from the County Board of Supervisors of an alternate
boundary on the proposed corporation of the City of Cudahy.
A letter from the County Boundary Commission notifying of proposed
Annexation No. 3 and Annexation #1 to the City of Bell.
A letter from the Feather River Project Association requesting contribu-
tions to their program.
It was moved by Councilman Dunnum, seconded by Councilman Temple and so
ordered that the letter be accepted and filed with a further study and report
being made to determine whether or not use of the contributions is toward
building a dam in Northern California or to furnish additional water to
Southern California.
A letter from Earl Planett in appreciation of flowers sent in remembrance
during his sorrow.
A letter from Mt. Charles Clark of 7920 Leeds Street, Downey, stating
the property owners on Smallwood and Leeds are overburdened with assessments
and taxes and do not feel they Should have street lights.
A notice from the State Chamber of Commerce of the Conference on
Metropolitan Transportation Problems to be held February 24, 1960, at the
Fairmont Hotel in San Francisco.
A letter addressed to Mr. A. C. Gabriel from the firm of Burke, Williams
and Serensen indicating an overdue license fee on a Downey bowling alley has
been received and recommending that a letter be sent to Mr. Raymond C. Herold
at 333 West Foothill Boulevard, Monrovia, stating the check has been received
and that the penalties have been waived.

passed by the following vote to waive the penalties of the overdue license
and accept the check in the amount of $360.00 from Mr. Raymond C. Herold.

Mayor Peavey requested Messrs. Byron White and Frank Beckner to come
forward. These two gentlemen were then presented a Certificate of Merit
for their activities in which they headed up the lighting district on 2nd
and 3rd Streets and Firestone Boulevard.
Messrs. White and Beckner thanked the Mayor, and Mr. Beckner added that
he hoped to continue the lights onto Paramount Boulevard.
The Mayor then presented a Certificate of Merit to Councilman
James Stamps for acting as Mayor and devoting extra time away from his
personal affairs at added cost and time and money.
Mr. James P. Gillespie, 7214 Cleargrove, Downey, on behalf of the
Chamber of Commerce, Religious Activities Committee, requested setting
up the week February 21 through February 27 as National Brotherhood
Week. Mr. Gillespie read a sample proclamation.
It was moved by Councilman Temple, seconded by Councilman Stamps
and so ordered to endorse the proclamation as read by Mr. Gillespie.
Councilman Temple inquired about the possibility of paveouts on
Quill Drive and recommended that the City Manager bring back a report
on this item.
Councilman Dunnum stated that the presentation to Mr. Stamps for
his service as Mayor prompts him to offer an abject apology for not rec-
ognizing Councilmen Temple and Giddings by presenting them with one of
the scrolls. Councilman Stamps also offered his apology for this oversight.
It was moved by Councilman Dunnum, seconded by Councilman Stamps
and so ordered that the City Manager be directed to prepare scrolls for
presentation to Councilmen Temple and Giddings at the next Council
Meeting.
Councilman Dunnum reported that he has been studying the Police
Department and Court System and has noted an appalling number of police
officers sitting in vestibules at the Municipal Court, waiting to testify.
This is a serious waste of manpower and man hours. This situation should
be looked into to determine if an "on call" list might be maintained at
the Court and a call sent by radio so that the officer can immediately
report to court to testify.
Councilman Dunnum reported that he had read an article in the American
Municipal Association publication which stated many arrests made are based
on violations while driving "under the influence of" statutes of the
Vehicle Code. In Tucson this problem has been solved by having the police
department take actual sound motion pictures of the arrests. They have had
a very salutory effect for when attorneys are called on and given a preview
of the picture that will be shown in court, the attorneys have not in one
incident proceeded to trial in this type of case. The films cost $12.00
per episode - -this would appear to do a great many things -- relieve the
congestion in the court to a very high degree -- courts have been crowding
the misdemeanor law in which this type case must come to trial within 30
days; the police are not being kept where they belong. Councilman Dunnum
stated this is a very equitable thing as far as safety is concerned.

so ordered that a study be initiated with the City's Police Committee as
to the advisability or inadvisability of carrying through by this system
outlined above.
Mayor Peavey remarked that the idea of setting up the Industrial
Committee of the City of Downey and the various other committees had been
acquired through attendance at the various Conferences of Mayors and the
American Municipal Association.
The Mayor also reported the results of the meeting with the State
Highway officials regarding the double - double line on Firestone Boulevard.
Another meeting is expected to be held in Los Angeles as soon as Assembly-
man Wilson can arrange it. Assemblyman Porter and Assemblyman William
Munnell, also representing a portion of Downey (the triangle area), are
expected to attend. Mr. Peavey added it may be necessary to go to
Sacramento to present the matter.
Relative to benefits derived through affiliation with various
organizations and Cities throughout the United States, Mr. King stated
he feels the Century Freeway Committee, even though the freeway may not
be a reality for 8 or 10 years, is imperative in order to have any
control over the location of the Century Freeway.
Mr. King stated that he feels the hearing on the Planning and Zoning
Ordinance was very well presented and that the display of the ordinance
and maps was viewed by approximately 1000 citizens.
Mr. King reported that in exchange for 30 feet of street right of
way and installation of curbs and gutters previously installed by
property owners, the City has been asked to paveout 30' x 250' of Albia
Street west of Brookshire at a cost of approximately $1200 from the mix -
cellaneous paveout fund, AN 1- 4130 -681. It was recommended that Council
approve this appropriation.
Councilman Dunnum moved, it was seconded by Councilman Temple and
passed by the following vote to authorize approximately $1200 from
Account No. 1- 4139 -681 for a paveout of 30' x 250' on Albia Street.

The following City street projects are recommended for priority com-
pletion by the Public Works Department:

Mayor Peavey stated that he feels Fifth Street is one which should have
priority when the above City projects are completed.

The City Manager stated that it was not necessary to approve the above
work priority at this time as no work can be done for some time and further
studies can be made.
The City Manager reported that authority is requested by the
Police Department to transfer $200 from rental of City Equipment,
General Account No. 9- 3040 -518 to Account No. 9- 3010 -693, Books -
$100; and Account No. 9- 3020 -164, Prosecution Services, $100.

The City Manager reported that he had talked with Assemblyman Willson
who is setting up a meeting in Sacramento for further discussion of possible
removal of the double double line on Firestone Boulevard and requested ap-
proval by the Council to send delegates from the City of Downey to attend.

passed by the following vote to authorize delegates to attend the meeting
in Sacramento with reasonable expenses allowed.

Mr. King requested approval of the City Council for the purchase of a
7,000 gallon pump with a 2" intake at a cost of $307.00 for pumping storm
water. In order to do this it is necessary to request authority for transfer

Public Works Department.

The City Manager read the report of the Safety Committee.
The City Manager reported that he has again presented the City's
entry to the American Society of Public Administration with the adminis-
trative achievements for the past year.
The City Manager requested a transfer of $60 deposits for cleaning
on the apartments purchased recently by the City, the transfer to be from
unappropriated reserve fund into the general fund, refundable deposits.
This money was included in the escrow of the apartment.

Councilman Dunnum stated that as it has been the announced policy to
hold the Council Meetings relative to any matter of great public interest
or upon the request of any number of citizens at an hour convenient to its
citizens, and as the Council is subject to the will of the people and the
desire of the people, he feels that the Council should try, for the conven-
ience of the citizens, to hold one of the two meetings of each month on a
Monday night at 7:30 P.M. He further suggested that the night meeting be
the first meeting of the month, the second meeting to be at the regular
hour, 8:00 A.M.

passed by the following vote that the City Attorney be instructed to
prepare the proper ordinance changing the first meeting of the month to the
second Monday niht at 7:30 P.M. and the second meeting on the fourth Tues-
day of the month at 8:00 A.M.
