HomeMy WebLinkAboutMinutes-02-23-60-Regular Meetingi' A MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY FEBRUARY 23RD, 1960 The City Council of the City of Downey held a regular meeting in the Council Chambers of the Downey City Hall at 8:00 A.M. on Tuesday, February 23rd, 1960, Mayor Hollis M. Peavey presiding. PRESENT: Councilmen: Temple, Dunnum, Giddings, Peavey ABSENT: Councilman: Stamps ALSO PRESENT: Oren L. King, City Manager Glenn Kendall, Assistant City Manager Royal M. Sorensen, City Attorney Ivan A. Robinson, Chief of Police Robert Gain, Fire Chief Ray Lake, Director of Building and Safety Richard Barhite' Director of Public Works Lee Leavitt, City Engineer Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk The invocation was delivered by Reverend Roy Grams of the Moravian Church of Downey. The Mayor announced that this is the time and place for the hearing on the Debt Limit Report for proposed improvement of Stamps Avenue, A.D. #24 The Mayor asked the City Clerk if she had the following affidavits relative to the hearing: 1. Affidavit of Publication of Notice. 2. Affidavit of Mailing. The City Clerk stated she had the affidavits of publication of notice and mailing. It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered that the affidavits of publication and mailing be received and filed. The Mayor requested the City Engineer to read the report on the debt limit. The Director of Public Works read the report as set forth in Section 2857 of the Streets and Highways Code which showed a total amount estimated to be assessed to District #24, Stamps Avenue, as $62,545.70. The Mayor asked if there were any written protests. The City Clerk stated she had received several petitions, the first petition having been checked by the Public Works Department. The Director of Public Works reported that the original petition represented 81.1% of the land area in the proposed district and 75.22% of the area protesting the proposed district, including original sponsors. There had not been time to check the other petitions which were received only this morning. The City Manager stated that inasmuch as about 80% of the property -- owners who originally requested street improvements for Stamps Avenue were now protesting, perhaps after reviewing costs for and determining they are too high, it would seem to be in order to continue the hearing until the next meeting to allow time to meet with the property owners and engineers to further study this improvement district and submit a final report at the next Council Meeting. The Mayor asked if there were any oral protests. 7CS44 9 Oral protests were received from the following persons: Bill Boehn, 8368 Vista Del Rio, Parcel #14 Mark Donaldson, 8327 Gallatin Rd., Parcel #13 Kenneth Yost, 9920 Downey Avenue, Parcel #5 Mr. Yost stated that there had been changes since the original petition was circulated. He also stated that he felt there were inequities and would like to discuss the matter further. It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote that the hearing on the Debt Limit Report for Stamps Avenue Improvement, A.D. #24, be continued to 8:00 A.M. Tuesday, March 8, 1960, in the Council Chamber of the City Hall. The City Clerk stated she had the affidavits of publication, posting and mailing. It was moved by Councilman Temple, seconded by Councilman Giddings and so ordered that the affidavits of publication, posting and mailing be received and filed. The Mayor asked if there were any written protests. The City Clerk stated the protests were the same as had been received and read at the hearing on the Debt Limit Report earlier this morning, and which had been filed. The Director of Public Works read the investigation report in con- nection with construction of curbs, gutters, pavement and sanitary sewers in the Stamps Avenue Improvement District, A.D. #24. The Mayor asked if there were any oral protests. There were none - -other than the protests as listed above. It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote that the hearing on the Resolution of Intention in Stamps Avenue Improvement, A.D. #24 be continued to 8:00 o'clock A.M., Tuesday, March 8, 1960, in the Council Chamber of the City Hall. There being no written and no oral protests to Nada Street Improvement, A.D. #9, it was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote that the hearing be closed. It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered that further reading be waived.. Harrington. A letter from William A. Munnell, Assemblyman from the 51st District, acknowledging receipt of the letter from the Mayor of Downey concerning the traffic situation on Firestone Boulevard and stating he is very much interested in the proposed plan and the present problems confronting the City of Downey outlined in Mayor Peavey's letter. He stated he is willing to cooperate to the fullest in resolving this traffic problem. A letter from the City of Lakewood requesting that the City Council of the City of Downey join in their plea for immediate and potent anti- " narcotics legiglation. A copy of their letter addressed to Governor Brown was read which requests unanimously a special session of the Legislature in order to ascertain and devise ways and means of controlling and eliminating the deadly narcotics traffic and its lethal consequences in the State of California. -3- 786 /� The Chief of Police stated he heartily concurs with Mayor Iacoboni's request. It was moved by Councilman Giddings, seconded by Councilman Temple and so ordered that the City of Lakewood's request be followed up with a similar letter from the City of Downey, to Governor Brown expressing a unanimous desire that anti - narcotics legislation be taken forthwith, and a carbon copy to be sent to Mayor Iacoboni of Lakewood. A letter from Southern California Clean -Up, Paint -Up, Fix -Up Com- mittee announcing their campaign the month of May. A Kick -Off luncheon will be held at the Statler Hotel on April 14, 1960 for officials and workers. Councilman Temple recommended support of this campaign. A letter from Frank G. Bonelli, Chairman of the County Board of Supervisors commending the City Council, other city officials, Chamber of Commerce members, and citizens of Downey for their success of the past. A letter from the City of San Marino protesting higher taxes. It was moved by Councilman Temple,.seconded by Councilman Giddings and so ordered that the letter be referred to the Chairman of the Citizens Tax Committee. An announcement of Health Week Show and Leadership Luncheon, March 23, 1960, at the Biltmore Bowl. The City Clerk reported minutes of the Board of Directors Meeting of the Los Angeles County Division of the League of California Cities have been received and will be on file in her office for anyone interested. A letter from the United States Conference of Mayors headquarters extending an invitation to become formally associated with the work and activities of the United States Conference of Mayors through active member- ^` ship in the organization during 1960 -61. An invoice for membership dues in the amount of $250.00 was enclosed with the letter. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote to continue membership in the United States Conference of Mayors and authorize payment of the 1960 membership dues in the amount of $250.00. AYES: 4 Councilmen: Temple, Dunnun, Giddings, Peavey NOES: 0 Councilmen: None ABSENT: 1 Councilman: Stamps A letter from the Downey Board of Realtors protesting the short time in which the public has had to study and voice their opinion on the new zoning ordinance and zoning of Downey property. The City Manager reported that the Board of Realtors has been making a complete study of the proposed zoning ordinance and has requested pub- lication of the full zoning ordinance and zoning map (as re- zones). The City Manager stated he will investigate the cost of an additional publication before the ordnance is adopted, as per the request of the Board of Realtors. A letter of protest to the zoning ordinance from Jesse & Ruth Tucker. It was moved by Councilman Temple, seconded by Councilman Giddings and so ordered to refer the letter to the Planning Commission. A letter from the City Council of the City of Los Angeles inviting attendance to an "Enlistment Ceremony" on February 25, 1960 at 10:00 o'clock in the Chambers of the Los Angeles City Council where 25 young men will be administered the Oath of Enlistment in the U.S. Army for assignment to the 47th Artillery Brigade, Fort McArthur, California. The City Clerk read a memorandum from the Assistant City Manager requesting various Council actions as follows: 1. Authorization for the Assistant City Manager to appear for the City in matters pertaining to small claims. This authorization should be a blanket authorization since matters of this type will arise from time to time and could conceivably arise on a five -day notice between Council Meetings. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote to authorize the Assistant City Manager to represent the City of Downey in small claims matters. Authorization to pay transportation costs to Sacramento for Assemblyman George Willson who went at the Council's request in regard to the elimination of the double- double line on Firestone Boulevard. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 2100 OF THE DOWNEY MUNICIPAL CODE WHICH SAID SECTION RELATES TO THE TIME OF THE COUNCIL MEETING The ordinance was read in full. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote that the ordinance be introduced. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTIONS 6227.1 AND 6253 of THE DOWNEY MUNICIPAL CODE, WHICH SAID SECTIONS RELATE TO BUSINESS LICENSES The ordinance was read by title only. It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered that further reading be waived. Mr. Leo Weiner, 6367 Orange Street, Los Angeles, representing the Western Vending Machine Operators Association, protested the fees set out in the ordinance for bulk vending machine (penny machines) operation. The City Manager reported the fee had been based on a survey made in other cities and on the model ordinance as presented by the League of California Cities. A comparison of fees set by other cities was read by the City Manager. ^ Mr. Philip Sreden, 2363 S. Robertson, Los Angeles, explained the manner of sanitation in the operating of the penny vending machines and stated policing was done by members of their association. It was recommended by Councilman Dunnum that any vending machine dispensing food products of any kind be inspected by the license inspector for wholesomeness and cleanliness and that the inspectors report to the administration for appropriate action, the appearance of any unwholesome food. The City Attorney advised that this measure cannot be added to the ordinance but that an additional section governing this particular facet of regulation can be added to other sections in the Downey Municipal Code. The petition is supported by a letter from the Los Angeles County Health Department which recommends this improvement as necessary to the protection of public health and pursuant to the provisions of Section 2808 of the Streets and Highways Code. It was recommended that the City Council authorize preparation of plans and specifications, employ- ment of the firm of Burke, Williams and Sorensen and advancement of funds for engineering. It was moved by Councilman Temple, seconded by Councilman Giddings and so ordered to authorize preparation of plans and specifications for De Palma Avenue A.D. #45. P.C. #5045 - Stewart and Gray Road westerly of Woodruff Avenue. 2. P.C. #5163 - Southerly of Telegraph Road, westerly of Birchbark Avenue. 3. P.C. #5098 - Northerly from Sttanbridge Ave., easterly of Ardis Avenue. It was moved by Councilman Temple, seconded by Councilman Giddings and so ordered to authorize acceptance of the sewers constructed under P.C. #5045 - Stewart and Gray Road westerly of Woodruff Avenue, and dedication to the City. It was moved by Councilman Giddings, seconded by Councilman Temple and so ordered to authorize acceptance of the work on the sewer southerly of Telegraph Road, westerly of Birchbark Avenue under P.C. #5163, and dedication to the City. It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered to authorize acceptance of the work on the sewer northerly from Stanbridge Avenue easterly of Ardis Avenue under P.C. #5098 and dedication to the City. The City Manager reported that the work included under Contract #30 with 0. R. Benedict Company has been completed (miscellaneous paveouts) throughout the City of Downey. The contractor violated the terms of the specifications in exceeding the time limit on individual sites by 46 working days, and the time limit on the contract by 14 working days. The specifications provide liquidation damages of $10.00 per day for each site, and $100.00 per day for the contract. The total liquidation damage, there- fore, is $1,860.00. The contractor was advised on numerous occasions of these conditions of the specifications, yet made no apparent attempt to comply. It is therefore recommended that the liquidated damage of $1,860.00 be deducted from the total cost of $28,752.83, reducing the total amount due the con- tractor to $26,892.83. AYES: 4 Councilman: Temple, Dunnum, Giddings, Peavey NOES: 0 Councilmen: None ABSENT: 1 Councilman: Stamps The City Manager reported that at the State City Manager's Meeting held in San Diego inter - governmental cooperation was stressed. He requested authority to write Sacramento endorsing legislature enabling the establishment and use of malls. The Council approved this action. He also reported that the County Board of Supervisors was considering leasing to the City of Downey the property for a new fire station to be located on county property at Old River School Road and Quill Drive at the rate of $1.00 per month for a 50-year lease, and that the County Board of Supervisors had approved $57,500.00 for Florence Avenue improvements. Mr. King reviewed the Department of Public Works project progress report, which had been submitted to the City Council. Mr. King reported a petition has been received for installation of sanitary sewers between Florence Avenue and Via Amorita and recommended authorization by the City Council to prepare plans and specifications, employ the firm of Burke, Williams and Sorensen +and to advance funds for engineering. It was moved by Councilman Temple, seconded by Councilman Giddings and so ordered to authorize preparation of plans and specifications for A.D. #49, Casanes Avenue. It was moved by Councilman Temple, seconded by Councilman Dunnum and so ordered to employ the firm of Burke, Williams and Sorensen for legal work for A.D. #49, Casanes Avenue. It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote to authorize advancement of $1500.00 for engineering work in A.D. #49, Casanes Avenue. AYES: 4 Councilmen: Temple, Dunnum, Giddings, Peavey NOES: 0 Councilmen: None ABSENT: 1 Councilman: Stamps The City Manager reported that in regard to the matter of the possible removal of the double - double line on Firestone Blvd., he has the assurance of the State Highway Department and the Assistant State Highway Engineer that they will make an on- the -spot review individually. Mrs. Earl F. Saunders, representing the South Junior High P.T.A., 11828 S. Belman, made inquiry about a license for the operation of amusement rides at their school carnival. Mrs. Saunders stated the operator of the amusement rides has requested the school P.T.A. to pay their license fee which runs $15.00 per quarter, as the rides would be in operation in the City of Downey for one day only. After much discussion, it was moved by Councilman Dunnum, seconded by Councilman Giddings and passed by the following vote that the City Attorney be directed to draft an appropriate ordinance with regard to license fees for amusement rides operating for the benefit of non - profit organizations, P.T.A., etc. AYES: 4 Councilmen: Temple, Dunnum, Giddings, Peavey NOES: 0 Councilmen: None ABSENT: 1 Councilman: Stamps Councilman Temple reported he had received a letter from Mr. Joseph Michaels outlining several complaints as to dairies, flies, etc. in areas adjacent to the City of Downey in the City of South Gate. Councilman Temple suggested getting together with a councilman from South Gate to go over some of the items outlined in the letter. Councilman Giddings inquired as to what can be done about repairs to streets which had been improved. The Director of Public Works stated they retain a list of streets in need of repair and handle them immediately, but this had not been done on Florence Avenue as further work is to be done there. It was moved by Councilman Temple, seconded by Councilman Peavey and so ordered that the City Manager be directed to send a letter to Councilman Stamps wishing him a speedy recovery and return to the Council as soon as possible. It was moved by Councilman Giddings, seconded by Councilman Temple and so ordered that Councilman Stamps be excused from his duties due to illness. Mayor Peavey presented certificates of merit to Councilmen Giddings and Temple for their past service as Mayor of the City of Downey and apologized for the oversight. The Mayor requested that letters of thanks be sent to Assemblymen Carley V. Porter and George Willson for their assistance in going to Sacramento and meeting with the State Highway Department with regard to the double - double line on Firestone Boulevard in the City of Downey, and also thanked Councilman Dunnum and Charles Barrett of the Chamber of Commerce for their participation.
