OF THE CITY OF DOWNEY
JANUARY 26TH, 1960
The City Council of the City of Downey held a regular meeting
in the Council Chambers of the Downey City Hall at 8:00 A.M. on
Tuesday, January 26th, 1960, Mayor Hollis M. Peavey presiding.

The Mayor announced that now is the time and place for the continu-
ation of the hearing on proposed Assessment District #21 (Elm Vista
Drive) in order to -make a change in the work.
The Mayor asked if there were any oral protests. There were none.
It was moved by Councilman Dunnum, seconded by Councilman Temple
and passed by the following vote that the hearing on Elm Vista Drive
A.D. #21 be closed.

RESOLUTION NO. 556

PROPOSING TO CHANGE THE WORK TO BE DONE IN ASSESSMENT
DISTRICT NO. 21 (ELM VISTA DRIVE)

RESOLUTION NO. 559

ESTABLISHING PARKING LIMITS ON CERTAIN STREETS

RESOLUTION NO. 563

REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF
LOS ANGELES TO PERMIT THE REGISTRAR OF VOTERS OF SAID
COUNTY TO RENDER SPECIFIED SERVICES TO THE CITY OF
DOWNEY, RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL
ELECTION TO BE HELD IN SAID CITY ON APRIL 12, 1960

The City Manager reported that upon action taken by the City Council
at their regular meeting on January 12 an escrow had been entered into
with the owners of the four -unit apartment house across from the City Hall
at a total cost of $39,000.00. After thorough investigation of current
funds, interest rates and the tedious procedure of setting up a partial
payment program as outlined by the City Attorney, it was felt it would be
more prudent for the City to pay cash for this property rather than
endeavor to enter into a long -time purchase agreement.
The owners agreed to include the furniture (estimated value of $2800.00)
with this purchase price and to assign the rents totaling $337 per month
to the City effective February 1, 1960. These arrangements were all made
subject to approval of the City Council. The City Manager reported that
the City Clerk, Della Doyle, has been assigned to manage the four -unit
apartment house.

An agreement between the Downey Museum of Arts and the City of
Downey pledging $666.64, payable $83.33 for the period commencing
November 1, 1959, and terminating June 30, 1960, was presented by the City
Clerk.

be authorized to execute same.

Mayor Peavey presented Certificates of Completion of Supervisory
Personnel for Completion of Training Course in "Supervisorial Method in
Municipal Administrations" to the following personnel:
Robert Vollmer, Robert DeSio, Thomas Nudson, Ralph
Hamilton, LaGrande Leavitt, Hal Durham, Robert F. Topliff,
William Parrott and Melvin Harldson
Roger Harmon and William A. Goggin were absent due to illness.
Mayor Peavey congratulated the recipients of the certificates and
stated he was happy to have them working for the City - -men who are looking
forward and trying to better themselves for their jobs.
The City Manager reported that work has been completed on Assessment
District #42 - sidewalks (Dempster Avenue) unsatisfactorily in accordance
with plans and specifications. It was recommended by the Director of
Public Works that this work not be accepted.
After discussion, it was moved by Councilman Dunnum, seconded
by Councilman Temple and so ordered that the matter of acceptance of
the work in Assessment District #42 (Dempster Avenue - sidewalks) be
continued until the next meeting of the City Council.
The City Manager reported the new library is meeting with a huge
success and that at the close of business on January 19, had shown an
increase of 101 %. Because the library feels that service to patrons
and control of the "crowds" is one of its first jobs, other equally
important duties have had to suffer. One of these duties is the pur-
chasing, cataloging and processing of new books. The City Council
recognized this serious problem when it voted $5,000.00 be appropriated
for the purchase of additional books. In order to speed up the
selection, purchasing and cataloging and processing of these new books,
it is suggested that the following distribution of the $5,000.00 be
authorized:
To Account No. 9- 7010 -399 - $312.50 - Increase the McNaughton
Service from 700 books to 900 books with 78 new books a
month instead of 58.
To Account No. 9- 7010 -121 - $750.00 - Temporary and casual wages.
Add some extra hours to the part -time staff. These extra
hours can be spent helping the Friends of the Library in
processing.
To Account No. 1- 7010 -693 - $3937.50 - Purchase additional books.

The City Manager reported that in response to a call for bid to
demolish and remove the old buildings on the 70 -foot lot facing
Firestone Boulevard, the City has received two quotations, one in the
amount of $937.00 from R. E. Merrill, 461 E. Harding St., Long Beach,
and the other in the amount of $999.00 from Koontz Demolition Contractors,
4162 Green Ave., Los Alamitos. It was suggested that Council authorize
Mr. R. E. Merrill to complete the work under the low bid of $937.00 and
that funds for this purpose be appropriated from the operating reserve.
It was moved by Councilman Temple, seconded by Councilman Dunnum
and passed by the following vote to authorize the following appropriation
of funds for demolishing and removing the old buildings on the 70 -foot
lot facing Firestone Boulevard across from the City Hall.

The City Manager reported that four fire hydrants have been
damaged through traffic collisions and amounts have been collected
and received into the general fund. However, in order to replace
these fire hydrants in their proper condition, it is necessary to
obtain authority for an appropriation in the amount of $781.47 from
the unappropriated reserves, broken down as follows as to location:
Lakewood Boulevard at Alameda
Lakewood Boulevard and Sixth St.
Firestone and Paramount
Lexington - Gallatin and Florence

The City Manager reported he had two recommendations from the Personnel
Board resulting from their meeting of last night. One is the consolidation
of two functions - -the parking meter collection and maintenance and the park-
ing meter violation program. It is the recommendation of the Personnel
Board to change the classification of Parking Meter Maintenance Man from
Class 13 to Class 14 to reflect the additional duties and added expense of
furnishing a uniform, and to establish and adopt the new characteristics and
typical duties of the change which would include parking meter violation
tickets, effective February 1, 1960.
It was moved by Councilman Temple, seconded by Councilman Dunuum and
passed by the following vote to accept the City Manager's and Personnel
Board's recommendation and authorize raising the category of Parking Meter
Maintenance Man from Class 13 to Class 14, placing the personnel presently
in that position on step "C "q effective February 1, 1960.

Mr. King reported that he has received a letter of resignation from
Don Simpson, the City Engineer, which has been accepted with a great deal
of regret and that he sincerely wished Mr. Simpson the best for the future
in his position as Director of Public Works at Newport Beach, beginning
February 23, 1960.
Mayor Peavey wished to add the regrets of the City of Downey; however,
he wished the best of success to Mr. Simpson in his new position.
Mr. Simpson thanked the City Manager and Mayor for their good wishes and
expressed his regrets of leaving the City.
Councilman Dunnum stated that he would like to join with the Mayor in
expressing his feeling that Mr. Simpson has done a tremendous job and that
he regrets very much seeing him leave. On the other hand, he is pleased
that his ability has been recognized and that he will be stepping up as
Director of Public Works in another city. He further stated that he feels
the City of Downey, through personnel such as Don Simpson, has established
a tremendous record which will undoubtedly attract other cities in need of
department head personnel.
Councilman Temple offered his regrets and congratulations for
a job well done.
The City Manager stated that in the personnel merit system set up
in each department, as part of a replacement program an endeavor is made
to recruit people who can step into positions when they are vacated.
In conferences with Mr. Barhite, Mr. Simpson and Mr. Kendall, the
Engineering Department was thoroughly reviewed and it has been recommended
that Mr. LaGrande Leavitt be placed in the position of City Engineer with
a probationary period of six months. This had been taken up with the
Personnel Board and they thoroughly recommended the promotion which would
be at a beginning salary of $900.00 per month% effective February 23, 1960.
Mr. King reported that advancement of Witold Hryniecki to that of
Associate Civil Engineer has also been recommended as he has been doing an
excellent job. The classification change would be from 23(e) - $729.00
to 25(e) - $766.00. Mr. Hrynwiecki is not a registered engineer but expects
to become registered at the end of this year or the early part of next year.
Councilman Dunnum made a motion, it was seconded by Councilman Temple
and passed by the following vote that the promotions of Lee Leavitt and
Witold Hrynwiecki as outlined above be approved, both effective February 23,
1960.

Don Simpson stated he wished to offer congratulations to Lee Leavitt
for he was his personal choice to fill the position vacated by him and he
also wished to assure the Council that Lee will do a 100% job all of the
time.
Councilman Peavey extended congratulations to Lee Leavitt upon his ad-
vancement to City Engineer.
Lee Leavitt voiced his appreciation of the confidence placed in him.
Mr. King stated the Annual Reports are now ready for mailing and dis-
tributed copies of an insert for the City Council's information relating
to the manner of obtaining public improvements and a statement to the effect
that a display has been arranged of the new zoning ordinance in its entirety
and maps, with a member of the Planning staff being on duty on February 5,
8:00 A.M. to 9:00 P.M., Saturday, February 6, 9:00 A.M. to 5:00 P.M. and
February 9, 8:00 A.M. to 5:00 P.M. in the former Council Chamber of the City
Hall.
Councilman Dunnum requested Mr. Barhite, Director of Public Works, to
report on his findings relative to the information contained in the letter
from Mr. Slabotnik.
Mr. Barhite reported that the $11,000.00 cost mentioned is a basic cost.
The contingency item includes engineering, inspection, and incidental costs
which is approximately 30 %. If condemnation proceedings are necessary, an
additional cost of $2,000 would be involved. Mr. Barhite reported it always
seems better to estimate high so in the event the final cost is less,the
people are happier than if it is more than the estimate.
Mr. Barhite stated that relative to the question of design, it will be
investigated.

passed by the following vote that the Director of Public Works proceed forth-
with with the following:

1. Preparation of Plans and Specifications;
2. Advancement of funds for the engineering work in the amount of
$2,000.00 for District #52 (Dolan Avenue) for the work proposed
in accordance with petitions and comments made by the Director
of Public Works;and
3. Authority to employ the firm of Burke, Williams and Sorenson to
do the legal work.

Councilman Dunnum inquired about the status of the large improvement
anticipated in the southeast area. Mr. Barhite reported it will be started
the latter part of February.
Councilman Dunnum inquired about the status of the acquisition of right
of way for the extension of Stewart and Gray Road. Mr. King reported that
the land is being appraised and preliminary negotiations with the property
owners had been held but that they want to discuss the matter again. It was
recommended that Mr. Barhite check back this week for it had been reported
that the appraiser has some problems with attorneys relative to some cloud
on the deed, and the appraisal figure is essential in talking with the
property owners.
Councilman Dunnum stated that he would like to see what causes so many
delays in Public Works projects.
Mr. Simpson stated he felt a priority list should be determined. The
department can only do so much work and it is a question of which job should
take priority. At the present time there are 10 assessment districts in
various stages of work, in addition to the other major city improvements.
The City Council should review the whole list of projects to be handled
through the Public Works Department, the percentage completed and determine
an over -all priority.
Mayor Peavey stated he feels the project having priority next to
Florence Avenue improvements should be, in his estimation, the extension of
Stewart and Gray Road.
Mayor Peavey announced that an invitation has been extended to the City
to attend the 2nd anniversary of the City of Pico Rivera on Friday, January 29,
at 3:30 P.M., with an open house being held at the City Hall from 10:00 A.M.
to 5:00 P.M. and an invitation from Governor Edmund G. Brown to attend the
Tenth Statewide Meeting of the Governor's Industrial Safety Conference at the
Fairmont Hotel in San Francisco, February 16 and 17, 1960.

administrative staff deemed necessary be authorized to attend this conference
with all necessary expenses paid.

Mayor Peavey reported that he had read an item in the American Municipal
Association pamphlet regarding governmental units' purchasing cooperatively
to lower the cost on such various items as cars, trucks, gasoline, oil and
grease by joint purchasing. Of the three original cities participating $35,000
had been saved. The Mayor feels this is worthwhile looking into inasmuch as
the City of Downey is associated with the mutual aid cities and recommends
discussing the matter at the next meeting held by these cities.

The Mayor reported that at a meeting held with the State Highway
Department yesterday relative to the removal of the double - double
line on Firestone Blvd., at which Assemblyman Carley V. Porter was also
present, it was decided that representatives from the state would come
to Downey on February 4, at 8 :30 A.M., to go over the project to see if
there is some way it can be worked out to eliminate the double- double
line,and the Mayor feels that their observation of the painted lines on
Florence Avenue would also be worthwhile.
Councilman Temple inquired what the report from the State Highway
Department was on the progress of the Century Freeway. Mayor Peavey
stated they had reported it would be about 15 years hence.
Mayor Peavey announced an invitation has been received from the
Knights of Columbus in Huntington Park for their Annual and Fraternal
Night on Wednesday, February 3, 1960, at 8:00 P.M., with Frank G. Bonelli
as Master of Ceremonies, and an invitation has been extended to attend
the next meeting of the Health Board during Health Week, to be a luncheon
meeting on Thursday, January 21, at the Los Angeles County Medical Building.
The City Manager reported that the annual spring conference of the
State City Managers is being held in San Diego February 18 and 19 and re-
quested permission for the City Manager and Assistant City Manager to attend.
It was moved by Councilman Temple, seconded by Councilman Dunnum and
passed by the following vote that authority be granted for the City Manager
and the Assistant City Manager to attend the Annual Spring Conference of
the State City Managers in San Diego February 18 and 19, with reasonable
and necessary expenses paid.

so ordered to recess the meeting at 10:00 A.M. to 7:30 P.M.
The meeting reconvened at 7:30 P.M. in the Council Chambers of the City
Hall, Mayor Hollis M. Peavey presiding.

Mayor Peavey announced that this is the time and place for the continua-
tion of the hearing on the Downey City Lighting District.
Mayor Peavey asked the City Clerk if there were any written protests.
Della Doyle, City Clerk, replied she had received a petition with 114
signatures which represented, as verified by the Engineering Department,
23% of the total parcels in the area.
The Mayor asked if there were any persons present who had signed the
petition who wished to protest orally. None came forward.
The Mayor then asked if there were any persons who have not signed the
petition who might wish to remove his or her name. No one came forward.
The City Clerk was asked to read the content of the written protest in
full.
It was moved by Councilman Temple, seconded by Councilman Dunnum and
passed by the following vote, in view of the fact the signatures on the
petition represent only 237. protesting, that the hearing on the Downey City
Lighting District be closed.

Mayor Peavey announced that he had just received a resignation
from Andy D. Cardona who is unable to act on the Sister -City Committee
and nominated Mrs. Freeman Campbell to serve in his place.
It was moved by Councilman Stamps, seconded by Councilman Temple
and passed by the following vote to accept the resignation of Mr. Cardona
from the Sister -City Committee and that Mrs. Freeman Campbell be ap-
pointed.

Councilman Dunnum congratulated Councilman Temple on his award of
an Honorary Life Membership in the P.T.A.
Mr. Barhite was asked to give a resume of the type of lights to be
installed in the lighting district, the cost breakdown and the difference
of Zone 1 and Zone 2 within the area.
Mr. John Corcoran, resident in Zone #2, 7953 Dalen St., Downey, wished
to voice an objection to the manner in which he felt the lighting district
had been "forced" onto the people in the area.
Mr. Clarence Murphy, 7931 Borson St., Downey, spoke for the Downey City
Lighting District and stated all residents within the area had received due
notice and had plenty of time to raise any objections. He stated he felt
the installation of lights in their area would be one of the best things the
City Council could do for them in adding safety of lighting for their
children, greater protection against crime and a benefit to all in the area.
Councilman Dunnum stated that he believes the lighting district serves
a very laudible purpose in the City by illumination and prevention of crime.
Statistics show in areas where there is adequate lighting, crime percentage
is lower. He is in favor of lighting whenever possible.
It was moved by Councilman Temple, seconded by Councilman Dunnum and
passed by the following vote that all protests be overridden and authority
be granted to proceed with the Downey City Lighting District.

APPLIANCES ON CERTAIN STREETS AND PUBLIC PLACES OF SAID
CITY TO BE MAINTAINED AND ELECTRIC CURRENT TO BE FUR-
NISHED, ALL IN ACCORDANCE WITH RESOLUTION NO. 538
OF SAID CITY ( DOWNEY CITY LIGHTING DISTRICT)
The resolution was read by title only. It was moved by Councilman
Dunnum, seconded by Councilman Temple and so ordered that further reading
be waived.
It was moved by Councilman Stamps, seconded by Councilman Temple and
passed by the following vote that Resolution No. 565 be adopted.
