Peavey presiding. PRESENT: Councilmen: Giddings, Temple, Peavey ABSENT: Councilmen: Dunnum, Stamps ALSO PRESENT: Glenn Kendall, Assistant City Manager Royal M. Sorensen, City Attorney Richard Barhite, Director of Public Works Ivan A. Robinson, Chief of Police Robert Gain, Fire Chief A. C. Gabriel, Purchasing Agent Dan McNutt, City Planner Tom Nudson, Chief Building Inspector Tom Brown, Fire Prevention Battalion Chief Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend Albert H. Epp, Immanuel Mennonite Church of Downey, delivered the invocation. The Mayor Pro Tem announced that now is the time and place for the hearing on the Plumbing Code. The Mayor Pro Tem asked if there were any written protests. The City Clerk replied there were none. The Mayor Pro Tem asked if there were any oral protests. There being no oral and no written protests on the Plumbing Code, it was moved by Councilman Temple, seconded by Councilman Giddings and so ordered that the hearing on the Plumbing Code be closed. ORDINANCE NO. 136 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING ARTICLE VIII OF THE DOWNEY MUNICIPAL CODE BY ADDING THERETO A NEW CHAPTER TO BE DESIGNATED CHAPTER 2 THEREOF AND ADOPTING THE UNIFORM PLUMBING CODE 1958 EDITION The ordinance was read by title only. It was moved by Councilman Giddings, seconded by Councilman Temple and so ordered that further read- ing be waived. It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote that Ordinance No. 136 be adopted. AYES: 3 Councilmen: Giddings, Temple, Peavey NOES: 0 Councilmen: None ABSENT: 2 Councilmen: Dunnum, Stamps ORDINANCE NO. 137 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING SECTION 8100.1 THERETO. THIS SAID SECTION RELATES TO THE PLUMB- ING CODE. The ordinance was read by title only. AYES: 3 Councilmen: Giddings, Temple, Peavey NOES: 0 Councilmen: None ABSENT: 2 Councilmen: Dunnum, Stamps The City Clerk read the following correspondence: A letter directed to Mr. Barhite from Mr. & Mrs. Lester Gamble in appreciation of the work at the corner of Telegraph Road and Tweedy Lane and requesting that something be done to clean up the unsightly gas sta- tion corner. A letter from K. F. Miller in thanks for the removal of a bus bench across from his home. An announcement of the Southeast District Veterans Service Center Annual Council Meeting to be held November 12, 1959, at 6:30 P.M. at the Maywood American Legion Hall. An announcement of the Board of Directors meeting of the League of California Cities, Los Angeles County Division, to be held on Thursday, November 5, 1959, at 7:15 P.M. at the Rodger Young Auditorium. A letter from Congressman Clyde Doyle regarding Post Office Build- ing and facilities in Downey, and a copy of a letter from Verne Scoggins, Regional Operations Director of the Post Office Department in San Fran- cisco, indicating that it has been determined that the space needs for postal service at Downey exceed the regional limitation of up to 12,000 sq. ft. and that their recommendations have been forwarded to the Post Office Department in Washington for final review and decision, with a request that the case be expedited as much as possible. A letter from Mayor Dale L. Ingram of the City of E1 Monte announc- ing a meeting of The West San Gabriel Association of Community Councils at an annual conference to be held at the Community Center Building at 7:30 P.M. on November 5, 1959, at E1 Monte. An announcement of the Central Basin Water Association meeting at Marsal's, 2782 Firestone Blvd., South Gate, at 6:30 P.M. on Thursday, November 5, 1959. A copy of a letter from Hanford F. Rants, Principal of West Jr. High School directed to Ivan A. Robinson, Chief of Police requesting a pedestrian activated signal or a crossing guard at the intersection of Old River School Road and Laura Street. Chief Robinson reported that a study has been made and that signals rather than guards were recommended -- perhaps with the school participating in the cost. The Director of Public Works was instructed to contact the school and report back to the Council. The City Clerk stated she had received two petitions requesting the establishment of a lighting district in the Smallwood Tract south of Imperial between Paramount and Rancho. These were referred to the City Attorney and the Director of Public Works. It was moved by Councilman Temple, seconded by Councilman Giddings and passed by the following vote that the minutes of the meeting of October 13, 1959, be approved as corrected. NIXON The resolution was read in full. It was moved by Councilman Temple, seconded by Councilman Giddings and passed by the following vote that Resolution No. 510 be adopted. AYES: 3 Councilmen: Giddings, Temple, Peavey NOES: 0 Councilmen: None ABSENT: 2 Councilmen: Dunnum, Stamps l _`+ . 5_ After a summation of bids for the traffic signal at Clark and Adoree, it was recommended that the contract be awarded to thelowest and best bidder, Westates Electric, for the sum of $6,099.00. The City Attorney reported he had checked the bid of Westates Electric and found it to be in order. It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote that the contract for traffic signal at Clark and Adoree be awarded to the lowest and best bidder, Westates Electric, that all other bids be rejected and bid bonds returned. AYES: 3 Councilmen: Giddings, Temple, Peavey NOES: 0 Councilmen: None ABSENT: 2 Councilmen: Dunnum, Stamps Mr. Barhite reported that an offer of dedication of a sanitary sewer constructed under P. C. #5088 has been received. The sewer is located in Quoit Street and is offered for dedication by the Archdiocese of Los Angeles Education and Welfare Corporation and has been approved by the Director of Public Works. It was moved by Councilman Temple, seconded by Councilman Giddings and passed by the following vote that Council authorize acceptance of Sewer P. C. #5088. AYES: 3 Councilmen: Giddings, Temple, Peavey NOES: 0 Councilmen: None ABSENT: 2 Councilmen: Dunnum, Stamps The City Attorney reported on the pending lawsuit, Bleamaster vs. City of Downey and County of Ins Angeles, regarding right -of -way action by the county prior to the incorporation of the City of Downey. The matter has been set for pre -trial November 6 and the City Attorney stated he has not discussed settlement with the other party and he feels it would be well to discuss the matter with the Council. The attorney for the client has certain privileges to settle out of court and the City Attorney stated he would like to make some comments in this respect which he would prefer the other party would not have access to. It was agreed that Council would meet privately with the City Attorney after the Council Meeting to discuss this case. The City Attorney then reported that in view of certain amendments to the statutes of this State, which were effective September 18, 1959, it appears advisable that there should be some changes in the Cityfs form of agreement with other cities for supplementary fire or police protection, and submitted a form of agreement which, if executed by the City of Downey and their Mutual Aid Cities, should offer the necessary protection to all firemen and policemen. It was recommended that the Council authorize the City Manager to execute this agreement and further authorize that such steps as may be necessary be taken to cause the execution of this agreement by Mutual Aid Cities. It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote to authorize the City Manager to execute the new agreement with other mutual aid cities for fire and police protection. AYES: 3 Councilmen: Giddings, Temple, Peavey NOES: 0 Councilmen: None ABSENT: 2 Councilmen: Dunnum, Stamps 7_: RESOLUTION NO. 511 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING CERTAIN WEEDS GROWING UPON AND CERTAIN REFUSE AND RUBBISH UPON CERTAIN LANDS WITHIN THE CITY OF DOWNEY TO BE A PUBLIC NUISANCE The resolution was read by title only. Mr. Barhite reported that the list of lots appearing in the resolution had been determined by complaints from the adjoining properties, with a subsequent inspection by the Department of Public Works verifying the need for their clean- ing. It was moved by Councilman Temple, seconded by Councilman Giddings and so ordered that further reading be waived. AYES: 3 Councilmen: Giddings, Temple, Peavey NOES: 0 Councilmen: None ABSENT: 2 Councilmen: Dunnum, Stamps Mr. Barhite reported that in accordance with the usual practice, when a subdivision is completed it is annexed to the Downey Lighting District and requested that Tract #24809 (Nada and Marbel) be so annexed. It was moved by Councilman Temple, seconded by Councilman Giddings and passed by the following vote authorizing that Tract #24809 (Nada and Marbel) be annexed to the Downey County Lighting District and setting a hearing for 8:00 A.M., Tuesday, November 24, 1959. AYES: 3 Councilmen: Giddings, Temple, Peavey NOES: 0 Councilmen: None ABSENT: 2 Councilmen: Dunnum, Stamps Chief Robinson asked assistance of parents and supervisors in Halloween parties or activities planned throughout the City in having adult supervision at all times, and he thanked the youth for their voluntary compliance in past years. Councilman Giddings commended the industrialists for the breakfast meeting held for the industrialists north of the City of Downey last Thursday morning. There were 120 industrialists who attended the meeting and since then, Councilman Giddings stated he has heard nothing but good come out of it. He added that the Downey industrialists are donating both time and dollars to this annexation program. Councilman Temple announced that there will be a formal ribbon cutting ceremony at the new fallout shelter by the Downey Savings & Loan Association with Governor Pat Brown present to break the ribbon, the exact time to be announced later. Councilman Peavey added to Councilman Giddings' statement that a very fine job is being done by the industrialists. Councilman Peavey reported that the League meeting in San Francisco was very worthwhile and that he feels much valuable information was gained from all who attended. He also recommended that the Parks and Recreation District be requested to attend the next League meeting, for he feels thereis much valuable information which they can gain from attending. Councilman Temple added that his first meeting at the League conference dealt with the Sister City program and that he had some valuable information to offer at their first committee meeting, which is to be announced in the near future.
