MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
OCTOBER 13TH, 1959
The City Council of the City of Downey held a regular meeting in
the Council Chambers of the Downey City Hall at 8:00 A.M. on Tuesday,
October 13th, 1959, Mayor James L. Stamps presiding.

Dr. Walter W. Armantage of the Congregational Church of Downey
delivered the invocation.
The Mayor announced that now is the time and place for the hearing on
Annexation No. 3.
The Mayor asked if the City Clerk had received any protests. The City
Clerk stated she had received a petition with seven (7) signatures of property
owners in protest and read a letter from the law firm of Bodle, Fogel and
Warren in protest of Annexation No. 3.
The City Attorney asked to examine the letter after which he reported
the statement in the letter is correct; if there are more than 11 registered
voters residing in the territory at the time the petition was filed for the
annexation, it must be handled as an inhabited area but that the letter of
protest is a little broader than the Act reads - -the critical point is the
voters residing in the area at the time of filing.
It was moved by Councilman Temple, seconded by Councilman Dunnum and
passed by the following vote that the hearing on Annexation No. 3 be continued
to 8 :00 A.M. on Tuesday, November 10, 1959, in the Council Chambers of the
Downey City Hall in order to do some further research.

The Mayor announced that this is the time and place for the continuation
of the hearing on Leeds Street Improvement District No. 11.
The Mayor asked if there were any protests on the work changes in Leeds
Street Improvement District No. 11. There being no written or oral protests,
it was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered
that the hearing be closed.
RESOLUTION NO. 497
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING CHANGES IN THE WORK PROPOSED TO BE DONE IN
ASSESSMENT DISTRICT NO. 11 (LEEDS STREET)
The resolution was read by title only. It was moved by Councilman
Dunnum, seconded by Councilman Temple and so ordered that further reading be
waived.

The Mayor announced that now is the time and place for the continuation
of the hearing on confirmation of assessment in Improvement District No. 11,
Leeds Street.
The Street Superintendent was asked to make certain changes or study
the possibility of making changes in the assessment at the last Council
Meeting. He was asked to present his report.
Mr. Barhite reported that the assessment was raised on Parcels #1 and
#8 based on their receiving one -half of the benefit the interior lots would,
based on the frontage, and the assessment was lowered on the interior lots,
Parcels #2 through #7.
Don Simpson, City Engineer, explained the formula used for arriving at
the proposed changed assessment on Leeds Street.
The following persons spoke in protest of the increased assessment:

There being no further protests, it was moved by Councilman Dunnum,
seconded by Councilman Temple and so ordered that the hearing be closed.

passed by the following vote that the Street Superintendent be directed to
revise the assessment roll and diagram on file in the City Clerk's office as
shown in the column "Revised Total Assessment" of the memorandum dated
September 22, 1959, and the revised assessment be brought back to the Council.

It was moved by Councilman Temple, seconded by Councilman Giddings and
so ordered that the minutes of the meetings of September 22nd and October 6th,
1959, be approved.
The City Clerk read the following written correspondence:
A letter from the Los Angeles Citizens Committee announcing that the 1960
Democratic Convention will be held in Los Angeles in July, 1960, and asking
the Mayor to join as a member of a Los Angeles County Non - Partisan Mayors'
Committee for the 1960 Democratic Convention.
It was moved by Councilman Temple, seconded by Councilman Giddings and
so ordered that this matter be referred to the Mayor.
A letter from the Southeast District Veterans Service Center announcing
a meeting of their Council on Thursday, October 22, 1959, at 6:30 P.M. at the
Maywood American Legion Hall.
A letter from Mayor Raymond H. Gregory of the City of San Bernardino
reporting that each year the California Junior Chamber of Commerce honors

the five outstanding young men of California and that on January 9,
1960, the winners for 1959 will be feted at a banquet hosted by the
San Bernardino Junior Chamber. The assistance of the Mayor and Council
to the local Junior Chamber of Commerce was urged.
Mr. C. "Red" Barrett, Manager of the Downey Chamber of Commerce,
explained the manner in which these young men may be selected. It was
recommended that the City Manager and Council work with the Junior
Chamber of Commerce in selecting a nominee in this area for considera-
tion of one of the awards.
A letter from the Chamber of Commerce giving a report of their
activities for the months of July, August and September and submitting
with it a report of receipts and disbursements during those months, re-
questing payment of $1,875.00 as set forth in the contract between the
City and the Chamber of Commerce.
The City Manager reported that he has observed the progress of the
Chamber of Commerce and is very encouraged by what they have accomplished.
It was recommended that the Council accept the report and approve payment
for the quarter of July, August and September, 1959 in the amount of
$1,875.00.
It was moved by Councilman Giddings, seconded by Councilman Temple
and passed by the following vote to accept the report presented by the
Chamber of Commerce and approve the quarterly payment in the amount of
$1,875.00.

Mr. King reported that material will be forthcoming from AMA and
Federal agencies shortly and it is desired that a meeting be called as

Mayor Stamps introduced Mr. William Montgomery, Vice Principal of
Downey West Junior High School, who was accompanied by a social studies
teacher and several students who were there to observe the Council in
session.
Mr. Barhite gave a resume of the installation of traffic signals at
Adoree and Clark, which North American Aviation is paying to have con-
structed. It was recommended that Council approve the plans and specifica-
tions and authorize the purchasing agent to advertise for bids.

so ordered to authorize approval of plans and specifications for installa-
tion of traffic signals at Adoree and Clark and call for bids.

Mr. Barhite reported that the property owners along the east side
of Paramount Blvd., extending from 200 feet north of Phlox St. to 800
feet south of Phlox St., requested that the City of Downey provide the
extension of pavement to join concrete curbs and gutters to be con-
structed over certain portions of the above described street. This
request has been reviewed by the Department of Public Works, resulting
in the following recommendations:
1. The City Council authorize the expenditure of $10,000 of the
improvement of this portion of Paramount Blvd. entailing the
construction of pavement, cross gutter and concrete curbs
and gutters north of Phlox St. (where the property owners
have previously improved the shoulder with a full width
pavement) .
2. That the project be financed from available Gas Tax Funds
which have not been previously budgeted.

on Paramount Boulevard as outlined.

The Mayor announced that now is the time and place for the continua-
tion of the hearing on the appeal of R. C. Walter for revocation of a
solicitor's permit.
The City Attorney stated for the record that pursuant to the power
granted to the Police Chief under the Downey Municipal Code, a letter was
sent to Mr. Walter dated September 17, 1959, setting forth the revocation.
Subsequent to the letter's being sent out, Mr. Walter filed an appeal with
the Council, as he has the authority to do under the Municipal Code. The
City Clerk advised that a certified letter, return receipt requested, had
been forwarded to Mr. Walter on October 6, 1959, notifying him of the
time and place of the hearing on his appeal, and that she had on file the
receipt, dated October 12, 1959, signed by Mr. R. C. Walter for the certi-
fied letter; however, Mr. Walter did not come forth when he was requested
to do so at the hearing, and apparently was not present in the Council
Chambers at that time.
Mr. Walter had been soliciting for the sale of fire alarm devices and
a number of the persons whom he solicited were under the impression that
Mr. Walter was a member of the Fire Department. This impression was
gleaned either by direct statements of Mr. Walter to that effect, or by
inference from his sales approach. The City Attorney stated it might be
well for the Council to be advised by Assistant Fire Chief Don Warren, in a
brief statement, as to the nature of the complaints received against
Mr. Walter.
Assistant Fire Chief Don Warren reported that the matter originated in
March. The public thought Mr. Walter was a representative of the Fire
Department in civilian clothes making inspections and setting up appoint-
ments for fire demonstrations and inspections later. Several complaints
were registered. The matter then subsided until June and then again in
September a series of complaints, in fact 15 or 20 in the matter of a very
_. few days, were made. The Police Chief had issued a solicitor's permit to
Mr. Walter. As Mr. Walter was in violation of certain State codes and the
Municipal Code, the Fire Department asked Mr. Walter's permit to be revoked.
This was due to the fact he was misrepresenting himself to the public as
being with the City Service (the Fire Service) to get his foot in the door.
These persons thought he was associated with the Fire Department until about
his third visit when Mr. Walter, after making fire demonstrations, inspections
and showing pictures of severe fire damage, informed the people that the cost
for the fire alarm was $500.

The following persons offered testimony in the case:
Mrs. Lida Jenkins, 9662 Ratliffe, who stated Mr. Walter said
he was representing the Fire Department and inspecting homes.
Mrs. James Jobling, 9658 Ratliffe, who stated Mr. Walter
claimed he had nothing to sell and implied he was represent-
ing the Fire Department.
Mrs. Oliver Minyard, 9638 E. Priscilla, who had bought one
of the alarm systems.
It was moved by Councilman Temple, seconded by Councilman Giddings
and so ordered that the hearing be closed in the matter of the revocation
of Mr. R. C. Walter's solicitor's permit.
It was moved by Councilman Temple, seconded by Councilman Giddings
and carried that the City Council find that Mr. R. C. Walter did mis-
represent himself to be a member of the Fire Department and that the
appeal of Mr. Walter be denied and the revocation by the Police Department
of his solicitor's permit be upheld.

Councilman stated that it is unfortunate and regrettable that there
are people with a complete lack of business ethics, and that the Fire and
Police Departments are to be commended for their alertness in stopping
this very questionable activity on the part of this individual. Councilman
Dunnum also commended the citizens for coming to the Council Meeting and
enabling the City Council to put a stop to it.
Mr. Barhite stated that the report of the Traffic Engineer has been
reviewed by the Traffic Committee and they concur with the recommendations
contained therein. Removal of parking along 5th Street seems to be in
accordance with the wishes of the majority of the property owners on 5th
Street between Birchdale and Brookshire Avenue who have informed the City
that they are opposed to the widening of the street and suggest as an
alternative that a parking prohibition be initiated. The following action,
therefore, has been recommended:
1. Remove parking on the south side of 5th Street at the curve just
east of Birchdale.
2. Remove parking on the south side of 5th Street between Birchdale
and Brookshire Avenue. This will provide two 11 -foot traveling
lanes in each direction. Parking can be removed from the north
side when additional capacity is required.
3. Remove parking at key or critical points on 5th Street between
Brookshire and Downey Avenue; i.e., at curves and adjacent to
intersections. It is felt that parking in the above section is
at a premium as a result of the demands of the hospital. Fur-
thermore, this section of the roadway is 34 feet wide and it can
accomodate parking and two 9 -foot traveled lanes.
4. Remove parking on the south of 5th Street between Downey and
Paramount Blvd. Present traffic demands do not require further
restrictions; however, future traffic requirements may dictate
the prohibition of parking on the north side of the street at a
later date.
The Traffic Committee reported that all of the above parking prohibitions
can be accomplished without Council action since the City Traffic Code provides

for the Traffic Engineer to remove parking from narrow streets. However,
because of the controversial nature of parking restrictions it is suggested
that the Council indicate approval of this report by minute action.
The above analysis is based entirely on the assumption that the exist-
ing major street patterns will remain unchanged. Any consideration of a
downtown mall or other drastic change in the major street plan will require
a re-evaluation of the problem.
It was moved by Councilman Giddings, seconded by Councilman Temple and
so ordered that the recommendations to restrict parking on 5th Street accord-
ing to the Traffic Committee's Report be accepted.
The City Manager reported that Chief Robinson of the Police Department
had made a very comprehensive report concerning crossing guards. Councilman
Dunnum inquired if copies of the report had been furnished the C. C. Carpenter
and Ed C. Lewis P.T.A. presidents. Chief Robinson stated they had been de-
livered last night.
After Chief Ivan A. Robinson presented his report on the crossing guards,
Mrs. Rogers, President of the Ed C. Lewis P.T.A., and Mrs. Brown, President
of the C. C. Carpenter P.T.A. protested the decision that the traffic signals
were felt to be adequate safety devices at the school crossings at Foster and
Bellflower and Foster and Clark Street. Mrs. Rogers also read an excerpt from
a survey of the Los Angeles County Road Department in support of her protest.
Mrs. Brown thanked Chief Robinson for his cooperation and for the complete
report which had been made.
The Traffic Engineer, Mr. Hal Durham, made a comparison of other busy
intersections which showed the one at Imperial is almost double in traffic.
Councilman Dunnum asked to be excused from the meeting at 9:15 A.M. to
take an urgent long distance telephone call.
After much discussion, it was moved by Councilman Temple, seconded by
Councilman Dunnum and so ordered that the matter of crossing guards for the
intersections of Foster and Bellflower and Foster and Clark be tabled for
further study.
Councilman Temple inquired what the possibility might be for installing
a directional signal opposite the West Junior High School at Laurel Street
and Old River School Road. The Traffic Engineer will report on this at a
later meeting.

Mr. King presented Mr. Kenneth Johnson, graduate student of U.C.L.A.
who is working on a case study of Downey versus Lakewood plans of City
government.

The City Manager reported that progress continues in effecting mutual
aid agreements with the 17 cities and County of Los Angeles in setting up
the local inter - agency Civil Defense and Disaster Relief Program and it is
hoped it will become operative by the first of January, 1960. Headquarters
for this disaster program will be in the newly rented building on Dolan
Street and funds and general administrative procedures will all be handled
through this local office. The budget for the first year is estimated at
$14,175.00, of which the City of Downey's share for the first year is
estimated at $1,459.00. It is necessary, therefore, to ask Council author-
ity to appropriate $1,459.00 from the reserve funds for this purpose.
It was moved by Councilman Temple, seconded by Councilman Dunnum and
passed by the following vote to approve the appropriation of $1,459.00 from
the reserve funds in order that the City can share its proportionate cost
in the Civil Defense and Disaster Relief Program.

Listed below are budgetary transfers requested by the Public Works
Department and recommended by the Department of Finance. Council authority
is necessary to effect these transfers under the 1959 -60 current budget.
JUSTIFICATION FOR TRANSFERS:
Items 1 & 2- -These transfers are necessary to cover a deficit existing in
these accounts. The Encumbrance Carry -Over from the 58 -59 Budget was not
sufficient to cover actual costs and no monies were requested this year in
these accounts.
Items 3 & 7 - -The money budgeted in Account 1- 4030 -621 was for the purchase of
a pickup truck with a utility body. The truck was purchased withoutthe
special body, resulting in a savings. $200.00 is requested to be transferred
to Account 1 -4030 -623 to purchase an Acetylene Outfit for the City Street
Maintenance Division. Experience has indicated a sufficient volume of con-
tract welding.work to justify the purchase. $600.00 is requested to be
transferred to Account 1 -4020 -611, Office Equipment, to purchase a small
Ozalid Machine for use in the Police Department. It is necessary that the
large Ozalid Machine be moved to the Engineering Annex where it is needed the
most.
Item 4 - -The purchase of the Paint Striping Machine resulted in a savings
sufficient to transfer $400 from Account 1- 4030 -623 to Account 1- 4036 -623
where additional money is needed to purchase an insecticide sprayer for
spraying street trees. Bid prices for the sprayer were higher than anticipated.
Items 5 & 6 - -It is requested that $2,500 be transferred from Account 9- 4020 -511,
Rental of Buildings, $950 to be transferred to Account 1- 4020 -611, Furniture
and Fixtures for the purchase of air conditioning units and storage facilities;
$1,550 to be transferred to Account 1 -4020 -691, Non - Structural Equipment, for
the purchase of necessary lighting improvements. Originally $5,000 was
budgeted for the rental of office space for additional engineering personnel.

When the Engineering Annex on Dolan was leased, it became apparent that
the above improvements would be necessary. Of the original $5,000 only
$2,500 is necessary for the rent and utilities, making available the
other $2,500 for air - conditioning and lighting improvements.
It was moved by Councilman Dunnum, seconded by Councilman Giddings
and passed by the following vote to approve the budget transfers as set
for above in Item #2 of the City Manager's Report.

The City Manager requested, as authority had been granted for him
to attend the League Meeting in San Francisco next week, and the Inter-
national City Managers' Association meeting in St. Louis the following
Sunday, that he be granted 12 days' vacation time between these two
meetings.
It was moved by Councilman Dunnum, seconded by Councilman Temple
and so ordered that approval be granted for 12 days' vacation time for
the City Manager between the League Meeting in San Francisco October 18,
19 and 20 and the International City Managers' Association meeting in
St. Louis beginning October 25.
The City Manager reported that at the Industrial Committee Meeting
held October 12, 1959 they unanimously agreed to employ Mr. Louis J.
Kroeger, a nationally recognized municipal analyst, to prepare an immediate
analysis showing exactly what benefits this annexation #3 would give the
industrialists as well as to the City of Downey. The Committee reports
that the City's own industrialists will subscribe to $2,000 or $3,000 in
contributions to pay for Mr. Kroeger's report.
Councilman Dunnum stated that the reason for his leaving the Council
for a few minutes was based on the urgency of a telephone call from one of
the major industrialists in the area, asking that a meeting be called as
there are a number of industrialists in that area who want to hear the
complete report on Downey so they can have both sides of the story and be
better enabled to make their decision.
Councilman Giddings commended the Industrial Development Committee for
their decision to hire Mr. Louis Kroeger.
The City Manager was asked to prepare a letter whereby the industrial-
ists will be invited to attend a meeting to be held the latter part of next week.
It is felt the industrialists will be more interested in answers and informa-
tion they get from the City's industrialists and from Mr. Kroeger than from
any of the City Officials.
The City Manager announced that there will be a meeting of the Trans-
portation Committee in the Council Chambers on Wednesday, October 14, 1959,
at 7:30 P.M.
It was moved by Councilman Temple, seconded by Councilman Dunnum and
passed by the following vote that approval be granted to issue Warrant #5357
for the quarterly payment of $1,875 to the Chamber of Commerce.
