The following written correspondence was read by the City Clerk: An announcement of the directors meeting of the League of California Cities to be held on Thursday, August 6, 1959, at 7:15 P.M. at the Roger Young Auditorium. A letter from the City of South E1 Monte announcing an open house on Saturday, August 1, 1959, from 5:00 to 8:00 P.M. in celebration of their first anniversary as a city. A letter from the National Safety Council inviting the Mayor to be their honored guest to receive an Award of Merit for the City of Downey at the August 5th meeting of the Metropolitan Traffic Planning Committee to be held at the Nikabob Restaurant, 9th and Western, Los Angeles, at 12:00 noon. An announcement of the Board of Directors meeting of the Central Basin Water Association to be held at Marsal's, 2782 Firestone Blvd., South Gate, at 6:30 P.M. on Thursday, August 6. A letter signed by James W. Hartley, President of the Downey Board of Realtors, Inc., notifying the Council that inasmuch as Mr. Reno Sirrine is no longer a member of the Downey Board of Realtors, Inc., he is no longer delegated to represent the Board on the City Tax Committee. The letter recommended that Mr. Robert Garstang fill this vacancy. It was moved by Councilman Giddings, seconded by Councilman Peavey and so ordered that the recommendations of the Downey Board of Realtors, Inc. contained in their letter be accepted. Councilman Giddings nominated Reno Sirrine as a member of the Citizens Tax Committee to fill the vacancy in his district, it was seconded by Councilman Peavey and approved by the following vote. AYES: 5 Councilmen: Peavey, Dunnum, Giddings, Temple, Stamps �— NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None A letter from the Downey Board of Realtors, Inc. stating that at their regular meeting of July 13, 1959 they went on record expressing their wish to offer the City Council the assistance of the Board in any matters concerning real property and land usage, and that it is the Board's desire to receive L copies of any and all ordinances, either new or amendments, in order that they may be advised at all times. It was recommended that the City Clerk instruct the Downey Board of Realtors the Municipal Code is available at the price of $25.00 per bound copy and that the Board be given copies of the zoning ordinance when it has been finalized. A copy of a letter to Mr. C. R. Baldwin, Manager of the General Tele- phone Company which had been prepared by Mr. King for approval of the Council was read by him relative to the payment of the City of Downey business license by the telephone company. A memo from Mr. R. L. Thorborn, Division Manager of the General Telephone Company, indicated that after the company had had time to compute the gross revenue for its income within the City, which would be much easier done after the division is set up by districts, a more accurate payment of license fees could be determined and the telephone company wished permission to pay the business license fees to the City during the month of February, 1960. Mr. King's letter indicated the license fee should be determined retro- active to the effective date of Ordinance No. 34, which is January 1, 1957. It was moved by Councilman Temple, seconded by Councilman Giddings and so ordered that the City Manager be authorized to sign the letter addressed to the General Telephone Company as read by Mr. King. The City Attorney called attention to the fact that according to the Code there would be a penalty due and payable on any delinquent payment and the Council does not have authority to waive any penalty. The City Clerk stated she had received a rather lengthy document from the Southern California Water Company which was turned over to Mr. King for a resume of its contents. Mr. King reported the Southern California Water Company has made applica- tion to the Public Utilities Commission of the State of California for an increase in water rates in the Central Basin District. They state that the two main reasons for the necessity of requesting this increase is the substantial ^ increase in their investment for the facilities to improve service throughout the system coupled with the sharp increase in operating expenses caused by increased cost of power used in pumping water and substantial increase in taxes as well as inflationary increase in cost of materials, supplies and labor. The City Clerk read a letter from the vice president of the Southern California Water Company requesting the Council to support their request for an increase in their water rates. Councilman Dunnum stated he did not believe the Southern California Water Company has shown that they are operating at a loss and until it is shown that they are not netting a fair rate from their investment, he felt the City Council should oppose the application to the Public Utilities Commission for an increase in rate. It was moved by Councilman Giddings, seconded by Councilman Peavey and so ordered that based on the record before them, the City Council of the City of Downey go on record as opposed to the application of the Southern Calif- ornia Water Company to the California Public Utilities Commission for an increase in water rate. Mr. Steven Skinner was recognized by Council and he indicated he was very glad to be back in Downey after his journey through Alaska. The City Clerk then read an announcement from the County Boundary Commission of the proposed annexation to the City of Bell of an area known as Rancho San Antonio No. 2 (alternate). A letter from Thayer Smith appealing the ruling of the Downey Planning Commission on his application for lot split ( #102). Mr. Smith was unable to attend the Council Meeting and requested that his appeal be heard at the next regular Council Meeting. It was so ordered. A letter from William P. Wilson, Attorney at Law, with the required $50 deposit, appealing Zone Exception Case #140, for a double -faced sign advertising applicant's pharmacy at 10734 Paramount Blvd., Downey. The City Planner presented a resume of this zone exception case. After discussion by the Council, Lt was moved by Councilman Dunnum, seconded by Councilman Peavey and passed by the following vote that the decision of the Planning Commission in denying Zone Exception Case No. 140 be reversed and the sign be granted on the following conditions: 1. That all street improvements be installed to the satisfaction of the Director of Planning. 2. That the sign installed conform to the approved design and location. 3. That the sign be interior lighted or back lighted and be non - flashing, non - rotating and not simulate motion. 4. All lights used to illuminate any display, portion of building, office space, parking area or access aisle shall be so arranged as to not emit rays from a luminous object on any adjacent properties or public rights of way. 5. That the exception be granted in accordance with Section 521. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote to accept the work on Contract No. 26A, the resurfacing of Wiley -Burke Avenue between Firestone Boulevard and Muller St. and to authorize filing a Notice of Completion. AYES: 5 Councilmen: Peavey, Dunnum, Giddings, Temple, Stamps NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Manager reported that Contract No. 19, the construction of traffic channelization at the intersection of Woodruff and Eglise Avenues, has been completed in accordance with the Plans and Specifications. The specifications provide that the City Council may deduct from compensation due the contractor liquidated damages at the rate of $100.00 for each day the work is not completed in excess of the completion date which, in this case, would amount to fourteen days or $1400.00. Acceptance of the work and final payment has been withheld until parkway and cleanup work was completed. It is recommended that the Council at this time accept the project and authorize final payment with authority to deduct $1400.00 from the final payment for liquidating damages for the delay of 14 days at $100.00 per day. It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote to accept the work under Contract No. 19, traffic channelization at the intersection of Woodruff and Eglise Avenues, and to authorize final payment less the deduction of $1400.00 liquidating damages. It was recommended that the City Council take the following actions: 1. Accept the work and authorize final payment to.Electric and Machinery Service, Inc. 2. Authorize the filing of "Notice of Completion." It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote to accept the work and authorize final payment to Electric Machinery Service, Inc. under Contract No. 24 for the installation of traffic signals at Woodruff Ave. and Foster Road; and Paramount Boulevard and Alameda Street, and authorize filing Notice of Completion. AYES: 5 Councilmen: Peavey, Dunnum, Giddings, Temple, Stamps NOES: 0 Councilmen: None ABSENT: 0 Councilmen: .None The City Manager reported that the Paramount Tire Company proposes the development of the property lying on the east side of Paramount Blvd. extending approximately 275 feet southerly of the Southern Pacific Railroad. This firm has indicated their willingness to dedicate the necessary rights of way along Paramount Boulevard and install concrete curbs and gutters. The Company has requested the City's cooperation in providing the necessary pavement extension to meet their contemplated improvements. The estimated cost of the City's work will be $2500 and it is recommended that the City Council authorize the expenditure of this amount from Street Improvement Fund No. 1 -4130 -681. It was moved by Councilman Temple, seconded by Councilman Giddings and passed by the following vote that the Council authorize the expenditure of $2500 from the Street Improvement Fund No. 1- 4130 -681 to provide the pavement extension on Paramount Boulevard as requested by the Paramount Tire Company. The City Clerk reported she had received a request for a parade permit for the Downey Rose Float Association for July 31 at 3:00 P.M. It was moved by Councilman Temple, seconded by Councilman Giddings and so ordered that the Downey Rose Float Association be granted permission to have a parade on July 31 at 3:00 P.M. The City Manager reported that although the City Council at their last meeting tentatively approved the expenditure of approximately $3,000 from Account No. 1- 4130 -681 for a drainage catch basin on Firestone Blvd. at Myrtle Street, it was not officially moved and a roll call vote taken for the approval of the expenditure of these funds. It will be necessary for the formal action of the Council before the City can proceed. It was moved by Councilman Peavey, seconded by Councilman Temple and passed by the following vote to authorize the expenditure of $3,000 from Account No. 1- 4130 -681 for enlargement of inlets to the storm drain at Firestone Blvd. and Myrtle St. AYES: 5 Councilmen: Peavey, Dunnum, Giddings, Temple, Stamps NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Ray Lake reported that the Plumbing Code Ordinance is ready for approval for adoption with seven major recommendations to become a uniform plumbing code. The City Attorney indicated the plumbing ordinance could not be approved until it is prepared in proper code form. Council requested the attorney to prepare this as quickly as possible. Messrs. Zyler, Clark and Harris representing the building trades were introduced by Mr. Lake. Mr. Zyler commended the action taken by Mr. Lake and the City Council at the recent hearing on the plumbing code. It was moved by Councilman Peavey, seconded by Councilman Giddings and so ordered that a Citizens Retail development committee be established for the purpose of bringing business to Downey and to work on increasing retail sales in the City of Downey. Councilman Temple displayed an automobile license plate holder designating "Future Unlimited - Downey" and recommended that the citizens be urged to secure these. He reported that all profits are to go to the Rose Float Associa- tion. It was moved by Councilman Temple, seconded by Councilman Peavey and so ordered that the City Council endorse the use of these license plates by all citizens of Downey. Councilman Giddings stated the weekend of August 15 and 16 Downey will host the State Championship playoffs in the Connie Mack Baseball Leagues, which are made up of 17 and 18 -year olds. He reported that other cities support this program and he would like to urge citizens as well as city personnel to support and attend the games and barbecue. Councilman Giddings read a letter which had been received from Mrs. Jacque- line Jablonski, 2128 S. Atlantic Blvd., Los Angeles, requesting the City of Downey's policy relative to the Bandini and Rosewood Park areas. Mr. Giddings then read a letter which had been written to Mrs. Jablonski stating the fol- lowing policy: "The City of Downey is receptive to possible annexation of the unincorporated areas northerly and northwesterly of the City of Downey and if such annexation should take place in the future, the City would not create any undesirable islands such as indicated in your letter of July 23. If annexation should take place in these areas, it would be done in a systematic and comprehensible manner wherein all parties, including residential, commercial and industrial would be benefitted." It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote that the Council approve and endorse the statement of policy as above stated and authcr ize the Mayor to sign the letter to Mrs. Jablonski. AYES: 5 Councilmen: Peavey, Dunnum, Giddings, Temple, Stamps NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Manager, in response to Council inquiry, submitted a report relative to improvement of Rives Avenue between Firestone Boulevard and the railroad tracks. The property owners on the easterly side of the street have indicated that they will install curbs and gutters if the City will pay for connecting the pavement to the curbs at an estimated cost of $1,000.00. The owners wish to save the six palm trees on the east side of Rives Avenue which would result in a street width of 33 feet from curb to curb which does not come up to recommended standards of 40 feet for a street of major importance. However, if it is approved that 33 feet is desirable to save the palm trees, it probably could be accomplished on this basis with the understanding that parking would be prohibited on the easterly side. It is also recommended that the curbs be recessed along the east side of Rives for the first 100 feet southerly of Firestone Boulevard where there are no palm trees in order to accomodate two lanes of traffic northbound at this signalized intersection. The drainage problem along this section of Rives Avenue can be solved by establishing the grade of the street to run northerly to a storm drain in Firestone Boulevard. The City Manager recommended that Council authorize this project to proceed with expenditure of $1,000.00 for this street of major importance from Street Improvement Fund Account No. 1- 4130 -681. It was moved by Councilman Peavey, seconded by Councilman Temple and passed by the following vote that Council authorize improvement of Rives Avenue south of Firestone Boulevard and expenditure of $1,000.00 from Street Improvement Fund Account No. 1- 4130 -681. Zyler and Byron White spoke in opposition to the width of the street proposed. It was moved by Councilman Peavey, seconded by Councilman Giddings and passed by the following vote that the matter of parking on Rives Avenue be referred to the Traffic Committee for study. AYES: 5 Councilmen: Peavey, Dunnum, Giddings, Temple, Stamps NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mr. King reported that in order to continue the services of Mr. John Crowley as a municipal and industrial consultant it would be necessary for Council to approve a retainer fee of $350 per month. Funds are available in the current budget. It was moved by Councilman Giddings, seconded by Councilman Temple and passed by the following vote to authorize retaining the services of Mr. John Crowley as a municipal and industrial consultant to the City of Downey to serve as such at the pleasure of the Council, on a retainer fee of $350 per month. The City Attorney was instructed to draw up the necessary papers for this program. The City Manager presented a report on the possibility of establishing bus transportation system in Downey and submitted an agreement between Mr. James C. Carson and the City of Downey for approval by the City Council. The Mayor declared a 15- minute recess at 10:30 to inspect the bus pro- posed for use in the municipal transportation system being considered. IF.771M The meeting reconvened at 10:45 A.M. Councilman Dunnum stated he wished a provision inserted in the contract with James Carson to provide the City of Downey with such statistical data relative to the number of passengers that are using the proposed facilities and Councilman Giddings added Council should like to know how many people in a particular area and during what periods of time they are using the trans- portation system. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote that the agreement with the alterations, additions, and corrections contained therein be approved and that Exhibit A establishing the routes be approved by the Council before being attached to the agreement. AYES: 5 Councilmen: Peavey, Dunnum, Giddings, Temple, Stamps NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Councilman Giddings stated that for the transportation system to be successful, the citizens have to be informed this bus system is being estab- lished and why, and that a great deal of publicity should be given not only by the pressand the City but by all the local merchants and businesses. Councilman Peavey suggested the City obtain schedules and tables of bus routes and rates throughout the City of Downey. The City Attorney informed the Council that he will be on vacation the next three or four weeks. It was suggested that he arrange with Harry Williams to attend the next Council Meeting in his place. There being no further business to come before the Council, the meeting adjourned to next Tuesday, August 4, 1959, at 8:00 A.M. in the Council Chambers
