MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOW EY
JUNE 9TH, 1959
The City Council of the City of Downey held a regular meeting in
the Council Chambers of the Downey City Hall at 8:00 A.M. on Tuesday,
June 91 1959. Mayor Edwin W. Giddings presiding.

Councilman Temple recommended that a Certificate of Award be given at
the next award presentation to members of the Ministerial Association of
Downey in commendation of their cooperation in opening the Council Meetings
by way of prayer.
The Mayor announced that now is the time and place for continuation of
the hearing on the Debt Limit Report prepared pursuant to Division 4 of the
Streets and Highways Code for the improvement of Tenth Street between Brook-
shire Avenue and Birchdale Avenue.
The Mayor asked the City Clerk if she had received any written protests
or objections relative to the report. The City Clerk replied she had none.
There being no written or oral statements for or against the improvement
of Tenth Street or relating to the Debt Limit Report, it was moved by Council-
man Peavey, seconded by Councilman Temple and so ordered that the hearing on
the Debt Limit Report prepared pursuant to Division 4 of the Streets and High-
ways Code for the improvement of Tenth Street between Brookshire Avenue and
Birchdale Avenue be closed.
RESOLUTION NO. 425
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
MAKING FINDING OF FEASIBILITY OF ACQUISITION OF NECESSARY
RIGHTS OF WAY AND THE CONSTRUCTION OF CURBS, GUTTERS, AND
PAVEMENT IN ASSESSMENT DISTRICT NO. 18 (TENTH STREET)
The resolution was read by title only. It was moved by Councilman
Peavey, seconded by Councilman Temple and so ordered that further reading be
waived.
It was moved by Councilman Peavey, seconded by Councilman Temple and

Mayor Giddings announced that now is the time and place for the
hearing on the report submitted pursuant to the Municipal Improvement Act
of 1913 for the improvement of Tenth Street and the acquisition of rights
of way between Brookshire and Birchdale.
Mayor Giddings asked the City Clerk if she had received any written
protests or objections to the report. The City Clerk read a petition bearing
22 signatures requesting that the street be changed to a 30 -foot street
instead of a 36 -foot street.
There being no other written or oral protests, it was moved by Council-
man Temple, seconded by Councilman Peavey and so ordered that the hearing on
the report submitted pursuant to the Municipal Improvement Act of 1913 for
the improvement of Tenth Street and the acquisitions of rights of way between
Brookshire and Birchdale be closed and a date set for hearing on the proposed
changes.
RESOLUTION NO. 426
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
PROPOSING CHANGES IN ASSESSMENT DISTRICT NO. 18 (TENTH
STREET)
The resolution was read by title only. It was moved by Councilman
Peavey, seconded by Councilman Temple and so ordered that further reading be
waived.
It was moved by Councilman Peavey, seconded by Councilman Temple and
passed by the following vote that Resolution No. 426 be adopted and that a
hearing be set for 8:00 A.M. on June 23, 1959, in the Council Chambers on the
intention to change the work to be done by modifying the construction of
Tenth Street as shown on Plan No. 1 -11 -68 to construct the vehicular roadway
of Tenth Street to a width of 30 feet rather than a width of 36 feet as shown
on said plan.

The Mayor announced that now is the time and place for hearing protests
or objections against the improvement of Nada Street and other streets and

to this hearing as follows:

3. Affidavit of Mailing
The City Clerk replied she had the affidavits.
It was moved by Councilman Temple, seconded by Councilman Peavey and so
ordered that the affidavits of publication, posting and mailing be filed.
There being no written and no oral protests, it was moved by Councilman
Peavey, seconded by Councilman Temple and so ordered that the hearing on the
improvement of Nada Street and other streets and rights of way as described in
Resolution of Intention No. 421 be closed.
RESOLUTION NO. 427
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING WORK TO BE DONE ON NADA STREET AND OTHER STREETS
AND RIGHTS OF WAY IN ACCORDANCE WITH RESOLUTION OF
INTENTION NO. 421
The resolution was read by title only. It was moved by Councilman Temple,
seconded by Councilman Peavey and so ordered that further reading be waived.

Mayor Giddings announced that now is the time and place for the hearing
on annexation to the Downey County Lighting District of Tract #20899.
The Mayor asked the City Clerk.if she had received any written protests.
The City Clerk replied she had none.
There being no written and no oral protests to the annexation of Tract
#20899 to the Downey County Lighting District, it was moved by Councilman
Temple, seconded by Councilman Peavey and so ordered that the hearing be closed.
RESOLUTION NO. 428
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ANNEXING CERTAIN TERRITORY TO THE DOWNEY COUNTY LIGHTING
DISTRICT
The resolution was read by title only. It was moved by Councilman
Temple, seconded by Councilman Peavey and so ordered that further reading be
waived.
It was moved by Councilman Peavey, seconded by Councilman Temple and passed
by the following vote that Resolution No. 428 be adopted.

Mayor Giddings announced that this is the time and place for the hearing
on confirmation of assessments on Cole Street Assessment District #1.
Mayor Giddings asked the City Clerk if she had received the affidavits
relative to the improvement of Cole Street as follows:

RESOLUTION NO. 429
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONFIRMING THE ASSESSMENT FOR THE IMPROVEMENT OF COLE
STREET
The resolution was read by title only. It was moved by Councilman
Peavey, seconded by Councilman Temple and so ordered that further reading be
waived.

Mayor Giddings announced that this is the time and place for the
operating budget hearing. Copies of the proposed municipal budget for the
fiscal year 1959 -60 were handed to those present at the Council Meeting and
Mr. King gave a -brief summary of the proposed budget. As there were no com-
ments or discussion from the floor, it was moved by Councilman Peavey,
seconded by Councilman Temple and so ordered that the budget hearing be
closed.
Councilman Peavey requested that his motion be changed in the minutes
of the Council Meeting of May 26, 1959, to read that the contract for the
construction of the City Library be awarded to the lowest and best bidder
subject to the inspection of the bids by the City Attorney. The City Clerk
reported that the City Attorney had inspected the library bids.
It was moved by Councilman Peavey, seconded by Councilman Temple and so
ordered that the minutes of the Council Meeting of May 26, 1959, be approved
as corrected.
The City Clerk read the following correspondence:
A letter from Dr. Leon A. Wright in appreciation of the efficient manner
in which the changing of Gallatin School House Road to the name "Gallatin Road"
was accomplished.
A letter from Mr. Joe Glenn Coss, Superintendent of Downey City School
District asking the City Council to extend occupancy of the administrative and
storage quarters which the school district now occupies on the City Hall site
to October 31, 1960.
It was moved by Councilman Peavey, seconded by Councilman Temple and
passed by the following vote to extend occupancy of the administrative and
storage quarters which the Downey City School District now occupies on the City
Hall site to the end of 1960 at the rate of $508.74 with one month's free rental
of $785.00 to be deducted from their total payment.

A letter from Mr. R. A. Peet, Vice Principal of Earl Warren Senior High
School, commending the police department, and particularly Detectives Duke and
Rogers, for the excellent cooperation they have given the schools.
A letter from Mr. Stephen G. Skinner, member of the Planning Commission,
requesting permission to be exeused from Planning Commission meetings during
the period from June 19, 1959, until approximately August 1, 1959. It was
moved by Councilman Peavey, seconded by Councilman Temple and so ordered that
Mr. Skinner's letter be acknowledged and that he be excused from Planning
Commission meetings during the period stated in his letter.
A letter from Old River Men's Club requesting permission to join with
other service clubs in the area to investigate the possibility of a site for
a civic auditorium. It was recommended that approval be given and that Mr. King
write a letter to the Old River Men's Club asking them to contact the Civic
Center Committee.
A letter from Assemblyman Carley V. Porter in reply to the Mayor's letter
to him urging opposition to AB 2811 with regard to utility services.
A letter from Assemblyman George A. Willson in reply to the Mayor's wire
urging opposition to Assembly Bill 2811.
A letter from Governor Edmund G. Brown in reply to the Mayor's letter con-
cerning Assembly Bill 1000 relating to adult education.
A letter from Mayor Harold Eaves announcing that Huntington Park will be
host to the Mutual Aid Cities to be held at the Hearth Restaurant on Monday,
June 29, 1959, at 6 :30 P.M.
A letter from the County of Los Angeles Board of Supervisors advising of
a proposed incorporation of a certain area as the City of Commerce.

advising of an area proposed to be incorporated as the City of East
Los Angeles.
A letter from Mr. Earle T. Gregg, Chairman of the Industrial
Committee, recommending that the Council retain Mr. John C. Crowley as
an Industrial and Planning Consultant on a temporary basis at a fee of
$100.00 per day to assist in the promotion of industrial development
including further study of the annexation of the industrial areas
northerly of the City.
It was moved by Councilman Temple, seconded by Councilman Peavey
and passed by the following vote that the Council employ Mr. John C.
Crowley as an Industrial and Planning Consultant on a temporary basis at
the rate of $100.00 per day to assist in the survey in the promotion of
industrial development in Downey.

A letter from the Downey Jr. Chamber of Commerce requesting permis-
sion to hold its 4th Annual Fireworks Display Program on the night of
July 3, 1959, between the hours of 7:00 and 9:00 P.M. at the Downey Union
High School Football Field, which will be handled by trained personnel from
the Atlas Fireworks Company. The display has been approved by the Fire and
Police Departments.
It was moved by Councilman Temple, seconded by Councilman Peavey and
passed by the following vote to grant approval for the Downey Jr. Chamber of
Commerce to hold its 4th Annual Fireworks Display Program on the night of
July 3, 1959, between the hours of 7:00 and 9:00 P.M. at the Downey Union
High School Football Field.

9961 Lexington and Gallatin Road. After considerable discussion, it was
recommended that this matter be held under submission for further study by
the Council.
A letter from the Downey Chamber of Commerce with accompanying financial
statement. The letter included a request for payment of the remaining $2500.00
under the current contractual agreement with the Chamber. Mr. King reported
this amount is included in the warrants for Council's approval.
ORDINANCE NO. 127
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING SECTIONS 4229, 4230 AND 4231 OF THE DOWNEY
MUNICIPAL CODE WHICH SAID SECTIONS RELATE TO DOG LICENSES
The ordinance was read in full. The City Attorney explained that inas-
much as the City of Downey has a contract agreement with the County of
Los Angeles for the operation of a dog pound and that their fee is being
raised to $4.00, effective July 1, 1959, this ordinance will of necessity have
to be an emergency ordinance in order that Downey can conform with the county.

The City Attorney presented a modification of contract between the
City of Downey and the Downey Park, Recreation and Parkway District No.7
changing the agreement to include the signature of the City Clerk- Treasurer
of the City in disbursing money for the Park District.
It was moved by Councilman Temple, seconded by Councilman Peavey and so
ordered that Council approve the modification of contract with the Downey
Park, Recreation and Parkway District to include the signature of the City
Clerk- Treasurer and to authorize the mayor to sign this modification.

The City Attorney reported that in the Bleamaster case the matter has
been taken under submission and a decision should be forthcoming within 10
days to two weeks.
After a summation of bids for legal advertising, Mr. King and the pur-
chasing agent recommended that the bid be awarded to the Downey Live Wire at
the price of $1.21 per inch for the first insertion and $1.11 per inch for
the second and each subsequent insertion, for the period of July 1, 1959
through June 30, 1960.
It was moved by Councilman Stamps, seconded by Councilman Peavey and
passed by the following vote to authorize awarding the bid for legal adver-
tising to the Downey Live Wire at the price of $1.21 per inch for the first
insertion and $1.11 per inch for the second and each subsequent insertion
for the period of July 1, 1959 through June 3D, 1960.

After a summation of bids for towing and impound services, Mr. King
reported that the Police Chief recommended that the City be divided into two
districts and that two companies be designated to furnish towing and impound
services. After discussion the City Attorney ruled that the bids as ad-
vertised could not legally be awarded to two bidders.
It was moved by Councilman Peavey and seconded by Councilman Temple and
passed by the following vote to reject all bids for towing and impound
services and new bids be advertised.

After a summation of bids for Cash Contract #26 -A, the resurfacing of
Wiley -Burke Avenue between Firestone Boulevard and Muller Street, Mr. King
recommended that the bid be awarded to the lowest and best bidder, A -1
Contractors, Inc. in the amount of $4,312.50.

and passed by the following vote that, subject to the City Attorney's
approval, Cash Contract #26 -A for the resurfacing of Wiley -Burke Avenue
between Firestone Boulevard and Muller Street be awarded to the lowest
and best bidder, A -1 Contractors, Inc., in the amount of $4,312.50.

The City Manager reported that the petitionsfor the improvement of
Phlox and Pivot Streets westerly of Downey Avenue have been returned with
60.10% of the area having signed. It was recommended that the City Council
authorize the following:
1. Preparation of Plans and Specifications
2. Employing the firm of Burke, Williams and
Sorensen to prepare the legal documents
3. Advancing $4,000 to pay the engineering costs
until the bonds are sold
It was moved by Councilman Peavey, seconded by Councilman Stamps and so
ordered to approve the preparation of Plans and Specifications for Improve-
ment District #33 - Phlox and Pivot Streets.
It was moved by Councilman Temple, seconded by Councilman Peavey and so
ordered to employ the firm of Burke, Williams & Sorensen to prepare the legal
documents for Improvement District #33.
It was moved by Councilman Peavey, seconded by Councilman Temple and
passed by the following vote to authorize advancement of #4,000 to pay the
engineering costs of Improvement District #33 until the bonds are sold.

It was moved by Councilman Temple, seconded by Councilman Peavey and

Mr. Simpson reported that a petition requesting the annexation of
Tract No. 24291 to the Downey County Lighting District has been received and
recommended setting a hearing on the petition and the protests of interested
parties.
It was moved by Councilman Stamps, seconded by Councilman Peavey and
so ordered that a hearing on the petition for street lighting for Tract #24291 -
Annexation No. 3 to the Downey County Lighting District, be set for July 14,
1959.
The City Manager reported the Municipal Code has been printed and copies
have been distributed. It was recommended that a price of $25.00 be set as
the selling price of the code, including the binder, and that lOfi per page be
charged for separate sections.
It was moved by Councilman Peavey, seconded by Councilman Temple and
passed by the following vote that a charge of $25.00 be set for the Municipal
Code book and 10,,% per page.

Mr. King reported a request has been made for the transfer of $2,000 from
the operating reserve fund to Account No. 9- 3810 -399 (Contract Plan Checking)
as funds previously allocated for this purpose are insufficient due to an
abnormally large amount of plan checking requirements which involves nearly
$8,000,000 worth of construction which has been plan checked, these funds to
be reimbursed as collected.
It was moved by Councilman Temple, seconded By Councilman Peavey and
passed by the following vote to authorize the transfer of $2,000 from the
operating reserve fund to Account No. 9- 3810 -399 (Contract Plan Checking).

Mr. King requested authority from the Council for one week's vacation.

It was moved by Councilman Temple, seconded by Councilman Peavey and so
ordered that permission be granted for the City Manager to take a week's
vacation beginning June 21, 1959.
Mr. King reported that an offer for the sale of the lot on Clark Street
has been made to Mr. C. Larry Hoag in the amount of $5350.00, with a $500
deposit. This would net the City approximately $5029.00 after deducting the
real estate broker's fee of $321.00.
It was moved by Councilman Peavey, seconded by Councilman Stamps and
passed by the following vote that a counter offer of $5750.00 be made for the
lot on Clark Street.

Mr. Gabriel was instructed to call the Hoag Realty Co. suggesting the
counter offer. Mr. Gabriel reported back to the Council that the amount of
$5350.00 was the maximum amount that the prospective buyer would offer.
Council did not change their price of $5750.00.
Mr. King reported that traffic signals are being installed at 5th and
Lakewood and Woodruff and Firestone.

Mr. King recommended that Assembly Bills No. AB 158 involving pre-
payment of business licenses and taxes and No. AB 570 involving collective
bargaining for public employees be opposed.
It was moved by Councilman Temple, seconded by Councilman Peavey and
so ordered that AB 158 be opposed.

The City Manager was instructed to notify the Assemblymen immediately.
Chief of Police Ivan A. Robinson gave a brief analysis of the 1959
Annual Report of the Police Department.
Mayor Giddings commended the Chief of Police on the remarkable job he
and his department have been doing.
Councilman Peavey inquired about the progress on the study for a
municipal bus service in the City of Downey. Mr. King reported it will prob-
ably be another 30 days before completion of the survey. Councilman Peavey
recommended checking with the City of Bell and the City of Hawthorne, and also
to check with Mr. Atkinson of the Park and Recreation Department who has ex-
pressed an interest in leasing buses to the City of Downey.
Councilman Peavey made a motion, it was seconded by Councilman Temple and
so ordered that the City Manager have a survey made of what can be done to
provide for alleys back of the stores in Downey and that the City Manager bring
back his recommendations as to the improvement of the downtown area.
Councilman inquired of the City Attorney if he had checked the South Gate
proposal for abolishing obscene literature. The City Attorney reported he had
checked the South Gate proposal and that he does not believe it would be valid.
It was recommended that the proposal of the City of Los Angeles on how to
deal with lewd literature would be more practicable.
There being no further business to come before the Council, the meeting
adjourned to Saturday morning at 10:00 o'clock A.M. on June 13, 1959, for the
purpose of holding a budget hearing.
