MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY MARCH 24, 1959 The City Council of the City of Downey held a regular meeting in the Council Chambers of the Downey City Hall at 8:00 A.M. on Tuesday, March 24, 1959. Gabriel, Purchasing Agent Lester Bergslien, City Librarian Della Doyle, City Clerk The Reverend F. Ward De Beck of St. Mark's Episcopal Church gave the invocation. Mayor Giddings announced that this was the time and place for the hearing on the vacation of utility easement on Imperial Highway. The City Attorney reported that the affidavits had been received and filed and a resolution of intention to vacate has been adopted. City Manager King reported that the utility companies had been notified of the City's intention to vacate the utility easement on Imperial Highway. There being no written and no oral protests, it was moved by Councilman Temple, seconded by Councilman Stamps and so ordered that the hearing be closed on the vacation of utility easement on Imperial Highway. RESOLUTION NO. 405 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING THE VACATION OF A PUBLIC UTILITY EASEMENT OF THE NORTHERLY SIDE OF IMPERIAL HIGHWAY WESTERLY OF OLD RIVER SCHOOL ROAD. The resolution was read by title only. It was moved by Councilman Temple, seconded by Councilman Stamps and so ordered that further reading be waived. It was moved by Councilman Stamps, seconded by Councilman Temple and passed by the following vote that Resolution No. 405 vacating utility easement on Imperial Highway be adopted. AYES: 4 Councilmen: Dunnum, Stamps, Temple, Giddings NOES: 0 Councilmen: None ABSENT: 1 Councilman: Peavey Mayor Giddings announced that this was the time and place for the hearing on the Planning Commission's denial for a request for Zone Exception Case #103 to establish, operate and maintain a beauty shop at 8303 Puritan Street. ^► The City Attorney reported he had a letter of appeal from Mr. S. E. Wicker containing a request for the sign to be deleted. The City Clerk presented one written protest that could not be accepted as there was no signature. There were no other written protests. Mr. S. E. Wicker was present to support his appeal, and stated all his neighbors were in favor of the zone exception. 5An Mr. Dan McNutt, City Planner, gave a report on the action taken at the regular hearing of the Planning Commission which had denied the request of Mr. S. E. Wicker for a zone exception. Mr. McNutt stated that there were 76 signatures of residents on a petition favorable to granting the zone exception, and that protests were received from residents outside the 500 -foot radius of those who had been notified prior to the hearing. City Clerk Della Doyle read the following correspondence: A letter from Mrs. Dorothy Fuller and Ardis Westerman thanking the City Council for the adoption of the resolution at the meeting of February 24, 1959 in memory of their late husband and father. A letter from Mrs. Edgar Knight expressing the need for a crossing guard on the corner of Paramount Boulevard and Quoit Street. It was suggested that a letter be sent to Father Patrick L. Cleary with a carbon copy being sent to Mrs. Knight stating this will be taken up for consideration in the budget for 1960. A letter from the County Boundary Commission advising of Annexation No. 8 to the City of Norwalk. Letters from the County Boundary Commission advising of Annexation No.'s 34 and 33 to the City of Santa Fe Springs. A letter from Mrs. Marguerite Llewellyn, Secretary of the Parent - Teacher Association of Downey North Junior High School expressing their thanks for helping secure the signal at Florence and Rives Avenue. A letter from Mr. Thomas A. Raffety, Director of Aeronautics in the City of Long Beach, expressing appreciation to Mr. King for his appearance at the Civil Aeronautics Board hearing and for his most effective presenta- tion which he felt would be of great benefit to their case and of substantial aid in their efforts to procure adequate airline service for this area. Mr. King's presence will be requested at a future hearing next month. An announcement of a Board of Directors Meeting of the Los Angeles County Division, League of California Cities, at the Rodger Young Auditorium in Los Angeles on Thursday, April 2, 1959, at 7:15 P.M. A letter from Mr. Ray A. Walton, Secretary of the Southeast Cities Mutual Aid Pact congratulating the Mayors of the cities for the recent forma- tion of the Mayor's Association, and attesting to the value of such associations as making it possible to provide better service to the people. He wished the group to enjoy the same measure of success as the Fire Chief's Association. A letter from Mrs. H. Pipinos and the family of Chris Kocalis expressing their thanks and deep appreciation to the Downey Fire Department for respond- ing so quickly to their call for help when their father and husband was stricken with a heart attack. Mayor Giddings announced there is to be a meeting of the Southeast Area Cities in Bell on March 30, 1959, the time and location of which will be fur- nished by the City Clerk at a later date. A letter from Mrs. Lucci requesting the City Council to rescind its order requesting payment of the bond on Tract #21227. Mr. Francis Stradling, counsel for Mrs. Lucci, reported that Mrs. Lucci has entered into an escrow with the Security Land - Escrow Company thereby acquiring fee title to the property to be dedicated to the City. Mr. Stradling stated that he felt within a month he would be able to comply with the stipu- lated requirements placed on Mrs. Lucci to open the necessary streets as outlined by Council. City Manager King reported that a letter had been sent to the Fidelity & Casualty Insurance Company requesting that the faithful performance bonds be executed forthwith and that the work on the improvements in Tract #21227 be started immediately. The Council stated they will not accelerate the matter, thus giving the Lucci's sufficient time to meet the requirements set forth before the time the bonding company would process the City's claim. The City Attorney presented the suggested legislation on the library district withdrawal as requested by Council and it was directed that it be sent to the legislation council. Mayor Giddings introduced Mr. Andy Cardona, member of the Chamber of Commerce Offstreet Parking Committee and also a member of the City Traffic Committee, who reported on an analysis made of the downtown parking area with particular emphasis on the Bert Douglas lot at Second and LaReina Streets. It was recommended that the lease on the Bert Douglas lot be renewed at a reduced rate of $4800 and that half the lot's parking meters be rented on a monthly basis at a cost of $5.00 per month. Mr. King reported that the City had bid on the parking meters and luminaires on said lot and purchased them at the price of $1.00 per meter, totaling $87.00, plus $37.50 for each of the four 500 watt luminaires or a total of $237.00, and that these would be transferred to the City within the next few days. After discussion it was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote that the Bert Douglas lot be leased on 5,'30 the terms and conditions set forth in Mr. King's report; i.e., that the City of Downey come into exclusive possession of the lot, title and ownership of all the equipment; and that not more than 48 spaces be leased on a basis of $5.00 monthly per space. It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote that authority be granted to install parking meters on both sides of LaReina Avenue between Second Street and Third Street for a 2 -hour limit. AYES: 4 Councilmen: Dunnum, Stamps, Temple, Giddings NOES: 0 Councilmen: None ABSENT: 1 Councilman: Peavey It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote that the following items reported by Mr. King on March 10, 1959 be authorized and appropriate action be taken: Install a sign at the Court House indicating that long time parking is available at Second Street and LaReina Avenue. Install larger and more attractive signs directing to all City parking lots. Enlist the cooperation of the Security First National Bank and the Bank of America in keeping the traffic flowing in New Street when .--, the bank parking lots are full. (This overflow of parkers will ultimately be attracted to the lot at Second Street and LaReina Avenue.) Post larger signs giving parking rates. AYES: 3 Councilmen: Dunnum, Temple, Giddings NOES: 0 Councilmen: None ABSENT: 1 Councilman: Peavey ABSTAIN: 1 Councilman: Stamps Mr. Harry Beddoe, Mr. Guy Thomas and Mrs. Beddoe presented leis to the Mayor, City Manager and members of the Council and press and announced that there are to be 500 acres in Hawaii known as Downey, Hawaii. Mr. Beddoe read a letter from James Kealoha and a parchment with an official greeting from the County of Hawaii. The City Manager was instructed to send a letter to the Chairman and Executive Officer of the County of Hawaii acknowledging the official greeting and thanking him for naming a portion of the County of Hawaii after the City of Downey. Bill Williams, Manager of the Chamber of Commerce, introduced Mr. Albert Courtney, Divisional Officer of the Essex Fire Brigade of England who has been assigned to the City of Downey for observation of our Fire Department. Mr. Courtney stated he has been greatly impressed by what he has seen of America and was glad to have the opportunity to view a true cross section of the fire organizations throughout the Nation. City Manager King presented Mrs. Russell Nowling, who in turn presented Marian Young, Brownie, Intermediate Scout Penny Shirley and Mariner Nancy Nowling. The girls presented the City Librarian, Mr. Lester Bergslien with scout books for the new City Library to establish a scout shelf. ORDINANCE NO. 121 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING TO CHAPTER 5 OF ARTICLE VI A NEW PART RELATING TO BILLIARD ROOMS. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY OPPOSING LEGISLATION WHICH WOULD REQUIRE WATER SUPPLY RESERVOIRS TO BE OPENED FOR RECREATIONAL PURPOSES. The resolution was read by title only. The lakes affected would be Matthews, Copper Basin Dam and Gene Wash. Mr. Harry P. Hogard and Phil Greystock, 10343 South Dolan spoke in favor of this legislation, Assembly Bill #286, inasmuch as the final per- mission for use of the reservoirs as recreational facilities would be left to the discretion of the individual health departments. 5.*34- - It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote that the resolution be tabled. Since this case is in Councilman Peavey's District, it was decided to defer action until Councilman Peavey can be present. City Attorney Sorensen reported he had filed condemnation action against property located as the new Fire Station site (Florence Avenue) in order to clear deed restrictions on the property and the hearing date set for April 3, 1959. City Attorney informed the Council that the court will probably enter interlocutory judgment at the hearing April 3 inasmuch as there were no protests filed. It was moved by Councilman Stamps, seconded by Councilman Temple and passed by the following vote to ratify proceedings and purchase the property for the Florence Avenue Fire Station. Mr. King read a letter from Stiglbauer Bros. requesting that their bid be withdrawn due to the fact that they misinterpreted the bid form and had not added the $4500 for site development to their bid of $44,995 which resulted in a total bid of $49,495. Mr. King read a letter from architects Anthony and Langford recommending that the Council approve the withdrawal of Stiglbauer's bid. City Manager King recommended that the contract be awarded to the second bidder, Deck & Moody, in the amount of $46,417.95 including con- struction of the station and site development. It was moved by Councilman Temple, seconded by Councilman Stamps and so ordered finding that there was a mistake in the bid of Stiglbauer Bros., the apparent low bid, that for them to be held to the contract would impose on them a hardship and cause a loss; that on that basis it would not be in the best interests of the City to award the contract to Stiglbauer Bros. and that they be permitted to withdraw their bid as requested. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote that the bid of $46,417.95 be accepted and contract awarded to Deck & Moody for the construction of the Fire Station on Florence Avenue. Robinson reported that in connection with the serious child molestation problem, since last November, the Downey Junior Woman's Club had been working on a booklet geared to the local problem. Chief Robinson read a letter from past President Leon Emerson of the Chamber of Commerce commending the Downey Junior Woman's Club on the booklet which they have formulated. Mrs. Peck and Mrs. Nair, members of the Downey Junior Woman's Club were presented by Chief Robinson. Mayor Giddings commended the Downey Junior Woman's Club for the outstanding manner in which they had handled a very delicate subject. It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered that the Administration be authorized and directed to do any and all acts necessary incidental and proper to exploit the excellent job done by the Downey Junior Woman's Club to the fullest extent. The City Attorney presented an Agreement for legal publications be- tween the City of Downey and the Downey Live Wire. The City Attorney raised a question of adjudication of the Downey Live Wire and the Downey Leader, published by the same owners. It was moved by Councilman Temple, seconded by Councilman Dunnun and so ordered that the Agreement for legal publications be held in abeyance until the question of adjudication has been cleared. The City Attorney reported that an action has been filed by Bleamaster vs. the City of Downey relating to the action of the County of Los Angeles, between the years of 1953 and 1955, installing a curb on private property and claiming damages in the amount of $2500.00. It was moved by Councilman Temple, seconded by Councilman Stamps and so ordered to authorize the firm of Burke, Williams & Sorensen to represent the City in the matter of Bleamaster vs. City of Downey. Mr. Barhite, Director of Public Works, reported on Assessment District No. 44, Firestone Boulevard between Brookshire Avenue and Paramount Boulevard, proposed project consisting of installing ornamental street lighting system, to be constructed under the provisions of the Improvement Act of 1911. Per- mission was requested to circulate petitions. It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered that authority be granted to circulate petitions regarding Assessment District No. 44. City Manager King presented a summation of bids for Contract No. 24 for installation of traffic signals at the intersection of Woodruff and Foster, and the intersection at Paramount Boulevard and Alameda Street. It was rec- ommended that the bid be awarded to the lowest and best bidder, Electric Machinery Service, Inc. in the amount of $15,993. AYES: 4 Councilmen: Dunnum, Stamps, Temple, Giddings NOES: 0 Councilmen: None ABSENT: 1 Councilman: Peavey Mr. Barhite reported that the State Division of Highways proposes the modification of the traffic signal installation at the intersection of Lakewood Boulevard and Florence Avenue to provide for left turning phases for both directions of Lakewood Boulevard as well as the Eastbound traffic on Florence Avenue. He reported the cost to the City would approximate $7500. It was recommended that this amount be set up in the 1959 -60 budget. It was moved by Councilman Temple, seconded by Councilman Stamps and passed by the following vote that authorization be granted to put in the 1959 -60 budget approximately $7500, constituting one -half of the estimated $14,000 cost for modification of the traffic signal installation at the inter- section of Lakewood Boulevard and Florence Avenue, with a further analysis toward the possibility of allowing left turning for the entire intersection. -AYES: 4 Councilmen: Dunnum, Stamps, Temple, Giddings NOES: 0 Councilmen: None ABSENT: 1 Councilman: Peavey City Manager King reported the Agreement with the County Flood Control District for the financial reimbursement to the city for the engineering work presently being performed by Koebig & Koebig for 1958 Storm Drain Bond Issue is now ready for approval by the City Council. 511§ It was moved by Councilman Temple, seconded by Councilman Stamps and passed by the following vote to approve the Agreement with the County Flood Control District for 1958 Storm Drain Bond Issue and authorize execution of the Agreement by the Mayor. AYES: 4 Councilmen: Dunnum, Stanps, Temple, Giddings NOES: 0 Councilmen: None ABSENT: 1 Councilman: Peavey City Manager King reported the need for an additional clerk typist in the Records Department of the Police Department due to the increase of crime reports, traffic accident reports, number of complaints, warrants and subpoenas, and recommended that the City Council approve employing one clerk typist at Pay Key 8A, $281, effective April 1, 1959. The total cost for the rest of the fiscal year amounts to $843 and there are funds in the current budget for this purpose. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote to authorize employment of one clerk typist at Pay Key 8A at $281 in accordance with the City Manager's report. AYES: 4 Councilmen: Dunnum, Stamps, Temple, Giddings NOES: 0 Councilmen: None ABSENT: 1 Councilman: Peavey City Manager King reported the results of an investigation of various means of supplying air conditioning for the City Hall and Library. It was recommended that Council approve an alternate for the installation of 16 two -ton units at $350 each plus installation costs of $35, four 1 -1/2 tons at $320 each plus installation of $35 each, one 1 -ton unit at $280 plus installation costs of $35 totaling $8,095 plus the installation of the 220 volt service and wiring to each room at a cost of $4,000, bringing the estimated total to $12,000 to be appropriated from the operating reserve fund. Authority was requested to call for competitive bids for this contract. It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote to authorize a request for competitive bids of the actual cost on a discount basis for air conditioning for the City Hall and Library with the necessary alternate bids for heating and air con- ditioning combined. AYES: 4 Councilmen: Dunnum, Stamps, Temple, Giddings NOES: 0 Councilmen: None ABSENT: 1 Councilman: Peavey Mr. King reported that no bids have been received for the sale of the lot on Clark Avenue and that he had received a call from Larry Hoag who indicated he felt he could sell the lot for around $8,000. Mr. King reported he had a letter from the Realty Board approving the listing through Larry Hoag and recommended that the lot be given as a multiple listing for $7950 to the Downey Realty Board through Larry Hoag Realty Company with courtesy to all brokers. The question was raised by the Council as to whether a multiple listing with Larry Hoag would bar independent realtors from selling. City Manager King reported a call to Mr. James W. Hartley, President of the Downey Board of Realtors, approved this listing and assured courtesy to all dealers through Mr. Hoag. It was moved by Councilman Stamps, seconded by Councilman Temple and passed by the following vote to authorize placing of the lot on Clark Avenue for $7950 as a multiple listing with the Downey Board of Realtors with courtesy to all brokers as outlined in the City Manager's report. Mr. King reported that the property for the Florence Avenue Fire Station had been purchased for $20,000 and that the rear half which will not be needed can be offered for sale. A figure of from $10,500 to $11,000 was suggested by Mr. King as the sale price. Mr. King reported there were two bids received for the construction of the two small rooms for the Police Department, one for $1750 and one for $1800. Mr. King recommended rejecting the bids and building the rooms with the City's own forces, which he felt could be done within $1200. It was moved by Councilman Temple, seconded by Councilman Stamps and passed by the following vote to reject all bids for construction of two rooms for the Police Department and authorize the City to perform the work. AYES: 4 Councilmen: Dunnum, Stamps, Temple, Giddings NOES: 0 Councilmen: None ABSENT: 1 Councilman: Peavey Councilman Temple reported he has received several calls from members of the Parent - Teacher Association in the matter of lewd literature, and inquired if the Council knew of some way of regulating and prohibiting this problem. It was suggested that contact with the markets who handle such literature by members of the Parent - Teacher Association and subsequent voluntary compliance was probably the best course to follow. Councilman Stamps requested that all water petitions be handed in to the City Clerk by April 2. Councilman Dunnum reported that it was his understanding that there will be a delay on the part of the Downey Elementary School District in vacating the premises in the City Hall occupied by them, and that there is an acute housing problem in various departments of the City Hall and made a motion, seconded by Councilman Temple and it was so ordered to authorize the Adminis- trative Officer to immediately make a survey of ways and means of coping with the housing problem, and in making the survey be authorized to obtain any and all necessary appraisals relative to any locations that would be suitable. Mayor Giddings commended City Manager King on keeping the Council informed of all matters to come before them at the Council Meetings. Mayor Giddings announced there is to be a meeting of the Council with the various committee chairmen to be held the evening of March 24. Mayor Giddings reported he had received a letter from Governor Brown of California informing him of a White House conference on children and youth on March 22, 1960, asking that a chairman be appointed for a youth study in the City of Downey between cities and counties. There is to be a March 25, 1959 meeting of City and County chairmen. Mayor Giddings reported he has asked the various youth agencies to recommend someone for the job. 0 Mr. Bill Williams, Manager of the Downey Chamber of Commerce, reported that in connection with the numerous complaints received regarding the great number of pigeons throughout the business district in Downey, Mr. Byron White and the Chamber are working on trapping the pigeons.
