OF THE CITY OF DOWNEY
MARCH 10, 1959
The City Council of the City of Downey held a regular meeting in the
Council Chambers of the Downey City Hall at 8:00 A.M. on Tuesday, March 10,
1959. Mayor Pro - Tempore James L. Stamps presiding.

The invocation was given by Reverend Milton C. Gould of the First
Baptist Church of Downey.
Mayor Pro - Tempore Stamps announced that this was the time and place for
the continuation of the hearing on the Nada Street Improvement #9 for sewers.
Mrs. Mary Gleasen Gibson, 8227 E. Stewart and Gray Road, Downey (not with-
in District boundary) again spoke in protest of the sewers crossing her property.
Mr. Richard Barhite, Director of Public Works reported that after a further in-
vestigation it was recommended that the location of the sewers remain as
originally planned.
There being no oral protests and no written protests from within the
District, it was moved by Councilman Temple, seconded by Councilman Peavey and
passed by the following vote that the hearing be closed on the Nada Street
Improvement #9 for installation of sewers.

RESOLUTION N0. 396
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING WORK TO BE DONE ON NADA STREET AND OTHER STREETS
IN ACCORDANCE WITH RESOLUTION OF INTENTION NO. 381.
The resolution was read by title only. It was moved by Councilman Peavey,
seconded by Councilman Temple and so ordered that further reading be waived.

passed by the following vote that Resolution No. 396 be adopted.

Mayor Pro - Tempore Stamps announced that now is the time and place for
the hearing on the Vacation Easement along Fontana Street (light and air).
He asked if there were any protests.
There being no written or oral protests it was moved by Councilman
Dunnum, seconded by Councilman Temple and so ordered that the hearing on the
vacation of light and air easement along Fontana Street be closed.
RESOLUTION NO. 397
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE VACATION OF THAT CERTAIN EASEMENT FOR LIGHT
AND AIR ALONG FONTANA STREET.

The City Clerk read the following correspondence:
Greetings from Mayor Giddings.
A thank you card from Mrs. Arch Fuller and family.
An acknowledgment from Frank Bonelli, Chairman of the Los Angeles
Board of Supervisors of our Resolution No. 394 requesting State Legislature
to adopt A.B. 487 -- possessory interests.
A wire and note from Charles Merz in Sacramento indicating the progress
in getting the double double line removed from Firestone Boulevard.
It was moved by Councilman Temple, seconded by Councilman Dunnum and so
ordered that Mr. Charles Merz be commended for his efforts and that the City
Manager follow through in the endeavor to have the double double lines removed
from Firestone Boulevard.
A notice of the March meeting of the Southeast District Mayors and
Councilmen to be held at the Long Beach Petroleum Club, 3636 Linden Avenue,
Long Beach, on Wednesday, March 11, 1959, at 6 :30 P.M.
A notice of a meeting of the League of California Cities Los Angeles
Division to be held on March 19, 1959 at Pomona at the newly opened
Recreation Building at Palomares Park at 7:00 P.M.
A letter of protest from Mr. S. E. Wicker, 8303 Puritan Street, Downey,
and deposit of $50.00 appealing Zone Exception Case #103. Mr. Dan McNutt,
City Planner, reported the exception was to operate a beauty shop in a
garage.
It was moved by Councilman Dunnum, seconded by Councilman Temple and so
ordered that a hearing on Zone Exception Case #103 be set for March 24, 1959.
Councilman Peavey submitted several letters regarding Assembly Bill #919
as follows (Federated Fire Fighters):
A letter from the Los Angeles County Division of the League of California
Cities disapproving of the bill as proposed and stating that the thirty -eight
cities present at the February 5th meeting voted unanimously to recommend
defeat of this bill.
A letter from the City of Long Beach advising the adoption of a motion
to go on record in opposition to AB 919 and requesting the City Attorney to
prepare a resolution.
A letter from the City of Bell concurring with the stand taken by the
Downey City Council on AB 919 and enclosing a copy of Resolution No. 1634.
A letter from Assemblyman George A. Willson acknowledging receipt of
Resolution #389.
Councilman Peavey reported that the City of Santa Fe Springs is also
passing a resolution in opposition of AB 919.
Councilman Peavey reported that the City of Lakewood asked support of
Assembly Bill 602 and suggested the City of Downey send instructions to the
League of California Cities stating our position in the matter.
Councilman Dunnum suggested that we have a committee to continue
vigilance in opposition to Assembly Bill #919. Mr. King, City Manager,
reported he had requested that notification be sent to the City of Downey of
the date of hearing on this bill in order to have representation in Sacramento.
It was moved by Councilman Temple, seconded by Councilman Dunnum and
passed by the following vote that Councilman Peavey and any other Councilmen
who can attend, as well as the City Manager or someone designated by the
City Manager, represent the City when Assembly Bill #919 is presented, and
that other cities be contacted to send representatives.

AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING TO CHAPTER
5 OF ARTICLE VI A NEW PART RELATING TO BILLIARD ROOMS.

City Manager King reported the contractor, McAmis & Baker, per-
forming the improvements in District No. 11, has requested a 30 day
extension of time to complete their contract. Mr. Barhite, Director
of Public Works, reported that difficulty had been encountered in the
relocation of various utilities and it was recommended that the extension
be granted.

passed by the following vote to approve the request of McAmis & Baker for
a 30 day extension of time to complete the contract for Improvement
District No. 11.

Mr. Barhite recommended acceptance of the Improvements on Smallwood
Avenue - AM. It was moved by Councilman Temple, seconded by Councilman

Avenue Improvement #4 -M be accepted, the Notice of Completion be filed and
payment to the contractor be authorized.

Mr. Barhite reported the petitions signed by owners of 60.7% of the
area have been submitted on Dempster Improvement District #42 for sidewalks
and recommended Council action to proceed.

for Dempster Street Improvement District #42.

Mr. Barhite reported petitions had been submitted to the Public Works
Department on Assessment District #20, street lighting for Second Street,
which bore a majority of signatures of the property owners -but not 60% as
required to waive the debt limit report. He recommended preparation of a
debt limit report in which case 50% would suffice.

passed by the following vote to authorize preparation of plans and
specifications for street lighting for Second Street.

A summation of bids was presented by City Manager King for Contract
No. 22 for weed abatement, the lowest bidder being the Carbohad Corp. for
$8,995.00. After the bids were reviewed and after a discussion of the possibility
of the City's doing the work themselves by renting equipment, it was moved
by Councilman Dunnum, seconded by Councilman Temple and passed by the following
vote that all bids be rejected.

deemed necessary to handle the project of weed abatement and authorizing the
necessary rental or purchase of equipment and employment of the necessary
personnel.

A summation of bids for construction on Cash Contract #17 for work on
Borson Street east of Glynn Avenue, Old River School Road between Country
Club Road and Via Rio N ido, Telegraph Road west of Birchbark Avenue and
northwest corner of Otto Street and Downey Avenue was presented and it was
recommended that the bid be awarded to the lowest and best bidder, J. E: Riley
& Son, in the amount of $12,446.14.
It was moved by Councilman Dunnum, seconded by Councilman Temple and
passed by the following vote to approve plans and specifications for improve-
ment of Borson Street east of Glynn Avenue, Old River School Road between
Country Club Road and Via Rio Nido, Telegraph Road west of Birchbark Avenue,
and the northwest corner of Otto Street and Downey Avenue.

It was moved by Councilman Dunnum, seconded by Councilman Temple
and passed by the following vote that the bid for Contract #17 for im-
provement of Borson Street east of Glynn Avenue, Old River School Road
between Country Club Road and Via Rio Nido, Telegraph Road west of
Birchbark Avenue and the northwest corner of Otto Street and Downey
Avenue be awarded to the lowest and best bidder, J. E. Riley and Son, in
the amount of $12,446.14.

Mr. Barhite reported the engineering firm of Koebig & Koebig requested
an extension of time for submission of the finished plans for the storm
drain bond issue program for 1958 and recommended extending the time as
requested to March 20, 1959.
It was moved by Councilman Dunnum, seconded by Councilman Temple and
passed by the following vote to extend the time to March 20, 1959 for Koebig
& Koebig for plans and specifications on storm drain engineering.

It was moved by Councilman Dunnum, seconded by Councilman Temple and
passed by the following vote to approve plans and specifications and authorize
the call for bids for traffic signals at Woodruff and Foster, and at Paramount

Mr. Barhite submitted a report on the Stamps Avenue Assessment #24 for
street improvements north of Gallatin School House Road and requested approval
to engage a private engineer for processing the improvement district because
of the heavy workload now in the City Engineering Department.
It was moved by Councilman Temple, seconded by Councilman Dunnum and
passed by the following vote to authorize engaging the firm of Kenneth Bruner
and authorize advancement of funds for the engineering work.

Mr. Barhite presented a report on the proposed Improvement District No. 25
(Eucalyptus, Glynn, Brookshire, etc.) and recommended the improvements be done
simultaneously in the area designated.

passed by the following vote that the Council go on record as approving an
over -all project for the proposed Improvement District No. 25. (Eucalyptus,
Glynn, Brookshire, etc.)

Mr. King reported that the Lucci's have not complied with the provisions
set forth for the extension of time on Tract #21277.
Mr. William Lister, 12631 E. Imperial Highway, Santa Fe Springs, legal
counsel for the Lucci's reported that his attempts to get in touch with the
Lucci's to request that they attend the Council Meeting had failed.
The City Attorney reported that a bond delivered by the Lucci's had
been returned to them for modification and to date had not been taken care
of.
Councilman Dunnum asked in what manner the Lucci's are in default.
Mr. Barhite reported that an instrument had been delivered to the Public
Works Department showing the Lucci's have title to the property for the
Lucci Manor project; however, there is an outstanding deed of several
thousand dollars which requires partial re- conveyance in order for the City
to have clear title. The bond which was delivered by the Lucci's included
a provision for reimbursement for sewers which was improper.
Councilman Dunnum moved and it was seconded by Councilman Temple that
a letter be mailed forthwith to the bonding company in accordance with his
prior motion made at the meeting of February 24, 1959, stating that the
time has elapsed and the City is ready to exhaust the remedies under the
bond as provided for in the original faithful performance bond, and it was
passed by the following vote:

Mr. King reported that the City Clerk had completed the preliminary
codification of ordinances and is now ready for final codification and indexing
at an estimate of approximately $2500. There are funds in the budget for
this purpose. City Manager recommended proceeding with this work at the
above estimated cost of supplying 100 initial copies.

the City Code at a cost not to exceed $2500.

City Manager reported on the parking lot situation in the City and made
several recommendations to bring the cost and revenues into closer balance
and to stimulate increased utilization of all City owned parking lots.
It was moved by Councilman Dunnum, seconded by Councilman Temple and
passed by the following vote to table action on the parking lot situation
until the next Council Meeting, March 24, 1959, and if satisfactory arrange-
ments have not been made, then the City Attorney be instructed to send a
notice to the Los Angeles County that they are collecting money from parking
meters which they own on a parking lot on which we are paying rental, giving
them five days to remove the parking meters from the City's lot or the City
will forthwith remove the meters and put them in storage.

Councilman Dunnum recommended that appropriate action be taken to
demand an accounting of the parking meter funds.
City Manager King reported that no bids had been received from the
advertisement for bids on the sale of a 50 x 120 foot lot on Clark Avenue.
It was recommended that it be held open for sale.
A summation of bids received for servicing City vehicles from bulk
tanks was reported by the City Manager who reported the low bid was by
04 L. & S. Service at .03(,, per gallon. Mr. King recommended that the bid
be awarded to the lowest and best bidder.
It was moved by Councilman Temple, seconded by Councilman Dunnum 'and
passed by the following vote to authorize awarding bid for servicing City
vehicles to the lowest and best bidder, L. & S. Service at .03(" per gallon,
the contract to expire June 30, 1960, with a 60 day cancellation clause
included.

City Manager reported that the owners in the estate of the James
Property which constitutes 70 feet on Firestone immediately adjacent to the
Bank of America property had agreed to sell this property to the City at a
price of $31,500.
It was moved by Councilman Temple, seconded by Councilman Dunnum and
passed by the following vote to accept the offer of the owners in the estate
of the James Property, to authorize the City Manager to accept the offer in
writing, and to do all things necessary for consummation of the sale at the
price of $31,500.

Mr. King reported that the work of painting the City Hall had been com-
pleted and recommended it be accepted and final payment to the contractor,
J. F. Justice Company be authorized.
It was moved by Councilman Dunnum, seconded by Councilman Temple and passed
by the following vote to approve accepting the job of the painting of the City
Hall by the J. F. Justice Company and authorize final payment to them.

Mr. Peavey recommended that Mr. King re- negotiate with Bert Douglas for
a more equitable price on lease of the parking lot by the City or for the pos-
sible purchase of the lot.
After a discussion of library withdrawals from the County, it was moved
by Councilman Temple, seconded by Conncilman Dunnum and so ordered that the
City Attorney be instructed to draw up legislation providing for a division
of assets upon the withdrawal from the library district.
Councilman Temple suggested,that the time element be watched a little
more closely on contracts for paving, etc. as in the past the contracts have
seemed to be unusually slow toward completion.
Councilman Dunnum officially commended Officer Foster for action taken
by him while off duty in quelling a major disturbance in the City of Downey.

Councilman Peavey asked if traffic signals were in order at Wiley -
Burke and Florence. It was suggested that a survey of the entire city
giving priority to actual hazardous traffic conditions be included in the
budget. It was reported a traffic signal at 5th Street and Lakewood Blvd.
will be on the way by May.
It was moved by Councilman Dunnum, seconded by Councilman Temple and
passed by the following vote to oppose the following Assembly Bills and
that telegrams be sent over the Mayor's signature:
AB 602 (providing for collective bargaining for public employees)
AB 618 (prohibiting fire fighters to join a labor union of their
own choice)
AB 631 (prohibiting any city from denying any employee, including
policemen, the right to join a union)
(The League of California Cities advises sending notifica-
tion to Assemblymen as to the wishes on above bills.)
AB 413 (Include all associations, such as employees association,
as a union and be treated as such)
AB 479 (Cost of uniforms to be borne by employer.)
Chief Gain of the Fire Department spoke against this bill.
Police Chief Ivan Robinson concurred with Fire Chief Gain.
Police Chief Robinson stated that an organization of law enforcement was
no place for a union to be established and the City should definitely fight
any action which would be an effort to unionize.
