Mayor Edwin W. Giddings presiding. PRESENT: Councilmen: Dunnum, Giddings, Temple, Peavey ABSENT: Councilman: Stamps ALSO PRESENT: Oren L. King, City Manager Glenn Kendall, Assistant City Manager Royal M. Sorensen, City Attorney Richard Barhite, Director of Public Works Robert Gain, Fire Chief Ivan A. Robinson, Chief of Police Ray Lake, Director of Building & Safety Dan McNutt, City Planner Harold Durham, Traffic Engineer Lester Bergslien, City Librarian Della Doyle, City Clerk The Mayor announced that this was the time and place for hearing protests or objections to the report prepared and submitted under the Debt Limit Act or to the proposed improvement of Cole Street, Improvement No. 1, or any protests or objections to the work or proceedings as described in the report. The Mayor asked the City Clerk if an Affidavit of Mailing had been received. The City Clerk answered yes. It was moved by Councilman Peavey, seconded by Councilman Temple and so ordered that the affidavit be received and filed. Mr. Barhite, Director of Public Works, was asked to read the report as set forth in Section 2857 of the Streets and Highways Code. The Mayor asked the City Clerk for any written protests. The City Clerk had one containing 15 signatures, representing 8 parcels. Mrs. James F. McWaters, 8329 E. Cole Street was present and spoke in sup- port of the written protest. Mr. John Bower, 9618 Shellyfield Rd., Downey, suggested that the cost of the Cole Street improvements be paid by the City. Councilman Dunnum explained that improvements of this nature are paid for by the City only on major arterials and that the cost of improvement of residential streets must be borne by the property owners. It was moved by Councilman Temple, seconded by Councilman Dunnum and so ordered that the hearing be closed, there being no further written or oral protests. The City Attorney stated the percentage of written protests or objections to the report should be referred to the engineer to compute. The Mayor announced that this was the time and place set for the hearing on ordering a work change on Smallwood Avenue Improvement 4 -M. The Mayor inquired if there were any written or verbal protests. There being none, Councilman Temple moved, Councilman Peavey seconded, and it was so ordered that the hearing be closed. • An RESOLUTION NO. 368 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING A CHANGE IN PROCEEDINGS IN DOWNEY IMPROVEMENT NO. 4 -M (Smallwood Avenue). The resolution was read by title only. It was moved by Councilman Peavey, seconded by Councilman Temple and so ordered that further reading be waived. It was moved by Councilman Temple, seconded by Councilman Peavey and passed by the following vote that Resolution No. 368 be adopted. The City Clerk read the following correspondence: Notices of Central Basin Water District Meeting of the Board of Directors and Meeting of the Los Angeles County Division, League of California Cities, both to be held February 5, 1959. A letter from Orville G. Miller, 7803 E. 8th Street, Downey, urging the City to build an adequate library, and expressing appreciation of the Council's excellent work. A letter from Charles R. Gainor, Acting Postal Installations Manager stating that the authority was granted to change the postal boundary between Paramount and Downey. The effective date for this adjustment in postal boundaries has been tentatively set for March 7, 1959. A letter from R. K. Goates, Superintendent of the Downey Park, Recreation and Parkway District stating the Downey Recreation and Park District is planning to form a civic organization to manage the affairs of the Downey Symphony Orchestra. However, at this time Park District officials are handling all affairs of the orchestra. Mr. Barhite reported that only 33.67 percent of the property owners in the Cole Street Improvement District #1 were represented by the written protest presented. It was moved by Councilman Peavey, seconded by Councilman Temple and so ordered that the finding of the Council was that only 33.67 percent of the owners did protest the Cole Street Improvement #1. It was moved by Councilman Peavey, seconded by Councilman Temple and passed by the following vote that all protests against the Cole Street Improve- ment #1 be overruled. The resolution was read by title only. It was moved by Councilman Peavey, seconded by Councilman Temple and so ordered that further reading be waived. It was moved by Councilman Temple, seconded by Councilman Peavey and passed by the following vote that Resolution No. 369 be adopted. It was moved by Councilman Peavey, seconded by Councilman Temple and so ordered that the affidavits be received and filed. The Mayor asked if there were any written protests. The City Clerk re -read the protest setting out 15 signatures. There were no oral protests. It was moved by Councilman Peavey, seconded by Councilman Temple and passed by the following vote that all protests against the improvement of Cole Street as described in Resolution of Intention No. 352 be overruled. The resolution was read by title only. It was moved by Councilman Peavey, seconded by Councilman Temple and so ordered that further reading be waived. AYES: 3 Councilmen: Peavey, Temple, Giddings ABSTAIN: 1 Councilman: Dunnum NOES: 0 Councilmen: None ABSENT: 1 Councilman: Stamps RESOLUTION NO. 371 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AUTHORIZING A CONTRIBUTION BY THE CITY IN THOSE CERTAIN ASSESSMENT DISTRICT PROCEEDINGS PURSUANT TO RESOLUTION OF INTENTION NO. 352. The resolution was read by title only. It was moved by Councilman Peavey, seconded by Councilman Temple and so ordered that further reading be waived. It was moved by Councilman Temple, seconded by Councilman Peavey and passed by the following vote that Resolution No. 371 be adopted. AYES: 3 Councilmen: Peavey, Temple, Giddings ABSTAIN: 1 Councilman: Dunnum NOES: 0 Councilmen: None ABSENT: 1 Councilman: Stamps • The Mayor announced there were several people present who might wish to express themselves on certain issues and be on their way as the meeting was becoming quite lengthy. He asked that anyone caring to speak, come forward at this time. Mr. E. F. Brown, 10548 Shellyfield Road, Downey, presented a protest by the residents of the area surrounding the Aloha Gardens Apartment Hotel which had been granted permission to erect a sign larger than that permitted in the R -3 zone. He was there to request a public hearing in their behalf. The City Attorney gave a review of the matter. He informed the citizens that when the City Council approved Mrs. Sammartano's appeal, reversing the Planning Commission, and granted an exception, according to the State Laws and City Ordinances there was no further appeal possible and the Council has no power to rescind or amend the exception granted. He further stated that the deed restrictions on the properties can act as no restriction on the zon- ing. The question of whether there is a violation of the deed restrictions is a matter between the private parties concerned and not a question which can be determined by the City. Their remedy to enforce the deed restriction, if it is applicable, would be in the courts. He stated further that while a public hearing could be held, it would be of no material advantage as there was nothing that the City Council could do under existing ordinances and state laws. The following citizens spoke in protest to the Council's action in grant- ing the exception to Mrs. Sammartano to erect the sign: Mrs. Virginia Beverly, 7973 Harper, Downey (Owns property at 10506 Arrington) Mr. R. J. McCray, 7740 Birchleaf, Downey (Owns property at 10537 Arrington) Mary E. Hollis, 10230 Cord Ave., Downey Everett Mason, 9111 Gallatin Schoolhouse Rd., Downey Mayor Giddings recommended that one of the group contact the City Manager to arrange for an unofficial public hearing if they so desired, but again stated that the Council could not legally do anything further on this matter. Councilman Stamps arrived at the meeting at 9:10 A.M. Mayor Giddings declared the hearing closed. ORDINANCE NO. 117 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING TO CHAPTER 1 OF ARTICLE III SECTION 3132.1 THERETO RELATING TO THE INSTALLATION OF YIELD SIGNS. The ordinance was read by title only. It was moved by Councilman Temple, seconded by Councilman Peavey and so ordered that further reading be waived. Mr. Harold Durham, Traffic Engineer, displayed charts and explained how justification was arrived at for changing the speed limits. It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered that further reading be waived. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING CERTAIN SECTIONS OF THE DOWNEY MUNICIPAL CODE, BEING RESPECTIVELY, SECTIONS 2801 RELATING TO THE DIS- POSAL OF UNCLAIMED PROPERTY, 4204 RELATING TO POUND SERVICE, 4505 RELATING TO CHARITABLE SOLICITATIONS, 6514.1, 6527, and 6530 RELATING TO TAXI CABS, 6538.1 RELATING TO PAWNBROKERS, AND 6547.1 RELATING TO DEALERS IN GOLD. Title and Section 4505 only of said ordinance were read. It was moved by Councilman Peavey, seconded by Councilman Temple and so ordered that fur- ther reading be waived. Mr. John Bower, 9618 Shellyfield Rd., Downey, reopened the issue of pro- viding shelters in public buildings, and the possibility of considering such plans for the new fire station. He urged again that provision of shelters in public buildings be considered and council action be taken. Councilman Temple recommended that the matter be referred to the Civic Center Study Committee. Mr. Dan McNutt, City Planner, presented a report on the Lucci property. He stated that Mrs. Lucci had agreed to dedicate property to the City and post bond, not to exceed $4500.00, for a City Street as shown on Exhibit A. It was moved by Councilman Peavey, seconded by Councilman Dunnum and passed by the following vote that the Agreement and the bonds on the Lucci Subdivision #21227 be extended for a period of four weeks from this date on the following conditions: That the following documents be filed with the City prior to February 1, 1959: AYES: NOES: ABSENT: 1. That a certificate be received from the bonding company stating that such extension is approved and accepted by the bonding company. 2. That there be delivered to the City an instrument indicating that the Luccis have the title to Parcel A as shown on City Council's Exhibit A dated January 27, 1959, or that they have the right to go upon that parcel for the purpose of improving it as a street including sidewalks, curbs and gutters, and including sewer rights as required by the Department of Public Works. 3. That there be an Agreement on file with the City to improve Parcel A on said Exhibit A in accordance with city standards and requirements of the Department of Public Works. 4. That there be an offer of dedication of Parcel A on file with the city. 5. That there be on file with the city, bonds guaranteeing that the improvements referred to here and above be completed on Parcel A within 90 days from February 1, 1959. 5 Councilmen: Peavey, Dunnum, Stamps, Temple, Giddings 0 Councilmen: None 0 Councilmen: None Mr. Langford of the firm of Anthony and Langford presented plans and specifications of the Fire Station on Florence Avenue. It was moved by Councilman Temple, seconded by Councilman Giddings and passed by the following vote that the plans and specifications of Fire Station #4, subject to City Attorney's review and approval be adopted as presented. AYES: 5 Councilmen: Peavey, Dunnum, Stamps, Temple, Giddings NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mr. Lee Felts, Chairman of the Planning Commission presented a report on Land Use Map. He outlined the progress that has been made and contrasted both time and costs with similar work in other cities and reported that the com- pleted ordinance should be ready for adoption by the latter part of May. The Mayor and councilmen congratulated Mr. Felts on the report and the work being done and added that the Planning Committee was one of the hardest working bodies in the City. done. The City Attorney was requested to give this ordinance immediate attention. Councilman Dunnum requested to be excused from the meeting and this was RESOLUTION NO. 372 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY REQUESTING THE EXPENDITURE OF COUNTY AID TO CITIES FUNDS ON CERTAIN MAJOR STREETS WITHIN THE CITY. "RECOMMENDATION: It is respectfully recommended that sanitary sewers be installed in this district. "ANALYSIS: This Department has made an investigation of the Otto Street Sanitary Sewer Improvement District No. 29, City of Downey, as shown on the attached map. During the course of this investi- gation nine house -to -house calls were made. Of this number 3 occupants were not at home or did not answer the door. Of the 6 property owners or tenants actually contacted, 4 or 66 -2/3% reported having experienced trouble with their individual subsurface sewage disposal systems. They complained that the systems filled up, causing raw sewage to back up into the house plumbing fixtures or to overflow on to the surface of the ground, also that frequent pumping and cleaning out of the systems was necessary. One contact reported that it was necessary for them to install the second cesspool one year ago. "The soil within the area of this proposed sanitary sewer district consists mostly of a fine silty sand. This type of soil is not conducive to the "^ proper functioning of any type of individual subsurface sewage disposal system as it has poor leaching qualities. "In view of the facts revealed by our survey, I, the undersigned Health Officer of the County of Los Angeles, having been officially designated by the City Council of the City of Downey to perform purlic health services for the City of Downey, do hereby recommend that proceedings be instituted e at once for the construction of sanitary sewers in Otto Street, City of Downey, as an improvement necessary to the protection of public health and pursuant to the provisions of Section 2808 of the Streets and Highways Code." "RECOMMENDATION: It is respectfully recommended that sanitary sewers be installed in this district. "ANALYSIS: This Department has made an investigation of City Im- provement Sanitary Sewer District No. 23, City of Downey, as shown on the attached map. During the course of this investigation 15 house -to -house calls were made. Of this number 6 occupants were not at home or did not answer the door. Of the 9 property owners or tenants actually contacted, 6 or 66 -2/3% reported having experienced trouble with their individual subsurface sewage dis- posal systems. They complained that the systems filled up, causing raw sewage to back up into the house plumbing fixtures or to overflow on to the surface of the ground, also that frequent pumping and cleaning out of the systems was necessary. One contact reported that it was necessary for them to pump their sewage disposal system every two or three months. Several of the homes in the area of this proposed sanitary sewer district are from 8 to 18 years old. The sewage disposal systems for these homes are now failing, due to the sealing of the voids in the soil with sludge and suspended material. "In view of our survey, I, the undersigned Health Officer of the County of Los Angeles, having been officially designated by the City Council of the City of Downey to perform public health services for the City of Downey, do hereby recommend that proceedings be instituted at once for the instal- lation of sanitary sewers in Nada Street west of Old River School Road, City of Downey, as an improvement necessary to the protection of public health and pursuant to the provisions of Section 2808 of the Streets and Highways Code." Of the four property owners or tenants actually contacted, one or 25% reported having experienced trouble with their individual subsurface sewage disposal system. They complained that the system filled up, causing raw sewage to back up into the house plumbing fixtures or to overflow on to the surface of the ground, also that it was necessary to pump the system every two months in order to prevent it from overflowing. "The soil within the area of this proposed sanitary sewer dis- trict consists mostly of a fine, silty sand. Councilman Peavey suggested that the City Attorney secure other property for parking facilities. The City Attorney reported he was attempting to get some commitment so that he can make a specific report to the City. Mr. King suggested that the Council meet with the architect and go over various phases of the Civic Center over -all plans. Mr. King submitted a report on the widening of Third Street and of Cherokee Drive, and an estimated cost. He suggested that an appraisal be made, which would cost approximately $300 for each subject, to determine a more accurate figure for the cost of these improvements. In order to start this operation by July 1, 1959, it would be necessary to place orders for equipment now. The City Manager requested that $14,000 from General Reserves be appropriated for equipment for the Electrical Division to initiate the purchase of equipment. Councilman Stamps wished to impress again the importance of getting enough signatures on the water replenishment district. It was suggested that the various service clubs and organizations work on getting the necessary petitions signed. Councilman Temple reported that he had attended the Long Beach City College awards program and that five out of eleven of the awards were presented to Downey students, and that Downey was well represented on various committees and the student council at the college, and that he was quite proud of this representa- tion for Downey. Councilman Temple suggested as a result of his attendance at the Boston Mayor's Conference, the possibility of Downey forming auxiliary reserve fire and police departments be considered. He suggested that a study of the feasibility of having auxiliary police and /or fire units be made. Councilman Temple again brought up the matter of non - licensed persons doing business in Downey, and in particular, television repairmen. Councilman Temple urged that no person in Downey use the services of, or purchase from anyone unless they can produce permit or license. Mr. Gordon Prentiss, 7901 Seventh Street, Downey, owner of Prentiss T.V. Repair Service, reported that on December 17 or 19 he had reported five persons operating television repair service from their garages without license or permit, or in the wrong zone. As far as he knew, there had been no action to correct this situation in these particular instances. Mr. Prentiss was in- formed that definite action would be taken immediately by the proper authorities. Councilman Temple reported that there has been a deluge of throw -aways on drives and lawns. The City Attorney stated there is an ordinance covering handbills. Any violation of this ordinance should be reported to the Police Department. Councilman Peavey requested that a study be made with the thought of putting a signal at Wiley -Burke and Florence being included in the budget. 499 Councilman Peavey inquired of the City Manager if he had had a response from the Gallatin School District about putting in their own sidewalks. The City Manager replied he had none but would contact them again. Councilman Temple moved, Councilman Peavey seconded and it was so ordered that a letter be written to the Gallatin School District asking them to include that installation of sidewalks in their budget. Councilman Peavey reported that various apartment house builders had built on approvals for a parking area and had subsequently torn out parking areas to install a pool. Councilman Peavey recommended that Mr. McNutt investigate to see if this deviation from building approvals is taking place and also that an inspection be made of these properties. There being no further business, the meeting adjourned at 12:00 noon. City Cler Mayor => 5 / 1 Mrs. M. L. Sammartano requested a review of yield on Lakewood Blvd. and Muller Street. This was referred to the Traffic Committee. Mr. Merl Nordschow personally appeared and stated he is a resident of 8703 Meadow Rd. near Blodgett, Downey, and submitted a petition signed by 41 of 44 families protesting construction at Meadow Road. It was referred to the Director of Public Works. Councilman Dunnum reported he and Mr. Gauldin had made a tour with '�`` members of the Police Department. Councilman Dunnum commended the depart- ment very highly on its speedy and efficient operation. He recommended that other members of the City Council take a similar tour. Councilman Dunnum recommended expediting the land use map. It was moved by Councilman Dunnum, seconded by Councilman Giddings and so ordered that the Planning Commission be requested to report at the next Council Meeting on the progress of the land use map and any possible ways to expedite its completion. Councilman Dunnum reported certain members of the Planning Commission have inquired about being reimbursed for expenses incurred by attendance at the Planning Congress monthly meeting. Councilman Giddings requested the City Attorney to submit a report at the next meeting on what steps, if any, could be taken to withdraw a portion of Downey in the Triangle area from another park district and make it a part of the Downey Parks & Recreation District. Councilman Giddings announced that there will be a baseball meeting next Monday at 6 :00 P.M. at the Elks Club for all who wish to attend. Councilman Peavey asked that the matter of installing sidewalks for North Downey Junior High School and Maude Price School be reported on again. Councilman Peavey asked that the City of Paramount be notified of the change of name of Florence Street to Prichard Street. Mayor Temple reported that the week of January 11 through January 17, 1959 has been designated National Printing Week and he so proclaimed. Mayor Temple reported that various operations of illegitimate businesses in Downey had been brought to his attention and he recommended that citizens challenge door -to -door peddlars by asking to see their permit or license and to report them if they were unable to produce a permit or license. Mayor Temple read his letter of resignation as Mayor of the City of Downey. Mayor Temple outlined some of the projects he would like to see accomplished during the coming year. After reading his letter of resignation to the City Council, Mayor Temple stated he was pleased to have had the experience of serving as Mayor and hoped the fine work would be carried out in the future.
