OF THE CITY OF DOWNEY
December 23, 1958
The City Council of the City of Downey held a regular meeting in the
Council Chambers of the Downey City Hall at 8:00 A.M. on Tuesday, December 23,
1958. Mayor Scott E. 'Temple presiding.

The Mayor announced that this was the time and place set for a public
hearing on the debt limit of Verdura Avenue in assessment District No. 5 -M.
Mr. W. J. Hanson, Deputy City Engineer for the County of Los Angeles presented
a report on the construction of sanitary sewers. There being no written
protests and no protests from the floor it was moved by Councilman Stamps and
seconded by Councilman Peavey and so ordered that the hearing be closed.
RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
MAKING FINDING OF FEASIBILITY IN THE MATTER OF DOWNEY
IMPROVEMENT NO. 5 -M (VERDURA AVENUE).
After some discussion this resolution was tabled until the next Council
meeting in order that it may possibly be presented as a combination district
including streets as well as gutters.
It was moved by Councilman Stamps, seconded by Councilman Giddings and so
ordered that the minutes of the meeting of December 9, 1958 be approved as
corrected.
The Mayor then announced that this was the time and place set for a public
hearing on the Cole Street Area Annexation to the Downey County Lighting
District. City Attorney Royal M. Sorensen asked if an Affidavit of Publication
and Petition were on file. City Clerk Della Doyle said yes. The Mayor in-
quired if there were any written or verbal protests. There being none,
Councilman Stamps moved, Councilman Peavey seconded and it was so ordered that
the hearing be closed.
RESOLUTION NO. 345
A RESOLUTION OF'THE CITY COUNCIL OF THE CITY OF DOWNEY
ANNEXING CERTAIN TERRITORY TO THE DOWNEY COUNTY LIGHTING
DISTRICT.
The resolution was read by title only. It was moved by Councilman Peavey,
seconded by Councilman Giddings and so ordered that further reading be waived.
It was moved by Councilman Peavey, seconded by Councilman Stamps and
passed by the following vote that Resolution No. 345 be adopted.

The City Clerk read the following correspondence:
A letter from Senator William F. Knowland, Senator Thomas H. Kuchel and
Senator Clyde Doyle in recognition of Resolution No. 330 requesting postal
facilities.
A letter from the Downey Elks Lodge 2020 expressing their appreciation
for supporting narcotics control program.
^ A letter from Mr. Frank Burdsall, Jr., Certified Public Accountant in
the City of Downey, and a letter from Southern California Edison Company in
Whittier, California, expressing appreciation for tax savings effected by
the City of Downey.
A letter from J. Lyle Cunningham of Louis J. Kroeger and Associates
extending seasons greetings.
A letter from City Manager Meno L. Wilhelms of the City of Santa Fe
Springs, California in appreciation of our aid in fire fighting.
A letter from Murray Kramer, Merchant's Division of Downey Chamber of
Commerce in appreciation of the City's cooperation on the Christmas Parade
Project.
A letter from Frank G. Bonelli, Chairman of the Board of Supervisors,
outlining procedure for flood control.
A letter from the County Boundary Commission announcing Annexation No. 30
to the City of Santa Fe Springs.
A letter from Wendell W. Schooling, 9315 Gaymont Avenue, Downey, re-
questing exemption to non - sidewalk areas where there is no foot traffic from
any proposed ordinance prohibiting shrubbery adjacent to the streets where
children walk. Councilman Peavey stated that was the intent of the Council to
so designate in any ordinance to be considered.
— A letter from Lee A. Schmidt, President of the Downey County Water
District stating they do not agree with the City Attorney that there has been
a dissolution or merger. Action by the City Attorney has already been started
toward adjudication of the matter.
A letter of resignation from the Water Committee from Mark F. Joseff.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING TO CHAPTER 5
OF ARTICLE VI A NEW PART RELATING TO BILLIARD ROOMS.
The ordinance was held over for future study.
RESOLUTION NO. 346
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AUTHORIZING THE USE OF CERTAIN ACCESS RIGHTS DEDICATED
TO THE CITY OF DOWNEY (S.E. CORNER FLORENCE & OLD RIVER
SCHOOL RD.).
The resolution was read by title only. It was moved by Councilman
Stamps, seconded by Councilman Giddings and so ordered that further reading

RESOLUTION NO. 347
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY AUTHORIZING THE USE OF CERTAIN ACCESS RIGHTS
ON IMPERIAL HIGHWAY WEST OF LAKEWOOD BOULEVARD.
The resolution was read by title only. It was moved by Councilman

A report of the Library Advisory Board and the Civic Center Advisory
Committee recommending to the City Council that the services of the firm
of Anthony and Langford of Whittier, California be used for the preliminary
drawings and cost estimates for the Library Building was presented. After
some discussion Council action was held pending the presentation of a
formal agreement.

BE ISSUED TO REPRESENT THE COST THEREFOR, DECLARING
THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC
BENEFIT, AND THAT THE EXPENSE THEREOF SHALL BE
ASSESSED UPON A DISTRICT.

The City Attorney reported that a preliminary title report on the property
in escrow on Florence Avenue shows that there are restrictions on it
limiting it to residential structures. It will be necessary to have Quit
Claims signed by adjacent property owners or condemnation proceedings will
have to be instigated. It was moved by Councilman Giddings, seconded
by Councilman Peavey and so ordered that the necessary signatures be
obtained if possible and that the City Attorney be authorized to prepare
the papers to start condemnation proceedings.
A summation of bids received on December 22, 1958 for Contract #19,
for traffic channelization at the intersection of Woodruff and Eglise was
presented and it was recommended that the bid be awarded to the lowest and
best bidder, U. S. Paving Company.

and passed by the following vote that the bid for Contract #19 for traffic

Stewart and Gray Road improvement from Paramount Boulevard to Horton Avenue
was presented and it was recommended that the bid be awarded to the lowest
and best bidder, Alan M. Hess d /b /a as H. & H. Construction Company, in the
amount of $24,685.20.
It was moved by Councilman Stamps, seconded by Councilman Giddings and
passed by the following vote that the bid for Contract #16,for Stewart and
Gray Road improvement from Paramount Boulevard to Horton Avenue be awarded to
the lowest and best bidder, Alan M. Hess d /b /a as H. & H. Construction
Company, in the amount of $24,685.20.

It was moved by Councilman Stamps, seconded by Councilman Peavey and
so ordered that the City Attorney be authorized to prepare deeds for
squaring up the property at 2nd and Brookshire purchased by the Downey
Elementary School District.
Mr. King reported that the Florence Avenue construction will be
completed this week.
The City Council approved Mr. King's request for a vacation between
Christmas and New Year's Day.
Mr. Roy Starkey, Director of Finance, reported that the sales taxes
were running over amounts estimated.
Mr. King recommended that all of the ordinances regarding safety of
excavations, etc. be reviewed.
Mr. King reported that he was working with the County of Los Angeles
endeavoring to clarify the responsibility of the parking lot meters.
Mrs. M. L. Sammartano, 9007 Muller Street, Downey, California, made a
plea to the Council for some relief to her problem in the Aloha Gardens
Apartments. She requested that she be allowed to erect a sign indicating
that thespartments were for rent on a day -to -day basis. It was pointed out
by the City Attorney that this was not within the Council's jurisdiction
and it should be applied for through the Planning Commission.
Ray Lake, Director of Building and Safety reported that he was prepared
to answer the protest issued against the Building Department for the denial
of pole type construction. He indicated that this report was quite lengthy
and Council recommended that the report be held over until after the first
of the year.
Mr. King presented an agreement between the Cities of Bellflower and
Downey to share half of the cost of street lighting on Gardendale Street and
Lakewood Boulevard. It was moved by Councilman Peavey, seconded by
Councilman Giddings and passed by the following vote to authorize the Mayor
to sign the agreement.

The Council issued a proclamation to extend seasons greetings to the
citizens of Downey.
Councilman Peavey recommended that the City Manager investigate the
possibility of widening the streets at Third and Paramount and Downey and
Cherokee.
Theme being no further business the meeting adjourned at 11 :00 A.M.
