OF THE CITY OF DOWNEY
HELD NOVEMBER 12th, 1958
The City Council of the City of Downey held a regular meeting in the
Council Chambers of the Downey City Hall at 8:00 A.M. on Wednesday, November
12th, 1958. Mayor Scott E. Temple presided.

The Reverend Joseph T. Hall of the Foursquare Church of Downey gave the
invocation.
The Mayor announced that the hour of eight o'clock A.M. was the hour and
this hhe place for hearing protests or objections against the improvement of
Leeds Street in the City of Downey, as described in Resolution of Intention No.313.
The Mayor inquired if the City Clerk had the Affidavit of Publication,
the affidavit of posting and hhe affidavit of mailing. The clerk presented the
evidence of such affidavits and same were ordered received and filed.
The Clerk stated that there were no written protests or objections and the
Mayor asked if there was anyone who wished to sp®wk. There being no one wishing
.` to speak it was moved by Councilman Giddings, seconded by Councilman Dunnum and
so ordered that the hearing be closed.
,RESOLUTION NO. 323
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING WORK TO BE DONE ON LEEDS STREET IN ACCORDANCE
WITH RESOLUTION OF INTENTION NO. 313.
The resolution was read by title only. It was moved by Councilman Dunnum,
seconded by Councilman Giddings and so ordered that further reading be waived.
It was moved by Councilman Dunnum, seconded by Councilman Giddings, and
passed by the following vote that Resolution No. 323 be adopted.

This being the hour and place that bids on bonds for the Smallwood Improve-
ment District 4M were to opened, the Clerk opened and read the following bids:
Victor Clifford Hunt, 97.61% of the principal at 6%
Eighth and Vigueroa Company 99.37% of the principal at 6%
,..,, James L. Lindsey 100% plus a premium of $102.50 at 6%
It was the recommendation of the City Attorney that the awarding of the bid
on bonds be withheld until the bid is awarded for the work on said improvements.
Councilmen Stamps took his place at 8:10 A.M.
It was moved by CouncilmanGiddings, seconded and so ordered that the minutes
of the meeting of October 28th, 1958 be approved as presented.
The Mayor requested that the matter of the merger of the Downey County Water
District with the City of Downey be considered next on the agenda.

Mayor Temple called on Mr. Ed. Lewis, Chairman of the CityWater Committee
for any comments. Mr. Lewis stated that the committee was in full accord with
the recommendations made by the CityAttorney.
Mr. Culver, Attorney for the Downey County Water District introduced Mr.
Stanley C. Lagerlof, 459 So. Spring St., Los Angeles 13, California, who spote
for the Water District. He stated that it was his belief that the City was not
responsible for the water supply to the citizens and there was a question in his
mind as to whether the City Attorney was correct in stating that the merger was
automatic with the annexation of the area that put the Downey CountyWater District
entirely within the city limits.
Mr. Lee Schmidt stated that inasmuch as the Directors of the Water District
were elected by the people they were responsible to them. It was his feeling that
there should be a definite ruling before any steps be taken.
RESOLUTION NO. 324
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING THE MERGER OF THE DOWNEY COUNTY WATER DISTRICT
WITH THE CITY OF DOWNEY.
The resolution was read in full. After some discussion Councilman Dunnum
stated that it was his feeling that this was the first step to establish the
fact of the right of priority in this case and therefore moved that the resolu-
tion be adopted. It was seconded by Councilman Peavey and passed by the following
vote.

Mayor Temple announced that this was the place and the hour for the hearing
on the vacation of a portion of Imperial Highway. He asked if anyone from the
audience wished to speak. There being none, it was moved by Councilman Dunnum,
secodded by Councilman Peavey and so ordered that the hearing be closed.
RESOLUTION NO. 325
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE VACATION OF A PORTION OF IMPERIAL HIGHWAY,
SAID PORTION LYING WESTERLY 0 F OLD RIVER SCHOOL ROAD.
The resolution was read in title only. It was moved by Councilman Stamps,
seconded by Councilman Peavey and so ordered that further reading be waived.
It was moved by Councilman Peavey, seconded by Councilman Giddings, and
passed by the following vote that Resolution No. 325 be adopted.

on the vacation of a drainage easement in Tract #16268. He asked if anyone from

Stamps, seconded by Councilman Giddings and so ordered that the hearing be closed.
RESOLUTION NO. 326
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE VACATION OF A DRAINAGE EASEMENT IN TRACT #16268.
The resolution was read by title only. It was moved by Councilman Dunnum,
seconded by Councilman Stamps and so ordered that further reading be waived.
It was moved by Councilman Giddings, seconded by Councilman Peavey and
passed by the following vote that Resolution No. 326 be adopted.

The clerk read the following correspondence:
A letter from the County Boundary Commission announcing the intention of
annexations to the City of Whittier and Bellflower. These were ordered filed.
A letter from the Old River Men's Club expressing thanks for clearing the
weeds on Imperial Highway and stating that they would continue to pressure for
the installation of curbs and sidewalks along this same stretch of Imperial
Highway as a satisfactory solution to the safety problem for school children.
A letter from the Mayor of Honolulu in recognition of the visit of the
City Clerk to their Supervisor's meeting.
A letter commending Steve Butler of the Police Department for his diplomacy
in handling an "angry neighbor's" complaint and commending the City for the
installation of the radar units to better handle the traffic control and safety.
A letter of appreciation for the prompt action in supplying clean -up trucks
to a request by the Island Civic Association after their last project.
Letters to Mayor Temple expressing pleasure in the reduction of the tax
rates and the services rendered by the City from the following:

Mr. & Mrs. Hal V. Mitchell
Kirkhill, Inc.
A request from the Eastern Air Lines for the City to support their application
to the Civil Aeronautic Board for authority to continue their route on to the
Pacific Coast thus providing a direct non -stop flight to Florida. This was refer -
ed to the City Manager for answer.
A letter from Merlin L. Newkirk, M.D. representing the Southeast Community
Hospital Association. The request for a hearing by the Council on their plan
for a community hospital was discussed. Inasmuch as there are other groups now
interested in and working for a program for hospitalization within the City of
Downey and because it is in no way a.matter for Council action this was referred
to the City Manager to answer.
Notice of the League of California Cities meeting to be held on November
20th, 1958 in the City of Santa Monica.
A permit for a parade sponsored by the Saint Mark's Church on November 15th,
1958 was presented for approval.
It was moved by Councilman Stamps, seconded by Councilman Dunnum and so
ordered that approval be granted.
A letter from Mary Ellen Tubbs, requesting a leave of absence from November
5hh, 1958 to January 1st, 1958 was read. It was moved by Councilman Peavey,
seconded by Councilman Stamps and so ordered that this request be granted.
Mr. King presented his report on the construction of the City Library. Mr.
King outlined what the minimum needs would be and an estimated cost of the build-
ing. After some discussion this matter was referred to the Civic Center Commit-
tee and the Library Board for further study and specific recommendations as to
the type of structure and basic needs in the building together with recommendations
for an architect.
Mr. John Nordbak, 726 Greenleaf, Whittier, outlined his experience as an
architect and requested that his firm be given consideration when architectural
bids were called for on the library building.
Mayor Temple left his place at 9:30 A.M. and Mayor Pro - tempore Giddings
presided.
Mr. Joseph Coss, representing the Downey City School District read a letter
from the Board ofTrustees requesting some definite information as to the design
plat plan and development of the unified Civic Center. The Board is endeavoring
to design their building in conformity with the Civic Center plans so that it
may be an integral part of the center in the future but are faced with immediate

plans as they must start their building in order to meet the time specified
for vacation of their present offices. It will be necessary to re -aline the
property lines if it is determined to use rectangular builings rather than
the proposed circular library building.
After some discussion it was moved by Councilman Dunnum, seconded by Council-
man Peavey and so ordered that the City Manager, CityAttorney and the Director of
Public Works be instructed to change the legal descriptions on the purchase of
the property by the Downey CitySchool District so that the property will conform
with the rectangular plans and that it be done on the basis of square feet for
square foot.
Mr. Sorensen presented an Agreement withAn.thony & Langford, Architect for
the architectural services for the Fire Station to be construced on Florence Ave.
It was moved by Councilman Peavey, seconded by Councilman Dunnum and passed by
the following vote that the Mayor be given authority to execute the contract tith
Anthong and Langford for services on the Fire Station.

AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING SECTIONS
2722 THERETO WHICH SAID SECTION RELATES TO HOLIDAYS AND
CLOSING OF THE CITY HALL.
The Ordinance was read in full. It was moved by Councilman Peavey, seconded
by Councilman Stamps, and passed by the following vote that said Ordinance be
introduced.

RANDUM OF AGREEMENT FOR EXPENDITURE OF GAS TAX ALLOCATION
FOR MAJOR CITY STREETS.

The CityyAttorney reported that he had drafted a resolution requesting a
new post office building be built in the City of Downey but felt that it would
be advisable to contact Postmaster Powell before it was presented to the Council.

FUNDS OUT OF WHICH THE SAME ARE TO BE PAID.

After a review of the warrants presented for payment Councilman Dunnum,
moved, Councilman Stamps seconded and it was passed by the following vote that
warrant #2799 in the amount of $6,538.06 drawn in favor of the County of Los
Angeles for engineering and legal fees be withheld pending settlement of the
Fire Protection District assets.

Mr. King gave a report on the division of the assets of the Consolidated
Fire Protection District and outlined the disputed items as follows:
~1. Determination of the assessed value - $745.89
2. Determination of amount of new assets on the withdrawal date- $7,259.26
3. Effective date of withdrawal - $9,808.00
4. Value of the lands and buildings turned over to the City - $21,001.02
5. Value of the District's equipment - $5,137.59
He recommended that some compromise of these claims would be advisable to avoid
litigation over the readjustment. After some discussion Councilman Dunnum, moved
Councilman Peavey seconded and it was passed by the following vote that our
compromise offer include items 3 and 4 of the above list.

Mr. King reported on a desirable site for a Fire Station in District #2.
This land is owned by the County and a station would be advantegeous to both
the City and the County. The Council concurred and authorized the City Manager
to proceed with neg6tiations,
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
+r AMENDING DOWNEY MUNICIPAL CODE BY ADDING 8111.2 RELATING
TO FIRE ZONES.

Mr. King outlined the recommendations and alternative for the painting
of the -City Hall. Councilman Stamps, moved, Councilman Dunnum seconded and it
was so- ordered that authority be given to call for bids on the painting of the
City Hall- alternate #2 as outlined in the City Manager's report.
Mr. King suggested that a committee be appointed to make plans for the
second anniversary of the City- December 16th, 1958
Councilman Peavey was called from the room.
The City Manager recommended that the City appropriate from its street
improvement fund (1- 4130 -681) the amount of $1,500.00 to be used to reconstruct
the westerly 10 feet of Dolan Street to match the improvements to be installed
by the'Downey Union High School District. Councilman Stamps moved, Councilman
Dunnum seconded and it was passed by the following vote that this appropriation
be approved.

It was moved by Councilman Dunnum, seconded by Councilman Stamps, and
passed by the following vote that authority be given to prepare plans and
specifications on the Cole Street City Improvement #1.

It was moved by Councilman Dunnum, seconded by Councilman Stamps, and
passed by the following vote that authority be given to engage Burke, Williams
and Sorensen to do the legal work on Cole Street City Improvement A.

Councilman Peavey returned and Councilman Dunnum left.
The quarterly report from the Junior Chamber of Commerce was read. It was
moved by Councilman Stamps, seconded by Councilman Peavey and passed by the
following vote that the $300.00 be paid Oer agreement.

It was moved by Councilman Peavey, seconded by Councilman Stamps and so
ordered that authority be given to circulate a petition for the improvement of
the alley west of Rives Avenue between the Santa Ane Freeway and Telegraph Road
Improvement District #29.
It was moved by Councilman Peavey, seconded by Councilman Stamps, and passed
by the following vote that approval be given the agreement with the engineering
firm of Koebig and Koebig to do the work on the storm drain as outlined in the
County Bond issues resently passed and that the Mayor be given authority to execute.

It was moved by Councilman Stamps, seconded by Councilman Peavey and so
ordered that authority for the City Engineer to prepare investigation report
on the Verdure Avenue Sewers- City Improvement #5M be given.
It was moved by Councilman Peavey, seconded by Councilman Stamps and so
ordered that the investigation report be approved and ordered filed with the Clerk.
It was moved by Councilman Stamps, seconded by Councilman Peavey, and so
ordered that the hearing date on said improvement be set as December 23rd, 1958
at 8 :00 A.M.
It was moved by Councilmen Peavey, seconded by Councilman Stamps, and so
ordered that authority be given to re- advertise for bids on the construction of
Smallwood Improvement 4M.
It was moved by Councilman Peavey, seconded by Councilman Stamps, and pass-
ed by the following vote that the agreement with the Downey Museum of Art be
approved and that the Mayor be given authority to execute.

Councilman Peavev asked approval of the appointment of Mrs. A.M. Bojanower,
7519 E. 4th Place to the City committee to --ork with the Park District Board.
This appointment was approved.
It was moved by Councilman Peavey, seconded by Councilman Stamps and so
ordered that the attorney prepare a resolution of commendation for the Elks,
#2020 of Downey in their efforts to get legislation that would have a control
of sentences given to dope peddlers.

It was moved by Councilman,Peavey, seconded by Councilman Stamps, and so
ordered that the City Manager contact the telephone company in an effort to have
the old telephone poles removed from Firestone Blvd. from Brookshire to Paramount.
Councilman Peavey recognized Major Wehking and welcomed him to the council
meetings.
There being no further business the meeting adjourned at 11:45 A.M.
