OF THE CITY OF DOWNEY
HELD OCTOBER 28, 1958
The City Council of the City of Downey held a regular meeting in the
Council Chambers of the Downey City Hall at 8:00 A.M. on Tuesday, October
28, 1958. Mayor Scott E. Temple presided.

Mr. Loren Morgan introduced the police officers who had graduated from
a 12- weeks' course in the City of Los Angeles Police Academy. Officer Jerry
L. Gilbert, one of the group who completed the course, was voted the out-
standing cadet going through the training. It is the first time anyone out -
side of the City of Los Angeles,has walked away with top honors.
Mayor Temple, Mr. King, Councilman Giddings, and Councilman Peavey
commended the Police Department on its outstanding work and ;welcomed the
boys to the force.
Mr. Temple presented a check for $218,871.17 to Mr. John Wells of the
^ Downey Elementary School District for payment in full for the purchase of the
City Hall Building and property. Mr. Wells accepted the check with thanks.
It was moved by Councilman Peavey, seconded by Councilman Stamps, and
passed that the minutes of October 14th, 1958 be approved as presented.
Mr. King reported that the insurance company involved in Chief Gain's
accident several months ago had agreed to a settlement on time lost by
Chief Gain on a 50% basis. The City Attorney recommended that the Council
approve the compromise. It was moved by Councilman Peavey, seconded by
Councilman Giddings, and passed by the following vote that the claim be
accepted and the compromise be approved:

The City Clerk read the following correspondence:
A letter was read from a citizen of Downey requesting that the City
Bus Service be extended as far as a mile past Stonewood Center on Firestone
and 3 miles toward Long Beach on Lakewood Boulevard. Ordered filed.
An Order of Revocation was presented from Airport Stages requesting
authority to discontinue a passenger stage service between Whittier, Downey,
Bell Gardens, Huntington Park, South Gate and Los Angeles International
Airport. Ordered filed.
Councilman Giddings and Mr. King questioned the possibility of getting
helicopter service in Downey. Mr. Sorensen was asked to check into this
and report to Council at a later date.
A letter was read from the Downey Junior Chamber of Commerce requesting
their quarterly payment of $300.00. The City Attorney stated this could not
be granted without a report from the Chamber as set down in the agreement.
The City Clerk was asked to contact the Downey Junior Chamber of Commerce
for this report.

A letter was read from Mr. Joe Mulder, 11527 South Bellflower Boulevard,
Downey, commending the police and fire departments for their services ren-
dered at a very serious accident at Bellflower and Hall Road at 2 :15 P.M.
Friday afternoon, October 17th, 1958. This letter also commended the em-
ployees of the Edison Company and the General Telephone Company for their
quick response. Ordered filed.
A letter to Mr. A. C. Gabriel, City Purchasing Agent, and Mr. Glenn
Kendall, Assistant City Manager, was read from Joe Glenn Coss, Chairman of
the Library Board, commending Mr. Gabriel and Mr. Kendall for the help given
•-� in the establishment of the City Library. Ordered filed.
Councilman Dunnum took his seat at 8:25 A.M.
A letter was read from the City of Bellflower stating they were opposed
to the formation of a hospital district that would encompass all or any por-
tion of the City of Bellflower in said district, as they had adequate hospital
facilities through private enterprise. Ordered filed and a copy sent to the
Community Hospital.
A letter was read from the Associated Student Body of the Downey Senior
High School inviting the Council to participate in the Homecoming Parade to
be held October 31, 1958 at 3 :00 P.M.
A letter was read from the Rio San Gabriel Civic Association stating
they had adopted three resolutions at their regular meeting on October 2,
1958: one, to commend the Police Department for the successful transition
from California Highway Patrol to local regulation of traffic on our major
highways; two, to place on the ballot at the next city -wide election the
matter of morning meetings; three, to place on the ballot a measure estab-
lishing salaries for members of the Downey City Council. Ordered filed.
In answer to Councilman Giddings' question regarding whether the next
Council could change the morning meetings to evening meetings, Mr. Sorensen
stated the time of the meetings could be changed at any time - by this Council
or any newly elected Council in the future - according to the ordinance.
Councilman Giddings remarked that he had heard no objections from anyone on
the morning meetings other than the Rio San Gabriel group, and he felt they
were a minority group in District 4.
An appeal from Eugene G. Garcia, Attorney at Law, was presented requesting
continued operation of Mrs. Sayre's beauty shop at 13257 Deming Avenue, Downey.
Mr. Garcia is representing Mrs. Juanita Sayre in Zone Exception Case No. 86.
Mr. McNutt gave a report covering Zone Exception Case No. 86 and stated
that he felt if an exception were granted in this case, it would have to be
granted in other cases. Mr. McNutt said that the one person who had objected
to Mrs. Sayre operating this beauty shop had now moved from the neighborhood,
and there were no objections from any of the others in the vicinity.
It was moved by Councilman Dunnum, seconded by Councilman Peavey, and
passed by the following vote that,finding such exception will not be materially
detrimental to the public welfare nor to the property of the other persons in
the vicinity thereof, Zone Exception Case No. 86 be granted on an annual basis
so that this matter may be reviewed periodically:

A letter was read from Ralph J. Maravez, Sr. appealing the ruling on
Zone Variance #83, together with exhibits, which were presented to Council
for study.
Mr. McNutt gave a report on Zone Variance #83, and Mr. Ralph J. Maravez
spoke in his own behalf.

A notice was presented from the League of California Cities announcing
their regular meeting to be held at the Rodger Young Auditorium in Los An-
geles on Thursday, November 6, 1958 at 7:15 P.M. Ordered filed.

to be held at the Huntington Park Elks Club, 3355 East Gage Avenue, Huntinton
Park, at 6:30 P.M. on Thursday, November 6, 1958. Councilman Stamps suggested
that someone from the Council should attend this meeting.

Chief Gain introduced Mr. Langford, a local architect, and presented
schematic sketches for the new fire station to be located between 9343 and
9355 Florence Avenue.
It was Mr. King's recommendation that the Council authorize the City
Attorney to draw up a contract between Anthony & Langford, Architects, and
the City of Downey for complete architectural work to present to Council
for approval. After considerable discussion by the Council, it was decided
that no contract should be drawn up until this had received further study.
Mayor Temple presented Mrs. Annie Laurie Howard with an Award of
Commendation for her outstanding work in the community. Mrs. Howard
accepted the award with thanks.

Mr. King presented a Bid Summation on Contract 12 (Florence Avenue
from Paramount to the west city limits), and upon his recommendation, it
was moved by Councilman Peavey, seconded by Councilman Dunnum, and passed
by the following vote that Contract 12 be awarded to the lowest and best
bidder, Vernon Paving Company, for the amount of $56,170.20:

Mr. King presented a Bid Summation on Contract 15 (Brookshire Avenue,
Old River School Road, and Stewart and Gray Road), and upon his recommenda-
tion, it was moved by Councilman Giddings, seconded by Councilman Peavey,
and passed by the following vote that Contract 15 be awarded to the lowest
and best bidder, 0. R. Benedict Paving Company, for the amount of $16,609.38:

Upon the recommendation of Mr. King, it was moved by Councilman Giddings,

be given to advertise for bids for Contract No. 19 - construction of traffic
channelization and the installation of highway safety lighting at Woodruff
Avenue and Eglise Avenue:

Upon the recommendation of Mr. King, it was moved by Councilman Dunnum,
seconded by Councilman Giddings, and passed by the following vote that au-
thority be given to advertise for bids for Contract No. 18 - resurfacing of
Ardis Avenue between Imperial Highway and Foster Road:

Upon the recommendation of Mr. King, it was moved by Councilman
Giddings, seconded by Councilman Peavey, and so ordered that authority be
given to file Notice of Completion on Contract No. 10 - Imperial Highway
and Rives Avenue Signals.
It was moved by Councilman Peavey, seconded by Councilman Stamps, and
passed by the following vote that authority be given to expend $2,700 from
Account No. 1- 4130 -681 to pay the cost of completing the street improvements
on the south side of Telegraph Road between Paramount Boulevard and Birch -
bark Avenue:

It was moved by Councilman Peavey, seconded by Councilman Giddings,
and so ordered that authority be given to circulate petitions in Assessment
District #1 for the improvement of Cole Street between Downey Avenue and
Brookshire Avenue with curbs, gutters, and paving.
After a brief review by Mr. King, it was moved by Councilman Peavey,
seconded by Councilman Dunnum, and so ordered that authority be given to
circulate petitions for Assessment District #20 for street lighting on
Second and Third Streets in the downtown business district.
It was moved by Councilman Dunnum, seconded by Councilman Giddings,
and so ordered that authority be given to circulate petitions for Assessment
District #30 for the improvement of Verdura and Earnshaw with curb, gutter,
and paving.

It was moved by Councilman Stamps, seconded by Councilman Peavey, and
so ordered that authority be given to circulate petitions for Assessment
District #35 for the improvement of Laureldale Avenue south of Gardendale
Street with sewers, curbs, gutters, and paving.
It was moved by Councilman Stamps, seconded by Councilman Giddings,
and so ordered that the parade permit application submitted by the Florence -
Downey Seventh -Day Adventist Church be approved for the period November 4,
1958 to April 1, 1959.
—� Upon the recommendation of Mr. McNutt, City Planner, it was moved by
Councilman Peavey, seconded by Councilman Giddings, and so ordered that a
30 -day extension of time (to be up December 1, 1958) be granted for the
completion of street improvements in Tract No. 21227 (Lucci), providing
the bonds will still be in effect.
It was moved by Councilman Dunnum, seconded by Councilman Peavey, and
so ordered that authority be given to prepare plans and specifications for
Improvement District No. 21 - Elm Vista Drive.
It was moved by Councilman Dunnum, seconded by Councilman Peavey, and
so ordered that the legal firm of Burke, Williams and Sorensen be engaged
to prepare the necessary legal documents for Improvement District No. 21.
It was moved by Councilman Dunnum, seconded by Councilman Peavey, and
passed by the following vote that authority be given to advance $2,000.00
to pay costs incurred on Improvement District #21 until the bonds are sold:

Mr. King reported that the Civic Center Committee met on a study of this
area for the future Civic Center, and it was recommended that the Council
engage Mr. Varner, Architect, to present a schematic layout of the Center for
$700, said sum to be taken from the Reserve Fund.
Councilman Peavey suggested that the Post Office be contacted to see
whether they are willing to build a new post office.
It was moved by Councilman Peavey, seconded by Councilman Dunnum, and
so ordered that the City Attorney be authorized to prepare a resolution to
be sent to the Postal Department, Senator Kuchel, Senator Knowland, and
Representative Doyle in an effort to get a new post office building large
enough for a city the size of Downey.
Upon the recommendation of Mr. King, it was moved by Councilman Peavey,
seconded by Councilman Giddings, and passed by the following vote that
approval be given to advance $200.00 from the Park Fund for tree planting,
said money to be reimbursed by individuals requesting the city to plant trees:

Mr. McNutt introduced Mr. Jamsheruddin Ahmed of Pakistan, who will be
here for two months (starting October 25, 1958) as a representative studying
our type of government.
•—• Mr. Ahmed thanked everyone for the kind way in which he had been received
and stated it was a great privilege to have this opportunity to study our type
of government, as it will help him a great deal when he returns to his country.
Mayor Temple spoke in behalf of the Council in welcoming Mr. Ahmed to the
City of Downey.
Councilman Dunnum remarked that the present library is overcrowded and
thought should be given to the possibility of starting the construction of
a new City Library. He stated he would like study of this to start immediately.
It was so ordered. Mr. King will review it and report to Council.

Councilman Giddings recommended that money be spent on fixing up the
present City Hall, now that the purchase of same is complete. Mr. King
will get estimates regarding painting, landscaping, etc. and the installa-
tion of combination heating and air conditioning units.
Councilman Giddings remarked he had spent several hours in the City
Attorneys' meeting at the League of California Cities conference held in
Los Angeles Monday, October 27th, 1958, and he said he was more convinced
than ever that the Council had never violated any part of the "Brown Act ".
Councilman Peavey asked for a report on the installation of traffic
signals, and Mr. Barhite stated progress was being made.
Councilman Peavey asked that the installation of a vault for city re-
cords be included in the study Mr. King will make regarding painting, etc.
Mayor Temple welcomed Miss Doyle, City Clerk, back from her vacation
in Hawaii.
Miss Doyle gave a brief report on her trip and stated she had attended
the Board of Supervisors' meeting while there and felt very much at home.
The city and county are all under one government in Hawaii, and they have
7 supervisors. She also stated she was very glad to be "home ".
Councilman Dunnum inquired as to how the drainage problem was progress -
ing'on Stewart and Gray Road. He then moved that the Director of Public
Works be authorized and directed to advise these people that unless they
give their answer to the City within thirty days, the Council will assume
they are denying the request for dedication and will proceed with condem-
nation of the property. The motion died for lack of a second. Mr. King was
directed to bring back a full report at the next meeting.
Mayor Temple announced that the Council, City Manager, and others were
attending the League of California Cities meeting in Los Angeles for three
days, October 27, 28, and 29, 1958.
Mayor Temple gave a brief review on Proposition "N ". It was moved by
Councilman Peavey, seconded by Councilman Dunnum, and so ordered that Pro-
position "N" be approved by the Council and the people be urged to get out
and vote in favor of same.
Mayor Temple also gave a brief review of Proposition 1117" and recom-
mended a "NO" vote on this proposition. Councilman Peavey moved, and it
was so ordered that the Council go on record as being against Proposition
1117".
Mr. King commended the press for covering the League of California
Cities meeting. Downey was the only city represented by the newspapers.
Mayor Temple announced that the California State Chamber of Commerce
is sponsoring a Statewide Conference on Proposed Highway Legislation before
the 1959 Legislature, to be held at the Statler - Hilton Hotel, Los Angeles,
Wednesday, November 12, 1958 from 10:00 a.m, to 4 :00 p.m.
