Mayor Scott E. Temple presided. PRESENT: Councilmen: Stamps, Dunnum, Peavey, Giddings, Temple ABSENT: Councilmen: None ALSO PRESENT: Oren L. King, City Manager Glenn Kendall, Assistant City Manager Royal M. Sorensen, City Attorney Della Doyle, City Clerk Wilma C. Erickson, Deputy City Clerk Ivan A. Robinson, Chief of Police Richard G. Barhite, Director of Public Works Dan McNutt, City Planner Roy Starkey, Director of Finance The Reverend R. V. Cogswell, First Presbyterian Church, gave the invo- cation. Mayor Temple announced that this was the place and the hour for the hearing on the vacation of Cord Avenue. He asked if anyone from the aud- ience wished to speak. There being none, it was moved by Councilman Peavey, seconded by Councilman Stamps and so ordered that the hearing be closed. RESOLUTION NO. 303 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING THE VACATION OF A PORTION OF CORD AVENUE, SAID PORTION LYING WESTERLY OF DOWNEY AND SANFORD BRIDGE ROAD. The resolution was read by title only. It was moved by Councilman Giddings, seconded by Councilman Peavey, and so ordered that further reading be waived. The City Clerk read the following correspondence: A letter from the Southern Pacific Company announcing a reduction of freight rates for Downey shippers and stated further study would be made. Received and filed. The Council commended the Industrial Committee for their wonderful work on the problems of Downey shippers. The City Clerk presented a protest to and a request from Mr. J. P. Samarin for a Council hearing on Zone Change Case #46, changing the zone from R -2 to R -3. Mr. J. P. Samarin, 3453 Siskiyou Street, Downey, spoke in his own behalf and presented pictures of the plans of the type of buildings to be constructed. Mrs. E. L. Buttner, 11807 Tristan Drive, Downey, Chairman for the homeowners in that vicinity, spoke against the rezoning in Case #46. It was moved by Councilman Dunnum, seconded by Councilman Peavey, and passed by the following vote that the appeal be denied and the action of the Planning Commission be affirmed since no new evidence or information was presented: 5 AYES: Councilmen: Giddings, Stamps, Dunnum, Peavey, Temple 0 NOES: Councilmen: None 0 ABSENT: Councilmen: None The City Clerk read an invitation for the Council, City Manager, and Fire Chief to attend Open House at the new Fire Department Headquarters Building, 201 South Acacia Street, Compton, California, Thursday, September 25, 1958, 2:00 P.M. Received and filed. A letter was read from the Los Angeles Dodgers regarding the "City Employees Day" at the Coliseum on Saturday, September 27, 1958 at 4 :00 P.M. and also requested notification of how many of the Councilmen, City Manager, and their wives will attend as "Special Guests ". Received and filed. A letter was read from the Los Angeles County Fair Association, ex- pressing their appreciation for the Council's assistance in publicizing the Los Angeles County Fair. Received and filed. A letter was read from the County of Los Angeles, expressing its appreciation for the outstanding manner in which municipalities have coop- erated with the Air Pollution Control District's ban on open fires as it affects local weed abatement programs, and the anti -smog program. Received and filed. A letter was read from the County Boundary Commission of Los Angeles, notifying that the City of Lynwood has filed annexation proceedings on Ozell Mannor Annexation No. 9. Received and filed. A letter was read from Royal M. Sorensen, City Attorney, requesting permission to attend the annual meeting of the National Institute of Muni- cipal Law Officers in Chattanooga, Tennessee on November 30, 1958 through December 3, 1958. Mr. King mentioned that there was $300.00 in the budget allotted to cover these expenses. It was moved by Councilman Dunnum, seconded by Councilman Giddings, and passed by the following vote that authority be given the City Attorney to attend the meeting of the National Institute of Municipal Law Officers, and that all necessary and reasonable traveling and miscellaneous expenses, not to exceed $300.00, be allowed: 5 AYES: Councilmen: Giddings,,Stamps, Dunnum, Peavey, Temple 0 NOES: Councilmen: None 0 ABSENT: Councilmen: None A letter was read from Pacific Ocean Park, Inc., correcting the time for the get together of Mayors and Administrative Officers at Pacific Ocean Park in a few days. The correct time is 7:00 P.M. until 12 :00 A.M. Received and filed. A letter was read from the Downey -Los Cerritos Bar Association stating that the Branch Courts Committee of the Superior Court, Los Angeles, has proposed a new division of the County into large multi -court districts, and also that Downey will be in what will be called the Southeast District. Council was requested to pass any appropriate resolutions and bring them to the dinner being held by the Downey -Los Cerritos Bar Association on September 24, 1958 at the Silver Saddle Inn, 7:15 P.M. RESOLUTION NO. 304 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY REQUESTING THE FORMATION OF THE SOUTHEAST COURT DISTRICT AND LOCATING SAME WITHIN THE CITY OF DOWNEY. The resolution was read in full. It was moved by Councilman Dunnum, seconded by Councilman Peavey, and passed by the following vote that Reso- lution No. 304 be adopted: 5 AYES: Councilmen: Giddings, Stamps, Dunnum, Peavey, Temple 0 NOES: Councilmen: None 0 ABSENT: Councilmen: None A petition was submitted requesting the Council to help pay improve- ment expenses in completing the work to be done on the block between Brock and Paramount Boulevard on Comolette Avenue. This was referred to the City Manager. A notice was read of the meeting of the Board of Directors, Los Angeles County Division, League of California Cities, to be held at the Rodger Young Auditorium in Los Angeles on Thursday, October 2, 1958 at 7:15 P.M. Received and filed. Councilman Peavey inquired about the steps being taken to correct the flow line on 7th Street and La Reina. Referred to the City Manager for action. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 9102.1 OF THE DOWNEY MUNICIPAL CODE. (Planning Resolution No. 27) The ordinance was read by title only. The former appraisal by the County last year totalled $400. It was Mr. King's recommendation that the Council authorize payment of the average of these two appraisals ($352.50) to the Erwins. It was moved by Councilman Dunnum, seconded by Councilman Giddings, and so ordered that the plans and specifications be approved. It was moved by Councilman Giddings, seconded by Councilman Stamps, and passed by the following vote that authority be given the City Manager to execute the contract and award same to the lowest and best bidder, Sully - Miller Contracting Company, for the amount of $5,654.60 - said fund to be taken from the Street Improvement Fund in the 1958 -59 budget #1- 681 -4130. (Contract No. 14 - Woodruff Avenue northerly of Firestone) 5 AYES: Councilmen: Giddings, Stamps, Dunnum, Peavey, Temple 0 NOES: Councilmen: None 0 ABSENT: Councilmen: None Mr. King reported that the Director of Public Works had secured all the rights -of -way on Florence Avenue west of Paramount Boulevard and recommended that the Council authorize calling for bids on this project. (Contract 12) It was moved by Councilman Stamps, seconded by Councilman Giddings, and so ordered that authority be given to call for bids on Contract 12 - Florence Avenue west of Paramount Boulevard. Mr. King recommended that Council authorize the City to pave the southwest corner of Downey and Priscilla Avenues between the present pavement and the newly installed curbs at an estimated cost of $800 with funds to come from the Street Improvement Fund in the 1958 -59 budget. It was moved by Councilman Peavey, seconded by Councilman Dunnum, and passed by the following vote that the City proceed with the Group Health Insurance Program as recommended by the Personnel Advisory Board: 5 AYES: Councilmen: Giddings, Dunnum, Peavey, Stamps, Temple 0 NOES: Councilmen: None 0 ABSENT: Councilmen: None It was moved by Councilman Giddings, seconded by Councilman Peavey, and passed by the following vote that Leave of Absence for approximately 30 days be granted Doraleene D. Bushman, as requested by L. D. Morgan, Deputy Chief of Police, due to injuries sustained in an automobile accident: 5 AYES: Councilmen: Giddings, Dunnum, Peavey, Stamps, Temple 0 NOES: Councilmen: None 0 ABSENT: Councilmen: None Mr. King gave a report on Sales Tax Revenues showing that the City at this time has on deposit approximately $1,500,000.00 in United States Trea- sury Bills and in interest - bearing time deposits in the four local banks. Mr. King also reported that they had acquired two large generators; one for the Fire Department and one for the Police Department to be used as part of the Civil Defense Program. Mr. Roy Starkey, Director of Finance, presented a claim against Ben Franklin Holton for approximately $200. to $225 to cover the damages caused to Police Unit #1 -27 for approximately $225. Investigations revealed that Mr. Holton, because of other heavy obligations, is able to pay only $15.00 per month. It was moved by Councilman Dunnum, seconded by Councilman Giddings, and passed by the following vote that a confession of judgement be obtained and that the City would stay execution on the judgement so long as it was paid off at the rate of $15.00 per month: 5 AYES: Councilmen: Giddings, Dunnum, Peavey, Stamps, Temple 0 NOES: Councilmen: None 0 ABSENT: Councilmen: None Mr. King commended the Street Department for their fine work in the short time it has been in operation. Mr. King gave an optimistic report on the All American Cities Award conference held in Colorado Springs and said he thought Downey stood a very good chance of becoming one of the All American Cities. i 401 Councilman Dunnum reported that he had attended a meeting where pre- sentations were made by a Representative of the City of Lakewood pertain- ing to traffic and bicycle safety for students, and he felt Downey definitely should take steps in the same direction. Chief Robinson replied that they were already working on such a program and pamphlets were ready to hand out on bicycle safety. In answer to Councilman Dunnum's inquire, Mr. Barhite gave a progress report on the street improvements on Stewart & Gray and Brookshire. Councilman Giddings first apologized for not attending the night Council meeting September 22nd, 1958 due to business obligations, and then he announced that he may be forced to resign because of pressure from the Cee Bee Chemical Company - where he works - to devote more time to company business and less to city affairs. He said he would give the Council a definite answer in 30 days. After some discussion on the newly considered fire station site on the north side of Florence near Woodruff, it was moved by Councilman Giddings, seconded by Councilman Peavey, and passed by the following vote that the City ask for an appraisal of this property for a fire station site: 5 AYES: Councilmen: Giddings, Stamps, Peavey, Dunnum, Temple 0 NOES: Councilmen: None 0 ABSENT: Councilmen: None Councilman Peavey gave a report on the Mayor's Conference in Miami Beach covering the importance of Home Rule for cities. Councilman Peavey also asked what could be done about putting neon signs on apartment buildings in residential areas and would like to have the code amended to allow for such signs. Councilman Temple added a few postscripts to Councilman Peavey's re- port on the Mayor's Conference in Miami Beach. There being no further business, the meeting adjourned at 10:00 A.M. City Cler Mayor
