MINUTES OF THE CITY COUNCIL OF
THE CITY OF DOWNEY
HELD SEPTEMBER 8,1958
The City Council of the City of Downey held an adjourned meeting in the
Council Chambers of the City Hall at 7:30 P.M. September 8, 1958. City Clerk
Della Doyle presided.

It was moved by Councilman Dunnum, seconded by Councilman Stamps, and
so ordered that the meeting adjourn to the cafetorium.
The City Council of the City of Downey reconvened in the cafetorium.

In the absence of the Mayor and Mayor Pro - Tempore, City Clerk Della Doyle
called the meeting to order. It was moved by Councilman Stamps, seconded by
Councilman Dunnum, and passed that Councilman Peavey act as Chairman.
Councilman Peavey announced that certificates would be awarded to per-
sonnel of the Fire Department for completion of their first year of service,
and he also commended the Department on its excellent record during the past
year.
Fire Chief Gain presented the personnel of the Fire Department, and he
stated that he was PROUD OF HIS DEPARTMENT and felt that it was SECOND TO
NONE.
City Manager King and Councilman Peavey extended their congratulations
as they presented the certificates to the Fire Department personnel.
Councilman Peavey presented Certificates of Commendation to the follow-
ing newspaper correspondents for their excellent reporting of municipal
affairs:

City Manager King commended Mr. & Mrs. Weiss of the Livewire for their
excellent work on the brochure for the All American Cities Award conference.
It was moved by Councilman Dunnum, seconded by Councilman Stamps, and
passed by the following vote that the minutes of August 25th and 29th, 1958
be approved as presented:

Councilmen Peavey announced that the problem of the traffic around
Harvey's Drive -In would be taken under reconsideration at this time.
Chief of Police Ivan A. Robinson read a report of the studies and
recommendations made to alleviate the traffic problem around Harvey's
Drive -In.
Richard Barhite, Director of Public Works, and Traffic Engineer Harold
Durham also gave reports of investigation and recommendations to control
traffic by the use of permanent tilt -up "NO RIGHT TURN" signs, parking re-
strictions, and continued law enforcement.
The following citizens stated that although the problem of traffic had
been reduced about 75% through police enforcement, there was still the problem
of horn blowing and excess noise, and they would continue to protest until
this was corrected:

Mr. Ray L. Mayfield, Attorney for Harvey Ortner, gave a survey of counts
taken on the streets around Harvey's Broiler, and in principle this survey
coincides with the Police Department's survey of traffic in the surrounding
area. Mr. Mayfield stated that he had contacted several people in the neigh-
borhood, and their response was that there had been a great improvement during
the past two weeks, and if it stayed that way, they would be satisfied.
It was Mr. Mayfield's contention that the use of a storage area would
not improve the traffic problem because there is only room for about 40 cars.
When the storage area is full, the traffic backs up and causes more conjention
than circulating traffic does.
Mr. Lester M. Zive, Court Reporter, 448 South Hill Street, Los Angeles,
California took recordings of the traffic discussions in behalf of Mr. Mayfield.
Mr. Douglas F. Bishop requested that trees be planted along the wall by
Harvey's Broiler, thus creating a natural sound barrier. This was referred
to the City Engineer for further check.
Mr. Mayfield, in response to Mr. Bishop's request, stated that he would
be happy to plant the trees himself ..... if it would help quiet the citizens'
protests in that area.
The City Clerk read the following correspondence:
A letter from C. R. Baldwin, Manager of the General Telephone Company,
congratulating the City Council, City.Manager, and his entire staff for their
accomplishments during the past year and a half.
A letter from Jack Robinson General Contractor regarding the disturbing
attitude of the same citizens toward the fire station site at 9500 Florence
Avenue, a park, a motel, and morning Council meetings; and he urged the City
Council to listen but not be swayed by the loud talk of these people.
A letter from the Los Angeles County Board of Supervisors announcing
the Notice of Intention for the incorporation of Artesia.
A letter from the Stonewood Shopping Center requesting permission to
deviate from a bonded requirement that they furnish a sprinkler system and
landscaping and in its stead requested that permission be granted to install
asphalt paving and a four -foot concrete sidewalk adjacent to Cecilia Street
and asphalt paving in the parkway adjacent to Woodruff Avenue. Hearing no
objections, this letter was referred to the Planning Commission.
A letter from the City of Lynwood announcing they would be host to the
Southeast District Mayors' & Councilmen's group at the regular meeting of
Wednesday, September 10, 1958 at 6 :30 P.M. at the Chateau, 12120 Long Beach
Boulevard, Lynwood.

A letter from the Welfare Planning Council, Los Angeles Region Volun-
teer Bureau, requesting permission to conduct a community -wide book drive for
the benefit of the Downey City Library. Councilman Peavey recommended that
the offer be accepted and that Mrs. Wheeler be notified the Council is very
grateful for the suggestion. Hearing no objections, it was so ordered.
A letter from Ralph and Betty Lucci advising that Lister Advertising,
Inc. of 12631 East Imperial Highway, Santa Fe Springs, California; and
Vernon Duckett & Associates, Architects and Engineers, Inc. of 3406 West
Washington Boulevard, Los Angeles, are aiding in the proposed development
of the Downey Lucci Manor.
A request for Leave of Absence from Robert W. Gain for Fireman Ora E.
Clutter because of critical illness of his elderly father. It was moved
by Councilman Dunnum, seconded by Councilman Peavey, and passed by the
following vote that a 30 -day Leave of Absence be granted Fireman Ora E.

A letter from Henry E. Catalano and George Atos filing an appeal on
Zone Exception Case No. 76 for a variance on their sign for Del Rio Bowling
Lanes at 7502 East Florence. This letter and appeal was referred to the
Planning Commission for study.
An appeal from Max Heine, together with a $50.00 deposit, protesting
Zone Case #47 (Pasko) and requesting a public hearing; also an appeal, to-
gether with $50.00 deposit, protesting Zone Case #50 (Beddoe) and request-
ing a public hearing.
Mr. King stated that the Planning Commission has had the initial study
on the Master Plan as it affects Paramount Boulevard and that the initial
^ suggested zoning will be ready in about two or three weeks for Council study.
Councilman Peavey recommended Zone Case #50 be held over. Hearing no ob-
jections, it was so ordered.
After a study review of maps and the Planning Commission's recommenda-
tions on Zone Case #47, it was moved by Councilman Dunnum, seconded by Coun-
cilman Stamps, and passed by the following vote that the action of the Plann-
ing Commission be affirmed and the appeal denied on Zone Case #47.'

Mr. Barhite reported on the progress being made on the drainage ease-
ment on Cole Street & Morning Avenue, and recommended that Council authorize
one of the following courses of action:
1. Authorize the Department of Public Works to engage an
independent appraiser to place a value on the property
- in question (Erwin property on Cole Street), as well
as to authorize the City Attorney to initiate eminent
domain proceedings with the right of immediate entry.
2. Authorize payment of $1500 to Mr. Erwin for the sub-
ject easement.

passed by the following vote that authority be given the Department of Public
Works to engage a competent, independent appraiser to place a value on the
Erwin Property located on Cole Street, and authority be given the City Attorney
to initiate eminent domain proceedings to acquire the land in question:

It was moved by Councilman Dunnum, seconded by Councilman Stamps, and
passed by the following vote that authority be given to advance the amount
of $400.00 to pay the costs incurred on City Improvement District No. 29
(Otto Street) until the contract is awarded. The successful contractor will
pay back to the City all costs incurred:

Mr. King presented a bill to cover power bills for the energy used by
the Cole Street Lighting District since the district was lighted in March
of 1957 through June 30, 1959. The total amount of the bills were $822.78.
It was moved by Councilman Dunnum, seconded by Councilman Stamps, and
so ordered that the Cole Street Lighting District bills be held in abeyance
until the next regular Council Meeting to be held on September 23rd, 1958
at 8:00 A.M.:

Mr. King reported that no direct appropriation of funds had been
made by the School Board as yet to install sidewalks in the Maude Price
School District, and he would present it to the Board again in hopes that
;proceedings may begin at the end of the fiscal year.

passed by the following vote that authority be given to invest five hundred
thousand ($500,000.00) dollars of the City's funds in 91 -day Treasury Notes
at the current rate of interest, which is approximately 2.50 %:
