Mayor Scott E. Temple presided. PRESENT: Councilmen: Stamps, Dunnum, Temple ABSENT : Councilmen: Peavey, Giddings It was moved by Councilman Dunnum, seconded -by Councilman Stamps, and so ordered that the meeting adjourn to the cafetorium. The City Council of the City of Downey reconvened in the cafetorium. PRESENT: Councilmen: Stamps, Dunnum, Temple ABSENT : Councilmen: Peavey, Giddings ALSO PRESENT: Oren L. Erickson, Deputy City Clerk The Reverend John T. Chase of the First Christian Church, Downey, gave the invocation. Councilman Peavey took his seat at 7:40 P.M. Mayor Temple announced that this was the time, place, and the hour for the public hearing on Smallwood Avenue, Downey Improvement No. 4 -M. Mr. W. J. Hansen, Deputy County Engineer, was present, and the following facts were established: 1. The Investigation Report for this project was prepared under his direction. 2. He is familiar with the plans, specifications, and "Report" for this project. 3. In his opinion all the property in the district will be benefited by the proposed improvement. 4. The deputy engineer read the report. The City Clerk read a letter of protest from Mr. Leon Emerson. Mr. Leon Emerson, 8238 East Third Street, Downey, District Couneel for the Downey Park District, stated that the Park Board felt that it was inequit- able for the park to have to relinquish the necessary easements of property where the fee title is held by the County of Los Angeles and at the same time assume the expense of the proposed improvements. Furthermore, the monies would have to come from the recreation fund that is badly needed elsewhere. Mr. D. R. Furman, Superintendent of Downey Park and Recreation District, stated that at the time the Improvement District wascreated, they went on record as being agreeable to the formation of such a district, providing the Park District would not have to pay for the improvements. The following people spoke in behalf of the improvement: Mr. C. C. Lawrence, 7917 East Leeds, Downey Mr. J. G. Cuevas, 7521 Cecilia Street, Downey There being no further comments, it was moved by Councilman Peavey, seconded by Councilman Dunnum, -and so ordered that the hearing on Downey Improvement District 4 -M (Smallwood Avenue) be closed. RESOLUTION NO. 284 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY MAKING FINDING OF FEASIBILITY AND ACQUISITION OF NECES- SARY RIGHTS OF WAY AND CONSTRUCTION OF CURB, GUTTER, AND PAVEMENT IN THE MATTER OF DOWNEY IMPROVEMENT NO. 4 -M. (Smallwood Avenue) The resolution was read by title only. It was moved by Councilman Dunnum, seconded by Councilman Peavey, and so ordered that further reading be waived. (Smallwood Avenue) The resolution was read by title only. It was moved by Councilman Dunnum, seconded by Councilman Peavey, and so ordered that further reading be waived. Mr. King, City Manager, read the recommendations of the Public Works Department regarding the vacation of Birchdale. Mayor Temple asked if anyone wished to speak for or against the vacation of Birchdale. Hearing none, it was moved by Councilman Stamps, seconded by Councilman Peavey, and so ordered that the hearing be closed. RESOLUTION NO. 286 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING THE VACATION OF A PORTION OF BIRCHDALE AVENUE, SAID PORTION LYING NORTHERLY OF SIXTH STREET. The resolution was read by title only. It was moved by Councilman Dunnum, seconded by Councilman Stamps, and so ordered that further reading be waived. The City Clerk read the following correspondence: Letters from the County Boundary Commission, announcing the following proposed annexations: City of Whittier City of Whittier City of Whittier City of South Gate - Annexation No. 9 - Annexation No. 10 - Annexation No. 11 - 10th Addition Territory Annexation A letter from the State of California, Department of Public Works, stating that plans are proceeding to correct the traffic conditions at the intersection of Firestone and Lakewood Boulevards in the City of Downey. Received and filed. A letter from Bob O'Leary tendering his resignation from the Water Study Committee, the City Hall Advisory Committee, and the All American City Award Committee. Mayor Temple ordered the resignation accepted with regrets. Mayor Temple presented Mr. O'Leary with a Certificate of Award for his outstanding activities in civic affairs. A letter from the County Auditor - Controller, stating that the transmittal of assessed valuation figures to the legislative body of each city would be delayed to on or before the third Monday in August; however, this would not affect the responsibility of the City to comply with legal dates. P-M A letter from the Downey Junior Woman's Club expressing their desire to have a Youth Center in Downey. Received and filed., A letter from Wendell W. Schooling, Attorney at Law, expressing his opposition to the assessment of an additional tax for the purpose of ac- quiring a Youth Center in Downey. Received and filed. A letter from Martin B. Conrad, Conrad Tools, opposing additional taxa- tion to take care of a Youth Center in Downey. Received and filed. Inter - office memo from Dan McNutt, Director of Planning, regarding the Planning Commission's approval for the acquisition for a fire station of a site located on the southwest corner of Pangborn Avenue and Florence Avenue. Received and filed. A letter from Alva L. Bryant, M. D., protesting the firestation site at 9500 East Florence. Received and filed. A survey from the Smallwood Home Owners Association. Received and filed. A letter from Arthur W. Crawford, President of the Rio San Gabriel Civic Association protesting the morning Council meetings. Received and filed. Petitions protesting the fire station site at 9500 Florence Avenue. Received and filed. (Approximately 280 signatures.) A letter from the United Restaurant Owner Association requesting a 30 day extension of time for study before the proposed City ordinance regarding drive -ins be read to Council. Received and filed with other information on this case. A letter from the Downey Chamber of Commerce expressing their concern over the proposed adoption of an ordinance restricting the hours that certain businesses can operate within the City of Downey. Received and filed. A letter was read by Leon Emerson, representing the Chamber of Commerce, from the National Municipal League stating that Downey has been selected as one of the 22 finalists in the All- American Cities contest of 1958. Received and filed. o • It was moved by Councilman Peavey, seconded by Councilman Stamps, and passed by the following vote that Councilman Dunnum and City Manager Oren L. King, be appointed as representative of the City to attend the public meetings Monday afternoon and Tuesday morning, September 15th and 16th, during the National Conference on Government at Colorado Springs, Colorado, where the All American City Awards will be made; all expenses paid: 4 AYES: Stamps, Peavey, Dunnum, Temple 0 NOES: None 1 ABSENT: Giddings Mayor Temple stated that the citizens also deserved a bouquet for all their hard work on the various committees that made Downey one of the 22 finalists in this All- American Cities contest. Mr. Ray L. Mayfield, Attorney for Harvey Ortner, asked that the ordinance relative to the regulation of drive -in restaurants be discussed before read to the Council. He also requested the Council to delay the matter until further study could be made. Mr. Douglas F. Bishop, 7429 East Third Street, Downey, spoke in favor of the ordinance and against the drive -in restaurants being open after 10:00 P.M. He called on Chief Robinson to give a general summary of the traffic citations given in the vicinity of drive -in restaurants. Chief Robinson stated that there have been 992 moving violations; 186 around Harvey's Broiler, 159 of which were non - residents and 27 residents. Out of the 186 there were 147 adults and 39 juveniles. Mr. Mayfield was allowed a five - minute rebuttal. At this time the ordinance on drive -ins was read in full. Mr. Mayfield asked for a continuance. Councilman Peavey moved that the ordinance be introduced as read. Hearing no second, the motion was dropped. Councilman Stamps moved that the ordinance be postponed for 30 days. Councilman Dunnum seconded Councilman °Stamps' motion to postpone the ordinance for 30 days, and it was passed by the following vote: 3 AYES: Councilmen: Stamps, Dunnum, Temple 1 NOES: Councilman: Peavey 1 ABSENT: Councilman: Giddings The following people spoke against the drive -ins being open after 10:00 P.M. H. B. Robinson, 7441 Firestone Place, Downey J. 0. Hansen, 7457 East Third Street, Downey Mr. P. B. Clayton, 7972 East Fourth Place, Downey, Architect who drew up the plans for Harvey's Broiler, spoke in behalf of the drive -in. Introduction of the ordinance was postponed until 7:30 P.M., September 8th, 1958. The resolution covering the fire station site at 9500 Florence Avenue was read by title only. The following people protested.putting a fire station at this location: R. C. Bartlett, 10216 Pangborn Avenue, Downey E1 J. C. It was moved by Councilman Dunnum, seconded by Councilman Peavey, and passed by the following vote that the resolution on the fire station site at 9500 East Florence be taken under submission until next Council meeting, August 25, 1958: 4 AYES: Councilmen: Stamps, Peavey, Dunnum, Temple 0 NOES: Councilmen: None 1 ABSENT: Councilman: Giddings The ordinance on property taxation was read by title only. After receiving a report from the Finance Committee recommending a 31p, ad- valorem tax rate for 1958 -59, it was moved by Councilman Stamps, seconded by Councilman Peavey, andcarried that an amount of approximately $283,000.00 be raised from taxes and that a tax rate of approximately 290, be affixed to raise this amount. Mr. R. E. Garstang, 10361 Chaney Avenue, spoke against higher property taxation in Downey. Mayor Temple at this time called on Jim Brown, 8902 Guatamala, Chairman of the Downey Community Youth Center, who presented a survey on those who are in favor of a Youth Center in Downey and asked to have a tax levied to finance the Center. Filed with City Clerk. Mr. Skinner, 8708 East Imperial Highway, stated he was opposed to taking the wealth of Downey and spending it outside of Downey. Mr. Greene, 10225 Chaney Avenue, questioned as to whether outsiders will be allowed to use the Youth Center. Mayor Temple stated that he is very much in favor of a Youth Center in Downey, but he felt that the matter should be given much more consideration. Mr. King suggested that,probably with more study, some other solution could be worked out for the Youth Center, and he proposed a meeting with the committee. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY FIXING THE AMOUNT OF MONEY NECESSARY TO BE RAISED BY TAXATION FOR THE FISCAL YEAR BEGINNING JULY 1, 1958. The ordinance was read in full. It was moved by Councilman Dunnum, seconded by Councilman Peavey, and so ordered that the bid for the Improvement District #3 (Dempster Ave.) be awarded to the Griffith Paving Company, the lowest and best bidder, in the amount of $23,535.37. IV RESOLUTION NO.288 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AWARDING CONTRACT TO IMPROVE DEMPSTER AVENUE AND PRICHARD STREET WITHIN THE CITY IN ACCORDANCE WITH RESOLUTION OF INTENTION NO. 256. (Improvement District No. 3) The resolution was read by title only. It was moved by Councilman Stamps, seconded by Councilman Peavey, and so ordered that further reading be waived. Simpson Assistant City Engineer SUBJECT: City Improvement Sanitary Sewer District No. 23, Nada Street West of Old River School Road, City of Downey. RECOMMENTATION: It is respectfully recommended that sanitary sewers be installed in this district. ANALYSIS: This Department has made an investigation of City Improvement Sanitary Sewer District No. 23, City of Downey, as shown on the attached map. During the course of this investigation 15 house -to -house calls were made. Of this number 6 occupants were not at home or did not answer the door. Of the 9 property owners or tenants actually contacted, 6 or 66 -2/3% reported having experienced trouble with their individual subsurface sewage disposal systems. They complained that the systems filled up, causing raw sewage to back up into the house plumbing fixtures or to overflow on to the surface of the ground, also that frequent pumping and cleaning out of the sys- tems was necessary. One contact reported that it was necessary for them to pump their sewage disposal system every two or three months. Several of the homes in the area of this proposed sanitary sewer district are from 8 to 18 years old. The sewage disposal systems for these homes are now failing, due to the sealing of the voids in the soil with sludge and suspended material. III In view of our survey, I, the undersigned Health Officer, of the County of Los Angeles, having been officially designated by the City Council of the City of Downey to perform public health services for the City of Downey, do hereby recommend that proceedings be instituted at once for the installation of sanitary sewers in Nada Street west of Old River School Road, City of Downey, as an improvement necessary to the protection of public health and pursuant to the provisions of Section 2808 of the Streets and Highways Code. Simpson Assistant City Engineer- SUBJECT: City Improvement Sanitary Sewer District No. 57 -9, South Orizaba Avenue and La Reina Avenue, City of Downey. RECOMMENDATION: It is respectfully recommended that sanitary sewers be installed in this district. ANALYSIS: This Department has made an investigation of the South Orizaba Avenue and La Reina Avenue Sanitary Sewer District, City Improvement District No. 57 -9, City of Downey, as shown on the attached map. During the course of this investigation 6 house -to -house calls were made. Of this number two occupants were not at home or did not answer the door. Of the four property owners or tenants actually contacted, one or 25% reported having experienced trouble with their individual subsurface sewage disposal system. They complained that the system filled up, causing raw sewage to back up into the house plumbing fixtures or to overflow on to the surface of the ground, also that it was necessary to pump the system every two months in �^ order to prevent it from overflowing. The soil within the area of this proposed sanitary sewer district consists mostly of a fine, silty sand. This type of soil is not conducive to the proper-functioning of any type of individual subsurface sewage disposal system for any great period of time as it has poor leaching qualities. In view of our survey, I, the undersigned Health Officer of the County of Los Angeles, having been officially designated by the City Council of the City of Downey to perform health services for the City of Downey, do hereby recommend that proceedings be instituted at once for the installation of sanitary sewers in South Orizaba Avenue and La Reina Avenue, City of Downey, as an improvement necessary to the protection of public health and pursuant to the provisions of Section 2808 of the Streets and Highways Code. Mayor Temple moved that the City Manager be the alternate representative for the City; E. W. Ward, 8402 Fontana, Representative for District #1 and J. Robert Looney, 11638 S. Rives Avenue, alternate representative for District #1. Hearing no objec- tions, it was so ordered. Mr. Barhite gave a report on the Borson Street improvement project. It was moved by Councilman Dunnum, seconded by Councilman Peavey, and passed by the following vote that approval be given to improve the portion of Borson Street immediately east of Glynn Avenue and authority be given to use up to $23300.00 from Account No. 1- 4130 -681, the Cooperative Street Pro- ject Fund: 4 AYES: Councilmen: Stamps, Peavey, Dunnum, Temple •--ft 0 NOES: Councilmen: None 1 ABSENT: Councilman: Giddings Mr. King submitted Engineering Proposals for Storm Drain Bond Issue and recommended that the contract be awarded to KOEBIG & KOEBIG, Consulting Engi- neers located in Los Angeles. It is estimated that the engineering costs will run somewhere between $82,600 and $100,000.
