OF THE CITY OF DOWNEY
HELD MAY 12th, 1958
The City Council of the City of Downey held a regular meeting in the
Council Chambers of the Downey City Hall at 7:30 P.M, on May 12th, 1958.
Mayor Carroll M. Dunnum presided.

The invocation was given by Reverend Norman Smith.
Mayor Dunnum announced that now was the time and this was the place
for the Public Hearing regarding Zone Exception Case #47; H. W. Pasko,
10310 S. Paramount Boulevard.
Mr. H. W. Pasko presented visual plans for the structure that he pro-
posed to use on the property and requested that letters from adjoining pro-
perty owners be read. The City Clerk read letters from John Berkes, 10314
South Paramount Boulevard; Anthony N. Shasha, 103042 South Paramount Boule-
vard; and Carl F. Shasha, 10304 Paramount Boulevard. After some discussion
regarding the parking facilities on the property, the Mayor called for any
comments in opposition to this exception.

It was moved by Councilman Temple, seconded by Councilman Stamps, and
passed that the hearing be closed.

Councilman Stamps requested Dan McNutt, City Planner, to outline the
thinking of the Planning Commission in their decision. Mr. McNutt reviewed
the fact that the Planning Commission denied the request because of the
multiple use of business and residential uses outlined for the proposed
structure.
Mr. John Ezzell of the Rotary Internationalof Downey and Mr. Leon
Emerson, President of the Chamber of Commerce, presented the City Council
with a framed "4 -Way Test" placque to be used in the Council Chambers.
It was moved by Councilman Temple, seconded by Councilman Peavey, and
passed that the minutes of the meeting held on May 5th, 1958 be approved
as presented.
Mr. William Troy, chairman of the Sanitation Committee, introduced

the members of the Sanitation Committee that were present and submitted
the following recommendation of the committee on the award of bid of the
refuse and garbage disposal: That the bid be awarded to the lowest and
best bidders, i.e.:

Zone #3 Rio Hondo Disposal
.--r Mayor Dunnum relinquished the gavel to Mayor Pro - Tempore Temple to
preside over the following awards inasmuch asst one time he had represented
one of the bidders and did not wish to be open to any criticism in any de-
cision.
Mayor Pro - Tempore Temple presided over the following actions:
It was moved by Councilman Stamps, seconded by Councilman Peavey, and
passed by the following vote that the recommendations made by the Sanitation
Committee from the summary of the bids as opened at 10:00 A.M. on Monday,
May 12th, 1958 be accepted and that the bids be awarded to the best and
lowest bidders as follows:
The City Clerk read a letter from Burke, Williams & Sorensen outlining
the activities and duties as performed by the City Attorney, Royal M. Sorensen,
during the past months and requesting that the retainer fee be $750.00 per
month instead of the existing $600.00.
It was moved by Councilman Peavey, seconded by Councilman Temple, and
passed by the following vote that the request of $750.00 per month retainer
fee be granted to Burke, Williams, and Sorensen; effective July 1, 1958.

The City Clerk read a letter from Burke, Williams & Sorensen outlining
the activities and duties as performed by the City Attorney, Royal M. Sorensen,
during the past months and requesting that the retainer fee be $750.00 per
month instead of the existing $600.00.
It was moved by Councilman Peavey, seconded by Councilman Temple, and
passed by the following vote that the request of $750.00 per month retainer
fee be granted to Burke, Williams, and Sorensen; effective July 1, 1958.

A letter from the Rio San Gabriel Civic Association was read requesting
that copies of council minutes, financial statements, committee reports, etc.
be mailed to the Association. Mayor Dunnum again stated that all information
was available to any and all citizens in the City Clerk's office, and there
will be no separate mailings. The council minutes will be posted on the
bulletin board in the corridor of the City Hall, and there will be copies
in the City Library. The City Attorney reiterated his previous statement
that the Council was under no obligation to furnish copies of said minutes
to individuals or organizations.
A letter was read regarding the resignation of LeRoy H. Showalter from
the Finance Committee. The City Council accepted Mr. Showalters resignation
with regret and extended best wishes for his future success in his new under-
taking.
It was moved by Councilman Peavey, seconded by Councilman Stamps, and
passed by the following vote that the committee should be enlarged by one
additional member. Mr. Blayne Hutchison and Mr. Murray Tanner were nomi-
nated and approved by the followirg vote of the Council:

A letter from Santa Fe Springs was read expressing appreciation for
the courtesy shown the members of their Fire Study Committee.
A letter was read announcing the meeting of the Subcommittee on
Highway Directional Signing of the Joint Interim Committee on Highway
Problems to be held on Monday, May 26th, 1958. The City Manager announced
that there would be a representative from the City present at the meeting.
The City Clerk presented a petition regarding Zone Exception Case #22
,�. (Rawlins). This case has had a public hearing and a ruling from the Council.
The City Attorney announced that there was no provision for the reopening of
this case.
Mr. King reported that contact had been made with Mr. Rawlins and that
plans were being made to use the disputed property for recreational purposes.
There were three (3) requests for parades presented to Council.
It was moved by Councilman Stamps, seconded by Councilman Temple, and
passed that permits be issued for the following parades:

Downey Jr. Athletic Association, June 7th, 1958
Committee to elect Gladys Hall to Assembly for
the 69th District, May 24, 1958
A petition was presented by the City Clerk regarding the unsanitary
conditions created in the southwestern area of Downey by the flies. This
matter was referred to the City Manager and the Director of Public Works
for investigation and recommendation.
A letter from the Housing and Home Finance Agency was read denying
the request for funds as requested by the City of Downey for advance planning.
A letter from the Los Angeles Chamber of Commerce was read announcing
the Southern California Water Conference sponsored by the Water and Power
Committee of the Chamber to be held at the Statler- Hilton Hotel on May 27th.
It was moved by Councilman Peavey, seconded by Councilman Stamps, and
passed that funds be made available to any of the councilmen wishing to
attend this meeting.
A letter from'the Stonewood Shopping Center was read regarding the
abandonment of certain easements of ingress and egress.
RESOLUTION NO. 237
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AUTHORIZING THE USE OF CERTAIN ACCESS RIGHTS DEDICATED
TO THE CITY.
The resolution was read in full. It was moved by Councilman Peavey,
seconded by Councilman Temple, and passed by the following vote that Resolu-
tion No. 237 be adopted:

Mr. King reported on the property recommended to be used as the City
Yard. Mayor Dunnum turned the gavel over to Mayor Pro - Tempore Temple to
preside during the ensuing discussion and action.

RESOLUTION NO. 238
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY FINDING AND DETERMING THAT THE PUBLIC
INTEREST, CONVENIENCE, AND NECESSITY REQUIRE USE
AND OCCUPANCY OF CERTAIN PROPERTY FOR PUBLIC
BUILDINGS AND GROUNDS.
The resolution was read by title only. It was moved by Councilman
Peavey, seconded by Councilman Stamps, and passed that further reading be

Mr. King reported on the progress of the budget and asked that pro-
cedure be established by the adoption. It was suggested and so ordered
that the budget be presented first to the Finance Committee for approval
and then presented at a joint meeting of the Council, Finance Committee,
and the Administration for final consideration.
Mr. King announced that Student in Government Day for the Senior High
School would be May 26th, 1958,and for Earl Warren High, the day would be
June 9th, 1958.
A report on the lighting of the parking lot on New Street between 2nd
and 3rd Street was made. It was moved by Councilman Peavey, seconded by
Councilman Temple, and passed by the following vote that approval be granted
for the installation of two (2) 20,000 lumen lights.

ORDINANCE NO. 90
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY
ADDING.TO CHAPTER 4 OF ARTICLE II A NEW PART TO
BE DESIGNATED "PUBLIC LIBRARY" AND CONSISTING OF
SECTIONS #2420 THROUGH #2426.

passed that the sewers be accepted on Tract No. 23734 and Tract No. 23900
and that the bonds be released.
A summary of the bids and cost break -down on Contract No. 6 (Dunrobin
Street Improvement) was presented. It was recommended that the bid be awarded
to the lowest and best bidder, J. S. Walker, for $7,020.80.
It was moved by Councilman Dunnum, seconded by Councilman Temple, and
passed by the following vote that the bid be awarded to J. S. Walker for
$7,020.80, the lowest and best .bidder for the Dunrobin Street Improvement.

for special pave -out contracts and authority to call for bids be given:

the acquisition of certain street rights of way by the County of Los Angeles
of tax delinquent parcels. (1. Century Blvd., 2. Dolan Ave., 3. Woodruff Ave.)

It was moved by Councilman Temple, seconded by Councilman Peavey, and
passed by the following vote that an agreement be approved providing for
the Lo's Angeles County to continue to operate that portion of the Gardendale
Council Minutes 5/12/58 -7-

Lighting District within the City of Downey until June 30, 1958, at which
time operation of the Gardendale Lighting District will automatically re-
vert to the Downey City.
Councilman Stamps went on record in favor of acquiring land as soon
as possible for the City Yards.
Councilman Temple extended an invitation to the Council to attend
the opening game of the Downey Little League, Saturday, May 17th, 1958.
Councilman Temple presented three copies of "Black Bonanza" - in
behalf of the Union Oil Company - to the City Library. This book covers
the history of early California and the Union Oil Company.
There being no further business, the meeting was adjourned.
