Mayor Pro - Tempore Scott E. Temple presided. PRESENT: Councilmen: Peavey, Stamps, Temple ABSENT: Councilmen: Giddings, Dunnum It was moved by Councilman Peavey, seconded by Councilman Stamps, and so ordered that the meeting adjourn to the cafetorium. The City Council of the City of Downey reconvened in the cafetorium. PRESENT: Councilmen: Peavey, Stamps, Temple ABSENT: Councilmen: Giddings, Dunnum ALSO PRESENT: Oren L. Sorensen, City Attorney The Reverend Curtis Puryear, Pastor of the Immanuel Baptist Church, gave the invocation. Councilman Temple introduced the students from Downey Senior High School who participated in "Students in Government Day ". Mr. Stanley Brown, President of the Pasadena Rose Float Association, pre- sented the Council with the Rose Float award for 1st place in the 1958 Rose Parade. It was moved by Councilman Peavey, seconded by Councilman Stamps, and so ordered that the minutes of May 12th, 1958 be approved as presented. A summary of bids on library furniture was presented, and the City Manager recommended that the bid be awarded to the lowest and best bidder, Remington Rand, for $6,602.35. It was moved by Councilman Peavey, seconded by Councilman Stamps, and passed by the following vote that the bid for library furnishing beawarded to the lowest and best bidder, Remington Rand, for $6,602.35: 3 AYES: Councilmen: Peavey, Stamps, Temple 0 NOES: Councilmen: None 2 ABSENT: Councilmen: Giddings, Dunnum At this time Mr. Lee A. Taylor, 10309 Chaney Avenue, interrupted Mr. King's report and requested that the minutes of May 12th be read in full for the benefit of the citizens present. Mr. King stated that the Fire Zone Ordinance would be presented later. If conditions fin- is being done without the benefit of a required the conditions will be forwarded to the Desk Officer, forwarded through channels to the Building and Safety Mr. King presented a report from Diehl -Evans & Associates on the Division of Consolidated Fire Protection District Assets and a proposed letter to be sent to Mr. Roscoe Hollinger, Chief Deputy Auditor - Controller, Los Angeles County Hall of Records, outlining that the audit indicates there is an additional $43,951.76 due the City, or a total of $746,399.69,as fair distribution of the assets in the Consolidated Fire District, for the approval of Council. Mr. King stated that the Chamber of Commerce is sponsoring the All American City Award application, and it was recommended that the following people be appointed to the committee by both the Council and the Chamber of Commerce: Leon Emerson, 8238 East 3rd Street Harold L. Smith, Chairman, 8650 Cleta Lloyd Thomas, 7150 East Firestone Bob O'Leary, 11214 S. Downey Avenue D. R. Dickson, 10927 S. Downey Avenue It was moved by Councilman Peavey, seconded by Councilman Stamps, and passed that the above mentioned appointments be approved. Carroll M. Dunnum, Mayor, took his seat at 8:15 P.M. ORDINANCE NO. 95 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY, AMENDING THE DOWNEY MUNICIPAL CODE BY CHAPTER 4, ARTICLE II, A NEW PART RELATING TO CIVIL DEFENSE AND DISASTERS. The ordinance was read in full. Councilman Giddings took his place at 8:39 P.M. City Manager Oren L. King continued with his report and asked the Council for approval to go ahead with the Little League Baseball Diamond. The Council thought $1,500.00 was too much to spend on this project and suggested the matter be given further study. Robert W. Gain, Chief of the Fire Department, presented a map of the central business district and gave a report on the Fire Zone 1 Ordinance as it would affect this commercial area. Mr. King gave a report made by the National & Pacific Boards of Fire Underwriters when they were in his office. Mr. Kim Stevenson, 10308 Chaney, spoke against the Fire Zone 1 Ordinance. Mayor Dunnum referred this ordinance to the Fire Committee and the Public Safety Committee for further study. Mr. Robert Reed, 9623 Shellyfield Road; and Mr. Harry Boand, 10340 Downey Avenue made inquiries regarding this Fire Zone 1 Ordinance. Mayor Dunnum re- ferred them to attend the committee meeting for complete details. Mr. King presented the council with a copy of the Major Street Improvement Program for study. ORDINANCE NO. 96 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING CHAPTER 6 TO ARTICLE IV, WHICH SAID CHAPTER RELATES TO UNNECESSARY NOISES. The ordinance was read by title only. It was moved by Councilman Temple, seconded by Councilman Peavey, and so ordered that further reading be waived. The City Clerk read the following correspondence: A letter was read from the County Boundary Commission stating that Long Beach had filed a proposal for annexation of territory known as Increment No. 164. Mayor Dunnum ordered the letter accepted and filed. A letter was read from the Southeast Recreation and Park District request- ing financial support in regard to a one school- centered program (Fairford School). Mr. King's reply stated that the City of Downey does not feel it is in a position to levy any taxes or allocate any funds for park development as long as tax levy- ing bodies are carrying these programs, as it would in a measure represent double taxation. Mayor Dunnum ordered the letter accepted and filed. A letter from Mr. H. L. Greenberg was read protesting the location of the "Four Way Test" signs on Florence Avenue near Pico Vista. Mr. King's reply stated that this program is sponsored and paid for by the Downey Rotary Cluk and other civic organizations, along with the Chamber of Commerce, and the steering committee in charge relative to the location of all these signs will be contacted. Mayor Dunnum ordered the letter accepted and filed. A letter was read from Burke, Williams, and Sorensen asking for approval to send a letter to Mrs. Gardner stating that the City is not liable for the damages caused by flooding. It was moved by Councilman Stamps, seconded by Councilman Temple, and passed that approval be given to send said letter. A letter was read from Mr. Max K. Heine requesting a hearing on Zone Ex- ception Case No. 56. It was moved by Councilman Peavey that the request be denied. Hearing no second to this motion, it was moved by Councilman Temple, seconded by Councilman Stamps, and passed by the following vote that the date of July 14th be set for the public hearing: 5 AYES: Councilmen: Giddings, Stamps, Temple, Peavey, Dunnum 0 NOES: Councilmen: None 0 ABSENT: Councilmen: None An invitation to the Mayor and City Council to attend the City of Lake - wood's Dedication Ceremonies for the City Administration Building. It was ordered accepted and filed. A letter was read from the Los Angeles County Road Department allocating the City of Downey Aid to Cities Money for 1958 -1959 in the amount of $52,313.14. It was ordered accepted and filed. A notice was read that there will be no League of California Cities' meetings during the month of June. A letter was read from Mr. Lansdale of the Stonewood Shopping Center stating that they have signed leases with a number of businesses as a result of certain rights being granted through Resolution #237. This letter was accepted and ordered filed. Petitions were presented from the Alameda School District regarding crossing guards at the Ed. C. Lewis School, 13220 S. Bellflower Boulevard, Downey, California. Mayor Dunnum authorized the City Clerk to write a letter to Mr. Wilburn E. King, stating that the council would be happy to hear from him at the next meeting relative to his letter of May 20th, 1958. Petitions of protest were presented on the Stoakes Lighting District. It was ordered that the names should be sent to the County so signatures could be verified and a report made at the next meeting. A letter from the Downey Museum of Art thanking the City Council for the financial support provided in 1957 and submitting their 1958 -59 Estimated Budget which calls for $2,000 to be contributed by the City of Downey. This letter was referred to the City Manager for budget consideration. Petitions for the Eradication of Health Manance as they exist on the north side of Orange & Mory Streets between Dolan &Glynn Avenues were presented and referred to the Director of Public Works and City Manager. Petitions were read in full protesting the Stonewood Shopping Center (Resolution No.237). Mr. Greene,,, 10225 Chaney, spoke in behalf of a group of property owners' meeting protesting Resolution No. 237. Hepresented peti- tions containing approximately 1100 signatures as evidence of criticism. These were ordered accepted and filed. The following people spoke in protest to the entrances provided for in Resolution No. 237: Mr. Merle E. Ballard, 10426 Chaney Mrs. Doran B. Harney, 10447 Chaney Mr. C. R. Housel, 9227 Cecilia Mr. R. C. Gusse, 9308 Fostoria Mr. Lansdale spoke briefly on the advantages of having these entrances installed. After some discussion, a hearing was set for June 2nd, 1958 at 7:30 P.M. Mr. Murry Kraemer spoke on the three hour "MAD MIDNIGHT SALE" that is going to take place June 7th, 1958. Mrs. Leach stated that she would like to keep her property which was being considered by the Council for the "Mall ". The matter was taken under submission. Larry Ezzell, Student Mayor of the day, expressed thanks in behalf of the student body to the City Council and the City of Downey for letting them par- ticipate in the "Students in Government" day.
