MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
HELD APRIL 28, 1958
The City Council of the City of Downey held a regular meeting in
the Council Chambers of the Downey City Hall at 7:30 P.M. on April 28,
1958. Mayor Pro- Tempore Scott E. Temple presided.

It was moved by Councilman Peavey, seconded by Councilman Giddings,
and passed that the meeting adjourn to the cafetorium.
The City Council of the City of Downey reconvened in the cafetorium.

It was moved by Councilman Giddings, seconded by Councilman Stamps,
and carried that the minutes of April 14th, April 15th (8 :00 a.m.), April
15th (9:27 a.m.), and April 16th, 1958 be approved as presented.
The City Clerk read the following correspondence:
A letter from the County of Los Angeles Boundary Commission, regarding
Whittier - Annexation #4.
A letter from the County of Los Angeles Boundary Commission, regarding
Bell - East of Otis Avenue Annexation.
A letter of congratulations from Autonetics of North American Aviation,
Inc. - John R. Moore, Vice President & General Manager.
A letter of congratulations from the City of Maywood - Mayor Verne K.
Tennis.
A clipping from the Livewire dated Thursday, April 17th from Mr. & Mrs.
John M. Barr extending congratulations to the council.
A letter from the Chamber of Commerce giving a quarterly report
A letter from the California National Guard postponing plans for relo-
cating units of the 160th Armored Infantry Battalion in the City of Downey.
A letter from the Central Water Basin Association regarding their
meeting Thursday, May 1, 1958 at the Huntington Park Elks Club, 6:30 p.m.
A notice from the Board of Directors, League of California Cities,
regarding their meeting in the Rodger Young Auditorium in Los Angeles,
Thursday, May 1, 1958, at 7:15 p.m.
A letter from the City of South Gate regarding property taxes.
A letter from Mrs. John B. Gardner regarding flood damage was referred
to the City Attorney.

A letter from John A. Nordbak resigning from the Water Committee.
It was moved by Councilman Peavey and carried that Mr. Nordbak's resignation
be accepted with regrets and that the City Manager send him a letter of
thanks for services rendered.
A letter from Rex H. Dyer, Jr. resigning from the position as temporary
City Librarian. It was moved by Councilman Peavey and carried that Rex H.
Dyer, Jr's resignation be accepted with regrets and that Mr. King send him
a letter of thanks for services rendered.
A letter from the League of California Cities regarding the Government
Study Commission.
A letter from the County of Los Angeles regarding the County Library
Building.
A letter from the Downey Junior Chamber of Commerce asking permission
to hold controlled Fireworks Display.
A letter from Robert W. Gain, Chief of the Fire Department, stating
the Downey Jr. Chamber of Commerce's request for a permit to stage a Public
Display of Fireworks.
It was moved by Councilman Giddings, seconded by Councilman Stamps,
and so ordered that the Jr. Chamber of Commerce be permitted to stage a
Public Display of Fireworks pursuant to Section 1204 of the Fire Code of
the City of Downey.
A letter from Harry Sloan resigning from the Sanitation Committee.
It was moved by Councilman Peavey, seconded by Councilman Stamps, and
carried that Harry Sloan's resignation be accepted with regrets and referred
to the City Manager to write a letter of thanks for services rendered.
A letter from the Downey Chamber of Commerce requesting an increase in
the fund allocation from $5,000.00 to $7,500.00 for the 1958 -1959 fiscal year.
Mayor Pro - Tempore Temple ordered the letter received and filed for budget
study.
A letter from the Downey Chamber of Commerce regarding financing of
Christmas lighting. Mr. King suggested looking into having a committee
to study this problem. Mayor Pro - Tempore Temple ordered the letter re-
ceived and filed for budget study.
A letter of protest from Rawlins Investment Company (Zone Case #22).
This was held for later action.
A letter of protest from John J. Patak regarding Zone Exception Case #50.
A letter of protest from John Barr and Max Heine regarding Zone Excep-
tion Case #50.
These protests on Zone Exception Case #50 were ordered held for full
council action.
The letters from Ethel A. Riggs,on Zone Exception Case #31, and the
Spencer V. Williams P. T. A. were ordered held and filed awaiting a reso-
lution from the Planning Commission.
A letter from Norman J. Ream formally requesting a copy of all minutes
and monthly financial reports of the City of Downey. Councilman Giddings
informed council that he had received a similar letter from Mr. Ream. Upon
the advise of the City Attorney that this was not mandatory, the request
was unanimously denied on the basis that all records are available at the
City Hall, and should all Downey Citizens start requesting copies of these
items, it would run into considerable, unnecessary, expense. Mayor Pro -
Tempore Temple suggested that if the citizens should request copies and
were willing to pay for the expense of the services, perhaps something
could be arranged on that basis.

Mr. William Troy, Chairman of the Sanitation Committee, read a letter
to the City Council regarding the termination of the sanitation contracts.
Mayor Pro - Tempore Temple extended his thanks to Mr. Troy for reading
the Sanitation Committee's report in full.
Councilman Peavey commended the disposal companies on their past per-
formances.
It was moved by Councilman Peavey, seconded by Councilman Giddings,
and carried that this report from the Sanitation Committee be included in
the call for bids.
RESOLUTION NO. 227
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ESTABLISHING RULES AND REGULATIONS FOR GARBAGE AND REFUSE
COLLECTION AND DISPOSAL, AND THE TERMS AND CONDITIONS FOR
BIDS FOR GARBAGE AND REFUSE COLLECTION AND DISPOSAL CON-
TRACTS, AND CALLING FOR SEALED BIDS FOR THE SAME.
(Call for bids - May 12, 1958 - 10:00 A.M.)
The resolution was read by title only. It was moved by Councilman
Giddings, seconded by Councilman Peavey, and passed by the following vote

Mrs. Wilma Dikerhoff of the Downey Young Republican Club presented the
City Council with the Congressional Record and informed the council that
the Library of the City of Downey would continue to receive copies as long
as they were published.
Mr. King, City Manager, presented the Library Report.
It was moved by Councilman Peavey, seconded by Councilman Giddings,
and so ordered that the City Manager be authorized to negotiate with proper
school authorities regarding the purchase of school property.
The request for donations to the Downey Babe Ruth League was not
approved because of the many similar requests that have been received.
The City Manager presented his report regarding additional personnel
in the building department, the personnel department, and the public works
department.

and passed by the following vote that the request for an additional building
inspector be approved:

It was moved by Councilman Peavey, seconded by Councilman Giddings,
and passed by the following vote that the request for a Jr. Civil Engineer
be approved:

Councilman Giddings again brought it to the attention of the council
that preference be given Downey residents on these positions, provided
they meet the necessary requirements.
It was moved by Councilman Giddings, seconded by Councilman Peavey,
and passed by the following vote that tenative approval be given to orga-
nize the City Street Department and recruit personnel needed and to autho-
rize the City Manager to call for bids for equipment as listed, one -half
(2)($37,750.00) to be paid from the current budget - unappropriated reserve,
and the remaining one -half (2) ($37,750.00) included in the 1958 -59 budget:

Mr. King presented the lease agreement for the building across from
the City Hall on the northwest corner of Dolan and Second Street. There
was some discussion as to the building not being large enough. Mr. Joe
Coss, Chairman of the Library Advisory Board, stated that he realized the
building was small, but it is to be used only as a temporary library (3
years, 8 months), and that they hope to build a larger building later, with
possible branches in each of the councilmanic districts. After considerable
discussion, this matter was referred back to the City Manager and the Library
Advisory Board.
It was moved by Councilman Peavey, seconded by Councilman Giddings, and
passed by the following vote that the City Manager be authorized to purchase
books for the Library:

RESOLUTION NO. 228
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CREATING THE POSITION OF CITY LIBRARIAN AND ESTABLISHING
COMPENSATION THEREFOR AND RESCINDING RESOLUTION NO. 197.
The resolution was read in full. It was moved by Councilman Peavey,
seconded by Councilman Giddings, and passed by the following vote that

Mr. King presented the Civic Center Study, but action on the "mall"
was deferred.
Mr. Royal M. Sorensen, City Attorney, presented a contract covering
joint services between the City of Downey and the Downey Park, Recreation
and Parkway District #7 (which was presented to council at an earlier date).
This simply formulates the policy which was discussed in advance and worked
out in concurrance with Mr. Kendall, Mr. Furman, Mr. Leon Emerson, and Mr.
Royal M. Sorensen.

ZONE EXCEPTION CASE NO. 22 (Rawlins). Mrs. Armeta Atkinson; Mrs. Ethel R.
Riggs, 7103 Luxor; Susy Harris, 7109 Luxor spoke against the zone case.
Mr. Dan McNutt, City Planner, recommended that the property is not
suitable in Case No. 22 for R -1 zoning. The people to the north of this
property have a right to expect a decent buffer strip if cattle are per-
mitted to go into that location. He recommended that an 8 foot solid fence
be constructed 200 feet southerly of the northerly line of subject property,
that the fence along South Gate City boundaries be designed or built so that
it would not permit cattle from the South Gate side into the buffer strip
area, Mr. McNutt also recommended this be placed on a time limit with
respect to the council's knowledge of the property's potential value as CM
Zone or whatever zone might be applied to this subject property in the
future with respect to heavy industry zoning in the City of South Gate.
Mr. McNutt recommended this be approved on this basis.
It was moved by Councilman Temple, seconded by Councilman Peavey,
and passed by the following vote that the City Council make findings that
Zone Exception Case #22 is necessary for the preservation of property rights,
that the granting of said zone exception will not be detrimental to public
peace, health, safety, or welfare and that it will not be contrary to the
general zoning plan for the city:

It was moved by Councilman Temple, seconded by Councilman Peavey, and
passed by the following vote that a zone exception in Zone Exception Case
#22 be granted on the following conditions:
1. That there be erected and maintained a solid fence, or wall, 8
feet high, extending the full width of said property, parallel to and 200
feet southerly from the northerly line of the subject property, said
northerly line being the same as the southerly line of Lot 3 of Tract #11979.
2. That there be a solid fence or wall erected and maintained 8 feet
in height placed along the westerly line, extending in a northerly direction
from the fence or wall set forth in condition 1 to said southerly property
line of said Lot 3.
Aar 3. That said exception shall expire on November 1, 1959.
4. That the exception shall be limited on the said property to that
portion of the subject property southerly of the fence or wall referred to
in condition 1 and said southerly portion of the property shall be used only
for the temporary keeping of cattle thereon and that cable shall be kept or
maintained thereon only intermittently and while their normal place of keep-
ing is unavailable.
5. That premises at all times be kept in as clean and sanitary condi-
tion as is reasonably possible. No cattle shall be kept on said southerly
portion of subject property until the fences required by conditions 1 and
2 hereof have'been installed.

6. That in the fence along said westerly line, there shall be no
openings of sufficient size to permit passage of cattle.
7. That the north portion of subject property northerly of the wall
described in condition 1 shall be kept in a clean and sanitary condition
and reasonably free of weeds, debree, or other refuse.

Mr. Rawlins wondered if the buffer strip could be used for recreational
Purposes and'suggested that the Park Department get in touch with him regard-
ing such possibilities.
Mayor Pro- Tempore directed the City Manager and the Park District (Mr.
Furman) to contact Mr. Rawlins regarding the use of subject property for
recreational purposes.
It was moved by Councilman Peavey, seconded by Councilman Giddings, and
passed by the following vote that Zone Exception Case #50 (Beddoe) be referred
back to the Planning Commission and recommended it be held until a full com-
mittee could act on it.
Councilman Peavey recommended that Donald R. Morrison, 10630 Horley
Avenue, be appointed to take the place of Harry Sloan on the Sanitation
Committee and that John Alexander, 7259 Via Rio Nido be appointed to fill
the vacancy of John Nordbak on the Wattr Committee.
There being no further business, the meeting adjourned till Monday,
May 5, 1958 at 7:30 P.M. in the Council Chambers of the City Hall.
