Assistant Dan McNutt, City Planner LeRoy Starkey, Director of Finance A. C. Gabriel, Purchasing Agent Della Doyle, City Clerk The Reverend John T. Chase, Downey Church of Christ, gave the invocation. Mayor Peavey declared the continued hearing on the Smallwood Lighting Dis- trict open for discussion. Mr. Oren L. King, City Manager, gave his report on the Smallwood Lighting District and indicated there was a majority protest of 51.8% against the for- mation of a 1911 Assessment District inthe area bounded generally by Paramount Boulevard, Imperial Highway, and the Rancho Los Amigos, for the purpose of in- stalling an-underground street lighting system. The City Attorney, Royal M. Sorensen, stated that inasmuch as the petitions constituted over 50% of the property owners in the district, any action was automatically stopped and no similar proceedings could be instigated within a year's period. It was moved by Councilman Temple, seconded by Councilman Giddings, and passed by the following vote that the Council find that the owners of more than one -half of the area of the property to be assessed for the Smallwood Lighting District have protested against the improvement, and therefore, the proceedings are automatically terminated: �— AYES: 4 Councilmen: Giddings, Dunnum, Temple, Peavey NOES: 0 ABSENT: 1 Councilman: Stamps Councilman Stamps took his place at 7:40 p.m. It was moved by Councilman Temple, seconded by Councilman Giddings, and passed by the following vote that the minutes of November 12, 1957 be approved as presented: AYES: 5 Councilmen: Giddings, Dunnum, Stamps, Temple, Peavey NOES: 0 ABSENT: 0 Mr. Dan MacKenzie, a member of the Rotary Club, and Mr. John Ezzell, President, presented a sample of the entrance sign to be used at certain entrances to Downey. They requested that the City Council go along with them at this time and buy five additional signs, which, together with the five they already have committments for, would be enough to cover the entire area at $5,000.00 per sign. The City Attorney informed the City Council that bids must be called for, specifying materials, design, and method of constuction; and the con- tract awarded to the lowest and best bidder. In answer to Councilman Giddings' question, Mr. Oren L. King, City Manager, stated that money was available for such an undertaking at this time through savings made elsewhere. It was moved by Councilman Giddings, seconded by Councilman Dunnum, and passed by the following vote to call for bids on five or six signs, the money to come out of the current budget. Brown, Vice President of the Pasadena Rose Float Association, who pre- sented the 1957 Rose Float Plaque to Mayor Peavey. The City Clerk read the following correspondence: Letter from the Associated Student Body regarding students mis- conduct in petty thievery. It was moved by Councilman Temple, seconded by Councilman Stamps, and passed by the following vote that the City Clerk send a letter of thanks to �. the Associated Student Body and refer the matter to the Chief of Police: AYES: 5 Councilmen: Giddings, Dunnum, Stamps, Temple, Peavey NOES: 0 ABSENT: 0 Letter from the Los Angeles County Boundary Commission stating that the City of Whittier has filed Annexation No. 9. Letter from the Earl Warren High School P. T. A. thanking Council for the quick action taken regarding lewd literature. Letter from C. C. Carpenter School P. T. A. suggesting an Ordinance be adopted to prevent the sale or possession of lewd literature. The City Attorney announced that an Ordinance was being prepared to cover said lewd literature. Letter from Mrs. Aldridge expressing appreciation to the Citizens' Sani- tation Committee. Letter from Mr. Thomas Gallagher, Downey City School District, to Mr. King, expressing appreciation for quick response for help on Downey 's first Business Education and Industry Day. Letter from Frank Bonelli regarding Real Property Tax in the County of Los Angeles. Letter from George Christopher, Mayor of San Francisco, urging the City of Downey to join the American Municipal Association. Letter from The Metropolitan Water District regarding District Taxes. Mr. King, City Manager, stated we have no choice other than to go ahead with the taxes. Mayor Peavey ordered letter to be filed. Letter from the Metropolitan Transportation Engineering Board inviting the City Manager to become a member of the Board. Mr. King recommended that someone should be on the Board. Mr. Giddings suggested it be either Mr. King or someone appointed by him. Mayor Peavey so ordered. Letter from Mr. John J. Patak appealing Zone Exception Case #28. It was decided that a public hearing was in order and was set for the second regular meeting in December, which is the 23rd. It was moved by Councilman Dunnum, seconded by Councilman Temple, and so ordered by Mayor Peavey. Letter from Rawlings Investment Corporation regarding Zone Exception Case 22. It was moved by Councilman Temple, seconded by Councilman Dunnum, and so ordered by Mayor Peavey that a public hearing be held on December 23rd, appealing the decision on Case 22. Letter from Herbert C. Legg, regarding taxes. Councilman Dunnum gave a resume of his findings, and Mayor Peavey requested the City Attorney check into this further. ORDINANCE NO. Sanitary Sewers in Lakewood Boulevard, Vicinity of Downey. RECOMMENDATION: It is respectfully recommended that sanitary sewers be installed in this district. ANALYSIS: This Department has made an investigation of the Lakewood Boulevard Sanitary Sewer District, City Improvement No. 6, City of Downey, as shown on the attached map. During the course of this investigation nine house -to -house calls were made. Of the nine property owners or tenants actually con- tacted, three or 33 -1/3% reported that they had experienced trouble with their individual subsurface sewage disposal systems. They complained that the systems filled up causing raw sewage to back up into the house plumbing fixtures or to overflow on to the surface of the ground, also that frequent pumping and cleaning out of the systems was necessary. The soil within the area of this proposed sanitary sewer district consists of a fine silty sand. Also during certain seasons of the year there is a fairly high ground water table. Nether of these conditions are conducive to the proper functioning of any type of individual subsurface sewage disposal system. In view of our survey, I, the undersigned Health Officer of the County of Los Angeles, having been officially designated by the Ctty Council of the City of Downey to perform public health ser- vices for the City of Downey, do hereby recommend that proceedings be instituted at once for the construction of sanitary sewers in the Lakewood Boulevard Sanitary Sewer District, City Improvement No. 6, City of Downey. This recommendation is made as an improvement ne- cessary to the protection of public health and pursuant to the pro- visions of Section 2808 of the Streets and Highways Code. Stevenson would like to have a stipulation signed that suit be terminated without prejudice to either party. The City Attorney requested advice of the Council as to whether it wished this suit to be so terminated.
