MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
HELD AUGUST 12th, 1957
The City Council of the City of Downey held a regular meeting in the
Council Chambers of the Downey City Hall at 7:30 p.m. bn August 12th, 1957,
Mayor Peavey presiding.

City Manager King introduced the newly employed Chief Building Inspector,
Ray Lake and the Assitant Fire Chief, Don Warren, to the Council.
The Mayor announced that the hour of 7:30 p.m. had arrived and opened
the Public Hearing on the vacation of certain access rights on the easterly side
of Old River School Road and the southerly side of Florence Avenue. There
being no protests offered either written or oral the hearing was declared closed.
RESOLUTION NO. 139
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF DOWNEY ORDERING THE VACATION OF C PERTAIN
ACCESS RIGHTS ON THE EASTERLY SIDE OF OLD RIVER
SCHOOL ROAD AND THE SOUTHERLY SIDE OF FLORENCE
AVENUE.

ORDINANCE NO. 42
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF DOWNEY AMENDING SECTIONS 2528 AND 2530 OF THE
DOWNEY MUNICIPAL CODE AND ADDING THERETO A
NEW SECTION TO BE DESIGNATED SECTION 2531, ALL
OF WHICH SECTIONS RELATE TO THE DRAWING AND
SIGNING OF WARRANTS.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF DOWNEY AMENDING; THE DOWNEY MUNICIPAL CODE
BY ADDING THERETO SECTIONS 8102, 8103, 8104, 8105
AND 8106, WHICH SAID SECTIONS RELATE TO THE ELECTRICAL
CODE OF SAID CITY.
Councilman Temple asked that any action be withheld on said Ordnance
until further study could be given to section 9103, paragraph (b) regarding
'Special Owner's Permits'.
Planning Commission Resolutions Nos. 8,10 ,11 ,12,13 and 14 were
presented to the Council by Dan McNutt, City Planner, for their consideration.
Mr. Robert Drews, 8333 Lyndora, Downey requested that action be withheld
on Resolution No. 8 for further study.

and passed by the following vote that a public hearing be called to consider
Resolution No. 8 and the companion Resolution No. 14 and that the date be set.

Mayor Peavey announced that the time of 8:00 p.m. was at hand and opened
the Public Hearing on the intention to call a special election in certain inhabited
territory contiguous to said City proposed to be annexed thereto- territory known
as Annexation No. 2

AATD ARTICLE TO BE DESIGNATED ARTICLE V AND SAID
CHAPTER TO BE DESIGNATED CHAPTER I THEREOF,
CONSISTING OF SECTIONS 5100 THROUGH 5120 RELATING
TO THE COLLECTION AND DISPOSAL OF GARBAGE AND
REFUSE.
Mrs. Olive J. Basinger, 7823 Arnett, asked for a clarification of the
regulation of burning garbage.

that Section 3501 be changed to read 'five days within any thirty day period'.

Mayor Peavey opened the meeting for any comments from the citizens present.
Norman Ream, 10546 Chaney, Downey gave a resume' of the fire facilities
and costs of various surrounding communities and contrasted them with the Los
Angeles County Department. He urged that theCity of Downey activate the Fire
Department of Downey by September 1 st, 1957.
The following citizens spoke in behalf of the City's own Fire Department
and each urged that it be pushed ahead of schedule and activated as soon as possible.

Chief Gain was called upon to discuss the possibility of having the Fire
Department in action at an earlier date than had originally been set. He would
exert every effort to have an active Department by the early part of September
but assured everyone that he would not push the date to the point that the service
would not be the most efficient and adequate. Downey will not be without the
very best of service at any time.
It was moved by Councilman Temple, seconded by Councilman Dunnum, and
passed by the following vote that the Fire Chief be given authority to proceed to
activate the Downey Fire Department at the earliest possible date consistant with
efficiency.

It was moved by Councilmn Giddings, seconded by Councilman Dunnum, and
passed by the following vote, minute action by the City Council authorizing the
preparation of plans and specifications and calling for bids for an 85 -foot aerial
ladder truck be taken and that authority be granted to purchase necessary fire hose
and communications equipment as outlined under the current budget.

This action was taken in accordance with recommendations from the National
Board of Fire Underwriters to improve fire protection within the City of Downey.

Ray Noxsel, Vice- President of the Junior Chamber of Commerce stated that
the JC was making an extensive study of the Fire Department si=tuation as it now
exists in the City of Downey and as a body urges that Downey have its own department
as soon as possible.
It was moved by Councilman Dunnum, seconded by Councilman Temple, and
passed by the following vote that the City Attorney be instructed to prepare a Res-
olution providing for the withdrawal from the County Fire District and that there
be filed all but one df the certified copies of such Resolution required by law to be
filed, that the remaining copy be held by the City Manager, to be filed when Fire
Chief Gain reports that all equipment and personnel are in a position to assume the
responsibility and can render services, as good as, or better than those now being
provided.

City Manager King presented tabulation of the bids as publicly opened for
the construction of the two substations at 10:00 a.m. , Friday, August 9th, 1957.
It was recommended that the low bid of Integrated Constructors in the amount of

It was moved by Councilman Temple, seconded by Councilman Stamps,
and passed by the following vote that the bid for the construction of the two fire
sub - stations be awarded, subject to the vesting of title, to the low bidder,
Integrated Constructors, to the exclusion of all other bidders. Bid as accepted

City Manager King requested that authority be granted to purchase two
additional sites for fire sub - stations, to complete the acquisition of four sites
for sub - stations in accordance with the National Board of Fire Underwriters'
recommendations.

City Manager King recommended that the Council authorize withdrawal from
the County contractural agreement for street sweeping effective October 1 st, 1957
and authorize the purchase of one power sweeper to be let on bid and to approve
an amendment to the salary resolution authorizing employment of a field service
man and of two equipment operators.

and passed by the following vote that the City notify the County Road Department
of the City's withdrawal from the County contractural agreements for street
sweeping effective October 1, 1957.

acknowledging receipt of a copy of Resolution No. 114 of the City declaring its
intention to withdraw from the Consolidated County Fire Protection District.
A letter from the Junior Chamber of Commerce stating that they unanimously
back the City Council in their formation of a Downey City Fire Department and
enclosing a news release which was distributed by them.
A letter from Monterey Park thanking the Council for their cooperation

A notice from the County Boundary Commission of a proposed annexation

A letter from William P. Wilson presenting an application for the exclusive

bank between Florence Avenue and Cecilia Street. This petition was referred to

A letter from W. Henry Rose expressing appreciation for the consideration
the City had shown by flying the flag at halfmast in respect for Hohn W. Frederickson.
An invitation from the Downey Post 270 American Legion, Inc . , to attend
their meeting of August 19th, 1957.
An announcement for the 1957 annual conference of Mayors to be held
at the Waldorf - Astoria in New Your City, Secptember 9,10,11 , 1957.

and passed by the following vote that Mayor Peavey attend this meeting with all
necessary expenses paid.

Proposals from several accounting firms were presented by the City Clerk.
Mayor Peavey appointed a committee of Councilman Dunnum, Councilman Giddings,
and the City Manager to open and tabulate the bids for presentation to the Council

A petition was presented by Robert Eriser, 7714 E. 2nd St., Downey
protesting a public nuisance at 7725 Firestone B1vd.,Downey. This petition was
referred to the City Manager.
