MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
HELD APRIL 29, 1957
The City Council of the City of Downey held a special meeting in the
Cafetorium of the Downey Elementary School at 7:30 P.M. on April 29th, 1957
with Mayor Stamps presiding.

ABSENT: COUNCILMEN: Carroll M. Dunnum, Edwin W. Giddings

Della Doyle, City Clerk
Mayor Stamps announced that 7:30 P.M. was the time and place that a
special public hearing was called for the purpose of reviewing the grant of
a special permit No. 1 to the Downey Fertilizer Company.
After Mayor Stamps administered the oaths the clerk read from the minutes
of the Planning Commission pertinent data as recorded previous to the ruling
of the Commission.
The meeting was opened to the petitioners.
The following citizens opposing the Special Permit spoke:
Charles L. Mitsch, 13647 Ocanna St., Downey
E. W. Ward, 8402 E. Fontana Ave., Downey
Donald R. Hansen, 12215 Dunrobin, Downey
William P. Wilson, attorney representing Downey Fertilizer Company spoke
in favor of the Special Permit. He read into the record a letter from the
Bureau of Sanitation and one from the County Health Officer stating that there
was no health or air polution eminating from said plant.
Donald R. Hansen, and E. W. Ward offered a rebuttal.
Letters of protest were presented by the City Clerk from:

Telegrams protesting were read from:

A telephone protest from Mrs. W. S. McElroy, 12602 Coldbrook Ave., Downey
was read.
A letter from the Alameda District Improvement Association entering the
official protest was presented.
A letter trom William P. Wilson, Attorney at Law was read in answer to
the otticial protest.
When no other citizen took the floor it was moved by Councilman Temple,
seconded by Councilman Peavey and passed that the hearing be closed and the
matter taken under submission.

Helen Clark, 12625 Woodruff, Downey asked to speak.
It was moved by Councilman Temple, seconded by Councilman Peavey and
carried that the hearing be reopened.

Councilman Temple asked if the defendant cared to make any remarks.
Arnold Babajian, 9229 W. Beverly, Whittier said they were willing to make
any improvements that would make the plant more acceptable to the citizens.
Councilman Peavey suggested that the Council make a survey of the situa-
tion before any decision be reached.
It was moved by Councilman Temple, seconded by Councilman Peavey and
carried that the hearing be closed.

A ten minute recess was declared. At 9:00 P.M. the meeting reconvened
with all present.
The City Manager presented demands No. 151 through No. 166 for the
Council's consideration. It was moved by Councilman Peavey, seconded by
Councilman Temple and unanimously carried that the City Council, after audit
of demands No. 151 through No. 166 finds and determines that the demands are
proper and the total amount thereof does not exceed the income and revenue
for the year in which the indebtedness was incurred, but that there are not
sufficient funds available for the payment of said warrants on their due date,
and the same shall not be approved for want of funds. The City. Clerk shall
endorse upon the demand the fact that the demands have been audited by the
City Council and not approved for want of funds.

The City Manager presented the lease for the building owned by the
Downey City School District.
It was moved by Councilman Temple, seconded by Councilman Peavey and
carried that the City Manager be given authority to execute the lease, sub-
ject to the approval of the City Attorney.

The City Manager announced that a meeting had been arranged with the
City Council of the City of Paramount and the Council of the City of Downey
to discuss the dissolution of the Garbage Districts that overlap the areas.
The City Manager announced the appointment of Mr. Richard George Barhite
as City Engineer and Director of Public Works for the City of Downey.
It was moved by Councilman Peavey, seconded by Councilman Temple and
carried by the following vote that Richard George Barhite be approved as
City Engineer and Director of Public Works for the City of Downey and the
rate of compensation be set at $953.00 per month under salary bracket No.
33 to be effective as of the 1st of June, 1957; and that the attorney be
instructed to draw a resolution to that effect.

The City Manager reported that competitive quotations had been procured
and recommended that the following equipment be purchased. Two IBM Executive

Electric Typewriters, one IBM Standard Electric Typewriter and one
Remington Rand Printing Calculator.
It was moved by Councilman Peavey, seconded by Councilman Temple and
carried that the authority to purchase the equipment be granted.
