HomeMy WebLinkAboutMinutes-03-11-57-Regular Meetinga MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY HELD MARCH 11, 1957 The City Council of the City of Downey held a regular meeting in the Council Chambers of the Downey City Hall at 7:40 P.M. on March 11, 1957 with Mayor Stamps presiding. PRESENT: COUNCILMEN: Carroll M. Dunnum, Edwin W. Giddings, Hollis M. Peavey, Scott E. Temple, James L. Stamps. Also Present: Glenn Kendall, Acting City Manager Royal Sorensen, City Attorney John Crowley, City Consultant Della Doyle, City Clerk It was moved by Councilman Giddings, seconded by Councilman Dunnum, and unanimously carried that the minutes of the meetings held on February 25th and March 1st, 1957 be approved as presented. The City Clerk announced that this was the time set for a public hearing on the vacation of certain Access Rights on the Westerly side of Brookshire Avenue. The Mayor asked if anyone in the audience wished to speak on this matter. There being no questions from the floor, it was moved by Councilman Temple, seconded by Councilman Dunnum, and unanimously carried that the hearing be closed. RESOLUTION NO. 50 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING THE VACATION OF CERTAIN ACCESS RIGHTS ON THE WESTERLY SIDE OF BROOKSHIRE AVENUE. It was moved by Councilman Dunnum, seconded by Councilman Peavey, and unani- mously carried that further reading be waived. It was moved by Councilman Giddings, seconded by Councilman Temple, and unani- mously carried by a roll call vote that Resolution No. 50 be adopted. NOES: 0 ABSENT: 0 ORDINANCE NO. 16 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DO'ZEY AMENDING THE DOWNEY MUNICIPAL CODE BY AMENDING SECTIONS 3200, 3201 and 3206 OF SAID CODE. (Re: Bicycles) The Ordinance was read by title only. It was moved by Councilman Dunnum, seconded by Councilman Temple, and unanimously carried that further reading be waived. NOES: 0 ABSENT: 0 RESOLUTION NO. 51 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING STEWART AND GRAY ROAD AT ITS INTERSECTION WITH VULTEE STREET AND CORRIGAN STREET TO BE A THROUGH STREET AND MULLER STREET AT ITS INTERSECTION WITH CHANEY STREET TO BE A THROITGH STREET. The Resolution was read by title only. It was moved by Councilman Dunnum, seconded by Councilman Giddings, and unanimously carried by a roll call vote that further reading be waived. NOES: 0 ABSENT: 0 It was moved by Councilman Dunnum, seconded by Councilman Temple, and unani- mously carried by a roll call vote that Resolution No. 51 be adopted. NOES: 0 ABSENT: 0 Mr. Norman Ream, 10516 Chaney, suggested, because of the number of acci- dents that occur at the corner of Chaney and Muller Avenues, stop signs be placed on both streets. RESOLUTION NO. 52 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY EXPRESSING ITS APPRECIATION TO ARTHUR W. BREWER. It was moved by Councilman Giddings, seconded by Councilman Peavey, and unanimously carried that further reading be waived. It was moved by Councilman Temple, seconded by Councilman Giddings, and un- animously carried by a roll call vote that Resolution No. 52 be adopted. NOES: 0 ABSENT: 0 ORDINANCE NO. 17 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING THERETO A NEW CHAPTE`r TO BE DESIGNATED CHAPTER 2 OF ARTICLE IV AND RELATING TO GAMBLING. It was moved by Councilman Dunnum, seconded by Councilman Temple, and unani- mously carried by a roll call vote that the Council approve Section2, the Emer- gency clause of Ordinance No. 17. NOES: 0 ABSENT: 0 ORDINANCE NO. 18 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF 1)OWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING TO ARTICLE IV THEREOF A NEW CHAPTER TO BE DESINATED CHAPTER 3 AND RELATING TO FORTUNE TELLING. It was moved by Councilman Giddings, seconded by Councilman Peavey, and unani- mously carried by a roll call vote that the Council approve Section 2, the emer- gency clause of Ordinance No. 18. NOES: 0 ABSENT: 0 It was moved by Councilman Dunnum, seconded by Councilman Temple, and unani- mously carried by a roll call vote that Ordinance No. 18 be adopted. NOES: 0 ABSENT: 0 It was moved by Councilman Peavey, seconded by Councilman Dunnum, and unani- mously carried that the Clerk be instructed to set the date and advertise for bids for liability insurance for the City of Downey. The second reading of Ordinance No. 15 regarding Southern California Edison Franchise be held pending further investigation. Councilman Peavey asked that the City Manager contact Mrs. Robert Oliver, 7238 Irwingrove, about the improvement of a 2 block section of Irwingrove Ave. Councilman Dunnum requested that the City Manager obtain information from the Water Company relative to the pumping of water on Patton Road. Councilman Temple discussed the possibility of an ordinance to prescribe a fence around all swimming pools. Councilman Peavey read a letter from the Chamber of Commerce asking that steps be taken to correct the traffic situation on New Street between Firestone 51 and 2nd Streets: and on 7th and 5th Streets between Paramount and Downey Avenue. The City Manager was asked to investigate and report of this situation. Councilman Dunnum brought to the attention of the Council the hazard being created by an island on Lakewood Blvd. where Stewart and Gray Road intersects. It was moved by Councilman Temple, seconded by Councilman Dunnum, and unani- mously carried that a letter be written to the State Division of Highway protesting this hazard and asking that immediate steps be taken to relie.re the situation. Mr. John Crowley, City Consultant, presented a report on the "Regulation of Fireworks Sales ". Mr. Ned Young, 10279 Priscilla, representing the American Legion Posts 11270 and #322 presented a suggested ordinance regarding the sale of fireworks, that they asked the Council to consider. Mr. Don Wal_ lick, 10417 S. Karmont Ave., South Gate, Commander, Hollydale American Legion Post #723 spoke in behalf of the suggested ordinance. It was moved by Councilman Peavey, seconded by Councilman Dunnum, and unani- mously carried that the suggested ordinance be referred to the City Attorney for his suggestions. Mr. Crowley stated that the reports on Southern California Gas Franchise were being held pending further investigation. The City Manager presented petitions on Assessment Districts for Smallwood, Rutgers, Dempster. He was instructed to proceed on those districts that had been started prior to incorporation and to hold all processing of new districts until such time as there is a City Engineer. The City Manager presented a letter from the Los Angeles Chamber of Commerce relative to the Industrial Development Conference. This letter was referred to the Planning Commission. A letter from the California Roadside Council regarding a legislative bill was referred to the Planning Commission. A letter from Mr. Ralph French, 506 Bank of America Bldg., San Diego 1, re- garding bids on group insurance was ordered filed pending action. A letter from the Public Utilities Commission regarding a public hearing of Southern California Gas Co. was referred to the City Attorney. Letters from the County of Los Angeles Board of Supervisors stating that the proposed areas for the City of Serra City and the City of East Santa Fe Springs had filed Notice of Intention to circulate petitions for incorporation. A letter from the Veterans Coordination Council suggesting that the City or- ganize a committee for the regulation of charitable solicitations. The letter was ordered filed. Mr. Crowley reported on moneys available from State and Federal funds, to the City for Planning. A letter from the Hollydale American Legion Post #723 asking that Ordinance No. 12 regarding dancing be amended to allow non - profit organizations to hold dances where alcholic beverages are sold. It was moved by Councilman Peavey, seconded by Councilman Temple, and unani- mously carried that the Attorney beinstructed to draw an ordinance amending Ordi- nance No. 12 to permit exceptions of certain community service organizations. A letter of resignation was received from Harry C. Williams stating that pre- vious commitments, of which the Council were aware, make it necessary for him to tender his resignation with regrets as City Attorney of the City of Downey. It was moved by Councilman Temple, seconded by Councilman Dunnum, and unani- mously carried that Mr. Willism's resi;_mati on be accepted with regrets and that 62 the City Manager be instructed to prepare a resolution expressing the Council's appreciation for Mr. Williams efforts in behalf of the City. It was moved by Councilman Dunnum, seconded by Councilman Temple, and unani- mously carried by a roll. call vote that Royal Sorensen be named the City Attorney. AYES: 5 COUNCILMEN: Dunnum, Giddings, Temple, Peavey, Stanps. NOES: 0 ABSENT: 0 The City Manager presented Demands No. 73 thru No. 92 for the Council's con- sideration. It was moved by Councilman Dunnum, seconded by Councilman Temple, and unanimously carried that the City Council, after audit of Demands #73 through #92 finds and determines that the demands are proper and the total amount thereof does not exceed the income and revenue for the year in which the indebtedness was incur- red, but that there are not sufficient funds presently available for their payments, and the same shall not be approved for want of funds. The City Clerk shall endorse upon the demand the fact that the demands have been audited by the City Council and not approved for want of funds. NOES: 0 ABSENT: 0 Mrs. Betty Lou Johnson, 9311 Gallatin School House Road and Mrs. Eve Garrett, 9337 Gallatin School House Road discussed the position of the Council in regards to the establishing of the City Police Department. After a report from the City Manager on the progress of the San Gabriel Free- way it was moved by Councilman Peavey, seconded by Councilman Dunnum, and unani- mously carried that a letter be written to Assemblymen Bonelli and Porter and to State Senator Richard Richards asking that this freeway be given priority because of the traffic hazards that now exist. NOES: 0 ABSENT: 0 It was moved by Councilman Temple, seconded by Councilman Giddings and unani- mously carried by a roll call vote that the lease in favor of Bert Douglas, for the parking lot at the corner of New and 2nd Street be amended to read $481.6o per month.
