PRESENT: COUNCILMEN: Dunnum, Giddings, Peavey, Temple, Stamps. It was moved by Councilman Temple, seconded by Councilman Peavey, and unanimously carried that the minutes of the meetings held on February 20th and 21st, 1957 be approved as presented. The City Clerk announced that, the hour of 7 :30 o'clock P X. having arrived, this was the time and place fixed for the hearing of objections to the granting to Southern California Edison Company of an electric franchise of the character and for the purposes stated in the resolution of intention, Resolution No. 33. The City Clerk presented Affidavits of the posting and publication of the Notice of Intention to Grant Franchise. The City Clerk announced that no written communications had been received relative to granting of said franchise. The Mayor asked if anyone present desired to be heard in the matter. No one answered, and, there being no protests, Councilman Dunnum moved that the hearing on objections to the granting of said franchise be closed, which motion was seconded by Councilman Temple and unanimously carried. ORDINANCE N0.15 ORDINANCE GRANTING TO SOUTHERN CALIFORNIA EDISON COMPANY, ITS SUCCESSORS AND ASSIGNS, A FRANCHISE TO USE AND TO CONSTRUCT AND USE, FOR TRANSMITTING AND DISTRIBUTING ELECTRICITY FOR ANY AND ALL PURPOSES, POLES, WIRES, CONDUITS AND APPURTENANCES, INCLUDING COT�'ITTNICATION CIRCUITS NECESSARY OR PROPER THEREFOR, IN, ALONG, ACROSS, UPON, OVER AND UNDER THE PUBLIC STREETS, WAYS, ALLEYS AND PLACES WITHIN THE CITY OF DOWNEY. After the reading of the title of said Ordinance, Councilman Giddings moved that further reading of Ordinance No. 15 be waived, which motion was seconded by Councilman Dunnum and unanimously carried. Councilman Dunnum moved that said Ordinance be introduced and passed to the second reading, which motion was seconded by Councilman Temple and unanimously carried. AYES: 5 COUNCILMEN: Dunnum, Giddings, Peavey, Temple, Stamps. NOES: 0 ABSENT: 0 ORDINANCE AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY AMENDING SECTIONS 3200, 3201 and 3206 OD SAID CODE. (re: Bicycles: The Ordinance was read by title only. It was moved by Councilman Temple, seconded by Councilman Peavey, and unanimously carried that further reading be waived. It was moved by Councilman Peavey, seconded by Councilman Dunnum, and unanimously carried by a roll call vote that said Ordinance be adopted. NOES: 0 ABSENT: 0 Council Minutes 2/25/57 41 ORDTNANCE AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY A'4ENDING ARTICLE VII OF THE DOWNEY MUNICIPAL CODE BY ADDING THERETO A NEW CHAPTER TO BE DESIGNATED CHAPTER 2 AND RELATING TO SANITARY SEWERS AND INDTTSTRTAL WASTE. The Ordinance was read by title only. It was moved by Councilman Dunnum, seconded by Councilman Temple, and unanimously carried that further reading be waived. It was moved by Councilman Dunnum, seconded by Councilman Temple, and unanimously carried by a roll call vote, that said Ordinance be introduced. AYES: 5 COUNCILMEN: Dunnum, Giddings, Peavey, Temple, Stamps. NOES: 0 ABSENT: 0 RESOLUTION NO. 46 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FIXING THE RATE OF C0114PENSATION FOR ACTING CITY MANAGER GLENN KENDALL UNTIL MARCH 31, 1957 AND FOR THE CITY CLERK. It was moved by Councilman Temple, seconded by Councilman Peavey, and unanimously carried by a roll call vote that Resolution No. 46 be adopted. AYES: 5 COUNCILMEN- Dunnum, Giddings, Peavey, Temple, Stamps. NOES: 0 ABSENT: 0 Councilman Dunnum discussed the fact that the permits for the Cement Contractors were the only ones that had to be obtained from the Los Angeles office and asked that consideration be given to have some arrangements whereby this could be handled in Downey. It was called to the attention of the Council that sufficient time had not elapsed in order to adopt the Ordinance re; bicycles amending the Downey Municipal Code. It was moved by Councilman Giddings, seconded by Councilman Peavey, and unanimously carried that the above motions be rescinded. AYES: 5 COUNCILMEN: Dunnum, Giddings, Peavey, Temple, Stamps. NOES: 0 ABSENT: 0 It was moved by Councilman Dunnum, seconded by Councilman Peavey, and unanimously carried that a letter, from the City Council, be sent to Mike Kearns, City Planning Commissioner, expressing their concern about, and best wishes for a speedy recovery from his recent heart attack. Councilman Giddings asked that the corner of Muller and Chaney be in- cluded in the Resolution being prepared re: Stop Signs. Councilman Giddings reported that the property owners in the Annexation known as the Telegraph Road Annexation were having difficulty in obtaining the legal boundaries of the territory and asked that the City assist them. The Acting City P4anager was instructed to assist in this matter. Councilman Peavey asked about the signs to be erected at the City Limits. Mr. Dan McKenzie, President of the Chamber of Commerce reported that these signs are presently being worked on. Councilman Peavey requested the Southern California Edison Company to make a survey of the Qity to determine where street lights could be erected on poles, using yard arms, and what the cost of these would be to the City. Council Minutes 2/25/57 -2- 42 Councilman Temple read a letter from the Church of Jesus Christ of Latter -Day Saints asking for permission to sell fireworks within the City. Mr. John Crowley was instructed to get information before any decision be reached by the Council. The Acting City Manager was asked to investigate the possibility of having same type of stop sign erected at the Southern Pacific tracks on Burns and Reeves Avenue. Councilman Temple reported that he had a communication from Mrs. Edward Konas, Jr., 12805 So. Brock Ave., (TO 927810 inquiring trhat steps should be taken to get curbs and street maintenance. Mr. Clarence Murphy, 7931 Borson, reported that there were undesirable characters canvasing the area picking up trash and salvage. It was moved by Councilman Peavey, seconded by Councilman Temple, and unanimously carried that an Ordinance be drawn putting restriction on this type of solicitation. A letter from the Downey Park, Recreation and Parkway District was pre- sented asking that the City of Downey participate in the financing of their program. The Council requested that this letter be answered stating that at this time there were no funds available but that the matter was being investigated. It was brought to the attention of the Council that the property owners on Phlox Avenue had sent deeds to the County dedicating right of way and offering; to stand the expense of bringing the street up to the standard specif ications. There has been no action taken by the County on this. The Acting City Manager was asked to investigate this delay. It was moved by Councilman Dunnum, seconded by Councilman Temple, and unanimously carried by a roll call vote that a contest be designed whereby the youth of the Downey Schools could develope the City Seal, the Motto, and Colors. It was suggested that the High School Students participate in the developement of the Seal, the Junior High School in the Motto, and the Elementary Schools in the Colors. The Council to serve as judging committee. AYES: 5 COUNCILMEN: Dunnum, Giddings, Peavey, Temple, Stamps. NOES: 0 ABSENT: 0 Mr. Bert Douglas, 11125 So. Downey Avenue, stated that the motto of "Future Unlimited" had been used as the City Motto during the incorporation proceedings. It was moved by Councilman Peavey, seconded by Councilman Dunnum, and unanimously carried that a letter be written to Arthur W. Brewer thanking him for his time and efforts during the time he served as Acting City Manager of the City of Downey. Approval of Job Classifications for Finance Director and Planning Director was held pending recommendations of Mr. King. The City Clerk read a letter from Mr. Oren L. King confirming his appoint- ment as the first City Manager of Downey, effective April 1, 1957, at a salary of $17,500.00 per year; stating that his resignation had been submitted to the Riverside Council as of February 19, 1957; and expressing his anticipation of his new assignment. A letter from the Chamber of Commerce was read asking the City Council to consider the retention of the parking lot on the southwest corner of 2nd and LaRiena Streets. It was moved by Councilman Giddings, seconded by Councilman Peavey, and unanimously carried by a roll call vote that a lease be drawn on Lots 13,14 and the northeast 50 feet of lot 15, block 10, tract of Downey, as shown on maps recorded in Book 2, Page 434 of miscellaneous records in the office of the Recorder, leasing said property on a monthly basis of 5450.00 to be paid by the City; said lease to be drawn between the City of Downey and Mr. Bert Douglas, 11125 So. Downey Ave., Downey; said property to be used for an off - street parking lot; that a right and legal lease be prepared and executed by the Mayor and the City Clerk. Council Minutes 2/25/57 -3- RESOLUTION N0. 47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING CONSENT AND JURISDICTION TO THE COUNTY OF LOS ANGELES FOR THE INCLUSION OF THE ENTIRETY OF THE CITY OF DOWNEY WITHIN THE DOWNEY SEWER MAINTENANCE DISTRICT, PURSUANT TO CHAPTER 4, PART 3, DIVISION 5 OF THE HEALTH AND SAFETY CODE, AS AMENDED, OF TIME STATE OF CALIFORNIA. It was moved by Councilman Dunnum, seconded by Councilman Temple, and unanimously carried that further reading'.be waived. It was moved by Councilman Giddings, seconded by Councilman Peavey, and unanimously carried that Resolution No. 47 be adopted. AYES: 5 COUNCILMEN: Dunnum, Giddings, Peavey, Temple, Stamps.
