PRESENT: CO'?NCIL'IEN: Giddings, Temple, Stamps. ABSENT: COUNCIL'iEN: Dunnam, Peavey. Councilman Dunnum took his place at 7:40 P.M. It was moved by Councilman Temple, seconded by Councilman Giddin7s, and unanimously carried that the minutes of the meetings held on January 7th, 9th, 14th and 21st, 1957 be accepted as presented. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 9102.1 OF THE DOWNEY MUNICIPAL CODE. (RE: Planning Commission Resolution No. 2, approving Zone Changes 3287 and 3140, Los Angeles County Reference.) The Ordinance was read by title only. It was moved by Councilman Temple, seconded by Councilman Giddin7s, and carried by a roll call vote that Resolution No. 29 be adopted. RESOLUTION NO. 30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY REQUESTIN s THE COTJNTY OF LOS ANGELES, DEPART 4FNT OF PARKS AND RECREATION TO PROVIDE ROADSIDE TREE SERVICE INSIDE THE CITY LIMITS. It was moved by Councilman Temple, seconded by Councilman Dunnum, and carried by a roll call vote that Resolution No. 30 be adopted. AYES: 4 COTJNCIL.,TN: Dunnum, Giddings, Temple, Stamps. At 8:00 P.'4. the City Clerk announced that this was the time set for a public hearin; on the "Los Angeles Building Law, 1956 Edition ", three copies of which are on file in the City Clerk's office. 11r. A.L.Schulte of the County Building and Inspection Department presented a brief resumer of the Code and the -Kayor asked if anyone in the audience wished to speak on this matter. 4r. Steve Skinner, 8707 E. Imperial Highway, inquired if the Code would apply to the entire city and '?r. Schulte's answer was in the affirmative. The 1,1ayor closed the hearin_;. A. the City Clerk announced that this was the time set for a public hearin,; on the "Fire Prevention Code of the County of Los Angeles ", three copies of which are on file in the City Clerk's office. Chief L.A. Dunton, Head of Fire Prevention Bureau of Los Angeles County, presented a resume' of the Code. There beinc, no questions from the floor, the hearing was closed by the f',.ayor. ORDINANCE NO. 5 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AHETZING THE DMMEY ;'MTICTPAL CODE AND ADOPTING THE "FIRE PREVENTION CODE OF THE COTJNTV OF LOS ANGELES. Ordinance No. 5 was read by title only. It was moved by Councilman Dunnum, seconded by Councilman Giddings, and carried by a roll call vote that further reading be waived. NCES: 0 ABSENT: 1 C(',UNCIL?,TAid: Peavey Letters were read from the Alameda District Improvement Association and the Alameda School District Board of Trustee protesting further expansion of the Downey Fertilizer Company, 9447 Imperial Highway. The City Council referred these letters to the City; Plannin; Commission. A letter from the Downey Junior Chamber of Commerce, P.O. 7ox 385, Downey, offering their congratulations and cooperation to the City Council was read. A letter was read from Assemblyman Frank G. Bonelli stating that he had introduced to the Assembly, bill AP3281, which would -amend Section 11193 of the State Health Safety Code, relating to the effect of withdrawal by a city from a garbage and refuse disposal district. An invitation wa.s received from the City of Lynwood inviting the Council to attend the monthly meetin; of the Southeast District 14avors' and Councilmen's group to be held Wednesday, February 13, at 6:30 P.�4. tD A letter from the Do -v-nev Com.~iunity Hospital regarding Proposed City Business license fee was read. This letter was referred to the temporary Business License Committee which was appointed January 21, 1957. The City Clerk read a letter from the City of °"onterey Park regarding the interpretation by the Board of Supervisors of the County of Los Angeles of Munici-nal Zonin7 Laws. It was moved by Councilman Temple, seconded by Councilman !(riddin7s, and carried by a roll call vote that a letter be sent to the Board of Supervisors, with a copy going to Monterey Park, stating that the City Council of Downey believe that County Governments should be bound by `,lunicipal Zonin in any City where the County may wish to install County facilities. This letter was referred to the City Attorney. Councilmen Dunnum, Giddings, and Temple reported to the Council concern - ing a meetin;T, they held with Police Chief Parker and Deputy Chief Simon of the Los Angeles Police Department relative to the City's desire to establish its own Police Department. The City Council accepted Deputy Chief Simon's offer to meet with the Council at an adjourned meeting on January 31, 1957 at 8 :00 P.M. Councilman Giddings went on record clarifying the Council's position on annexation of the area east of the San Gabriel River. The Council indicated that they would consider annexation if and when the citizens presented proper le al petitions. Councilman Peavey took his place at � ;:25 P.M. The City 1` "anager recommended that the City use the 9)ecial Assessment District office of the County to reprocess those Assessment District pro - ceedin;s which were pending at the time of Incorporation. No action was taken. The Cite- Manager recommended a salary ran e for certain Department head. It was moved by Councilman Giddings, seconded by Councilman Temp le, and unanimously carried by a roll call vote that the City Tanager be authorized to recruit for the positions of Planning Director, Finance Director, Police Chief and Fire Chief at a salary range of 0667 to $832 per month. McCarthy, head of the Hartford Insurance Company, Bonding Department, who recommended that all City employees be covered by a blanket honesty bond. After some discussion the Council recommended that the City Attorney approve any and all bonds. Mr. Richard rove, 10315 Julius Street, asked that local insurance agents be given the opportunity to su1hmit proposal on bonds and insurance. It was moved by Councilman Peavey, seconded by Councilman Temple, and unanimously carried that the '_ond of the City Clerk be filed with the "ayor, and that all other bonds be filed with the City Clerk. It was moved by Councilman Temnle, seconded by Councilman Peavey, and unanimously carried that the Citv Clerk be bonded for4"?"50,000.00. The City Manager presented the j'irst demands for the Council's consideration. It was moved by Councilman Peavey, seconded by Councilman Giddin -s, and unanimous- ly carried that the City Clerk, after audit of Demands 1 th.., 9, determine that the demands are proper and the amount does not exceed the income and revenue for the year in which the indebtedness was incurred, but that there are not suf- ficient funds presently available for the payment, be not approved for want of funds. The City Clerk shall so endorse upon the demand the Fact that the demand has been auditied by the City Council and not approved for want of funds. NOES: 0 ABSENT: 0 A minute action was read from the Plannin7 Commission minutes for Jant:ary 2.3, 1957 recomraendinr that at this time no chant -e be made in the existing charges to applicants for the filincr of Zone Changes, Zone exceptions, Sub- divisions, etc. and that steps be taken to establish a City planning office at an early date.
