MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
HELD DECEMBER 17,1956
The City Council of the City of Downey held its first meeting in the
cafetorium of the Downey Elementary School District at 1 :00 p.m., no
officer presiding inasmuch as a Mayor or Mayor Pro -tern had not as yet been
selected.
PRESENT: COUNCILMEN: Dunnum, Giddings, Peavey, Temple, Stamps.
ABSENT: none
It was moved by Councilman Stamps and seconded by Councilman Giddings
that Councilman Peavey be nominated as temporary chairman. Motion unanimously
carried.
RESOLUTION NO. 1
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPOINTING ARTHUR W.. BREWER TO THE POSITION OF CITY
CLERK AND FIXING THE RATE OF COlZPENSATION FOR SAID
POSITION.
It was moved by Councilman Temple, seconded by Councilman Dunnum, and
unanimously carried that this Resolution be adopted by the following called
vote.
AYES: 5 COTjNCIL 4EN: Dunham, Giddings, Peavey, Temple, Stamps.
NOES: 0 COUNCILMEN: none
ABSENT: 0 COUNCILMEN: none
Judge Boone gave oath to City Clerk, Arthur Brewer.
It was moved by Councilman Peavey, seconded by Councilman-Temple that
Councilman Stamps be elected as First Mayor of the new City of Downey. By
a roll call vote the motion was unanimously carried.
It was moved by Councilman Giddings, seconded by Councilman Dunnum,
and unanimously carried, that Councilman Peavey be elected mayor Pro -tem.
The Council recessed from 2:00 to 2:45 p.m.
The Clerk called the roll and found all members present.
RESOLUTION NO. 2

It was moved by Councilman Dunnum, seconded by Councilman Peavey, and
unanimously carried by a roll call vote.
RESOLUTION NO. 3
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPOINTING RUDOLPH WEHKING TO THE POSITION OF CITY TREASURER
AND FIXING THE RATE OF CO1IPENSATION FOR SAID POSITION
It was moved by Councilman Peavey, seconded by Councilman Dunnum, and
unanimously carried by a roll call vote.
RESOLUTION NO. 4
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY-
APPOINTING ARTHUR W. BREWER TO THE POSITION OF ACTING
CITY MANAGER AND FIXING THE RATE OF COMPENSATION FOR
SAID POSITION.
It was moved by Councilman Giddings, seconded by Councilman Temple,
and unanimously carried by a roll call vote.

It was moved by Councilman Temple, seconded by Councilman Peavey,
and unanimously carried by a roll call vote that letters be sent to the,
County Engineer's office, the Sheriff's office, the State Highway Patrol,
and the County Health Officer requesting these offices to continue their
respective services for a temporary period of time.
It was moved by Councilman Giddings, seconded by Councilman Dunnum, and
unanimously carried by a roll call vote that the Council approve a binder
insurance policy covering comprehensive liability insurance for the City
from the Hartford Insurance Company for a 30 day period pending a request
for bids from any interested insurance companies.
A long discussion took place involving the Council, the City Attorney,
Mr. John Crowley, Consultant to the City, and Mr. Robert Blinn from the
County administrators office on the proposed garbage contract to serve
the Downey Garbage Disposal District. Mr. Blinn explained that, under the
terms of the existing District Act, if the Council wished the City to with-
draw from the District after February 1st of any year, there would still
be a property tax rate levied for the subsequent year on that part of the
district which had already been withdrawn. It was moved by Councilman
Giddings, seconded by Councilman Dunnum, and unanimously carried by a roll
call vote that the City make no objection to the Board of Supervisors
granting a 22 year garbage contract to the lowest responsible bidder for
collection of garbage and refuse in the Downey Garbage Disposal District,
that the city not withdraw from the District prior to July 1, 1957, and
that the Board of Supervisors be requested to join in sponsoring and /or
endorsing an amendment to the District Act in the next session of the
State Legislature to make it possible for the City to share in some
equitable rebate of property taxes, if the City decided to withdraw from
the district after the February lst deadline of any one year. It was
agreed that the Mayor and the City Attorney, would attend the Board of
Supervisors meeting on December 18th to discuss the garbage problem and
press for an amendment to the District Act.
It was moved by Councilman Peavey, seconded by Councilman Dunnum
and motion carried unanimously by a roll call vote that Assemblymen
Porter and Bonelli be requested to assistthe City in furthering the leg-
islative change desired by the Council.
The City Clerk presented two informal petitions requesting the
consent of the City Council to circulate petitions in two contiguous
areas southwest of the Downey City limits for annexation of those areas
to the city. For the most northerly of the two areas whose southerly
boundary is Rosecrans Avenue it was moved by Councilman Dunnum, seconded
by Councilman Giddings and unanimously carried by a roll call vote that
the City Council consent to the circulation of petitions providing all
legal aspects have been fully complied with. On the petition whose
southerly boundary is the sourtherly boundary of the Alameda School
District it was moved by Councilman Dunnum, seconded by Councilman Peavey,
and unanimously carried by a roll call vote that the City Council consent
to the circulation of petitions.
It was moved by Councilman Dunnum, duly seconded, and motion carried
unanimously that a letter be sent to Mr. and Mrs. K. C. Weiss expressing
the gratitude of the City for their complimentary gift of stationery bearing
the City's name.
It was moved by Councilman Dunnum, duly seconded, and motion carried
unanimously that a public apology be made to the officials of the Downey
Chamber of Commerce for the lack of recognition given them at the installa-
tion ceremony earlier in the meeting.
It was moved by Councilman Temple, duly seconded, and motion carried
unanimously that the City Council commend the Downey High School football
team for having gained the 1956 County Championship title and for the high
character of the boys representing the City of Downey.
It was moved, duly seconded, and motion carried unanimously that the
Council accept the seal presented by the City Attorney at this meeting
bearin:T the words "City of Downey, Incorporated 1956" and containing the
great seal of the State of California in the center.

three copies of the Los Angeles County Building Code be filed with the
City Clerk.
It was moved, duly seconded, and motion carried unanimously that
three copies of the Los Angeles County Zoning Ordinance be filed with
the City Clerk.
RESOLUTION NO. 5
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
•--� DETERMINING THAT ORDINANCES OF SAID CITY SHALL BE POSTED
FOR THE FIRST YEAR AFTER ITS DATE OF INCORPORATION.
It was moved by Councilman Dunnum, seconded by Councilman Giddings, and
unanimously carried by a roll call vote.
RESOLUTION NO. 6
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY,
CALIFORNIA, PROVIDING FOR THE ENFORCEMENT OF LAWS AND
REGULATIONS RELATING TO PIJ13LIC HEALTH BY THE COUNTY
HEALTH OFFICER WITHIN THE CITY OF DOWNEY.
It was moved by Councilman Dunnum, seconded by Councilman Giddings,
and unanimously carried by a roll call vote.
RESOLUTION NO. 7
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF D01kNEY
APPROVING A PROPOSED A21REE1,14ENT BETWEEN SAID CITY AND THE
COUNTY OF LOS ANGELES FOR THE PERFORMANCE OF THE FTINCTIONS
OF BUILDINGr INSPECTOR.
It was moved by Councilman Dunnum, seconded by Councilman Giddings,
and unanimously carried by a roll call vote.
RESOLUTION NO. 8
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING AGREEi'J1_ENTS WITH THE COUNTY OF LOS ANGELES FOR
ASSESSMENT AND COLLECTION OF TAXES, HEALTH SERVICE AND
COT114 'Y JAIL SERVICE.
It was moved by Councilman Dunnum, seconded by Councilman Giddings,
and unanimously carried by a roll call vote.
The council recessed from 4!00 to 4:25P.M. After recess a roll call
vote all members were present.
RESOLUTION NO. 9

APPOINTING DELLA DOYLE TO THE POSITION OF DEPUTY CITY
CLERK AND FIXING THE RATE OF CO1,4PENSATION FOR SAID POSITION.
It was moved, duly seconded and unanimously carried by a roll call vote.
ORDINANCE NO. 1
ORDINANCE OF THE CTTY COUNCIL OF THE CITY OF DOWNEY_
ENACTING AND ADOPTINr's THE DOWNEY MUNICIPAL CODE.
The City Attorney commenced the reading in full of this Ordinance.
The Council recessed from 6:00 P.M. to 7:L4K P.',T.
After recess on a roll call all members were present.
After recess the City Attorney continued to read Ordinance No. 1

It was moved, duly seconded, and motion carried unanimously to delete
Section 9205 as read and to correct Section 9228.10.
It was moved, duly seconded, and motion carried unanimously by all
five Councilmen voting aye that the Council approve Section 2, the
Emercency Clause, or Ordinance No. 1.
It was moved, duly seconded, and unanimously carried by all five
Councilmen voting aye that Ordinance No. 1 be approved and adopted as read.
RESOLUTION NO. 10
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROJING TIJE TJNIFORi4 AGREEMENT FOR STATE ADMINISTRATION
OF LOCAL SALES AND USE TAXES AND AUTHORIZING THE EXECUTION
THEREOF.
It was moved, duly seconded, and unanimously carried by all five
Councilmen voting aye that this resolution be adopted.
It was moved by Councilman Giddin,;;s, seconded by Councilman Temple,
and unanimously carried that Councilman Peavey and Steve Skinner be asked
to take the Sales Tax agreement and related papers to Sacramento; the
trip to be paid out of City funds when available.
The Council informally instructed the City Manager to attempt to
purchase all supplies and materials locally whenever possible, as long as
local prices were not more than 5% higher than outside prices on a given
item.
It was moved by Councilman Peavey, seconded by Councilman Temple, and
unanimously carried that the City Manager be allowed to purchase supplies
up to a total amount of $600.00
