SUBJECT: PLN-13-00191 (GENERAL PLAN CONSISTENCY) – A REQUEST TO
FIND THAT THE PURCHASE AND SALE AGREEMENT REGARDING
THE SALE OF 11500 BROOKSHIRE AVENUE BY THE CITY OF
DOWNEY TO PRESBYTERIAN INTERCOMMUNITY HOSPITAL IS
CONSISTENT WITH THE DOWNEY GENERAL PLAN
LOCATION: 11500 BROOKSHIRE AVENUE (AIN 6255-009-901 AND 902)
ZONING: H-M (HOSPITAL-MEDICAL ARTS)
REPORT SUMMARY
The City of Downey recently negotiated a purchase and sale agreement that would allow
the City to sell the land and all improvements located on it to the Presbyterian
Intercommunity Hospital. Prior to completing the transaction, State law requires the
Planning Commission to make a finding that this disposal of City-owned property is
consistent with the City’s General Plan. Based on the findings contained in this report, staff
recommends that the Planning Commission adopt the following titled resolution:

009-901 AND 902) BY THE CITY OF DOWNEY TO THE PRESBYTERIAN
INTERCOMMUNITY HOSPITAL IS CONSISTENT WITH THE DOWNEY
GENERAL PLAN
BACKGROUND
The City of Downey owns the property located at 11500 Brookshire Avenue, which it leases
to Downey Regional Medical Center Hospital, Inc. The City negotiated a purchase and sale
agreement with the Presbyterian Intercommunity Hospital recently, through which the City
would sell the subject property, including the land and all improvements located thereon to
Presbyterian Intercommunity Hospital. However, pursuant with Government Code Section
65402 (a), the City cannot complete this transaction until the Planning Commission makes
a determination that the disposition of the subject property is consistent with the Downey
General Plan.
Since 1967, the City of Downey has leased the property at 11500 Brookshire Avenue for
hospital uses. Downey Regional Medical Center, Inc. (DRMC) has been the hospital tenant
for several years, but has experienced substantial financial difficulties recently. To alleviate
those burdens, DRMC entered into an agreement with Presbyterian Intercommunity
Hospital (PIH), whereby PIH would become the sole corporate member of DRMC.
As part of the DRMC transaction, PIH approached the City with a proposal to purchase the
subject property. The City Council approved this proposal on August 13, 2013. The subject
property is comprised of two parcels as described by the following table:

General Plan Conformity
Government Code Section 65402 (a) provides that if a general plan has been adopted, no
real property shall be disposed of until the purpose and intent of such disposition has been
submitted to and reported upon by the planning agency as to conformity with the general
plan.
Chapter 9 of Vision 2025, the Downey General Plan, identifies the long term economic
development issues confronting the community and goals to address them. Goal 9.3 of the
General Plan states: “Ensure the continued fiscal balance of the community. “ Policy 9.3.1
of the General Plan seeks to “Balance the maximization of revenue generation with costs
for providing services.” This policy is implemented through Program 9.3.1.4, which states:
“Encourage a diversified tax base by encouraging revenue from sources other than sales
taxes and property taxes.”
Staff finds that the City’s approval of the sale of the subject property is consistent with the
General Plan, because the transaction would provide $9,850,000 in revenues to the City,
while ensuring that the City’s residents continue to receive quality hospital services.
ENVIRONMENTAL ANALYSIS
Pursuant to Section 15061 (b) (3) of the State of California Code of Regulations, staff finds
that this transaction is not subject to the California Environmental Quality Act (CEQA) since
act o making a finding that a purchase of a property is consistent with the General Plan
does not have the potential to create an environmental impact.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY
ADOPTING A RESOLUTION FINDING THAT THE SALE OF PROPERTY LOCATED
AT 11500 BROOKSHIRE AVENUE (AIN 6255-009-901 AND 902) BY THE CITY OF
DOWNEY TO THE PRESBYTERIAN INTERCOMMUNITY HOSPITAL IS CONSISTENT
WITH THE DOWNEY GENERAL PLAN
WHEREAS, on January 25, 2005, the Downey City Council adopted Vision 2025, the
Downey General Plan, and
WHEREAS, the State of California Government Code Section 65402 (a) provides that if
a general plan has been adopted, no real property shall be disposed of until the purpose and
intent of such disposition has been submitted to and reported upon by the planning agency as
to conformity with the general plan; and
WHEREAS, Goal 9.3 of the General Plan strives to “Ensure the continued fiscal balance

to purchase the subject property, and
WHEREAS, the City negotiated a purchase and sale agreement with the Presbyterian
Intercommunity Hospital recently, through which the City would sell the subject property,
including the land and all improvements located thereon to Presbyterian Intercommunity
Hospital, and
WHEREAS, the Downey City Council approved this proposal on August 13, 2013, to sell
the subject property that is comprised of two parcels as described by the following table:

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF DOWNEY
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The Planning Commission does hereby find and determine that the
proposed City’s approval of the sale of real property located at 11500 Brookshire Avenue (AIN
6255-009-901 and 902) is in conformance with the City’s adopted General Plan, because the

transaction would provide $9,850,000 in revenues to the City, while ensuring that the City’s
residents continue to receive quality hospital services.
The City negotiated a purchase and sale agreement with the Presbyterian

including the land and all improvements located thereon to Presbyterian Intercommunity
Hospital.
SECTION 2. The Secretary shall certify the adoption of this Resolution.
