A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING
THE APPEAL AND DENYING CONDITIONAL USE PERMIT 98-16 FOR THE
ESTABLISHMENT OF A PRIVATE ELEMENTARY SCHOOL ON PROPERTY ZONED
C-1 LOCATED AT 10890 PARAMOUNT BOULEVARD.
CONDITIONAL USE PERMIT#98 -16
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The City of Downey hereby finds, determines, and declares that:
A. The City of Downey's City Council has considered an appeal of
Conditional Use Permit 98-16 for properties located at 10890 Paramount
Boulevard (hereafter known as property),
B. This property's zoning is C-1 (Neighborhood Commercial), and is
developed with a one-story office building; and
C. Said property is a rectangularly shaped parcel containing a total of
10,657+ square feet of land which is identified by the Assessor's Parcel
Numbers of 6251- 038- 025; and
D. The City Council held a duly noticed public hearing on this request on
June 23, and July 14, 1998, and fully considered all oral and written testimony
and facts and opinions offered at that hearing; and
E. The City Council finds that the applicant's requested elementary school,
for the subject property, is not adequate in size to provide sufficient areas to
handle the amount of traffic that could be generated from the school and how it
conflicts with the activities of the surrounding uses, and is therefore not an
appropriate land use.
F. The City Council further finds that the utilization of this site, for a school,
will not encourage proper growth and development of this area and that this site
is not large enough to protect the public's convenience and general welfare and;
G. The City Council has considered the effects of this decision on the
housing needs of the region in which the City is located and balanced those
needs and found that while the proposed use would not adversely impact these
needs, this finding is not a basis for permitting this application and;

H. Based upon Studies and comments received it was determined that there
is no substantial evidence that the requested modification will have a significant
adverse effect upon the environment, and that even though this project was
found to be a Class I, Categorically Exempt project from the California
Environmental Quality Act, this finding is not the only factors that need to be
considered in the granting of this request.
SECTION 2. The City Council hereby grants the appeal and denies Conditional
Use Permit No. 98-16 for the establishment and operation of a private elementary
school.
SECTION 3. The City Clerk shall certify to the adoption of this Resolution.
