HomeMy WebLinkAboutResolution No. 6141 RESOLUTION NO. 6141 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, SETTING PRIORITIES FOR FILING A WRITTEN ARGUMENT REGARDING AN ADDITIONAL PROPOSED CHARTER AMENDMENT RELATING TO ELECTIONS AND DIRECTING THE CITY ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS WHEREAS, a Special Municipal Election on May 5, 1998, has been called by Resolution No. 6137, adopted on January 27, 1998, for the purpose of submitting to the qualified electors thereof the question of the adoption of a proposed Charter Amendment#11, regarding Section 702, Officers and Employees, Administrative Functions; and WHEREAS, the Downey City Council desires to submit to the voters at the election an additional proposed Ordinance for a Charter amendment relating to Elections which question reads a follows: Charter Amendment#12: Shall a Charter amendment proposed by the Downey City Council which requires that any proposed amendment to the City Charter on the same subject matter shall not be voted upon twice within any 12-month period at any special or general municipal election, be adopted? NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. With respect to proposed Charter Amendment#12, the City Council hereby authorized Mayor Barbara Riley and Council Members Keith McCarthy, Gary McCaughan, Joyce Lawrence and Robert Brazelton to file the written argument in favor, in accordance with the provisions and requirements set forth in Section 2 of this Resolution. SECTION 2. The argument referenced in Section 1 regarding the City measure shall be prepared and filed in accordance with Article 4, Chapter 3, Division 9 of the Elections Code of the State of California and to change the argument until and including the date fixed by the City Clerk after which no arguments for or against the City measure may be submitted to the City Clerk. SECTION 3. That the City Council directs the City Clerk to transmit a copy of the Charter measure to the City Attorney. The City Attorney shall prepare an impartial analysis of the Charter measure showing the effect of the measure on the existing law and the operation of the measure. The impartial analysis shall be filed by the date set by the City Clerk for the filing of primary arguments. Resolution No. 6141 Page 2 SECTION 4. The City Clerk shall certify to the adoption of this Resolution and shall cause the same to be processed in the manner required by law. PASSED, APPROVED AND ADOPTED this 27th day of January, 1998.
