HomeMy WebLinkAboutResolution No. 6138 RESOLUTION NO. 6138 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, SETTING PRIORITIES FOR FILING A WRITTEN ARGUMENT REGARDING PROPOSED CITY CHARTER AMENDMENT NO. 11 RELATING TO POLICE AND FIRE SERVICES AND DIRECTING THE CITY ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS WHEREAS, a Special Municipal Election is to be held in the City of Downey, California, on May 5, 1998, at which time there will be submitted to the voters the following Charter amendment: Charter Amendment No. 11: Shall a Charter amendment proposed by the Downey City Council which requires authorization through an affirmative advisory vote by not less than two-thirds of the voters at a general municipal election in order to permit an alternative to providing through its own staff for police and fire departments, be adopted? NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. With respect to Charter Amendment No. 11, the City Council hereby authorizes Mayor Barbara Riley and Council Members Keith McCarthy, Gary McCaughan, Joyce Lawrence and Robert Brazelton to file the written argument in favor, in accordance with the provisions and requirements set forth in Section 2 of this Resolution. SECTION 2. The argument referenced in Section 1 regarding the City measure shall be prepared and filed in accordance with Article 4, Chapter 3, Division 9 of the Elections Code of the State of California and to change the argument until and including the date fixed by the City Clerk after which no arguments for or against the City measure may be submitted to the City Clerk. SECTION 3. That the City Council directs the City Clerk to transmit a copy of the Charter amendment to the City Attorney. The City Attorney shall prepare an impartial analysis of the Charter amendment showing the affect of the measure on the existing law and the operation of the measure. The impartial analysis shall be filed by the date set by the City Clerk for the filing of primary arguments. SECTION 4. That the City Clerk shall certify to the passage and adoption of this Resolution. APPROVED AND ADOPTED this 27th day of January, 1998. ATTEST: Barb a J. Riley, yor 6-kaaff-- Judith E.
