HomeMy WebLinkAboutResolution No. 6126 RESOLUTION NO. 6126 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING A TRAFFIC OFFENDER FUND IN SUPPORT OF A TRAFFIC OFFENDER PROGRAM WHEREAS, the City Council of the City of Downey, California desires to undertake a certain project designated as the "Downey Traffic Offender Program," funded in part from funds made available through the State of California Office of Traffic Safety (hereafter referred to as OTS) and, WHEREAS, the OTS requires a special fund be established in support of the Downey Traffic Offender Program, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION t There is hereby established a special fund for the purpose of receiving and expending fees collected for the impoundment of a vehicle pursuant to the above. Said special fund shall be known and designated as the Traffic Offender Fund, and shall receive fees to reimburse the City for costs incurred in the administration of the procedures for removing vehicles. Said fee shall be charged by the police department to the registered owner of a vehicle removed pursuant to Sections 14602.6(a), 22651(h), 22651(p), 22655.5 or 22850.5 of the California Vehicle Code. The fee shall not exceed an amount that covers the actual costs incurred by the City in the removal, impoundment, storage, and release of the vehicle. SECTION 2. The Chief of Police is hereby authorized to adopt such rules, regulations and procedures as he/she determines are necessary for the department to impose, collect and administer the fee imposed by this document. SECTION 3. The appropriation of all monies in the Traffic Offender Fund ("Fund") shall be made exclusively for the purpose of the Traffic Offender Program. The Traffic Offender Program shall include the enforcement of, education for, and prosecution of a suspended or revoked driving privilege, unlicensed driver, and persons driving under the influence of alcohol or drugs. Expenditures shall include, but not be limited to, purchase of equipment, contractual services, material and supplies, and other technology necessary to prosecute the case, and personnel costs, including salary and benefits of personnel specifically provided to the Program. The balance remaining in the Traffic Offender Fund at the close of any fiscal year shall be deemed to have been provided for a specific purpose and shall be carried forward by re-appropriation and accumulated in said fund for the purposes recited herein. SECTION 5. The City Clerk shall certify to the passage and adoption of this Resolution and provide for appropriate distribution thereof. APPROVED AND ADOPTED this 13th day of January, 1998.
