HomeMy WebLinkAboutResolution No. 6125 RESOLUTION NO. 6125 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING GPA 97-46 AMENDING THE CITY'S GENERAL PLAN LAND USE DIAGRAM CHANGING THE LAND USE DESIGNATION FROM GENERAL COMMERCIAL TO COMMERCIAL MANUFACTURING FOR PROPERTIES LOCATED AT 7200-7262 FIRESTONE BOULEVARD AND CERTIFYING A NEGATIVE DECLARATION FOR THIS GENERAL PLAN AMENDMENT. GENERAL PLAN AMENDMENT 97-46 THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City of Downey hereby finds, determines, and declares that: A. The City of Downey has considered a General Plan Amendment for properties located at 7200 - 7262 Firestone Boulevard (hereafter known as property), based on an application filed by Andrews Rancho Del Sur & Wilbur's Trust (hereafter known as applicant). The present Land Use Designation of said property being considered is "General Commercial"; and B. This property's zoning is C-2, it is developed with a commercial use on one lot, the rest of the property is vacant; the requested new Commercial/ Manufacturing designation would correspond with existing land uses and would accommodate new appropriate land uses on this site; and C. Said properties are irregularly shaped parcels containing a total of 4.5+ acres of land which are identified by the Assessor's Parcel Numbers of 6231- 004-009 and 010; and D. The Planning Commission held a duly noticed public hearing on this request on November 19, 1997, and fully considered all oral and written testimony and facts and opinions offered at that hearing; and E. This Planning Commission concluded this revision to Downey General Plan Land Use Element Diagram would be consistent with good planning practice, necessary and desirable for the development of the community and necessary for the preservation of the public health, safety, and general welfare of the City of Downey; and F. The City Council has considered the effects of this decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City's residents, its fiscal and -environmental resources; and Resolution No. 6125 GPA#97-46 Page 2 G. An Initial Study of Environmental Impacts and a Negative Declaration have been prepared for this General Plan Amendment in accordance with the provisions of the California Environmental Quality Act, the State CEQA Guidelines, and the City of Downey's Revised Environmental Procedures; and H. The City Council considered the Initial Study of Environmental Impact and the Negative Declaration together with any comments received during the public review process and at the hearings; and I. Based upon the Initial Study and any comments received in the public review process, determined that there is no substantial evidence that the requested General Plan Amendment will have a significant adverse effect upon the environment. SECTION Z. The City Council hereby approves and certifies the Negative Declaration for this General Plan Amendment. SECTION 3. The City Council hereby amends the City's General Plan Land Use Diagram designation for the subject properties from General Commercial to Commercial Manufacturing. .-.
