CEQA
Staff has reviewed the proposed use for compliance with the California Environmental Quality

B. Surrounding Properties
The subject site is located within the heart of the Downtown Downey, which has a virtual
plethora of business types. This includes restaurants, stores, offices, and churches. All of
these properties have General Plan Land Use Designation of Mixed Use and are zoned
Downtown Downey Specific Plan.
C. Site Photographs
BACKGROUND
The subject site is an approximate 6,393 square foot rectangular shaped lot on the east side of
Downey Ave, north of Second St. The site has a General Plan Land Use Designation of Mixed
Use and it is within the Downtown Downey Specific Plan. The site is improved with a 5,932
square foot restaurant, which includes 5,281 square feet on the first floor and a 651 square foot
office on the second floor. On the west side of the building there is an outdoor dining area,
which is surrounded by a 42” tall fence. This outdoor dining area encroaches six (6) feet into
the public right-of-way, which is permitted by the Downtown Downey Specific Plan. In addition
to the building, there are two parking spaces on the east (rear) side of the building. The
previous restaurant that previously operated on the site (Granatas and Tapas) has been closed
for a couple of months; however, it operated with an ABC Type 47 (On-Sale General, Eating
Place) license.
On December 18, 2012, the applicant submitted a Conditional Use Permit (PLN-12-00303)
application, requesting to operate a new restaurant at the site (Joseph’s Bar and Grill) with the

Type 47 alcohol license and live entertainment. After a comprehensive review of the request, staff
deemed the application completed on January 17, 2013.
On February 7, 2013, notice of the pending application was published in the Downey Patriot.
Furthermore, the notice was mailed to all property owners within 500’ of the subject site.
DISCUSSION/ANALYSIS
The applicant is proposing to change the restaurant to a bar and grill (to be called Joseph’s Bar
and Grill). This will include expanding the bar area within the existing building and utilizing a
new floor plan. Notwithstanding this, the applic ant is not proposing to change the kitchen area,
bathrooms, storage areas, or the second story office. The applicant proposes to operate
Joseph’s with an ABC Type 47 license, which allows the sale of alcohol for onsite consumption
in conjunction with a restaurant. Additionally, the bar and grill will host live entertainment in the
form of DJ, dancing, bands, and karaoke. The proposed hours of operation will be 10:00 a.m.
until midnight, seven (7) days a week with the live entertainment occurring between 7:00 p.m.
until midnight.
In addition to the tenant improvements, the applicant is proposing to update the façades of the
building to give the building a new fresh look. This includes the increased use of glass and
metal framing on the front (east)
side of the building. More
specifically, the applicant will revise
the front façade to increase size of
the windows, provide glass doors,
and add new precast concrete
columns and cornice molding.
Additionally, the applicant will
replace existing canopies with a new
metal and glass canopy and replace
the solid wall that encompasses the
outdoor dining area with a new glass wall with solid pilasters. Finally, the applicant will repaint
the building a terracotta color with sand color trim. It should be noted, the applicant is not
proposing to construct any additions to the building, so the façade modifications do not require
Planning Commission approval.
Pursuant to Municipal Code Section 9824.06, there are four (4) findings that must be adopted prior
to the Planning Commission approving the Conditional Use Permit. A discussion of the findings
follows:
A. The requested Conditional Use Permit will not adversely affect the purpose and
intent of this chapter or the City’s General Plan or the public convenience or
general welfare of persons residing or working in the neighborhood thereof.
The subject site has a General Plan Land Use Designation of Mixed Use and is within the
Downtown Downey Specific Plan. It is the intent of the Mixed Use designation and the
Downtown Specific Plan to encourage development that exhibits the physical design
characteristics of pedestrian-oriented, storefront-style shopping streets that creates a more
active and vibrant street life. The proposed changes to the façade give the business an
open look, and in staff’s opinion, tend to promote a walkable environment. Staff is of the
further opinion that the addition of live entertainment to the restaurant will increase

pedestrian traffic on Downey Avenue as new people patronize the business. For these
reasons staff believes the business will be operated in a manner that is conducive to
pedestrian traffic and will serve people who live and work in the area.
B. The requested use will not adversely affect the adjoining land uses and the growth
and development of the area in which it is proposed to be located.
The subject site is in a fully developed area of the City, with little to no vacant properties
in the immediate area. Inasmuch as a restaurant previously operated with alcohol sales,
staff is of the opinion that the re-establishing a restaurant and adding live entertainment
will not affect surrounding properties. Furthermore, the success of this business can
serve to draw people into the area, which will encourage growth and development of
adjoining properties.
C. The size and shape of the site proposed for the use is adequate to allow the full
development of the proposed use in a manner not detrimental to the particular
area.
The proposed use will be contained within an existing site (not including the outdoor
eating area), which does not require an expansion of the buildings. The restaurant is a
permitted use on the site and has sufficient parking, setbacks, and landscaping to allow
it to operate without creating a detriment to others. As such, staff believes that the
subject has sufficient shape and size to accommodate the proposed use.
D. The traffic generated by the proposed use will not impose an undue burden upon
the streets and highways in the area.
The subject site is located within the heart of Downtown Downey on Downey Ave. Staff
has reviewed the proposal and is not anticipating any increase in traffic caused by
operation of the business. It is staff’s opinion that the surrounding streets and highways in
the area have sufficient capacity to accommodate the existing traffic generated by the
business.
CORRESPONDENCE
As of the date that this report was printed, staff has not received any correspondence regarding
this matter.
CONCLUSION
Based on the analysis contained within this report, staff is concluding that operating a restaurant
with live entertainment and the sale of alcohol can be a benefit to the business without
impacting the surrounding area, provided that all conditions of approval are adhered to .
Furthermore, as noted above, staff believes that all four findings required to approve a
Conditional Use Permit can be made in a positive manner . As such , staff is recommending that
the Planning Commission approve the Conditional Use Permit (PLN-12-00303) , subject to the
recommended conditions of approval.
